And that the OCPIMC send a letter saying thank you his service, dedication and great work, and that he is welcome anytime to rejoin the committee if the situation changes. CARRIED

BUSINESS

1. Aaron presentation on our process to date (10min)

Review on how things got started with the OCP update and where we are now. This spring the OCPIMC and Council approved the scope of the OCP update. The intention behind the OCP update was largely to ensure the OCP was on the right track so that we could start on a rezoning. The zoning bylaw has to be in line with the OCP if it is amended, so updating the OCP was the first step.

Our zoning bylaw is older than our current OCP. A zoning bylaw is usually reviewed or rewritten after an OCP is written or amended, but that never happened after our OCP was written in 2002. Because our rezoning was not done after OCP review in 2002 it is not in line with the OCP on some points and has caused some challenges for staff working towards the goals of the OCP. Council agreed that the OCP update should happen and that we should then move right into the rezoning process.

Juliet hired to look after OCP update related research, policy writing, public engagement and event planning. Reminder that staff does not work for the OCPIMC. District Staff work for the CAO, who works for Council. So the OCPIMC directs the OCP update process but does not direct staff work plans.

We are already in the middle of this OCP update; we have already started with the items approved within the scope of the OCP update. Any direction for the OCP update by the committee should be constructive and relevant to our place in the process. If we move backwards without good reason we are slowing down the process funded through district monies making it more expensive.

Anything that is suggested should be constructive, build on what we are doing and what the public feedback has been so far.

2. Content proposed for public consultation:

Recognizing that we are coming up on a public meeting on November 29, committee members should expect to speak to some of these topics at this upcoming meeting. Committee members should identify topics they are interested in being involved with as we go through.

a. Report on required Transportation Map and Road Typology; including reference in infrastructure policies 3.2.3.13 includes an infrastructure map which is also a Local Government Act requirement.

c. Report on implications of the stratification of tourist accommodations (includes committee feedback) asking for direction on the engagement process for this topic.

Tourism Master Plan is on Council’s radar but we won’t see tourism master plan before next fall as this has not yet been set into motion by Council.

What is the scope of this stratification report? When this objective was brought forward by Mayor Schmunk it was to better understand the implications of the stratification of tourist accommodations. This report explores this issue as well as the question of what powers local governments even have to affect this issue. It became clear to staff that this research does not have a place within the OCP update but does constitute research that should be conducted through a tourism master plan.

The recommendation of the report is to get a tourism master plan going that would include the question and the research on the implications of the stratification of tourist accommodations.

The report states that the research included in the appendix satisfies the scope item: “research the implications of the stratification of tourism accommodations”.

Whistler has done some interesting things around how to manage the stratification of new tourist accommodations – maybe these could be expanded on in any final report on stratification of tourist accommodations

Enforcement is an existing issue of our zoning bylaw. issue some areas being used as stratified tourist accommodation while not zoned for that

Complex issue, more study needed, support for the recommendation to leave it to a future meeting when a more comprehensive conversation on tourism can be held. In the meantime Steve will be involved on that and other tourism-related topics at the Jan 26 meeting

d. Report on Local Area Plans (LAPs) and Development Approval Information Areas (DAIAs) asking for direction on the engagement process for this topic.

LAPs that are finished will remain as they are (Chesterman Beach Neighbourhood LAP and DL114 LAP)

Confusion around the “biggest impact” part of the report as there may have been a poorly phrased sentence. LAPs have pushed growth away from where we want it to the areas we did not have LAPs, which were areas not designated for growth, for example South Tofino Rural.

Could we remove an LAP? Yes, but it throws away a lot of planning and information and a lot of money spent on making the plan. This has not yet been discussed, and would require the same public engagement as an OCP update, that may have to go back to Council and the public as it is a significant change.

LAPs do provide an additional level of planning, even if they are not perfect planning tools for a town our size.

In this scope item was imagined to just replace with LAP areas with DAIA

We get more info from the DL114 LAP than a DAIA would give us if we replaced it, to let the LAP go we would redo all that work of getting developers to provide us with information we already have collected through the LAP.

DPA was added in DL114 where LAP was done and some pre zoning to make sure the developer follows the best practices indicated in the LAP

Is the developer responsibility similar for DAIA or LAP? Less developer responsibility and cost in an DAIA but the district is still getting the info it needs to ensure that the property is being developed according to environmental and infrastructure standards.

Chesterman beach Neighbourhood LAP name is misleading could have a name including the District lots it references for example in the case of DL114.

DL114 should also have a comment name “village reserve” or “tonquin neighbourhood” along with its DL114 identifier.

Peter will be involved on this topic at the Nov 29 meeting.

MOTION Moved that the three village nodes be named for accuracy with a common name and a DL name. Chesterman beach LAP be renamed to DL 132 274 “Chesterman Beach” LAP and DL114 be given a common name in quotations for consistency and accuracy. This topic will go to the public on Nov 29. CARRIED

f. Report on Tofino Mudflats Wildlife Management Area DPA

Contact RES to help answer some of the questions about why this is important, link and follow up on their work on the WMA research and protection

Why is the buffer area not all the way up the peninsula? The buffer area is only along where the Mudflats marine park area intersects with district terrestrial area.

The Tofino Mudflats WMA Advisory Committee is hoping recommend to the Province that the boundaries of the WMA be extended to include all intertidal portions of the mudflats on the northern end of Esowista Peninsula (e.g., from the Botanical Gardens up to about the Gas'n'Go station) and Meares Island., So why not stay ahead of that movement to extend the protected area? Those are just the lines the province has drawn, they are not wildlife lines.

Where there is already a protected area it is easier to justify a buffer area because there is already research and other supporting materials - one step at a time useing existing science and research.

Isn’t there already a protective buffer in that area? There are covenants along some of those properties. This buffer will better support the district to get the info we need and to support low development effect on the mudflats by involving a professional biologist where currently this is not necessary.

Why is there no buffer area on the other side of the bay? Outside of district lands.

Process– all about communication, how do we best communicate these to the public in a way that will not impact our policy or become incorrect as the treaty process moves forward? Do we talk to TFN before we include anything in our plan referencing land being set aside for them?

Would treaty lands override OCP land use designations? Prov and feds are negotiating on our behalf and we have little input, however, if lands are transferred as fee simple ownership then in theory they have to follow the OCP land use designations. If they come as federal reserve land, OCP has no say. Example, no say over Tin Wis, as they are fed reserve lands. And if it is fee simple then how do we move forward? Idea to bring in someone from another treaty nation to

talk about how they have gone through the process and how they figured stuff out with the surrounding districts. One well respected speaker/ treaty negotiator/legislator is Andrew Bak from Tsawassen First Nation.

This should be discussed further by the OCPIMC at a future meeting.

Do we really need a vision statement? Still important to have a vision because it could be the only thing read in the OCP. The vision and guiding principles make the intent of the

document known to those that will not read the whole thing. The vision ties it all up, describing what we want to move forward towards.

This should go to the public right away as written because even if we were to wordsmith it and all agree on it, the public may not agree on it, so may as well just put it to the public and try and move forward best as possible

Does the vision have implications on the OCP that follows? Broad statement so does not have direct implications on the OCP but it does focus the intent of the document.

Put out what we have on the website now, so the public has time to think about the vision statement before the Nov 29

The guiding principles are not going to the public on Nov 29. The bullet points were something the committee asked for months ago because they halped qualify the guiding principles but they were not delivered to the committee for consideration and direction until now.

This Section reviews Tofino’s regional setting, community consultation process and key issues addressed in the District of Tofino’s Official Community Plan. It provides background information for the Official Community Plan by identifying the contextual elements that have affected the development of the Plan.

1.1 OverviewThe Official Community Plan (OCP) is a general statement of the objectives and policies outlining the form and character of land uses and servicing requirements for the District of Tofino. The Local Government Act provides the authority and direction for the preparation of the OCP. The Plan provides guidance for economic, environmental, physical design and development, and social considerations. It promotes the quality of life of residents and visitors to Tofino by providing direction for future growth, community development, economic, environmental and social well-being, provision of amenities and services, and transportation system.

The OCP is adopted by Council to guide land use and development decisions as well as provide detailed planning direction for the Downtown Commercial Core and Downtown Gateway, and Neighbourhoods. To address future growth and development challenges and respond to the changes that have occurred in the community over the past few years, this OCP replaces the 1992 OCP.

The following key considerations provided direction for the preparation of the Plan:

Recognition that Smart Growth attributes should guide the Plan;

Incorporation of community issues, opportunities, and vision to improve the quality of life and economic, environmental, physical development and social well-being of residents and visitors;

Identification of environmental features that frame the character of the community and potential development options;

Recognition of the unique character of Tofino and the importance of maintaining that character; and

Integration of economic, environmental, physical design and land use and social considerations into the Plan.

The long-term Vision for the District of Tofino recognises the importance of Tofino’s place within the broader region as a leader in environmental stewardship, economic self-sufficiency, building design, character and development, tourism development and social wellbeing.

1.2 BackgroundThe District of Tofino has experienced significant change and growth over the past decade. It has become an international destination. Tourism is increasingly a year-round activity. Resource-based aspects of Tofino’s economy are adapting to market place changes through increased reliance upon aquaculture and sustainable logging. Its population has increased from 1,222 in 1996 to 1,540 in 2000 (an increase of 20%). Future population projections suggest that Tofino could grow to over 2,500 people in 2020 with an annual average rate of growth of 2.5%. It was one of the fastest growing communities in British Columbia during the 1990’s. The Official Community Plan sets direction for future growth.

1.2.1 LocationLocated at the northern tip of the relatively narrow Esowista Peninsula, Tofino’s development pattern is restricted by ocean on three sides (Figure 1). Future village expansion is limited to a southerly direction. Pacific Rim Highway, which runs up the middle of the peninsula, divides the peninsula into east and west sectors. On the west side of the peninsula, large expansive beaches with rugged headlands create a dramatic setting (Photo 1). Along the east shore of the peninsula, tidal flats extend well out into Browning Passage (Photo 2). Future expansion is limited to the south as the community borders Pacific Rim National Park Reserve (Figure 1)2. Tofino is situated within one of the most dramatic and pristine landscapes on the southern coast. It is part of the Clayoquot Sound UNESCO (United Nations Educational, Scientific and Cultural Organisation) Biosphere Reserve, an internationally recognised area that includes terrestrial and marine environments and extends from the southern boundary of the Long Beach Unit of Pacific Rim National Park Reserve to just north of Estevan Point. The Reserve includes approximately 350,000 hectares of which nearly 83,000 hectares are
