1. Vandalism is implied when using force to break into a structure. 2. By illegally entering a structure, the offender is trespassing , which is a group B offense and group B’s aren’t reported with group A offenses. 3. Stealing items from inside a structure is larceny which is part of the burglary definition - to commit a theft so a separate offense doesn’t have to be reported.

Presenter
Presentation Notes
If a structure is entered without the intent to commit a felony or a theft the offense classification would be Trespass, which is a Group B offenses and reported to SCIBRS only when an arrest is made. Example: a group of teenagers break into an abandoned house to have a beer party. They don’t intend to commit a felony and there is nothing to steal so the definition of burglary has not been met. But if someone breaks into a warehouse full of TV’s, even if they don’t manage to get anything, the intent is there.

Example 1: robber goes into the bank and hands the teller a note that says, this is a stick-up, put money in the bag or I’ll shoot. Only the one teller and the bank are victims. Same robber goes into the bank waving a gun around and says this is a stick-up. Then all the tellers and customers as well as the bank become victims if they are in the vicinity of the robber.

The agency who reported the vehicle stolen will go into the original report and report the recovery date and value of the vehicle.
