Decision No. 133/2008* issuing the regulation organizing the

registration and Utilization of frequencies and radio equipment and their pricing

PursuanttotheTelecommunicationsRegulatoryActissuedbytheRoyalDecreeNo.30/2002and;

TheExecutiveRegulationoftheActissuedbytheMinisterialDecisionNo.10/2007and;

The Decision No. 46/2003 on Radio Frequency Registration and Utilization Fees and Fees of some RadioLicensesand;

TheDecisionNo.198/2007regulatingtheexemptionofWAS/RLANSfromRadioLicensingand;

TheDecisionNo.55/2008onregulationofGSMservices(1800MHz)onboardaeroplanesand;

TheDecisionNo.90/2008regulatingthelicensingofStationsandRadioEquipmentOperationand;

TheAuthority’sapprovaldated17/9/2008and;

Basedontheexigenciesofthepublicinterest;

It is decided:Article 1: Theprovisionsoftheattachedregulationshallcomeintoforceinrespectoforganizingtheregistration

andutilizationoffrequenciesandradioequipmentandtheirpricing.

Article 2: Withoutprejudicetotheprovisionsof(Article5repeated1)oftheTelecommunicationsRegulatoryActreferredto,themilitaryandsecuritybodiesshallcomplywithpaymentofradiofrequencyregistrationfeesonly.

Article 3: ThefollowingshallbeexemptedfromtheprovisionsofArticle1ofthisDecision:1. Traditionalandcoastalfishingboatsownedbyindividuals,providedthatthemaximumloadcapac-

itydoesnotexceed50tonsandlengthdoesnotexceed30meters.

2. UsersofradiofrequencieswhenalternativefrequenciesareassignedinsteadofthefrequenciesdecidedtobevacatedbytheAuthority.

Article 4: Durationofthelicensetouseorpossessradioequipmentshallbeforoneyear(Twelvemonths).Thevalidityofthelicensetouseradioequipmentmaybeextendedforamaximumperiodoffiveyearsafteranadvancepaymentoffeesismadeforthewholeperiodontheapprovaloftheapplication.Theradiolicensemayalsobeissuedforaperiodlessthanayearbasedontheexigenciesofthepublicinterestorbasedonthelicensee’srequesttounifytheexpirydatesofallorsomeoftheradiolicensesissuedtothelicensee.TheAuthoritywillnotbeboundbythedatespecifiedintheapplicationsubmittedbythelicensee,andthelicensingfeesoftheremainingperiodswillbecalculatedproportionatelywiththeannualusagefeesaccordingtotheradioservices.

TheeffectivelicensingdateshallstartfromthepurchasingdateoftheequipmentfromthedealersinradioequipmentthatareregisteredwiththeAuthorityorfromthearrivaldateoftheequipmenttotheOmanisoilincaseofimportationfromabroad.

Article 5: Without prejudice to the provisions of Article No. 90/2008 cited above, the Authority may issuetemporarylicensesthevalidityandfeesofwhicharetobedeterminedinaccordancewiththeattachedregulation.Thelicenseshallbeautomaticallycancelledupontheexpiryofitsduration.

Article 6: TheprovisionalapprovalissuedbytheAuthorityforradiolicenseapplicantthatenableshimtoidentifytheradio frequenciesandthetechnicalcharacteristicsanddataapprovedtobeusedforpurposesofprogrammingtheradioequipmentbythemanufacturerandtheirimportationtoOmanshallnotbeconsideredalicensetousetheradioequipment.ThedurationofthisapprovalshallonlybelimitedtothreemonthsandtheAuthoritymay,basedonasubstantiatedrequest,approveitsextensionforfurtherthreemonths.Incaseofnon-importationofequipment,ornon-provisionoftheradioequipmentserialnumberstotheAuthoritywithinthisperiod,theprovisionalapprovalshallbedeemedexpiredandtheapplicantshallsubmitafreshapplicationtoobtaintheradiolicensepursuanttotheapplicableprocedures.

Article 7: Anapplicationrequestingchangeoffrequency,increaseofpower,increaseoftransmissioncapacity,changeof locationor increaseofantennaheightwillbeconsideredasanewapplicationrequiringpaymentofalltheconsequentfeespayableforregistrationandutilizationofnewradiofrequencies.

Article 8: Aonemonthgraceperiodstartingfromthelicenseexpirydateshallbegrantedforpaymentoftheprescribedfeesforrenewaloftheradiolicense.Incaseofdelayoffeepayment,thepenaltysetoutintheattachedregulationshallbeapplicableforeachmonthofdelayuptotwelvemonths.Wherethedelayispartofamonth,thefeeshallbecalculatedproportionatelybasedontheperiodofdelaytoamonth.Ifnopaymentismadeduringthisperiod,thelicensewillberevokedandtheradioequipmentwillbeseizedandlegalactionsstipulatedintheActwillbetaken.

Article 9: Agraceperiodof twomonthsshallbegiven forpaymentof fees for registrationofassigningnewfrequencies and licensing new radio equipment. If no payment is made during this period, theapplicationshallbedeemedcancelledandtheapplicantwillberequiredtofileanewapplicationforassignmentandusageoffrequenciesandradioequipment.

Article 10:Agraceperiodofonemonthshallbegivenforpaymentoffeesforlicensingofradioequipmentusedinships,boatsandplanes.Incaseofdelayoffeepayment,thepenaltysetoutintheattachedregulationshallbeapplicable.Wherethedelay ispartofamonth, thefeeshallbecalculatedproportionatelybasedontheperiodofdelaytoamonth.

Article 11:The Authority may periodically review and amend the annexes attached to this regulation if sorequiredbytherecommendationsandresolutionsoftheITUandtheinternationalorganizationsandinaccordancewithmarketrequirementsandtechnologicaldevelopment.

Article 12:DecisionsNo.46/2003,198/2007and55/2008referredtoshallberepealed,aswellasallthatisincontraventionwiththeprovisionsofthisDecision.

Article 13:ThisDecisionshallbepublishedintheGazetteandshallcomeintoforcewitheffectfrom1January,2009.

Thefollowingwordsandexpressionsshallhavethemeaningssetoutoppositethemunlessotherwiserequiredbythetext

Location

A location of a fixed station is defined through its exact geographical co-ordinates,which consist of latitude,longitudeandheightabovemeansealevel.Latitudeandlongitudeshallbegivenindegrees(°),minutes(‘)andfullseconds(‘’)whichallowtolocalisethestationwithinarangeofuncertaintyoflessthan30m.Thesevaluesmaybeexpressedinequivalentdecimalformataswell.“Heightabovemeansealevel”shallbegivenwithanaccuracyof10morless.

- Number of Locations

Thenumberoflocationsistobedeterminedasfollows:

a. In case of fixed stations, “number of locations” is the total amount of fixed stations at different sites(geographicallocations).

b. Incaseofmobilestations,“numberoflocations”referstothenumberofWilayatswherethemobilestationsarelicensedtobeoperated.AlistoftheWilayatscanbefoundinAnnexA.

- Governorates

governoratesaretobeunderstoodasthegovernoratesoftheSultanateofOman(asperAnnexB).

- Coverage Zone Factor

The coverage zone factor (CZF) is a measure for population density in aWilayat. There are three CZFscorresponding to high,medium, and low population density. TheCZF is determined by the location of thetransmittersite,irrespectiveofactualcoverage.

AlistindicatingtheassignmentofthePopulationDensitytotheWilayatsispresentedinAnnexA.

- Frequency

Frequency is definedas thenumberof periodsperunit of timeof a transmitter’s electromagneticemissionmeasuredinkHz,MHzorGHz.

- Bandwidth

BandwidthisdefinedasthedifferenceinkHzorMHzbetweentheuppermostandlowermostfrequenciesofabandofatransmitter’selectromagneticemission.

- Power

Thepowerofatransmitter’selectromagneticemission,measuredindBWisdefinedasfollows:

1 - EIRP

EquivalentIsotropicallyRadiatedPower–theproductofthepowersuppliedtotheantennaanditsgaininagivendirectionrelativetoanidealreferencedisotropicantenna(absoluteorisotropicgain).

2 - ERP

EffectiveRadiatedPower–theproductofthepowersuppliedtotheantennaanditsgainrelativetoahalf-wavedipoleinagivendirection.Theloss-freereferenceantennaisisolatedinspacewhoseequatorialplanecontainsthegivendirection.

-Relationsbetweentheabovedefinitions:

ERP = EIRP – 2.15dB

EIRP = ERP + 2.15dB

Note:Theabovevaluesareonlyapplicableforthemaindirectionofradiation.

Operation Modes

1. Simplex Operation

Modeofoperationwheretransmissionismadepossiblealternatelyineachdirectionofatelecommunicationchannel,forexample,bymeansofmanualcontrol.

2. Duplex Operation

Modeofoperationwheretransmissionispossiblesimultaneouslyinbothdirectionsofatelecommunicationchannel.

3. Semi-Duplex Operation

Modeofoperationwhichissimplexoperationatoneendofthecircuitandduplexoperationattheother.

4. Frequency Division Duplex

Modeofoperationwhichusesdifferentchannels, i.e.different frequencies,and is thereforecomparable toduplexoperationfromtheviewpointoffrequencyusage.

5. Time Division Duplex

Modeofoperationwhichusesonechannelbothways(alternately),andisthereforecomparabletosimplexoperationfromtheviewpointoffrequencyusage.

Note: For charging, thenumber of frequencies (channels) is important (andnot the typeof operation) but,e.g.,simplexoperationusingtwodifferentfrequencies(channels)countsthesameassemi-duplexorduplexoperation.

Service:ThelistofradioservicesasdefinedbytheITU.

- Aeronautical Mobile Service

amobileservicebetweenaeronauticalstationsandaircraftstationsorbetweenaircraftstations,inwhichsurvivalcraftstationsmayparticipate;emergencyposition-indicatingradiobeaconstationsmayalsoparticipateinthisserviceondesignateddistressandemergencyfrequencies.

- Aeronautical Mobile (OR) Service

an aeronauticalmobile service intended for communications, including those relating to flight coordination,primarilyoutsidenationalorinternationalcivilairroutes.

- Aeronautical Mobile (R) Service

anaeronauticalmobileservicereservedforcommunicationsrelatingtosafetyandregularityofflight,primarilyalongnationalorinternationalcivilairroutes.

- Aeronautical Mobile-Satellite Service

aamobile-satelliteserviceinwhichmo¬bileearthstationsarelocatedonboardaircraft;survivalcraftstationsandemer¬gencyposition-indicatingradiobeaconstationsmayalsoparticipateinthisservice.

- Aeronautical Mobile-Satellite (OR) Service

an aeronautical mobile-satellite service intended for communications, including those relating to flightcoordination,primarilyoutsidenationalandinternationalcivilairroutes.

- Aeronautical Mobile-Satellite (R) Service

anaeronauticalmobile-satelliteservicereservedforcommunicationsrelatingtosafetyandregularityofflight,primarilyalongnationalorinternationalcivilairroutes.

- Aeronautical Radio Navigation Service

aradionavigationserviceintendedforthebenefitandforthesafeoperationofaircraft.

- Aeronautical Radio Navigation-Satellite Service

aradionavigation-satelliteserviceinwhichearthstationsarelocatedonboardaircraft.

- Aeronautical Station

alandstationintheaeronauticalmobileservice.

- Aircraft Station

amobilestationintheaeronauticalmobileservice,otherthanasurvivalcraftstation,locatedonboardofanaircraft.

- Amateur Service

aradiocommunicationserviceforthepurposeofselftraining,intercommunicationandtechnicalinvestigationscarriedoutbyanamateur,thataredulyauthorizedpersonsinterestedinradiotechniquesolelywithapersonalaimandwithoutpecuniaryinterest.

- Amateur-Satellite Service

a radiocommunicationserviceusingspacestationsonearthsatellites for thesamepurposeas foramateurservices.

- Broadcasting Service

a radiocommunicationservice inwhich the trans¬missionsare intended fordirect receptionby thegeneralpublic.Thisservicemayincludesoundtransmission,televisiontransmissionorothertypesoftransmission.

- Broadcasting-Satellite Service

aradiocommunicationserviceinwhichsignalstransmittedbyspacestationsareintendedfordirectreceptionbythegeneralpublic.

- Coast Station

alandstationinthemaritimemobileservice.

- DECT

anETSIstandardforportablephones,commonlyusedfordomesticorcorporateapplications.DECTcanalsobeused forwirelessdata transfer. Itworks likeacellular system.DECTshowsonemajordifferencewhencomparedtoGSM:thecellradiusisonly25–100m,whileGSMoperatesina2–10kmrange.Thesystemoperateswith10carriersintherange1,880–1900MHz.

- Earth Exploration-Satellite Service

aradiocommunicationservicebetweenearthstationsandoneormorespacestations,whichmayincludelinksbetweenspacestations,inwhich:

InformationrelatingtothecharacteristicsoftheEarthanditsnaturalphenomena,includingdatarelatingtothestateoftheenvironment,isobtainedfromactivesensorsorpassivesensorsonearthsatellites;

Similarinformationiscollectedfromair-borneorearth-basedplatforms;

Suchinformationmaybedistributedtoearthstationswithinthesystemconcerned;

Platforminterrogationmaybeincluded.

Thisservicemayalsoincludefeederlinksnecessaryforitsoperation.

- Feeder Link

aradiolinkfromanearthstationatagivenlocationtoaspacestation,orviceversa,conveyinginformationforaspaceradiocommunicationserviceotherthanforthefixed-satelliteservice.Thegivenlocationmaybeataspecifiedfixedpoint,oratanyfixedpointwithinspecifiedareas.

- Fixed Service

aradiocommunicationservicebetweenspecifiedfixedpoints.

- Fixed-Satellite Service

aradiocommunicationservicebetweenearthstationsatgivenpositions,whenoneormoresatellitesareused;thegivenpositionmaybeaspecificpointoranyfixedpointwithinspecifiedarea;insomecasesthisserviceincludessatellite-to-satellite links,whichmayalsobeoperated inthe inter-satelliteservice; thefixed-satelliteservicemayalsoincludefeederlinksforotherspaceradiocommunicationservices.

GMPCS is a personal communication system providing transnational, regional or global coverage from aconstellationofsatellitesaccessiblewithsmallandeasilytransportableterminals.RegardlessoftheGMPCSsatellitesystemsbeinggeostationaryornon-geostationary,fixedormobile,broadbandornarrowband,globalorregional,theyarecapableofprovidingtelecommunicationservicesdirectlytoendusers.GMPCSservicesincludetwo-wayvoice,fax,messaging,dataandevenbroadbandmultimedia.E.g.,Inmarsat,Thuraya,GlobalstarandIridiumaretobetreatedinlinetherewith.

- GSM

GSMisacellularnetworkofthesecondgeneration(2G).Mobilephonesconnecttoitbysearchingforcellsintheimmediatevicinity.GSMnetworksoper¬atemainlyintwodifferentfrequencyrangesinthe900MHzor1800MHzband.

Inthe900MHzband,theuplinkfrequencybandis890–915MHz,andthedownlinkfrequencybandis935–960MHz.These25MHzbandwidtharesubdividedinto124carrierfrequencychannels,eachspaced200kHz

apart.Timedivisionmultiplexingisusedtoalloweightfull-rateorsixteenhalf-ratespeechchannelsperradiofrequencychannel.Thereareeight radio timeslots(givingeightburstperiods)grouped intowhat iscalledaTDMAframe.Halfratechannelsusealternateframesinthesametimeslot.Thechanneldatarateis270.833kbit/s,andtheframedurationis4.615ms.

The1800MHzbanduses1,710–1,785MHz foruplinkand1,805–1,880MHz fordownlink; the resultingbandwidthof75MHzissubdividedinto374channelswithsimilarspecificationsasabove.

Thetransmissionpowerofthehandsetislimitedtoamaximumof2WintheGSM900bandandto1WintheGSM1800band.

AmajordifferencebetweenUMTSandGSMistheair interfaceformingGSM/EDGERadioAccessNetwork(GeRAN).ItcanbeconnectedtovariousbackbonenetworksliketheInternet,ISDN,GSMortoaUMTSnetwork.GeRANincludesthethreelowestlayersoftheOSImodel.Thenetworklayer(OSI3)

2.1 Application Fee

TheApplicationFee isaservice-independentone-time feeand is tobepaidonsubmissionofanapplicationaccordingtothefollowing:

-(50)FiftyRiyalforeachapplicationfortheusageofaircraftandshipstations.

- (50)FiftyRiyalforeachfrequencyperlocationforotherservices.

Itisnon-refundableincasetheapplicantdoesnotwishtocontinuethelicensingprocedure.

2.2 Survey Fee

ASurveyFeeshallbecollectedfortheactualvisitofanynumberoflocationsforoneapplicationinanywilayatofanygovernorateorregionaccordingtothefollowing:

2.3 Registration Fee

TheRegistrationFee isaonetimefee(non-recurring). It is for theentireassignmentperiodand isdueuponnotificationofthefrequencyassignedtotheapplicantbytheTRA.

Asregistrationfeesareservice-dependent,theindividualregistrationfeeapplicableisindicatedintherespectiveservicesection.Whenalicenceisgrantedandconsequentlytheregistrationfeebecomesdue,theapplicationfeeiscreditedagainsttheregistrationfee.Incaseswheretheapplicationfeeishigherthantheregistrationfee,thepaymentoftheapplicationfeereplacestheregistrationfeeanditisnon-refundablefee.

Short Range Devices, Frequency Ranges and Power Limitations

SRDsmaybefixed,mobileorportablestationswhichhavearadiofrequencyoutputconnectoranddedicatedantennaoran integralantenna.Applications include telecommand,alarms,datacommunication,detectionofavalanchevictims,meterreading,assettracking,hearingaids,movementdetectionandalert,remotecontrols,inductivesystems,andmanyotherapplications.Thesedevicesmayemploydifferenttypesofmodulationandmayhavespeechapplication.

- SRDs shall be designed to meet the following basic objectives:

▫ Thedeviceisintendedtooperateinunprotectedandsharedfrequencybands.Itsoperationshallnotcauseinterferencewith other authorized radio-communication services, and be able to tolerate any interferencecausedbyotherradio-communicationservices,electricalorelectronicequipment.

▫ ThedeviceshallnotbeconstructedwithanyexternalorreadilyaccessiblecontrolwhichpermitstheadjustmentofitsoperationinamannerthatisinconsistentwiththeseRequirements.

▫ Thedeviceshallbemarkedwiththesupplier/manufacturer’snameor identificationmark,andthesupplier/manufacturer’smodelortypereference.Themarkingsshallbelegible,indelibleandreadilyvisible.

- Regulatory Requirements▫ AllSRDsthatareintendedtobemanufacturedand/orimportedshallbetypeapprovedbytheTelecommunications

RegulatoryAuthority(TRA)oftheSultanateofOmanbeforetheyareplacedontheOmanimarket.

▫ TheoperationofSRDsthatmeettheserequirementsandareappropriatelytypeapprovedareexemptedfromindividuallicensingifotherconditionsarenotstatedhereinafter.

▫ Localcompaniesselling,manufacturingand/orimportingSRDsarerequestedtoregisterwithTRAasdealersoftelecommunicationsequipment.

- Technical Requirements ▫ TheSRDshallcomplywiththemaximumfieldstrengthoroutputpowergiveninTable124,operatinginits

intendedfrequencybandorfrequencies.Itshallfulfiltherelevantrequirementsofthisspecificationonallthepermittedfrequencieswhichitisintendedtooperate.

- Type-approval Requirements Alongwithapplicationfortypeapproval,theapplicantshallpresentthedocumentsthatprovidethefulltechnical

specificationsoftheequipmentandthedocumentsthatproveitsconformitytothetechnicalstandardsadopted(orrequired)intheSultanatelikeETSIandIECstandardsoralternativenationalstandards.Thesedocumentsshallbeobtainedfromaccreditedbodiesandmayinclude,butnotlimitedto:

▫ EMC,SafetyandRFconformitytestreports

▫ Manufacturer’sDeclarationofConformity

▫ CertificatesofConformity.

Technical Specifications of Mobile Communications Onboard Aircraft (MCA)

1. Mobile Communications onboard Aircraft (MCA) shall fulfil the requirements of Decision Amended ECC/DEC(06)07oftheElectronicCommunicationsCommittee(ECC)amendedon13thMarch2009,particularlythefollowing:

• Theabsoluteminimumheightabovegroundforanytransmissionfromthesysteminoperationshallbe3,000metres;

• TotalEIRPdefinedoutsidetheaircraftresultingfromthebasestation(BTS)withintheaircraftshallnotexceed-13dBm/channelat3,000m;

• EIRPdefinedoutsidetheaircraft,resultingfromtheGSMmobileterminaltransmittingat0dBmshallnotexceed1.8dBm/channelat3,000m;

• Theaircraft-BTSshallcontrolthetransmitpowerofallGSMmobileterminals,transmittingintheGSM1800band,totheminimumnominalvalueof0dBmatallstagesofcommunication,includinginitialaccess;

CorrespondingMCAlicensesissuedbyforeignauthoritiesforaircraftregisteredoutsideoftheSultanateofOmanwillberecognisedintheSultanate.

2. Thecompanieslicensedshallcomplywiththefollowing:

Technical Specifications of the Operation of Ku-Band Aircraft Earth Stations (AES) On Board Aircrafts

1. AircraftEarthStationsareallowedtooperateinKu-BandonboardaircraftsintheuplinkBand(14-14.5GHz)Earth-to-Space,providedthat:

• AircraftEarthStationsareoperatedviarecognizedsatellitesthatprovideFixedSatelliteServices(FSS)andAeronauticalMobileSatelliteServices(AMSS)andthathavesuccessfullyfinalizedcoordinationandnotificationprocedurespursuanttotheproceduresfollowedinITURadioRegulations.

• Thetechnicalandoperationalrequirementsof(AES)containedinITUrecommendation(ITU-RM.1643)arecompliedwith.

• The(AES)isincompliancewiththerequirementsofEuropeanTelecommunicationStandardsNo.(ETSIEN302186).

• (AES)areoperatedataheightnotlessthan3000mabovesealevel.

• Theoperationof(AES)isonasecondarybasis.

• Theradiatedpowerdoesnotexceed50dBW.

• Foreign(AES)areallowediftheyhaveavalidlicenseissuedbytheregisteringcountries.
