Can Social Security Checks beGarnished?
Dear Savvy Senior,I have some outstanding debts and would like to find
out if my Social Security checks can be garnished.What can you tell me?
Old and IndebtDear Old,Whether your Social Security benefits are garnishable or
not depends on who you owe. Banks and other financialcreditors, for example, can’t touch your Social Securitychecks. But if Uncle Sam is collecting on a debt, some ofyour benefits are fair game. Here’s what you should know.
Creditor ProtectionsIf you have credit card debts, medical bills, unpaid per-
sonal loans or pay day loans, you’ll be happy to know thatyour Social Security benefits are safe from your creditors(those you owe).
But, be aware that your creditors can still take legalaction against you to recover what you owe them, anddepending on your state’s law, they may be able to garnishyour wages and tap into other allowable assets, if you haveany. But they can’t take the money you receive from SocialSecurity. Nor can they touch Supplemental Security Income(SSI), veterans benefits, federal employee and civil serviceretirement benefits, and benefits administered by theRailroad Retirement Board Administration.
To ensure your Social Security or other government ben-efits are protected from creditors, you need to have themdirect deposited into your bank account, or to a DirectExpress Debit MasterCard account (see godirect.org).Benefits deposited by check into your bank account aren’tprotected. Also, be sure you don’t transfer your benefits toanother account, or else the protection is void. And don’thave credit cards or other loans at the bank where yourbenefits are deposited. Money owed to a bank, if it alsoholds the deposit account, can be frozen.
Government GarnishmentIf, however, you owe money to Uncle Sam, it’s a very dif-
ferent story. The federal government can garnish a portionof your benefits for repayment of several types of debts,including federal income taxes, federal student loans, childsupport and alimony, nontax debt owed to other federalagencies, defaulted federal home loans and certain civilpenalties. (If you receive SSI, those benefits cannot be gar-nished under any circumstance.)
How much can actually be garnished depends on whatyou owe for. If you owe back taxes to the IRS, 15 percentof your Social Security benefits can be taken each monthuntil the debt is paid in full. The government uses theFederal Payment Levy Program to garnish your payments.
If you owe money on a student loan – it doesn’t matterhow long ago you were in school – the first $750 of yourmonthly benefits is off-limits to garnishment. After that, thegovernment can shave off up to 15 percent.
And if you owe past or current child or spousal supportyou could lose as much as 50 to 65 percent of your bene-fits. Delinquent child support and alimony cases areprocessed through the national Court Ordered GarnishmentSystem. In these situations, the maximum reduction to yourbenefits depends on the state where you live. The garnish-ment is limited to either the maximum allowed under statelaw or the maximum under the Consumer Credit ProtectionAct, or CCPA, whichever is less.
You also need to know that before your Social Securitybenefits are garnished, you’ll receive several letters ofnotice from the IRS, and be given ample opportunity tomake a pay arrangement. If you don’t, the agency will startdocking your monthly checks.

A little history:The state’s first DWI Law enacted was
in 1911.When baby boomers began to drive in the 1960s more than
60% of traffic deaths were due to drinking and driving. Thisstarted to decrease in the 1980s. Currently about 30% of allfatalities are alcohol related.
The earliest record of traffic deaths was in 1910, with 23fatalities. Systematic record keeping on crashes started muchlater in the 1930s.
Who and how many:Over 570,191 Minnesotans [10.7%] have one or more
DWIs on record. Of licensed drivers in the state, 1 in 7 haveone or more incidents on record, 1 in 17 have two or more and1 in 30 have three or more. Startling, 1,265 Minnesotans have10 or more impaired driving incidents.
In 2011, there were 29,257 impaired driving incidents, with1,903 being underage drivers.
In fifty-five percent of impaired driving incidents the viola-tors are 20 to 34 year olds. Males committed 73% of the inci-dents.
Of all violators, 60% had no prior alcohol incidents onrecord, leaving 40 percent as re-offenders. Of those who incura second violation, half of them will go on to a third, half witha third incident will incur a fourth. Impaired driving incidentsremain permanently on a violator’s record.
Where and when:Mahnomen, Mille Lacs, Clearwater, Cass and Becker
Counties have the highest percentage of impaired driving inci-dents on record and Stevens, Rock, Lincoln, Carver andWashington have the lowest.
Fridays account for 16% of all alcohol incidents, Saturdaysfor 27% and, finally, Sunday for 23%.

1 tsp. soda1 3/4 c. flour
Cream together: 1/2 c. shorteningand 1/2 c. peanut butter1 pkg. chocolate kisses
Gradually add 1/2 c. sugar and 1/2 c. packed brown sugar, creaming well.Add 1 unbeaten egg and 1 tsp. vanilla. Beat well. Blend in dry ingredientsgradually. Mix thoroughly. Shape dough into balls using a rounded tsp. foreach. Roll balls in sugar and place on greased baking sheet. Bake at 375ºfor 10 min. Remove from oven. Top each cookie with a solid milk chocolatecandy kiss, pressing down firmly so cookie cracks around edge. Return tooven, bake 2 to 3 min. longer until golden brown.

1/2 c. butter1 c. nuts1 16 oz. can chocolate syrup
Frosting:1 c. sugar
6 tsp. butter6 tsp. milk
Beat eggs and add remaining ingredients and beat well. Pour into greased 9x 13 or 10 x 13 pan. Bake 350º- 30 min. or until done.
Combine ingredient and boil 4 min. Remove from heat and add small 1/2 c.chocolate chips. Mix well. Cool and beat until thick. Spread on cooledbrownies.

Two local soccer players, Conner Forrest and KellyLattner from the Euro Football Club based out of Rochester,MN were invited to guest play for the internationally recog-nized Brazilian Santos Futebol Clube (Meninos da Vila)youth team at the Disney's ESPN Junior Soccer Showcasethis November 23 - 25, 2012.
Director of Coaching for Euro and Tetra Brazil -Rochester, Wesley Costa states, "This is two big steps for ourprograms based out of Southern Minnesota. First the oppor-tunity to send our players to play for a pro sponsored youthdevelopment program like Santos FC is a level of play weare delighted to see. Many in the U.S may be unfamiliar withthe Santos Futebol Club based out of Santos, Sao Paulo,Brasil but they are a top professional team and have had leg-ends of soccer like Pelé and Neymar play for them. Secondly,to have our players compete in the top-notch and interna-tionally recognized Disney's ESPN Junior Soccer Showcaseis a great way to build on our club's resume and show theskill of our players."
As to how our local players fared, Coach Wesley stated,"The Santos FC Head Coach, Marcio Alexandre and othercoaching staff were pleased with the skills of Conner andKelly. They worked hard in practices, showed a positive atti-tude, and played well in games. They also commented on thepositive bond with the team and the lasting friendships thathave come from this cultural interchange. This is what soc-cer does. It is an international game and builds positive rela-tionships throughout the world."
Both players are grateful for this opportunity. They wishto thank Coach Wesley Costa, Tetra Brazil, and their manycoaches in Euro and at school for the training they providedthat prepared them for this experience. They're grateful forthe high level training and competition provided by theircoaches and teammates with the Santos FC. They're appre-ciative of the long hours put in by the committed staff atDisney and ESPN required to host the top 300 teams fromaround the world.
