    material

  • The report is primarily a source of information for the participants of the "Evening with the Ombudsman" and all who are interested in the subject of fundamental rights. It compiles institutions and organizations from Poland, Romania, Estonia, Czech Republic and Slovenia that are active in the field of human rights as well as presents a selection of teaching materials related to this topic, especially those useful in adult education. It also includes European sources, including the websites of the European institutions and their materials published online.

  • 1. Poland Public institutions and non-governmental organizations involved in promoting and protecting fundamental rights Polish public institutions

    Office of the Human Rights Defender (Ombudsman) http://www.rpo.gov.pl/ Human Rights Defender is a constitutional authority for legal protection in Poland that was established by the Human Rights Defender Act in 1987. The Defender is appointed by the Sejm and approved by the Senate for a term of five years. The Defender is independent of other state authorities, safeguards human and civic rights and freedoms specified in the Constitution and other laws.

    Inspector General for Personal Data Protection www.giodo.gov.pl/ Inspector General for Personal Data Protection (GIODO) is an authority for the protection of personal data. Its tasks and responsibilities are defined by the provisions of the Act of 29 August 1997 on the protection of personal data. GIODO is authorized to check compliance with the provisions, to make administrative decisions or to handle the complaints about the implementation of the provisions on the protection of personal data.

    Ombudsman for Children http://www.brpd.gov.pl/ The Ombudsman for Children (RPD) is a constitutional state authority. RPD acts to protect the right to a life, the health of children, the right to family care, the right to decent social conditions and the right to education. Ombudsmans special care and assistance surrounds children with disabilities, he promotes children's rights and the methods of protecting them. The Ombudsman is currently authorized to, for example, participate in proceedings in criminal constitutional complaint concerning children's rights before the Constitutional Court, submit a cassation appeal of a final judgment of the court, or take part in the ongoing proceedings in juvenile cases.

    Patient Ombudsman http://www.bpp.gov.pl/ Patient Ombudsman is a central body of government administration. Every citizen has the right to a free appeal to the Patient Ombudsman for assistance in matters concerning the protection of patients' rights specified in the Act on patients rights and on the Patient's Ombudsman. The Ombudsman may also initiate an investigation on their own initiative, taking into account valid information as to the violation of patients' rights. In the organizational structure of the Office of the Patient Ombudsman there operate Patients' Rights Ombudsmen for Psychiatric Hospital whose mission is to protect the rights of of persons benefiting from health care provided by the psychiatric hospital during hospitalization.

    Office of Competition and Consumer Protection is a central authority of government administration. The main task of the Office is to prevent anti-competitive agreements and the abuse of dominant position as well as the control of concentrations businesses. The Offices powers were increased several times, for example to protect the interests of consumers. Subordinated to the President of the Office is the Chief Inspector of Commerce. Since 2000, the Office monitors the state aid granted to entrepreneurs and supervises general product safety.     Amnesty International www.amnesty.org.pl Amnesty International is an international non-governmental organization working for human rights. It works through peaceful civic actions, for example by writing letters to the governments of the countries which violate human rights, public release of information about such violations and it offers realistic financial and legal assistance to victims.

    Helsinki Foundation for Human Rights www.hfhr.pl The Helsinki Foundation for Human Rights, is an organization that was founded in 1989 on the initiative of the Helsinki Committee. The Foundation runs a program in the field of human rights and monitors the activities of public institutions for their compliance with the rule of law.

    Human Rights Watch http://www.hrw.org/europecentral-asia/poland Human Rights Watch is a non-governmental organization dedicated to the protection of human rights. Its main task is to monitor the human rights situation in various parts of the world. It acts in the defense of freedom of speech and belief, to provide defendants with the right to a fair trial and asylum; to prevent torture and arbitrary deprivation of liberty, it also works for the protection of women and children's rights.

    Halina Nie Legal Aid Center http://www.pomocprawna.org/ The Halina Nie Legal Aid Center is a non-governmental organization that was founded in 2002 by the graduates of the Jagiellonian University. The organization works to protect human rights, provide free legal assistance, to implement projects in the field of education and democratization.

    Polish Social Watch Coalition Social Watch is an international network of civic society organizations operating in 60 countries around the world to promote social development and gender equality. Polish Social Watch Coalition was established in 2008 and its mission is to monitor the implementation of the Polish government's international obligations relating to social development and gender equality.

  • Citizens Network - Watchdog Poland acts to secure for every person an equal and full access to public information and to strengthen the local community residents in the supervision over the activities of their government.

    Association for Legal Intervention http://interwencjaprawna.pl/ The aim of the Association for Legal Intervention is to aid the disadvantaged and marginalized, among other measures it provides legal and social assistance.

    Polish Association of Legal Education www.psep.pl/ Polish Association of Legal Education PSEP works to expand the legal knowledge of the citizens. PSEP members include lawyers, philosophers, journalists, academics and school teachers. It works through projects such as Street Law, "Everyday Law"; publishes educational materials and conducts training in law for a variety of occupational groups.

    Academia Iuris Foundation https://sites.google.com/a/academiaiuris.pl/www/o-fundacji Academia Iuris Foundation is a non-governmental organization that was established in 2002. The primary goal of the Foundation is to protect civil rights and freedoms, strengthen confidence in the state and its laws, as well as to promote personal involvement of lawyers in helping those in need.

    Consumer Federation http://www.federacja-konsumentow.org.pl/ Consumer Federation is a non-governmental organization whose main objective is to protect consumers in Poland. The actions it takes include, among others: issuing opinions on the laws that should govern any action in the field of consumer co-operation with government and public institutions.

    Caritas Poland http://caritas.pl/o-nas/caritas-polska Caritas Poland is a charity of the Conference of the Polish Episcopate. It takes specific actions providing training, symposia, identifying the areas and extent of poverty in Poland, initiates nationwide fundraising campaigns for Poland and other countries, and provides financial support, legal and financial assistance to the unemployed, the homeless, the sick, the elderly, children from poor families and immigrants and refugees.

    Center for Womens Rights http://www.cpk.org.pl/ The Center for Womens Rights is an organization with a mission to promote equality between women and men in public life and in the family. It takes actions related to the provision of psychological and legal aid, the promotion of publications of the Center of Women's Rights, including the legal manual series, "Know Your Rights", and organizing meetings on women's rights.

    Rule of Law Institute http://panstwoprawa.org/pl/o-nas/o-fundacji/0,-e,1,13 The Rule of Law Institute is a non-governmental organization established by Polish and American lawyers associated with the Faculty of Catholic Law of the University of Lublin. Their goal is to support the initiatives aiming to improve the legal awareness of the public, to improve the professional qualifications of lawyers, to promote European law and the idea of European integration and to promote human rights and a reform of legal education.

    The purpose of the Foundation Against Human Trafficking and Slavery is to counteract human trafficking, slavery and forced labor and to prevent the exploitation of prostitution. The Foundation engages in preventive action related to human trafficking, it publishes materials, supports victims of human trafficking and runs a telephone helpline.

    The Association was founded in 1999 with the purpose of preventing xenophobic and anti-Semitic prejudices in public life. The basic objectives of the Association are: to foster an attitude of openness and respect for individuals and groups with different backgrounds, including ethnic, national, religious, cultural or social, and to combat all forms of racism, anti-Semitism, xenophobia and other attitudes that undermine human dignity.

    MaMa Foundation http://fundacjamama.pl/index.php?mnu=6 MaMa Foundation was established in 2006 in Warsaw by Sylwia Chutnik, Julia Kubis and Anna Petruszka-Drd. The organization fights discrimination against mothers in public life, in the labor market, in society and culture. The Foundation organizes public awareness campaigns, campaigns for labor rights, workshops and training courses, legal, psychological, and civic or artistic and educational projects for parents and children.

    Anti-discrimination Education Association http://www.tea.org.pl/eng/index Anti-discrimination Education Association was founded in 2009 by people involved in anti-discrimination education. The main aim of the Association is to prevent discrimination and violence due to: ethnic and national origin, disability, age, gender, sexual orientation or religion, to raise knowledge concerning the anti-discrimination education for equality and diversity, and the integration of those involved in anti-discrimination education.

    Autonomy Foundation http://www.autonomia.org.pl/ Autonomy Foundation is a non-governmental organization primarily engaged in education and social activism. The Foundation's aim is to prevent intolerance, discrimination and violence based on gender, sexual orientation, ethnic or national origin, and age, the strengthening of civil courage in acting against discrimination and violence and promoting the idea of feminism, human rights and gender equality.

    UNESCO Initiatives Centre http://www.unescocentre.pl/ UNESCO Initiatives Centre is an association that promotes intercultural dialogue as well as active participation of young people. The Center organizes educational initiatives, training, youth exchanges, workshops and conferences dealing with the training of teachers, pupils and students.

    Homo Faber Organization http://www.hf.org.pl/ao/index.php Homo Faber Organization from Lublin is an NGO dedicated to the prevention of discrimination against minority groups. The aim of the organization is to see whether the public authority effectively fulfills its obligations and respects human rights and freedoms.

  • The aim of the Campaign Against Homophobia is to prevent discrimination against lesbian, gay, bisexual and transgender people (LGBT). The organization specializes in creating large educational and social campaigns, presenting gay people in a positive light (eg social campaign "Let Them See Us", co-organizer of the annual festival "Culture for Tolerance" in Krakow, and actions aimed at students, teachers and parents).

  • 2. Romania SUMMARY

    The main actors active in the field of fundamental rights in Romania are mainly public institutions and other other non-public organizations, such as NGOs, foundations, educational centres. Educational materials in this area are available on their websites and within the conferences, seminars, workshops, trainings that they are organizing. This report includes the most active actors in Romania in the defending of human rights with a specification of the rights they are promoting. Some educational materials available online to be downloaded are suggested as well as legislation documentation regarding this topic.

Although some of them declare fundamental rights training as one of their asctivities, there is lack of detailed information on covered topics as well as of training materials. Estonian Human Rights Centre/EHRC (humanrights.ee) is organising projects aimed on raising awareness of human rights; monitoring the human rights situation in Estonia and other countries; disseminating information about human rights and protection of human rights in Estonia; consulting of individuals in human rights issues; advancing of human rights education in universities and other educational institutions. Centre does not organise trainings itself but provides non-students an opportunity to participate to human rights law courses at the Law School of the Tallinn University of Technology.

  • In cooperation with the Law School of the Tallinn University of Technology the EHRC developed Discrimination wizard to help people find out by answering few simple questions whether he/she is discriminated against. The wizard also assists you in finding out where to get help if you suspect discrimination.     Estonian Patient Advocacy Association (www.epey.ee) is primarily advocating for the human and civil rights of health and social care service users. In addition to councelling and advocacy services on individual cases, advocacy and litigation EPAA: provides information and additional training.

    EPAA considers information and additional training extremely important to prevent further abuses and to change the practice in health care system according to its users' perspective. The EPAA team organises all sorts of informative events seminars, lectures, workshops, information days, discussion groups a.o. to inform different stakeholders about human rights in health and social sector and provide counsel in respecting users' rights in practice. Some written materials have also been published and distributed.

    In 2012 EPAA organised 27 lectures for 1016 participants (in 2011 respective figures were 30 and 1039).

  • Estonian Union for Child Welfare/EUWC (www.lastekaitseliit.ee) is a non-governmental non-profit organisation, which helps to assure childrens rights and the development of a child-friendly society.

    According to the EUCW webpage the Union has its own Training Centre to offer work related additional training to representatives from different occupations whose every day work is related to children and families. There is one training video available on the webpage. Legal Information Centre for Human Rights/LICHR (www.lichr.ee) ic focusing in its activities on: provision of access to justice and protection of human rights; analysis of the human rights and national minorities' rights situation, monitoring of Estonian legislation; legal training in the sphere of human rights. Unfortunately there is neither detailed information about training activities of the LICHR nor didactict materials on the webpage (exept FAQ on discrimination issues). Considering social and workers' rights including the right to fair working conditions and protection against unjustified dismissal the webpage of the EAKL Estonian Trade Union Confederation (www.eakl.ee) is worth of mentioning.

    There is link (http://www.xn--tiguskoolitus-3lboa.eu/front/et_EE/) to the e-manual on new employment contract act (both in estonian and russian). The manual was elaborated by the trade union confederation with financial support from the European Social Fund as a tool for adult education in 2010. The reason for preparing e-manual was major labour law reform that came into force in July 2009.

    E-manual consists of animations, videos, texts, cases and tests and provides for users most important information on basic principles of the new law, rights and obligations of workers and employers, regulation of working conditions (wages, working and rest time, vocations etc). This training course is free of charge and available for everybody.

    Conclusions

    The public awareness on fundamental rights is relatively low in Estonia. Main target groups in awareness raising activities should be children/pupils and parents, teachers, general public.

OUR RIGHTS: Human rights educational project The MINISTRY OF FOREING AFFAIRS (Slovenia) implements Slovenia's foreign policy, carrying out the duties set out in the Foreign Affairs Act and other regulations. It also contributes expert positions during the entire process of planning and determining Slovenia's foreign policy, including collaborating in the passing of resolutions by the National Assembly and the Government. The empowerment of children both by educating them on their rights and by ensuring them access to justice is a key priority of Slovenian foreign policy. With the project Our rights, Slovenia has actively enabled education on the rights of the child to more than 150,000 children in a number of countries from 2005 onwards. 3.1. OUR RIGHTS Slovenia launched a pilot project on human rights education entitled Our Rights(1), based on the Convention on the Rights of the Child during its chairmanship of the OSCE in 2005. Slovenian experts designed, initiated and led the implementation of the pilot project, which involved a number of governments of the OSCE participating States, NGOs, individual experts, ombudsmans offices, field offices of international organisations and other stakeholders.
