I grew up going to concerts and

music festivals. I love listening to

music. Loud.

I probably wasn’t the ideal

neighbour in years past – but I

think I made the right move living in

communities where there were like-

minded neighbours. In fact, in one

place I regularly popped next door for

impromptu dance breaks.

I guess if you’re enjoying it, and it

works for you and your neighbours,

then it’s fi ne – but this isn’t the

norm. Residents are guaranteed a

reasonable level of enjoyment of their

home, and nobody’s need to listen to

loud music supersedes that.

If you’re losing enjoyment of your

home because of noise, talk to the

The neighbourhood comprises

both banks of the Grand River and

stretches south to Ainslie/Concession

and up the hill to Dundas in the east.

It’s a slower pace here, owing partly

to the older population. But it’s still

a lively downtown. While it retains

an urban feel, this is still relatively

small-town Ontario. It’s a family

friendly community on the cusp of

gentrifi cation.

territories have smoke-free laws

that ban smoking at work and public

places, but there is no law banning

smoking in private residences.

A landlord has the legal right to

include a no-smoking clause in your

rental agreement. The landlord can

ban smoking in the whole building,

individual units, common areas

and even balconies. Smoking is not

considered a legal human right in any

province. Apartments in your building

could legally be smoke-free rentals.

If a smoke-free clause has

not been included in your rental

agreement, but other tenants are

complaining of second-hand smoke,

a landlord is still legally permitted

to do whatever is necessary to deal

with the issue reasonably. Most

provincial tenancy laws state that

a tenant is entitled to “quiet or

peaceful enjoyment” of their home

and/or it should be “fi t for human

habitation.” They recognize that

tenants have the legal right to live

free from unreasonable disturbances.

An o� cial tribunal could determine

that second-hand smoke entering

another residence to be an

unreasonable disturbance.

Second hand smoke could violate

“peaceful enjoyment” of one’s home

and, in many cases, that is enough

to legally do something about it.

Landlords can ask the smokers to

stop, repair or renovate the building

to minimize the transfer of second-

hand smoke.

gives comprehensive advice for

Unpack your common sense

WHEN IT COMES to moving, a little

common sense goes a long way

in getting your belongings to your

destination in good shape, on time.

Considering the importance of

our possessions, these items deserve

proper care. Thinking ahead is the

best thing you can do when it comes

to making arrangements, packing, etc.

Organization should be your mantra,

e� ciency your goal.

If you’re doing your own packing,

look ahead to lifting, stacking and

unpacking the boxes. People often

run to the grocery or liquor store

to pick up cartons, and then use

newspaper as cushioning. Although

this approach can save you a few

dollars, in the long run, you may pay

for it in stress, time and broken items.

Instead, think about purchasing

cartons and packing paper from the

professional mover you’ve chosen.

The boxes come in uniform small,

medium and large sizes, which are

easy to stack in a moving truck or van.

Trust me, this convenience is huge

on moving day. Unlike newspaper,

packing paper does not leave behind

ink that then has to be cleaned

during unpacking - which is already a

hectic enough time.

During the packing itself, be

generous with whatever you are

using to cushion your things,

especially fragile items. People

often cram too much in each box

in an attempt to keep the number

of cartons down. As good as that

sounds, it can backfi re, as too many

items with not enough cushioning

may shift during transportation and

damage each other.

In addition, someone has to lift

each box and place it into the moving

vehicle. Packing too many heavy

items into one container can result

in no one being able to pick it up, or

worse yet, the box breaking from the

weight. Common sense will tell you

that heavier items should be packed

in smaller boxes, and vice versa.

Did I mention labeling?

you build equity, conventional

wisdom isn’t always the best option.

It sounds great in theory, however,

that theory assumes that you will

buy at the best time and sell at

the best time, thus maximizing

your profi ts. Nor does it factor in

the costs of infl ation, renovations,

maintenance and upkeep, property

taxes and so on.

Often, being a lifetime renter is

the preferred option. Here are some

scenarios where those who could

a� ord to buy still opt to rent, and

why.

1. YOUNG PROFESSIONALS MORE

INTERESTED IN TRAVEL THAN

YARD WORK. Couples without

children who travel a lot often prefer

to ditch the gardening obligations,

bills and headaches associated

with owning a home. Footloose

and fancy free, they would rather

put their money into an investment

portfolio – yeilding the same or

better returns in the long run. Let

the landlord deal with utilities and

upkeep. They’re o� on adventures!

2. ENTREPRENEURS RUNNING A

BUSINESS. They frequently work

long hours and struggle to fi nd time

for family and friends, never mind

house repairs or tenants. Any extra

funds they have are being put into

building the business, therefore

The midnight moveThe stupidest move:

PICTURE THIS: You and your lover rent a truck

and move out of your apartment in the middle

of the night. O� into the sunset you go – no

worries about broken leases, no cleaning fees,

no goodbyes – just each other and your stu� .

Sound romantic? Well, it isn’t! Bailing on your

lease agreement and leaving your landlord high

and dry – especially when you owe them rent –

is actually the stupidest move you could make.

Consider these seven cautionary tales before

you do a midnight move:

YOU WON’T GET AWAY WITH IT: Let’s just

start with the fact that you’re not going to get

away with bailing on your lease. Be realistic.

Just because you have left the premises,

doesn’t mean your landlord won’t fi nd you.

That is, unless, you plan on never using a

traceable electronic device again – cell phone,

Gmail, Facebook.

I didn’t think so.

IT’S GOING TO COST YOU: You’re on the run

and you think you just left your landlord high

and dry, but the truth is you’re still liable. You’re

responsible for the remainder of your lease,

for any damage to the apartment, cleaning

fees, any outstanding payments and additional

payment for the notice you didn’t give. It’s

going to cost you – and it’s going to cost you

more than necessary. Your landlord is getting

the last laugh, all the way to the bank.

YOU WILL RUIN YOUR CREDIT RATING: So

much rides on your credit rating: your ability to

rent an apartment, lease a car and even obtain

a credit card. Now, wave all of those things

good-bye, because you’re not going to get

them after a midnight move! Bills that are past

due, like the rent you decided not to pay, will

come back to haunt you. If things go all the

way to court (yes, your landlord will sue you), it

will be refl ected on your credit score as well.

NEED A REFERENCE?: I’m assuming you need

a new place to stay after you completely bailed

on your last apartment. Did you forget that a

new landlord can ask you to provide references

and documents that show you are responsible

and would not do something as stupid as a

midnight move? I guess you did. Don’t worry

about getting your hands on a new reference

though. One look at your credit report and any

landlord will probably show you the door.

DON’T FORGET TO…: When you’re in the

middle of a midnight move your mind is

wandering, and well, you forget things. You

can’t exactly just go back to your recently

vacated rental however, and pick up whatever

you left behind. Also, don’t forget to ask your

landlord for your security deposit back. Oh

wait…

BYE BYE NEIGHBOURS: I know it’s hard to

believe, but some people actually like their

neighbours. Or maybe you convinced your

brother-in-law to move into the building you

have decided to casually fl ee. Well, so much for

dinner parties at uncle Dom’s. Once you leave,

there’s not going back.

WHAT’S THE POINT?: You’re not the fi rst –

and certainly not the last – person who has

ever had to break a lease, or who has fallen

behind in rent. What’s the point of jumping ship

and pulling a midnight move? Just speak with

your landlord and see if you can both work out

an arrangement that will save you time and

money. Often the best solution is to fi nd a new

renter to take over your lease. Sure it requires

some leg work, but it will defi nitely be worth it.

Moral of the story: Always remain faithful to

your lease agreement and don’t try anything

stupid. The villain doesn’t win this battle.
