THE vast majority of homebuyers have noknowledge of their legal liabilities or thefinancial implications of purchasing a homewith illegal building, Archicentre, the buildingadvisory service of the Australia Institute ofArchitects has warned.

According to Archicentre statistics, 29 percent of Australian homes inspected by

Archicentre Architects have some form ofillegal building.

Maureen Letter, Archicentre WAmanager, said in extreme cases homebuyerscould be forced to pull down or rectify illegalstructures and become legally liable for anyinjuries caused to visitors or tradespeoplewho suffered injury because of the illegalbuilding.

“Most dangerous situations are wherepeople have undertaken illegal wiring,plumbing, structural changes or theconstruction of balconies and decks on theproperty,” she said.

“But people contemplating undertakingillegal building should be aware, one way orthe other, it will catch up with them.”

Ms Letter said that the harsh reality of theimpact of illegal building hit home whenpeople went to sell their homes and foundpurchasers were requesting the appropriatepaperwork, including building permits, anddocumentation from licensed plumbers andelectricians certifying work done.

“Even if the home is sold to anunsuspecting buyer with illegal wiring orillegal plumbing, an accident caused as a resultof the unregistered and illegal work could

place the buyer in court facing huge legaldamages,” she said.

Ms Letter said the illegal building, whichcould cost the homeowner thousands ofdollars, was a false economy because it coulddevalue the home and make it difficult to sell.

"If there is an accident at the home, such asa balcony collapse or a death byelectrocution, investigations by authoritieswill ultimately turn up if the building workdoes not have the appropriate certification.”

Ms Letter said that, all homebuyers shouldask to check the paperwork and permitsbefore purchasing a home. ■
