Part 1 Preliminary
1 Short title
This regulation may be cited as the Dental PractitionersRegistration Regulation 2001.
2 Commencement
This regulation commences on 1 January 2002.
Part 2 General registration
3 Qualifications for general registration—Act, s 44
For section 44(1)(a) of the Act, a qualification stated inschedule 1, column 1, and conferred or awarded by theeducational institution stated in column 2 for the qualification,is a qualification for general registration.
4 Period of registration—Act, s 56
For section 56(1) of the Act, the general registration period isa financial year.

Part 3 Specialist registration5 Specialties—Act, sch 4, definition specialty
For the definition specialty in schedule 4 of the Act, a branchof dentistry mentioned in schedule 2, column 1 is a specialty.
6 Qualifications for specialist registration—Act, s 102
(1) For section 102(1)(a)(ii) of the Act, a qualification forspecialist registration in a specialty mentioned in schedule 2,column 1 is a qualification stated opposite the specialty incolumn 2 and conferred or awarded by the educationalinstitution stated for the qualification.
(2) However, for an individual who holds a qualification ofMaster of Dental Science conferred or awarded by theUniversity of Melbourne or the University of WesternAustralia, the qualification applies only for the specialty inwhich the individual undertook the Masters program leadingto the qualification.
7 Restricted specialist titles—Act, sch 4, definition restricted specialist title
For the definition restricted specialist title in schedule 4 of theAct, the restricted specialist title for a specialty mentioned inschedule 2, column 1 is a title that consists of, or includes, thewords stated opposite the specialty in column 3.
8 Period of registration—Act, s 109
For section 109(1) of the Act, the specialist registration periodis a financial year.

8A Qualifications for dental auxiliary registration—Act, s 133C
(1) For section 133C(1)(a) of the Act, a qualification stated inschedule 2A, part 1, column 1, and conferred or awarded bythe educational institution stated in column 2 for thequalification, is a qualification for dental auxiliary registrationin the category of dental therapy.
(2) For section 133C(1)(a) of the Act, a qualification stated inschedule 2A, part 2, column 1, and conferred or awarded bythe educational institution stated in column 2 for thequalification, is a qualification for dental auxiliary registrationin the category of dental hygiene.
8B Period of registration—Act, ss 56 and 133G
For sections 56(1) and 133G(1)(b) of the Act, the dentalauxiliary registration period is a financial year.
8C Additional functions of dental auxiliaries—Act, s 139A(2)(d)(ii)
(1) For section 139A(2)(d)(ii) of the Act, the additional functionstated in schedule 2B, part 1, column 1 is prescribed for adental therapist, if the dental therapist holds the qualificationstated in column 2 opposite the additional function andconferred or awarded by the educational institution stated forthe qualification.
(2) For section 139A(2)(d)(ii) of the Act, an additional functionstated in schedule 2B, part 2, column 1 is prescribed for adental hygienist, if the dental hygienist holds the qualificationstated in column 2 opposite the additional function andconferred or awarded by the educational institution stated forthe qualification.

Part 4 Fees9 Fees
The fees payable under the Act are stated in schedule 3.
9A Waiver of restoration component of restoration fee
(1) The board may waive payment of the restoration componentof a restoration fee by a person if—
(a) the person applies to the board for a waiver of therestoration component of the restoration fee when theperson applies for restoration of his or her registration;and
(b) the board is satisfied that, because of circumstancesrelating to the non-renewal of the person’s registration,the restoration component of the restoration fee shouldbe waived.
(2) In this section—
restoration component, of a restoration fee, means theamount of $75.
10 Waiver of fee—financial hardship
The board may waive, wholly or partly, the payment of a feeby a person if the board is satisfied payment of the fee wouldcause the person financial hardship.
11 Refund of registration fee, specialist registration fee or dental auxiliary registration fee
(1) The board must refund the registration fee accompanying aperson’s application for registration, or renewal ofregistration, if—
(a) the board refuses to grant the application; or

(b) the person withdraws the application before it isdecided.
(2) Subsection (3) applies if, within 3 months after the boarddecides to register a person or renew a person’s registration,the person surrenders the registration.
(3) The board must refund the registration fee paid by the personless the amount of the registration fee for the registration for aperiod of registration of not more than 3 months.
12 Refund of restoration fee
(1) The board must refund the registration component of arestoration fee accompanying a person’s application forrestoration of registration if—
(a) the board refuses to grant the application; or
(b) the person withdraws the application before it isdecided.
(2) Subsection (3) applies if, within 3 months after the boarddecides to restore a person’s registration, the personsurrenders the registration.
(3) The board must refund the registration component of therestoration fee paid by the person less the amount of theregistration fee for the registration for a period of registrationof not more than 3 months.
(4) In this section—
registration component, of a restoration fee, means theamount of the restoration fee less $75.

Part 5 Miscellaneous13 Notification of change in circumstances—Act, s 138
For section 138 of the Act, each of the following is a changein a registrant’s circumstances of which the board must beadvised—
(a) a change in the registrant’s name;
(b) a change in the registrant’s address;
(c) for a special purpose registrant—a change in the way theregistrant undertakes the special activity for which theregistrant is registered;
Examples of a change for paragraph (c)—
1 a registrant undertakes the activity at a different place
2 a registrant changes the amount of time spent doing theactivity
3 a registrant ceases to do the activity
(d) the registrant ceases to be qualified for registration.

15 Transitional provision about certain existing specialties—Act, s 250
For section 250(6) of the Act, a new specialty mentioned inschedule 4, column 1 includes, or is the equivalent of, theprevious specialty stated opposite the new specialty in column2.

16 Transitional provision about certain persons—dental therapy
(1) This section applies to a person who, before 1 July 2004—
(a) had satisfactorily completed a course of training at aschool dental therapists training centre conducted by thedepartment; or
(b) had satisfactorily completed—
(i) another course of training for dental therapists; and
(ii) a retraining or re-entry course approved by theboard.
(2) For section 133C(1)(a) of the Act, the person is taken to havea qualification prescribed for registration as a dental auxiliaryin the category of dental therapy.
18 Transitional provision about certain persons—dental hygiene
(1) This section applies to a person who, before 1 July 2004—
(a) had satisfactorily completed a course of dental hygienisttraining at the School of Para Dental Studies, GillesPlains Community College, South Australia; or
(b) had satisfactorily completed—
(i) another course of training for dental hygienists;and
(ii) passed an examination set by or for the board, orrecognised by the board.

(2) For section 133C(1)(a) of the Act, the person is taken to havea qualification prescribed for registration as a dental auxiliaryin the category of dental hygiene.
