PUBLIC SESSION MINUTES

May 28, 2019

I. CALL TO ORDER PUBLIC MEETING

President Jane Luciano called the May 28, 2019 meeting of the Robbinsville Board of Education to order at 6:03

PM. She read the New Jersey Open Public Meeting Law announcement and led the flag salute.

III. MOTION TO CONVENE IN EXECUTIVE SESSION

On motion of Mr. Galluccio and seconded by Mr. Heilman, the Robbinsville Board of Education voted to enter

Executive Session at 6:04 PM to discuss the topics indicated below.

WHEREAS, while the Sen. Byron M. Baer Open Public Meetings Act (N.J.S.A. 10:4-6 et seq.) requires all

meetings of the Robbinsville Board of Education to be held in public, N.J.S.A. 10:4-12(b) sets forth nine (9) types

of matters that may lawfully be discussed in "Executive Session," without the public being permitted to attend, and

WHEREAS, the Board has determined that one (1) issue is permitted by N.J.S.A. 10:4-12(b) to be discussed

without the public in attendance and shall be discussed during an Executive Session to be held on Tuesday, May

28, 2019 at 6:00 P.M, and

WHEREAS, the nine (9) exceptions to open public meetings set forth in N.J.S.A. 10:4-12(b) are listed below, and

next to each exception is a box which will be marked when the issues to be privately discussed fall within that

exception, and after each exception is a space where additional information that will disclose as much information

about the discussion as possible without undermining the purpose of the exception shall be written:

1. Any matter which, by express provision of Federal law, State statute or rule of court shall be rendered

confidential or excluded from public discussion.” The nature of the matter, described as specifically as

possible without undermining the need for confidentiality is: Attorney / Client Privilege

2. Any matter in which the release of information would impair a right to receive funds from the federal

admitted to or served by such institution or program, including but not limited to information relative to the

individual's personal and family circumstances, and any material pertaining to admission, discharge, treatment,

progress or condition of any individual, unless the individual concerned (or, in the case of a minor or

incompetent, his guardian) shall request in writing that the same be disclosed publicly." The nature of the

4. Any collective bargaining agreement, or the terms and conditions of which are proposed for inclusion in any

collective bargaining agreement, including the negotiation of terms and conditions with employees or

representatives of employees of the public body." The collective bargaining contract(s) discussed are between

the Board and____________________.

5. Any matter involving the purchase lease or acquisition of real property with public funds, the setting of bank

rates or investment of public funds where it could adversely affect the public interest if discussion of such

matters were disclosed." The nature of the matter, described as specifically as possible without undermining

the need for confidentiality is:

6. Any tactics and techniques utilized in protecting the safety and property of the public provided that their

disclosure could impair such protection. Any investigations of violations or possible violations of the law."

party. Any matters falling within the attorney-client privilege, to the extent that confidentiality is required in

order for the attorney to exercise his ethical duties as a lawyer." The parties to and docket numbers of each

item of litigation and/or the parties to each contract discussed are and the nature of the discussion, described as

specifically as possible without undermining the need for confidentiality is:

8. Any matter involving the employment, appointment, termination of employment, terms and conditions of

employment, evaluation of the performance, promotion or disciplining of any specific prospective public

officer or employee or current public officer or employee employed or appointed by the public body, unless all

individual employees or appointees whose rights could be adversely affected request in writing that such

matter or matters be discussed at a public meeting." Subject to the balancing of the public's interest and the

employee's privacy rights under South Jersey Publishing Co. v. New Jersey Expressway Authority, 124 N.J.

478 (1991), the employee(s) and nature of the discussion, described as specifically as possible without

undermining the need for confidentiality are: Personnel / Superintendent Merit Goals & Evaluation

9. Any deliberation of a public body occurring after a public hearing that may result in the imposition of a

specific civil penalty upon the responding party or the suspension or loss of a license or permit belonging to

the responding party as a result of an act of omission for which the responding party bears responsibility." The

nature of the matter, described as specifically as possible without undermining the need for confidentiality is:

WHEREAS, the length of the Executive Session is estimated to be sixty (60) minutes after which the public

meeting of the Board shall reconvene and proceed with business where formal action will be taken.

NOW, THEREFORE, BE IT RESOLVED that the Robbinsville Board of Education will go into Executive Session

for only the above stated reasons; and

BE IT FURTHER RESOLVED that the Board hereby declares that its discussion of the aforementioned subject(s)

will be made public at a time when the public's interest in disclosure is greater than any privacy or governmental

interest being protected from disclosure.

B. CONGRATULATIONS CAMERON COYLE, NJCSS First Place Student Recognition Award – Hank

Bitten, President, NJCSS and Rose McGlew, PRMS

Mrs. McGlew and NJCSS President Hank Bitten introduced RHS Sophomore Cameron Coyle and

congratulated him on his first place award from the New Jersey Council for Social Studies.

VI. RHS STUDENT GOVERNMENT REPORT – Kelly Herbert, President, RHS Executive Council

Kelly Herbert reported on the most recent news at Robbinsville High School.

Sports: ● The RHS baseball team has made it to the third round of states. After defeating the Bordentown Scottie’s 2-1

at their home game today, they will go onto to play Point Pleasant High School in the Sectional Final on

Friday.

● The boys and girls lacrosse teams had a great season as they made it all to the state competition..

Clubs: ● Next weekend Robbinsville will be hosting their annual Q & A race. Many students will be volunteering at the

race.

● The end of the year is winding down and everyone is getting ready for finals. The annual tropical smoothie

fundraiser will be going on during finals week and is always a big hit with the students.

● The Junior class is collecting Disney money.

● Sophomores went to Great Adventure as a reward for promoting safe driving and for winning the window

decorating contest.

Executive Council:

● The Executive Council will be hosting their election on Friday as well as other class council elections.

● The freshmen class has eleven students running for class council.

PEI Reflection:

● Students are preparing for their final PEI sessions on the school year.

VII. PRMS / SES STUDENT COUNCIL REPORT – Hannah James, RHS Executive Council

Hannah James reported on the latest news from Pond Road Middle School and Sharon Elementary School.

VIII. PUBLIC HEARING: POLICY & REGULATION 5536: RANDOM DRUG TESTING

RHS Principal Molly Avery addressed the Board of Education and members of the public regarding the Random

Drug Testing policy and regulation scheduled for implementation in September. She detailed changes in drug use

over the past 5-7 years and addressed student rights vs. creating a safe environment for students. Ms. Avery noted

that because the district is required to tie random drug testing to a privilege such as parking or extra-curricular

activities approximately 85% of RHS students will be eligible for random drug testing.

Sargent Scott Kivit, Robbinsville Police Department, also addressed the Board. He echoed Ms. Avery’s remarks

and talked about how current drugs are unrecognizable to parents.

Members of the public were invited to comment.

Avery Hutchinson

Appreciates RDT policy adjustments and urged administration to ensure that this and the suspected use policy

mirror one another – Asked if PRMS RDT was considered and inquired into how much parents of 18 year olds can

be told about RDT results.

Mary Caffrey

Commended BOE for the RDT policy and spoke about her professional experience in this area.

Carol Ann Blank

Requested that nicotine be added to the list of tested substances.

Leif Breeden

Discussed false/positive results and asked about establishing a protocol if one is not already in place.

Gwendolyn Wood

Related her experience of working with addicts and expressed concern about the punitive aspect of the policy,

particularly with regard to students with IEPs or 504 plans. Indicated that the policy doesn’t address the most

vulnerable kids (those who are not involved in extra-curriculars).

IX. ADOPT POLICY & REGULATION 5536 (Attachments #1 & #2)

Discussion

Several Board members expressed agreement that implementation of the RDT policy is a step in the right direction

and will ultimately benefit students. Mr. Young applauded Dr. Foster and Dr. Tew for their holistic approach to

the drug testing issue. Mrs. Temple noted that the policy is but one of a number of supports in place for students

who may be struggling.

On motion of Mrs. DeVito and seconded by Mr. Young, the Robbinsville Board of Education voted 8-0-1 to adopt

Policy and Regulation 5536, Random Drug Testing. Mr. Galluccio abstained.

X. INTERVIEWS: ARCHITECT OF RECORD

The Board conducted interviews for the Architect of Record. The bid opening took place on May 17, 2019 and

representative from the following firms participated in the interviews.

XI. MOTION TO CONVENE IN EXECUTIVE SESSION – 10:20 PM

On motion of Mr. Heilman and seconded by Mrs. DeVito, the Robbinsville Board of Education voted to convene

in Executive Session to engage in deliberations regarding the Architect of Record.

Dr. Foster, Dr. Tew, Ms. Brooks, Mr. Veisz and Mr. Young were excused from Executive Session.

XIII. APPOINT ARCHITECT OF RECORD

On motion of Mr. Young and seconded by Mr. Heilman, the Robbinsville Board of Education voted 6-2-1 to

appoint Frayhlak, Veisz, Hopkins, Duthie, P.C. to serve as the Robbinsville Public Schools Architect of Record for

the period dating from July 1, 2019 through June 30, 2020. Mrs. DeVito and Mr. Halm dissented. Mr. Veisz

abstained.

XIV. SUPERINTENDENT’S REPORT – Dr. Kathie Foster

A. 2018-2019 MERIT GOALS – Dr. Foster provided a brief overview of her merit goals.

B. PRESENTATION: ROBBINSVILLE PUBLIC SCHOOLS STRATEGIC PLAN – Because of the time,

Dr. Foster’s presentation on the Strategic Plan was postponed until the June meeting. In the meantime, a draft

of the presentation will be posted on the district website.

XVII. APPROVE ANNUAL RESOLUTIONS FOR 2019-2020 (XIX.A-Z)

Discussion

Financial Advisor for ESIP – Ms. Brooks explained that the district obtained quotes for this position and that the

district’s financial advisor (Acacia) was not yet scheduled for review.

Treasurer of School Monies – Outside vs. internal position necessary for segregation of duties.

Special Education Attorney – A Board member asked when the position of Special Education Attorney is due to be

reviewed. Additional discussion at committee level will take place.

On motion of Mr. Halm and seconded by Mrs. DeVito the Robbinsville Board of Education upon recommendation

of the Superintendent voted 9-0 to approve annual resolutions XIX.A-Z for school year 2019-2020 as indicated.

Mrs. DeVito and Mr. Heilman dissented on item F.6 (Appoint Special Education Attorney).

A. Financial Depositories

Motion to approve the following financial institutions as official depositories for the School District’s funds

for the 2019-2020 school year.

B. Authorization to Mandate Direct Deposit

Motion to designate Investors Bank, the district’s banking institution, to administer the direct deposit program

for all district employees as per requirements of N.J.S.A.52:14-15h. All employees shall receive their net pay

via direct deposit for the 2019-2020 school year. The Robbinsville Board of Education will make exception to

this resolution for the following employee payments:

Athletic and co-curricular stipends

June 30th payments to staff members that have not checked out appropriately for the year

Final check upon termination

Note: The Principal or his / her designee shall notify the Business Office by the close of business on June 21, 2019 as to those

employees that have not checked out appropriately.

Interscholastic Athletic Association (NJSIAA) to participate in approved interschool programs sponsored by

governed by the Constitution, Bylaws and Rules and Regulations of NJSIAA, including all rules governing

Motion to establish The Trenton Times as the official newspaper for district announcements for the 2019-2020

XVIII. APPROVE MONTHLY RESOLUTIONS

A. PERSONNEL (A.1 – 22)

On motion of Mrs. DeVito and seconded by Mr. Halm, the Robbinsville Board of Education upon

recommendation of the Superintendent voted 6-0-3 to approve the 2019-2020 annual reappointments on pages

29-44 and personnel resolutions A.1- 9 on pages 45-51. Mr. Heilman dissented on resolution b on the

reappointment list (Non-affiliate Salaries). Mr. Galluccio, Mr. Veisz and Mr. Young abstained.

On motion of Mrs. DeVito and seconded by Mr. Heilman, the Robbinsville Board of Education voted 7-0-2 to

amend Qualitative Goal #2 of resolution A.10 (Request Payment for Completion of Superintendent’s Merit

Goals) from $4,462.50 to $4,000.00. Total merit goal payment will be $20,242.50. Mr. Veisz and Mr. Young

abstained.

On motion of Mr. Halm and seconded by Mr. Galluccio, the Robbinsville Board of Education voted 3-4-2 to

approve resolution A-10 as amended. Mrs. DeVito, Mr. Halm, Mrs. Temple and Mrs. Luciano dissented. Mr.

Veisz and Mr. Young abstained. The resolution fails to pass.

Discussion ensued after Mr. Halm and Mr. Galluccio made the motion.

On motion of Mr. Halm and seconded by Mrs. DeVito, the Robbinsville Board of Education voted 5-1-3 to

amend resolution A.10 (Request Payment for Completion of Superintendent’s Merit Goals) to reflect the

original payment amount of $4,462.50 for Qualitative Goal #2. Mr. Galluccio dissented. Mr. Heilman, Mr.

Veisz and Mr. Young abstained.

Commentary:

Board members stressed that the motion to withhold part of Dr. Foster’s merit goal payment was not personal

against Dr. Foster or any members of the Strategic Planning Committee.

On motion of Mrs. DeVito and seconded by Mr. Halm, the Robbinsville Board of Education upon

recommendation of the Superintendent voted 9-0 to approve personnel resolutions A.11-22 below.

10. REQUEST PAYMENT FOR COMPLETION OF SUPERINTENDENT’S MERIT GOALS

Motion to request payment to the Superintendent in the amount of $20,706.00 per employment agreement

for completion of merit goals for 2018-2019 as indicated.

Quantitative Goal #1: 3.3% of Annual Salary = $5,890.50

Maintain a strong academic culture in Robbinsville.

Audit the current grade 9 curriculum to directly address the NJ Student Learning Standards and improve

foundational math, critical thinking, and problem solving skills. Resources leveraged to specifically

address Algebra I and mathematical mindset.

Evidence of Completion

1. Target a mean score increase of 5% on two Grade 9 school-wide benchmarks within the curriculum.

2. Target an increase of 20% in Algebraic Thinking Skills as measured through iXL.com.

Quantitative Goal #2: 3.3% of Annual Salary = $5,890.50

Promote a healthy school culture.

Provide ongoing support for struggling high school students with social-emotional needs.

Evidence of Completion

1. Track data for identified students in academic performance by 3% (pending first quarter review).

2. Track data for identified students in the student absences and an increase in student attendance by 5%

(pending first quarter review).

Qualitative Goal #1: 2.5% of Annual Salary = $4,462.50

Effectively manage facilities and operations.

The Superintendent will foster an active and comprehensive security drilling protocol so that an array of

scenarios is routinely practiced with all district personnel, outsourced staff, and students and a culture of

safety is expected. Scenarios must include locking down students during high traffic times, recognizing

and removing strangers from the building, accounting for all students at all times, and reunification plan.

Evidence of Completion

11. EXTEND SIDEBAR AGREEMENT BETWEEN THE ROBBINSVILLE BOARD OF

EDUCATION AND THE ROBBINSVILLE EDUCATION ASSOCIATION

WHEREAS, the Robbinsville Board of Education (“Board”) and the Robbinsville Education Association

(“Association”) are parties to a collective negotiations agreement (hereinafter “Agreement”); and

WHEREAS, the terms of the Agreement do not provide for a sick leave donation bank; and

WHEREAS, both the Board and the Association wish to extend a one-time sick leave bank for Employee

#5431; and

WHEREAS, Association members wish to voluntarily transfer accumulated sick, vacation, and/or personal

leave to the sick leave bank for use by Employee #5431.

NOW, THEREFORE, in consideration of the foregoing, the Board and the Association agree as follows:

1. Association members shall be permitted to voluntarily donate accrued sick, vacation, and/or personal

days to the Employee’s sick leave bank, up to a maximum of ten (10) days per member, so long as the

Association member maintains a minimum sick leave bank of thirty (30) days. The maximum number

of days permitted in the leave bank is fifteen (15) days. Members’ donations will added to the leave

bank in the order in which they are donated but shall be used one at a time on an as needed basis (If a

member donates ten (10) days to the bank, days shall be left in the members own sick leave bank until

one or more is needed by employee #5431).

2. The leave bank may only be utilized by Employee #5431 for the purposes of leave associated with the

treatment and / or recovery from his / her own personal illness.

3. The sick leave bank expires on June 21, 2019. Any leave days remaining in the leave bank upon its

expiration shall also expire.

4. Employee #5431 shall be compensated 1/185 of his / her annual salary for each day of the leave bank,

irrespective of the salary of the donating member.

5. This Agreement shall be non-precedential and cannot be used by either party in any future dispute for

any purpose whatsoever, including, but not limited to, establishing past practice.

12. EXTEND SIDEBAR AGREEMENT BETWEEN THE ROBBINSVILLE BOARD OF

EDUCATION AND THE ROBBINSVILLE EDUCATION ASSOCIATION

WHEREAS, the Robbinsville Board of Education (“Board”) and the Robbinsville Education Association

13. AUTHORIZATION TO HIRE

Motion to grant authority to the Superintendent to hire district personnel in between monthly meetings of

the Board of Education during the period dating from May 29, 2019 through September 24, 2019.

14. APPROVE 2019-2020 COACHING STAFF FOR SUMMER WORK OUTS

Motion to permit all 2019-2020 Board approved coaching staff to work out with their teams on a voluntary

basis per NJSIAA Guidelines during the period dating from June 10, 2019 – August 31, 2019.

15. APPROVE 2019-2020 COACHING STAFF FOR WEIGHT ROOM OVERSIGHT

Motion to approve all 2019-2020 Board approved coaching staff to oversee student workouts in the RHS

weight room during the period dating from July 1, 2019 through June 30, 2020.

recommendation of the Superintendent voted 9-0 to amend resolution B.2 by tabling Policy and Regulation

Motion to accept and submit a grant from the New Jersey School Insurance Group in the amount of

$7,822.61 for use during the 2019-2020 school year. The funds are designated to enhance the safety of

master throughout the district.

l. Authorize Shared Service Agreement: Robbinsville Board of Education and Robbinsville

Township – School Resource Officers

Motion to authorize a shared service agreement between the Robbinsville Board of Education and

Robbinsville Township to fund three School Resource Officers for the period dating July 1, 2019

through June 30, 2020. The district will pay the township $260,000.00 by November 30, 2019 or

within 30 days of the date of billing, whichever occurs first.

m. Authorize Shared Service Agreement: Robbinsville Board of Education and Robbinsville

Township – Recreation Summer Camp Supplies and Services

Motion to enter into a shared service agreement with Robbinsville Township. During the period dating

July 1, 2019 through August 16, 2019, the Board will provide nursing supplies and nursing services to

the township for summer recreation camp as detailed in the agreement. Lunch service, not to exceed

$26,000.00, will also be provided.

n. Approve MOA between Robbinsville Schools and Law Enforcement (Attachment #22)

Motion to approve a Memorandum of Agreement between Robbinsville Schools and the Robbinsville

Township Police Department.

o. Approve Professional Services Agreement: Food Service Monitoring

Motion to approve a professional services agreement with Edvocate, Inc. in the amount of $12,000.00

to monitor the district’s food service contract for the period dating from July 1, 2019 through June 30,

2020. The agreement is subject to four – one year extensions at the district’s option.

p. Withdraw from the National School Lunch Program

Motion to withdraw Sharon Elementary and Pond Road Middle Schools from participation in the

National School Lunch Program (NSLP) effective July 1, 2019. Robbinsville High School withdrew

from the NSLP on July 1, 2012. Effective July 1, 2019, all Robbinsville Public Schools will no longer

participate in the NSLP.

XVII. OLD BUSINESS

Mrs. Temple reported that she has received feedback about the length of time the CST / IEP process takes.

Mrs. Luciano suggested that it would be helpful to help parents understand the timeline associated with this

process.

Mrs. Temple also reported that she is concerned for 9th grade math students. Because of the lack of math

teachers, students have been relegated to spending class time in the commons. There is a concern that PARCC

scores will reflect a gap in instruction.

XVIII. NEW BUSINESS

Mr. Heilman addressed the Board about his recent attendance at the NJSBA Delegate Assembly and informed

that that NJSBA has entered an agreement with Rutgers University for provision of additional training

opportunities.

Mr. Young indicated that he was disturbed by the discussion that took place in public earlier in the meeting

about Dr. Foster’s merit goals.

Mrs. Ciaccio indicated that she recently attended a Special Education Symposium and found it very

informative.

On motion of Mrs. DeVito and seconded by Mrs. Temple, the Robbinsville Board of Education voted to

adjourn the May 28, 2019 monthly meeting at 12:57 AM.
