The prospective bidders were allowed toseek clarifications till 25.4.2003 vide Clause 5 of Section II of the Tenderdocument. The compilation of the clarifications sought and BSNL's reply isattached as Annexure-A.In addition to the above, BSNL hereby issues amendment/ additions tosome of the clauses/ annexures etc. of the Tender document. Theamendments/ additions are attached as Annexure-B. The tender documentgets modified to the extent of clarification/ amendments/ additions givenherein in accordance with para 5 and 6 of Section-II of the tender document.The bidders are required to fill up the bid in English and the documents/brochures etc attached should be in English. In case the attached documentsare not in English, the bidder is required to submit an English translationalongwith the original, duly certified by the authorised signatory.The prospective bidders are requested to submit their bids after takingthe amendments/ clarifications into consideration. Sec-II31 (iii)The clause 31 (iii) may be read as "Clause-2 & 10.1 to 10.2 of Section-II: If the eligibility conditions as perclause-2 of Section-II are not metand/or documents prescribed toestablish the eligibility as per Clause-10.1 to 10.2 of section-II are notenclosed, the bids will be rejectedwithout further evaluation."43. By virtue of Special conditions of thecontract in Section IV (clause 13: 5 yearsfrom the 1st Sepember'2003) beingoverriding to these General (Commercial)conditions of the contract, the spares needto be provided for a period of 5 years fromthe date of commissioning. Kindly confirmSec-III9.2The spares are presently not beingprocured by BSNL, however thebidder is required to guarantee theiravailability as per clause 13 of SecIV.Simultaneously the bidder is requiredto maintain spares to meet thewarranty/AMC clauses of this tender44. Kindly confirm that once thevalidation/field trial has been conducted foreach type Low, medium and high capacityRAS at 3 locations, then there is no needfor the same at any other locationSec-IV3.1(C)Please refer clause 3.1(e) of Sec IV45. Since there are 134 locations, please clarifythe meaning of "ONSITE" warranty. Is theexpectation is to have a fulltime engineer atevery site?Sec-IV3.7 (a)The bidder is required to meet thewarranty/AMC clauses of this tender.Also the increase in the number oflocations may kindly be taken note of.46. Kindly clarify the basis/logic of calculationof RAS ports. Is it the number of modemsports?Annexure IV RAS ports are same as modem ports.47. The number of ingress ports in Section V,

Kindly clarify.Table-2 of Sec-VI and row 15of Section VPlease refer the revised table.Signature of Tenderer 6Annexure - BAmendments/ Additions to the tender document for Procurement of RASTender No BSNL/DNW/Tech-4601/20031. The phrase "Remote Access Servers for NIB 'C' type Nodes" appearingin the heading of the Tender and elsewhere in the tender document may beread as " Remote Access Servers for NIB 'C' type Nodes and additionallocations".2. Clause 12 of Section -II is revised to the extent that the Earnestmoney deposit is being increased from Rs 20 lakhs to Rs 40 Lakhs.3. The following clause regarding near relatives is inserted as Clause 32of Section-II :-"The company or firm or any other person is not permitted to tender for works inBSNL unit in which his near relative(s) is (are) posted.i. The near relatives for this purpose are defined as:(i) Members of a Hindu Undivided family.(ii) They are husband and wife(iii) The one is related to the other in the manner as father, mother, son(s)& son’s wife (daughter-in-law), Daughter(s) & daughter’s husband (sonin-law), brother(s) & brother’s wife, sister(s) & sister’s husband(brother-in-law).ii. The unit is defined as SSA/ Circle/ Chief Engineer/Chief Archt./ CorporateOffice for non-executive employees and all SSA in a circle including circleoffice/Chief Eng/Chief Archt/Corporate office for executive employees(including those called as Gazetted officers at present).iii. Certificate for the same in the following format is to be given by all Directorsof the company at the time of submission of tender document :-“I………….S/o…………r/o…………… hereby certify that none of myrelative(s) as defined in the tender document is/ are employed in BSNL unit asper details given in the tender document. In case at any stage, it is found thatthe information given by me is false/ incorrect, BSNL shall have the absoluteright to take any action as deemed fit/ without any prior intimation to me”iv. Government of India / Financial Institutions nominees and independent nonofficialpart time Directors appointed by Govt. of India or the Governor of theState are excluded from the purview of submission of certificate in regard toemployment of near relatives working in the BSNL while submitting tenders bythe limited companies”4. The following clause is added as Clause 16.3 of Section III :-”Should the tenderer fail to commission the equipment within time as prescribed inclause 3.1(e) of Section-IV (as amended), the purchaser shall be entitled to recoverliquidated damages @ 0.5% of the value of the equipment commissioned late, for

each week of delay or part thereof for a period upto 10 weeks of delay. Thereafter,Signature of Tenderer 7liquidated damages will be recovered @ 0.7% of the value of the equipmentcommissioned late for each week of delay or part thereof for a period upto another 10weeks of delay. Quantum of liquidated damages assessed and levied by the purchasershall be final and not challengeable by the supplier."5. The following clause is added as Clause 16.4 of Section III :-"In case the successful bidder fails to give acceptance of Advance PurchaseOrder (APO) within the prescribed time of 14 days alongwith the performancesecurity and any other documents required, if any, the purchaser shall be entitledto recover Rs 10,000/- per day of delay. However, this will not prevent thepurchaser to take action of encashing and forfeiting the EMD (under clause 12.6of Sec-II )."6. The Clause 3.1 (e) of Section-IV is amended to the extent that thetime prescribed for commissioning of equipment is reduced from 120 daysto 105 days.7. The Clause 3.3 (e) of Section-IV (Interface approval) is revised to :-"The Interface approval from TEC of the equipment being offered must besubmitted along with the tender. However if the equipment(s) being offered is inthe process of getting Interface approval, then a documentary proofdemonstrating that equipment has been submitted to TEC for Interface approvalhas to be enclosed along with the bid . In such a case, the tender shall beconditionally accepted and evaluated subject to:(a) Presentation of documentation from TEC within one week i.e. by 19th

May, 2003 indicating that the equipment model(s) quoted for in tender hassuccessfully completed Interface approval test and(b) Production of certificate from TEC regarding successful completion ofInterface approval by 30th May, 2003."8. The Clause 3.11.3 of Section-IV (Proveness) is revised to :-"At least 2000 dialup ports of the RAS being offered must have been in operationin India or alternatively, at least 2000 dialup ports of the RAS being offered musthave been in operation in two different countries each. Relevant document mustbe submitted in this regard."9.(a) Clause 22 (c) of Section -IV is revised to the extent that :-The value of order can be varied (i.e. increased or decreased) by 25%9.(b) Clauses 24 (c) and 25 of Section -II are revised to the extent that :-The value of order can be varied (i.e. increased or decreased) by 25%10. The Section-V of the tender document (Schedule of Requirements)stands revised. The Revised Section-V is attached.11. Para 2.2.8 in Section - VI of the tender document stands deleted12. The clause 3 (iv) of Annexure-II (i.e. AMC) is revised to :-"The AMC charges shall be paid to the contractor on quarterly basis at the end ofthe respective quarter subject to deduction of penalties, Income Tax etc.Contractor shall submit a performance Bank guarantee for the amount of AMC atthe time of signing of the AMC agreement. Although AMC shall be signedbetween the Purchaser and the Contractor, the implementation of the AMCwill done by the respective Telecom Circles/NIB circle co-ordinators."15. The clause 3 (vi) of Annexure-II (i.e. AMC) may be read as :-The faults will be classified as Major faults and Minor faults. Any fault will beconsidered as a Major fault if it affects the quality of service/ availability ofservice of more than:• 20% ports of the supplied equipment at a Low capacity node• 10% ports of the supplied equipment at a Medium capacity node• 5% ports of the supplied equipment at a High capacity nodeOther faults will be termed as Minor faults.16. The clause 3 (viii) of Annexure-II (i.e. AMC) is revised to :-"In case of delay in rectification of faults beyond the above time limit, thecontractor shall be charged penalty at the following rates for the delay beyondthe time limits prescribed above for fault rectification :-• For Major faults @ Rs 5,000/- (Rupees Five Thousand only) per 12hours or part thereof for 72 hours (3 days) and beyond that @ Rs

The clause 3 (x) of Annexure-II (i.e. AMC) is amended to the extentthat the periodicity of preventive maintenance will be every six months insteadof each quarter.18. * For RAS of 390, 480 and 600 ports [S No 2, 3 & 4 of Revised Section-V] the maximum(scalability) shall be upto atleast 22 E1-R2/PRI ports (660 modem ports) + 2 E1-PRIports.** In case of multiple chassis: modem ports, Ingress ports, WAN ports should be equallydistributed and each chassis must have a minimum of 2 WAN ports and 2 Ethernet ports.Note:- E1-PRI ports are required for providing ISDN dialup connections.
