Here is the document that Fred just put together. As we talked about, he added BillStone's edits (made this past weekend) to the version that Andrew A. edited. I took aquick look, and it looks OK.

Of course, formatting is now completely off (see the last several pages, starting with"Selected Definitions from the LMRDA"). I'm thinking we should wait until we knowwhich edits will actually be made before we make those formatting changes. With thatsaid, we might want to mention to CRLM that we are aware that we'll need to reformatthe last several pages before it goes to Exec. Sec.

Further, we'll want to know CRLM's opinion on the issues raised in the body of the emailthat Andrew A. sent yesterday (e.g., possible changes to the form, and possiblechanges to the instructions regarding the use of "you" vs. "filer").

As soon as we know which edits will be made to the form and instructions, we'll need tobe conscientious about making all necessary modifications to the preamble. We'll needto be clear on who is doing what (CRLM? OLMS?).

I put the attached document on the Y drive - just "loose" in the Revised LM-30 folder.

The Office of Labor-Management Standards (OLMS) will hold a July 21, 2009 meeting Intended to solicitcomments concerning two regulatory actions It is considering,

As noted In the spring 2009 Semi-Annual Regulatory Agenda, the Department is considering a rulemaklngproposing to revise the Form LM-30 (Labor Organization Officer and Employee Report), a reporting anddisclosure form promulgated by the Department pursuant to the Labor-Management Reporting andDisclosure Act (LMRDA). The rulemakfng Is Intended to review questions of policy and law surrounding theLMRDA union officer and employee reporting requirements and will focus on reporting changes resultingfrom the 2007 regulatory revision of the Form LM-30 and Instructions.

This 2007 revision significantly revised the previous Form LM-30 and Instructions, which had notsubstantially changed In over 40 years. Fliers have raised significant Issues regarding the scope and extentof the new Form LM-30 reporting requirements and format. Issues raised Include the following:

. the layout of the form and Instructions;

. the de minimis threshold, which exempts reporting under a minimal dollar amount, including Itsapplication In connection with participation in "widely attended gatherings;"

. the definition of "labor organization employee," as It relates to union stewards;

. the "bona fide employee exception," as It relates to union leave/no docking payments;

. the reporting of payments and Interests to a union officer from an employer or a business whoserelationship Is with unions affiliated with the union In which an Individual Is an officer or employee;

. the reporting of loans from financial Institutions; and

. the scope of Form LM-30 reporting under section 202(a)(6) of the LMRDA, 29 U.S.c. 9432(a)(6),particularly concerning the classification of trusts and labor organizations as employers.

Additionally, as noted in the spring 2009 Semi-Annual Regulatory Agenda, the Department is consideringa rulemaklng proposing to rescind the Form T-1, Trust Annual Report, which certain labor organizationsmust file to disclose financial Information regarding trusts In which they are Interested pursuant to theLMRDA. The Department also Is considering a proposal to re-establish the requirement that filers of FormLM-2, Labor Organization Annual Report, report on their wholly owned, wholly controlled and whollyfinanced ("subsidiary") organizations on their Form LM-2, as was required prior to the 2003 revision ofForm LM-2 and Issuance of Form T-!' A revision to "subsidiary" organization reporting Instructions on theForm LM-3, Labor Organization Annual Report, also Is under consideration. Finally, the rulemaklng wouldpropose to change an Interpretation of the LMRDA regarding Intermediate bodies. The proposed revisedInterpretation would state that Intermediate bodies are covered only If they are themselves composed, inwhole or part, of private sector affiliates.

OLMS had most recently revised the Form LM-30 in 2007. OLMS now proposes to revise the FormLM-30 and its instructions, based on an examination of the policy and legal justifications for, and utilityof, certain changes implemented in the 2007 Form LM-30 Final Rule. Proposals for considerationinclude: the coverage of shop stewards under the LMRDA section 202 reporting requirement; therequirement to report union-Ieavelno-docking payments; the requirement to report certain loans,including home mortgages; the requirement to report payments from certain trusts and unions; and thescope of reporting for higher level union officials.

OLMS will receive comments from the public on the proposed rule through October 12,2010.Additional information about the rulemaking and about LM-30 reporting is available on the OLMSwebsite.
