    Missing DocumentsVarious Document Requests Made to the Director of Central Intelligence

    We need to discuss the status of following items ~ what if any additional documents needto be produced, and if there are none, what assurances you can give us that your searchhas been sufficient and the production complete.

    Items 1 through 6, DCI Document Request #1. If such documents do not exist,please be prepared to have the DCI certify that this fact.^f W/W ' t y n t 9.7^

    - No documents have been provided for Items(^(ljJ, 17, 20, 30 and 36.- Item 14 of this request - the National Intelligence Priorities Framework -was determined to be "out of scope" by the DCI in his response to the

    Commission. We disagree and have raised this concern with the AttorneyGeneral's Office several months ago.

    - Item 16, DCI Directives, is incomplete. DCIDs forWarning, theCounterterrorism Center, and Counterterrorism coordination within theIntelligence Community are missing.

    - Item 19, guidance related to the DCI's declaration of war against al-Qa'ida. A list of documents was provided, however we require the actualdocuments.

    - Item 22, documents of the National Intelligence Collection Board relatedto UBL or al Qa'ida. No documents have been provided for the period ofSeptember 2000 to September 2001.

    - Item 24,documents of the National Intelligence Production Board relatedto UBL, al Qa'ida or other foreign terrorist threats. Documents reflectonly two meetings over the three year period requested and that the CTportion of the meetings had no backup materials.

    - Item 29, "ThePlan,"only PowerPoint slides provided. Please provide anywritten documents that memorialize this "Plan."- Item 34, Spot Reports. The Commission staff put this on hold. We now

    need this item fulfilled.- Item 37, analytic products of the CTC. We are willing to limit this to

    analytic products "disseminated to policy officials" related to UBL, al

    I am responding to The National Commission on TerroristAttacks Upon the United States' (the Commission) request for anupdate on the status of the Central Intelligence Agency's (CIA)response to Item Nos. 1, 2, 3, 4, 5, 6, 8, and 18 of DCIDocument Request No. 8. In your memorandum of 26 August 2003,you identify these items as the >vmost important categories ofdocuments requested by the Commission." Below is our report onthese items:

    1. Item Nos. 1 (Presidential Daily Briefs [PDBs]), 2 (PDBFeedback), 3 (Briefing Packages for Principals and DeputiesMeetingsJ of PR #8. As regards Item No. 1, we have beeninformed that the Commission will receive a briefing on PDBs onTuesday, 14 October 2003. We understand that the ExecutiveBranch focal point, Mr. Daniel Levin, is responsible for workingwith the Commission staff to resolve Item Nos. 2 and 3 ofRequest No. 8. We are in the final stages of reviewing many ofthe briefing packages for the Principals and Deputies meetingsand expect to begin making these documents available to theCommission on a rolling basis beginning on 17 October 2003.

    2. Item No. 4, PR #8 (DCI Presentations to President ofthe United States and Vice President of the United States). Weunderstand that the Executive Branch focal point, Mr. DanielLevin, is responsible for working with the Commission Staff toresolve Item No. 4 of Request No. 8, and we have been informedthat he will establish procedures with the Commission for

    providing access to information responsive to this request. Inaddition, we have recently identified additional materialsresponsive to Item No. 4, and the production of these materialswill also be coordinated through Mr. Levin.

    3. Item No. 5, PR #8 (Preparatory Materials for DCI'sMeetings with NSC, Secretary of Defense [SecDef], Secretary ofState [SoS], and Director/Federal Bureau of Investigation[D/FBI]). We have identified responsive documents pertaining tothe DCI's meetings with the SecDef, SoS, and D/FBI, and, byprior agreement, these documents have been retained by theAgency and are available for your inspection at CIAheadquarters. We understand that the Executive Branch focalpoint, Mr. Daniel Levin, is responsible for working with theCommission Staff to resolve that part of Item No, 5 ofRequest No. 8 pertaining to the DCI's meetings with the NationalSecurity Advisor. We expect to make this latter category ofdocuments available to the Commission by 17 October 2003.

    4. Item No. 6, PR #8 (Reports of DCI7s Meeting with SeniorForeign Officials). We have identified responsive documentspertaining to the DCI's meetings with senior foreign officials,and, by prior agreement, these documents have been retained bythe Agency and are available 'for your inspection at CIAheadquarters. We again note that CIA does not systematicallystore and maintain summaries for the numerous meetings andconversations that the DCI has with senior foreign officials.The Commission therefore should not consider CIA's production ofdocuments responsive to Item No. 6 to reflect the universe ofthe DCI's meetings with senior foreign officials.

    5. Item No. 8, PR #8 (Lessons Learned from Prior TerroristAttacks). In addition to materials previously produced to theCommission for Item No. 8, we have recently identified severalCIA "lessons learned" documents responsive to this request andexpect to produce them to the Commission by 17 October 2003.6. Item No. 18, PR #8 (Agenda and CounterterrorismMaterials from DCI's Meeting with SecDef). We have previouslyproduced responsive documents pertaining to the DCI's meetingswith the Secretary of Defense. We have not located any newdocuments that are responsive to this request.
