At the outset, the Secretary, State Level Expert Appraisal Committee

(SEAC) welcomed the members of the SEAC in its 55th meeting. Thereafter, various

agenda items were discussed in detail as under:

Item no. 55.01 Confirmation of the minutes of 54th meeting of State Level Expert Appraisal Committee held on 30.12.2011.

It was informed that minutes of 54th meeting of State Level

Expert Appraisal Committee held on 30.12.2011 were circulated to the members

vide letter no. 63-72 dated 05.01.2012. No observations have been received on the

same from any of the members, thus, the SEAC confirmed the said proceedings.

Item no. 55.02 Action taken on the proceedings on the 54th meeting of State Level Expert Appraisal Committee held on 30.12.2011.

It was seen by the State Level Expert Appraisal Committee.

Item no. 55.03: Application for obtaining Environmental Clearance under EIA Notification dated 14.9.2006 for Hotel Complex namely “Curo North Square” to be developed by M/s Curo India Pvt. Ltd., at Mullanpur, Tehsil Kharar, District Ropar (Formerly known as M/s Dynamic Continental Pvt. Ltd.).

The SEAC observed that:

1. M/s Curo India Pvt. Ltd., has applied for obtaining environmental clearance

under EIA Notification dated 14.09.2006 for developing a Hotel-cum-

Residential Complex namely “Curo North Square" at Mullanpur, Tehsil

Kharar, District Ropar. The project is covered under category 8 (a) of the

said notification.

2. The case of the project proponent was considered by the SEAC in its 53rd

meeting held on 24.11.2011 and the Committee noted that the project

proponent has neither submitted any elevation plan duly authenticated by

authorized signatory of the promoter company nor submitted such plan duly

approved by competent authority of the State. Therefore, there will be no

permanent check on the submission of the project proponent to the effect

that the height of the building will not exceed 104 m above the ground level.

The committee also noted that the project proponent has not submitted

proper details regarding EMP and CSR. After detailed deliberations in the

matter, the majority of the Committee members observed that project

proponent is required to submit the certain information/data for appraisal of

the project proposal. The Committee decided to defer the case till the reply

of its observations is received. The decision of the Committee was conveyed

to project proponent vide letter no. 49584 dated 21.12.2011.

3. Thereafter, the project proponent vide letter dated 29.12.2011 has

submitted the reply to the observations of the Committee, the details of

which are as under:

d) For how long period the project proponent will be responsible for implementation of EMP and the name of the person(s) responsible for implementation of EMP.

e) Capital & recurring cost for the EMP per year and the details of funds for the same.

f) Name of the individual person / organization, who will be responsible for implementation of EMP after the lapse of the period for which the project proponent is responsible.

f) Environmental Officer of the promoter company shall be responsible for implementation of EMP.

4. Corporate Social Responsibility indicating various activities to be undertaken, provisions of funds for the same, the period for which the same is to be implemented and the person(s) responsible for the implementation of the same.

About 1% of the profit will be used on account of various activities of Corporate Social Responsibility such as welfare of eyes care and eye donation for poor people etc. The CEO of the promoter company shall be responsible for implementation of the same.

4. The project proponent was requested by the SEAC vide letter No. 2043

dated 16.1.2012 to attend its 55th meeting on 20.01.2012 to present the

reply of its observations.

5. The said meeting was attended by the following on behalf of the project

proponent to present the reply of the observations of the SEAC.

i) Sh. J.K. Goel, Vice President of the promoter Company

ii) Sh. Parshan Singh Sindhu, DGM (Arch) of the promoter company

iii) Sh. Praveen Bhargava Environmental Consultant, M/s Perfect Enviro-Solution Pvt. Limited, Delhi.

Sh. Praveen Bhargava, who is the Environmental Consultant of

the promoter company, presented the reply of the observations of the

Committee as under:

1. The heights of six residential towers marked as A, B, C, D, E & F has

been refixed as 103.825 m, 103.725 m, 80.25 m, 103.725 m, 40.925

m and 40.925 m above ground level, respectively, so as to comply

with the prescribed height (104 m) fixed by the Govt. of India,

Ministry of Defence vide letter dated 03.10.2011.

2. He illustrated the details of EMP and CSR.

The Committee members observed that the details given in the layout

plan approved by the Chief Town Planner, Punjab vide no. 6872 CTP (Pb)/SC-122

dated 03.09.2009 are not matching with the details mentioned in the revised

elevation plan submitted by the project proponent vide letter dated 29.12.2011.

The majority of the Committee members were of the opinion that before sending

the recommendations to SEIAA, the project proponent is required to incorporate

the changes made with respect to height of the towers in the approved layout plan.

The Committee, therefore, decided to defer the case till the project

proponent submits the layout plan having incorporated all the changes as shown in

the elevation plans submitted to the Committee vide letter dated 29.12.2011.

Item No. 55.04: Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for developing a Residential Apartment Complex namely "Jalandhar Heights" in the revenue estate of Villages Pholriwal & Alipur, Tehsil & District Jalandhar by M/s G.I. Builders (P) Ltd.,

The SEAC observed that:

1. M/s G.I. Builders (P) Ltd., has applied for obtaining environmental clearance

as required under the EIA notification dated 14/9/2006 for development of a

Residential Apartment Complex namely "Jalandhar Heights" in the revenue

estate of Villages Pholriwal & Alipur, Tehsil & District Jalandhar. The project

is covered under category 8 (a) of the Schedule appended to the said

notification.

2. The case was considered by the SEAC in its 49th meeting held on 18.07.2011

and the same was deferred to the next meeting in light of request made by

the project proponent vide letter no. 215 dated 18.07.2011.

3. The case was again considered by the SEAC in its 50th meeting held on

12.08.2011, wherein, the Committee brought into the notice of the

representative of the project proponent that Sh. Vishal Duggal will not be

allowed to present the project proposal till he submits a documentary

evidence to the effect that he is one of the applicants in the application

submitted M/s Ace Engineers and Consultants, Patiala for accreditation to

the MoEF, New Delhi. The Committee further observed that the project

proponent is required to submit certain information/data for appraisal of the

project proposal. Sh. Ashwani Kant, General Manager of the promoter

Company, who was also present in the meeting, requested the SEAC for one

month time period to submit the said documents/data and to look into/sort

out the matter regarding accredited environment consultant. The Committee

agreed to accept the request made by Sh. Ashwani Kant and decided to

defer the case till the reply of the observations, is received. The said

decision was conveyed to the project promoter vide letter No. 3606 dated

30.08.2011.

4. The project proponent vide letter dated 24.09.2011 and 14.11.2011 has

submitted the reply of the observations of the SEAC, the details of which are

as under:

Initially there was a proposal to provide borewells to supply the water to the residents, but now the promoter company has planned to get the water supply from Municipal Corporation, Jalandhar and submitted a copy of the letter bearing no. CE/1616 dated 11.11.2011 of Municipal Corporation,

Jalandhar mentioning that: 1. The firm can take the water

supply connection at their own cost by depositing the sharing charges against water supply head.

2. The existing water supply line has the capacity of more than 500 KLD. The firm can take the required quantity of 240 KLD for water supply connection.

Specific approval of the Municipal Corporation, Jalandhar showing as to how much quantity of treated wastewater of the residential colony will be allowed to be discharged into the sewerage system and the latest position for laying down sewerage system in the area with which the sewer of the residential colony is proposed to be connected.

The project proponent has submitted a letter bearing No. CE 1236 dated 07.09.2011 of Municipal Corporation, Jalandhar mentioning that the project proponent will be allowed to dispose off the treated wastewater into Municipal Corporation sewer as the existing sewer has the intake capacity of more than 1 Lac KLD of sewage, subject to the condition that the project proponent will pay sharing charges and connection fee charges before making the sewer connection with the main sewer of Municipal Corporation.

3. An undertaking to the effect that electromagnetic flow meter shall be installed at each source of water supply and appropriate flow measuring device at the outlet of the sewerage system/STP of the residential colony to have a check on the quantity of ground water to be consumed and quantity of sewage to be generated from the colony.

4. Permission of Municipal Corporation, Jalandhar to the effect that the management and handling of the entire solid waste to be generated from the

5. Land area earmarked in the layout plan for collection of solid waste outside the boundary limits of the residential colony is not in order, as such, the promoter is required to earmark the adequate land area within the boundary limits of the residential colony for storage of solid waste.

5. The case was considered by the SEAC in its 53rd meeting held on

24.11.2011, which was attended by the following on behalf of the project

proponent to present the case before the SEAC:

i) Sh. Ashwani Kant, General Manager of the promoter company

ii) Sh. Vishal Duggal of M/s Ace Engineers & Consultants, Patiala

Sh. Vishal Duggal of M/s Ace Engineers & Consultants, Patiala, who is

the Environmental Consultant of the promoter company, submitted a copy of

the application filed by M/s Ace Engineers and Consultants, Patiala in the

office of the Ministry of Environment & Forests, New Delhi in which the

name of Sh. Vishal Duggal has been mentioned as technical expert of the

consultancy firm. He presented the case before the Committee as under:

The total plot area is 30070 sq. m and the built up area of the project

will be 75125 sq. m.

The site of the project is located outside M.C. limits of Jalandhar.

The total water requirement for the project will be 300 KLD, out of which

240 KLD will be met from Municipal Corporation water supply and

balance 60 KLD will be met through recycling of treated wastewater. The

Municipal Corporation Jalandhar has already given a permission vide

letter no. CE/1616 dated 11/11/2011 to the effect that 240 KLD of supply

of water will be provided to the project proponent.

The total wastewater generation from the proposed project will be about

225 KLD, out of which 60 KLD will be used for flushing, 145 KLD will be

used for horticulture purpose and the remaining treated wastewater will

be discharged into sewer in summer season. In winter season, 60 KLD

will be used for flushing, 70 KLD will be used for horticulture purpose and

the remaining treated wastewater will be discharged into sewer. In rainy

season 60 KLD will be used for flushing, 30 KLD will be used for

horticulture purpose and the remaining treated wastewater will be

discharged into sewer. The Municipal Corporation Jalandhar has already

given a permission vide letter no. CE/1236 dated 07/09/2011 to the

effect that the project proponent will be allowed to discharge the treated

wastewater into MC sewer since the capacity of the existing sewer is to

take 1 lac KLD of sewage.

The project proponent has proposed to install a STP having capacity 225

KLD consisting of bar screen, collection tank, primary clarifier, aeration

tank, secondary clarifier, pressure sand filter, chlorination tank and

sludge drying beds to treat wastewater.

About 600 kg/day of solid waste will be generated, which will be

segregated into dry and wet waste. Recyclable dry waste will be sold to

scrap dealers. Bio-degradable and non-recyclable will be disposed off in

the earmarked area of M.C. Jalandhar and the M.C. Jalandhar has

issued a letter bearing no. CE/1236 dated 07/09/2011 in this regard.

The total power requirement will be 3.5 MW which will be taken from

Punjab State Power Corporation Ltd.

The project proponent has proposed to provide 9 no. rain water

harvesting pits to replenish the groundwater.

Parking provision has been kept for 888 ECS against total requirement of

756 ECS.

Analysis reports of ambient air of M/s Industrial Testing Laboratory and

Consulting House, Patiala indicate that the conc. of PM2.5, PM10, SOx,

NOx, Ozone and CO in the ambient air of the area is within the

prescribed standards. As per analysis report, ambient noise levels of the

area is also conforming to the standards laid down by the Board. Further,

the analysis report of ground water indicates that the groundwater of the

area is potable in nature.

No construction activity has been started at site.

After detailed discussions in the matter, the SEAC observed

that the project proponent is required to still submit certain information and

data for appraisal of the project proposal. The Committee decided to defer

the case till the reply of observations is received. The decision of the

Committee was conveyed to project proponent vide letter no. 49518 dated

21.12.2011.

6. The project proponent vide letter dated 6.1.2012 has submitted the reply to

the observations of the Committee, the details of which are as under:

4 Corporate Social Responsibility indicating various activities to be undertaken, provisions of funds for the same, the period for which the same is to be implemented and the person (s) responsible for the implementation of the same.

Rs.5 Lacs has been earmarked for sponsoring public services and educational activities.

5. Consent to establish (NOC) of the board granted under Water Act, 1974 and Air Act,1981.

The Board has granted NOC for development of a group housing project in the revenue estate of Village Pholriwal & Alipur, District Jalandhar vide no. Z.O. J/ CTE / NOC / Colony / 2011 / 441 dated 29.07.2011.

6. The project proponent was requested by the SEAC vide letter no. 2044

dated 16.01.2012 to attend its 55th meeting on 20.01.2012 to present the

reply of the observations. Accordingly, following were present on behalf of

the project proponent:-

1. Sh. Ashwani Kant, General Manager of the promoter Company

2. Sh. Vishal Duggal, Environmental Consultant of M/s Ace Engineers & Consultants, Patiala

Sh. Ashwani Kant, General Manager of the promoter Company,

presented the reply of the observations of the SEAC. He intimated that:

(i) The promoter company will lay down its own sewer line along the road in

a stretch of 700 m, so as to connect the existing sewerage system of

M.C., Jalandhar with sewerage system of the residential colony. The

entire cost for laying down the said sewer line will be borne by the

promoter company and submitted a copy of the letter in this regard and

a copy of the letter vide which NOC has been obtained from PWD (B&R)

for laying down sewer line along the road.

(ii) The promoter company will lay down its own pipeline along the road in a

stretch of 700 m, so as to connect the existing water supply line of M.C.,

Jalandhar with water supply line of the residential colony. The entire cost

for laying down the said water supply line will be borne by the promoter

company and submitted a copy of the letter in this regard. But the NOC

in this regard is yet to be obtained from the PWD (B&R).

(iii) About 4590 sq. m of area will be developed as parks/green belt and the

treated wastewater will be utilized for irrigation of the same.

The Committee observed that the Environment Management Plan

(EMP) and Corporate Social Responsibility (CSR) submitted by the project

proponent do not contain the requisite information since the same is sketchy one,

therefore, the project proponent is required to submit detailed EMP and CSR

regarding the various points already conveyed to the promoter company vide letter

no. 49518 dated 21.12.2011. The Committee further observed that the project

proponent is required to obtain NOC from PWD (B&R) for laying down pipeline for

water supply along the road from the point where the water supply of M.C.

Jalandhar is existing upto the point of the residential colony. The representative of

the project proponent assured that the said documents will be submitted to the

SEIAA at the earliest. However, the Committee was satisfied with the other

clarifications of the observations raised by it, therefore, the Committee awarded

'Silver Grading' to the project proposal and decided to forward the case to the

SEIAA with the recommendation to grant environmental clearance to the project

proponent (for construction of seven blocks of 8 floors each, two blocks of 6 floors

each, one block of four floors and one block of 7 floors) only after getting proper

EMP and CSR and NOC of PWD (B&R) from project proponent, subject to the

following conditions in addition to the proposed measures.

PART A – Specific conditions

I. Construction Phase

I. “Consent to establish” shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority before the start of any construction work at site.

II. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase.

III. A first aid room will be provided in the project both during construction and operation phase of the project.

IV. All the topsoil excavated during construction activities should be stored for use in horticulture / landscape development within the project site.

V. Disposal of muck during construction phase should not create any adverse effect on the neighboring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority.

VI. Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump sites for such material must be secured, so that they should not leach into the ground water.

VII. The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards.

VIII. Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards.

IX. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase.

X. Fly ash should be used as construction material in the construction as per the provisions of Fly Ash Notification of September, 1999 and as amended on August, 2003 (This condition is applicable only if the project is within 100 Km of Thermal Power Station).

XI. Ready mixed concrete should be used in building construction as far as possible.

XII. Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices.

XIII. Separation of drinking water supply and treated sewage supply should be done by the use of different colours.

XIV. Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control.

XV. Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code.

XVI. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning.

XVII. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, disposal of waste water & solid waste in an environmentally sound manner, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

II. Operation Phase

I. The installation of sewage treatment plant (STP) and adequacy of disposal system should be certified by Punjab Pollution Control Board and a report in this regard should be submitted to the Ministry of Environment & Forests/State Level Environment Impact Assessment Authority before the project is commissioned for operation. The discharge of treated sewage shall conform to the norms and standards prescribed by Punjab Pollution Control Board for such discharges. The project proponent shall discharge not more than 135 KLD of treated wastewater into public sewer.

II. The project proponent shall provide electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for re-using the treated wastewater back into the system for flushing and for horticulture purpose/green etc. and shall maintain a record of readings of each such meter on daily basis.

III. Adequate & appropriate pollution control measures should be provided to control fugitive emissions to be emitted within the commercial complex.

IV. Adequate treatment facility for drinking water shall be provided, if required.

V. Rainwater harvesting for roof run-off should be implemented. Before recharging the roof run-off, pretreatment must be done to remove suspended matter, oil and grease. However, no run off from gardens/green area/roads/pavements shall be connected with the ground water recharging system.

VI. The solid waste generated should be properly collected and segregated. The recyclable solid waste shall be sold out to the authorized vendors and inerts shall be sent to disposal facility. The Bio-degradable solid waste shall be adequately treated as per the scheme submitted by the project proponent. Prior approval of competent authority should be obtained, if required.

VII. Hazardous waste/E-waste should be disposed off as per Rules applicable and with the necessary approval of the Punjab Pollution Control Board.

VIII. The green belt design along the periphery of the plot shall achieve attenuation factor conforming to the day and night noise standards prescribed for residential land use. The open spaces inside the plot should be suitably landscaped and covered with vegetation of indigenous species/variety.

IX. The project proponent should take adequate and appropriate measures to contain the ambient air quality with in the prescribed standards. The proposal regarding mitigation measures to be taken at site should be submitted to the Ministry of Environment & Forests/ State Level Environment Impact Assessment Authority within three months.

X. Incremental pollution loads on the ambient air quality, noise and water quality should be periodically monitored after commissioning of the project.

XI. Application of solar energy should be incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating.

XII. Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized.

XIII. A report on the energy conservation measures conforming to energy conservation norms finalized by Bureau of Energy Efficiency should be prepared incorporating details about machinery of air conditioning, lifts, lighting, building materials, R & U Factors etc. and submitted to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA in three months time.

XIV. Environment Management Cell shall be formed during operation phase which will supervise and monitor the environment related aspects of the project.

PART B – General Conditions : i) This environmental clearance will be valid for a period of five years from the

date of its issue or till the completion of the project, whichever is earlier.

ii) The environmental safeguards contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority/State Expert Appraisal Committee should be implemented in letter and spirit.

iii) The entire cost of the environmental management plan (i.e. capital cost as well as recurring cost) will continue to be borne by the project proponent until the responsibility of environmental management plan is transferred to

the occupier/residents society under proper MOU after obtaining prior permission of the Punjab Pollution Control Board.

iv) The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by mail) to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA.

v) Officials from the Regional Office of Ministry of Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority / State Level Expert Appraisal Committee / Punjab Pollution Control Board who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents submitted to State Environment Impact Assessment Authority should be forwarded to the CCF, Regional Office of Ministry of Environment & Forests, Chandigarh/State Level Environment Impact Assessment Authority.

vi) In the case of any change(s) in the scope of the project, the project would require a fresh appraisal by State Environment Impact Assessment Authority.

vii) Separate distribution pipelines be laid down for use of treated effluent / raw water for horticultural/gardening purposes with different colour coding.

viii) All other statutory clearances such as the approvals for storage of diesel from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, by project proponents from the competent authorities including Punjab Pollution Control Board and from other statutory bodies as applicable.

ix) The project proponent should advertise in at least two local newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded environmental clearance and copies of clearance letters are available with the Punjab Pollution Control Board. The advertisement should be made within seven days from the day of issue of the clearance letter and a copy of the same should be forwarded to the Regional Office, Ministry of Environment & Forests, Chandigarh.

x) These stipulations would be enforced among others under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environmental (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification, 2006.

xi) Environmental clearance is subject to final order of the Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 460 of 2004 as may be applicable to this project and decisions of any competent court, to the extent applicable.

xii) A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the

local NGO, if any, from whom suggestions / representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

xiii) The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levels namely; PM2.5, PM10, SO2, NOx , CO, Pb, Ozone (ambient air as well as stack emissions) shall be monitored and displayed at a convenient location near the main gate of the company in the public domain.

xiv) The project proponent shall not install tubewell during construction as well as operation phase without the prior permission of the SEIAA/CGWA.

xv) The project proponent shall comply with the conditions imposed by the Department of Town & Country Planning in the permission for CLU granted vide Memo No. 2080 STP (J)/CLU dated 30.12.2010.

xvi) The project proponent shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility.

xvii) The State Environment Impact Assessment Authority reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner.

xviii) Any appeal against this environmental clearance shall lie with the National Environment Appellate Authority, if preferred, within a period of 30 days as prescribed under section 11 of the National Environment Appellate Act, 1987.

Item No. 55.05 Application for obtaining Environmental Clearance as required under EIA notification dated 14.09.2006 for development of Commercial Complex namely "Khanna City Centre" at G.T. Road, Khanna, Distt. Ludhiana by M/s PPR Constructions.

The SEAC observed that:

1. M/s PPR Constructions has submitted an application for obtaining

environmental clearance under EIA notification dated 14.09.2006 for

development of a commercial Complex namely "Khanna City Centre" at G.T.

Road, Khanna, Distt Ludhiana, on Form 1 & 1A. The project is covered under

category 8 (a) of the Schedule appended to said notification.

2. The case was considered by the SEAC in its 48th meeting held on

11.06.2011, which was attended by the following on behalf of the project

promoter:

(i) Sh. Rupinder Singh, Partner of the promoter company

(ii) Sh. Vishal Duggal, authorized representative of M/s ACE Engineer & Consultants, Patiala.

Sh. Vishal Duggal, who is the Environmental Consultant of the

project proponent, presented the case before the SEAC as under:

The total plot area of the proposed project is 13,830 sq. m and total built

up area is 27,166 Sq. m.

The total water requirement for the project will be 60 KLD, out of which

30 KLD will be met with groundwater by installing tubewell of capacity 10

Kl/hr and balance 30 KLD will be met through recycling of treated

wastewater.

The total wastewater generation from the proposed project will be about

30 KLD, out of which 10 KLD will be used for flushing and remaining 20

KLD will be used for irrigation of green area (23,402.21 sq. m).

The project proponent shall install STP having capacity to handle 30 KLD

of wastewater, consisting of bar screens, collection tank, primary

clarifier, sequencing batch reactor (SBR), pressure sand filter,

chlorination tank & sludge drying beds.

The total quantity of MSW has been estimated as 250 Kg/day. The solid

waste will be collected separately as dry and wet waste. Dry waste will

be collected in separate primary bins and stored for disposal. Recyclable

waste will be sold out to scrap dealers. Biodegradable and non-recyclable

component will be disposed off through MSW landfill of MC Khanna. The

Municipal Council Khanna vide letter no. 4517 dated 18.1.2011 has

issued a certificate to the effect that the M.C. will lift the entire solid

waste to be generated by the Khanna City Centre.

The total power requirement will be 3 MW, which will be supplied by

Punjab State Power Corporation Ltd. and DG sets will be installed as

standby arrangement of power supply.

Rain water harvesting system will be provided for recharge of 3600

cum/yr of rain water into ground by installing 4 no. recharging wells.

Parking provision has been kept for 850 ECS.

About 50% of the construction has been completed.

The SEAC observed that the project proponent is required to

submit the certain information / data for appraisal of the project proposal.

Sh. Rupinder Singh, Partner of the promoter company informed that the said

documents/data will be submitted within 15 days. The Committee agreed to

accept the request made by Sh. Rupinder Singh, Partner of the promoter

company and decided to defer the case till the reply of the aforesaid

observations, is received. The decision of the Committee was conveyed to

the project proponent vide letter no. 27700 dated 5.7.2011.

3. Thereafter the project proponent vide letter dated 9.1.2012 has submitted

the reply of the observations of the SEAC, the details of which are as under:

In all the three seasons, the consumption of water for various activities will be 60 KLD out of which 30 KLD of wastewater will be generated. However, the quantity of wastewater generation is not matching with treated

wastewater reuse for all the three seasons.

4. Quantification of energy saved and renewable energy devices used and permission of PSPCL for power connection.

Quantification of energy to be saved, submitted, but permission of PSPCL for power connection has not been submitted.

5. Construction schedule (PERT/CPM Chart)

Submitted.

4. The project proponent was requested by the SEAC vide letter no. 2046

dated 16.01.2012 to attend its 55th meeting on 20.01.2012 to present the

reply of the observations. Accordingly, following were present on behalf of

the project proponent:-

2. Sh. Vishal Duggal, Environmental Consultant of M/s Ace Engineers & Consultants, Patiala

Sh. Upinder Malhotra, Project Manager of the promoter Company,

presented the reply of the observations of the SEAC and submitted the permission

granted by PSPCL for power connection to the commercial complex, which was

taken on record by the Committee. He also informed that:

(i) About 32 KLD of wastewater will be generated, which will be treated in a

STP of capacity 35 KLD.

(ii) About 32 KLD of treated wastewater will be generated, out of which 2 KLD

will be used for hotel facility, 2 KLD for shopping area, 9 KLD for flushing

purpose and 19 KLD for horticulture purpose in summer season. In rainy

season, 2 KLD will be used for hotel facility, 2 KLD for shopping area, 9 KLD

for flushing purpose, 10 KLD for horticulture purpose and 9 KLD into sewer.

In winter season, 2 KLD will be used for hotel facility, 2 KLD for shopping

area, 9 KLD for flushing purpose, 15 KLD for horticulture purpose and 4 KLD

into sewer. He submitted revised water balance statement showing the

above details, which was taken on record by the Committee.

(iii) Green area will be developed in about 1700 sq. m, which will be irrigated

with treated wastewater.

(iv) The ambient air quality has been monitored for PM2.5, PM10, SOx, NOx Ozone

and CO and as per analysis results the ambient air quality is conforming to

the standards laid down by the MoEF.

The Committee observed that the Environment Management Plan

(EMP) and Corporate Social Responsibility (CSR) submitted by the project

proponent do not contain the requisite information since the same is sketchy one,

therefore, the project proponent is required to submit detailed EMP and CSR

containing the details in respect of following points:

1. Environmental Management Plan indicating the following:

a) All mitigation measures for each item-wise activity to be undertaken during the construction, operation and the entire life cycle to minimize adverse environmental impacts as a result of the activities of the project.

b) Compliance of various environmental regulations

c) Steps to be taken in case of emergency such as accidents at the site including fire.

d) For how long period the project proponent will be responsible for implementation of EMP and the name of the person(s) responsible for implementation of EMP.

e) Capital & recurring cost for the EMP per year and the details of funds for the same.

f) Name of the individual person / organization, who will be responsible for implementation of EMP after the lapse of the period for which the project proponent is responsible.

2. Corporate Social Responsibility indicating various activities to be undertaken,

provisions of funds for the same, the period for which the same is to be

implemented and the person(s) responsible for the implementation of the

same.

The representative of the project proponent assured that the said

documents/information will be submitted to the SEIAA at the earliest. The

Committee also observed that the project proponent has already started

construction of the project, which is a violation of the provisions of EIA notification

dated 14.9.2006. Therefore, in compliance to Govt. of India, Ministry of

Environment & Forests, New Delhi Office Memorandum dated 16.11.2010, the

project proponent is required to place the matter before the Board of Directors of

the Company for starting construction work of the project in violation of the

provision of the EIA Notification framed under the Environment (Protection) Act,

1986 and is required to submit a written commitment in the form of a formal

resolution to the SEIAA to the effect that the violation of the Environment

(Protection) Act, 1986 will not be repeated in future. The Committee further

observed that the project proponent has provided adequate and satisfactory

clarifications of the observations raised by it, therefore, the Committee awarded

'Silver Grading' to the project proposal and decided to forward the case to the

SEIAA, with the recommendation to grant environmental clearance to the project

proponent (for construction of two blocks having five floors including lower ground

floor and ground floor in each block + one block having three floors including

ground floor) only after getting proper EMP, CSR and aforesaid resolution subject

to the following conditions, in addition to the proposed measures.

PART A – Specific conditions

I. Construction Phase

I. “Consent to establish” shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority before the start of any construction work at site.

II. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase.

III. A first aid room will be provided in the project both during construction and operation phase of the project.

IV. All the topsoil excavated during construction activities should be stored for use in horticulture / landscape development within the project site.

V. Disposal of muck during construction phase should not create any adverse effect on the neighboring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority.

VI. Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump

sites for such material must be secured, so that they should not leach into the ground water.

VII. The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards.

VIII. Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards.

IX. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase.

X. Fly ash should be used as construction material in the construction as per the provisions of Fly Ash Notification of September, 1999 and as amended on August, 2003 (This condition is applicable only if the project is within 100 Km of Thermal Power Station).

XI. Ready mixed concrete should be used in building construction as far as possible.

XII. Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices.

XIII. Separation of drinking water supply and treated sewage supply should be done by the use of different colours.

XIV. Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control.

XV. Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code.

XVI. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning.

XVII. xxxiii) The project proponent shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility.

xxxiv) The State Environment Impact Assessment Authority reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner.

xxxv) Any appeal against this environmental clearance shall lie with the National Environment Appellate Authority, if preferred, within a period of 30 days as prescribed under section 11 of the National Environment Appellate Act, 1987.

Item No. 55.06: Application for obtaining the Environmental Clearance under EIA notification dated 14.09.2006 for the development of a residential colony namely “Medicity Heights” in the revenue estate of Village Singhpura near Zirakpur, Tehsil Dera Bassi, Distt Mohali by M/s Sunrise Infratech Pvt. Ltd.,

The SEAC observed that:

1. M/s Sunrise Infratech Pvt. Ltd., has applied for obtaining the Environmental

Clearance under EIA notification dated 14.09.2006 for developing a residential

complex namely “Medicity Heights“ in the revenue estate of Village Singhpura

near Zirakpur, Tehsil Dera Bassi, Distt SAS Nagar ,Punjab on Form I &I A and

other documents.

2. The project proponent was requested by the SEAC vide letter No. 2051 dated

16.01.2012 to attend its 55th meeting on 20.01.2012 to present the project

proposal.

3. The environmental consultant of the project proponent vide letter dated

17.01.2012 has informed that stage-II assessment of their company has been

fixed by QCI on 18-20th January,2012, as such, they will not be able to

present the project proposal on 20.01.2012 and requested to defer the case

to the next meeting of SEAC.

The Committee further observed that the project proponent has not

submitted the following information / data required for appraisal of the project

proposal:

1. Proof of ownership of land

2. Layout plan / building plan duly approved by the Competent Authority of the State

3. Topographical map of the area showing Contour Plan

4. Status of construction, if any, alongwith photographs from all the four sides.

5. A map showing various features including industrial units within a radius of

till the Engineered Landfill facility is developed by the Govt. and submit a

copy of layout plan showing the said site.

After detailed deliberations in the matter, the SEAC agreed to accept

the request of the environmental consultant of the project proponent made vide

letter dated 17.01.2012 and the Committee decided to defer the case till the

project proponent submits the above noted information / data.

Item No. 55.07: Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for development of a residential colony namely “Aero Homes” in the revenue estate of Village Gazipur, Tehsil Dera Bassi, Distt SAS Nagar by M/s N.H. Matcon Pvt. Ltd.,

The SEAC observed that:

1. M/s N.H. Matcon Pvt Ltd. has applied for obtaining the environmental

clearance under EIA notification dated 14.09.2006 for developing a

residential complex namely “Aero Homes” in the revenue estate of Village

Gazipur, Tehsil Derabassi, Distt SAS Nagar by submitting Form I &I A and

other documents. The project is covered under category 8(a) of the said

notification.

2. The project proponent was requested by the SEAC vide letter No. 2048

dated 16.01.2012 to attend its 55th meeting on 20.01.2012 to present the

project proposal.

3. The environmental consultant of the project proponent vide letter dated

17.01.2012 has informed that stage-II assessment of their company has

been fixed by QCI on 18-20th January,2012, as such, they will not be able to

present the project proposal on 20.01.2012 and requested to defer the case

to the next meeting of SEAC.

The Committee further observed that the project proponent has not

submitted the following information / data required for appraisal of the project

Item No. 55.08 Application for obtaining the Environmental Clearance under EIA notification dated 14.09.2006 for development of a residential project namely „Leaf Stone Apartments‟ in the revenue estate of Village Madhopur, Tehsil Dera Bassi, Distt. SAS Nagar by M/s MD Promoters and Developers.

The SEAC observed that:

1. M/s M.D Promoters and Developers has applied for obtaining the

Environmental Clearance under EIA notification dated 14.09.2006 for

development of a residential project namely „Leaf Stone Apartments‟ in the

revenue estate of Village Madhopur, Tehsil Dera Bassi, Distt. SAS Nagar, on

Form 1 and I A.

2. The project proponent was requested by the SEAC vide letter No. 2041

dated 16.01.2012 to attend its 55th meeting on 20.01.2012 to present the

project proposal.

3. The project proponent vide letter dated 19.01.2012 has informed that the

technical team of their environmental consultant has gone somewhere else,

as such, they will not be able to present the project proposal on 20.01.2012

and requested to defer the case to the next meeting of SEAC.

The Committee further observed that the project proponent has not

submitted the following information / data required for appraisal of the project

proposal:

1. Proof of ownership of land

2. Permission for CLU of the Competent Authority of the State

3. Layout plan / building plan duly approved by the Competent Authority of the State

4. Topographical map of the area showing Contour Plan

project proponent is responsible.

16. Corporate Social Responsibility indicating various activities to be undertaken,

provisions of funds for the same, the period for which the same is to be

implemented and the person (s) responsible for the implementation of the

same.

After detailed deliberations in the matter, the SEAC agreed to accept

the request of the project proponent made vide letter dated 19.01.2012 and the

Committee decided to defer the case till the project proponent submits the above

noted information / data.

Item No. 55.09: Application for obtaining Environmental Clearance under EIA notification dated 14.09.2006 for developing a project namely 'Eco City' in the revenue estate of Village Mullanpur, District S.A.S Nagar.

The facts of the case are as under:

1. The Greater Mohali Area Development Authority (GMADA) has applied for

obtaining environmental clearance as required under the EIA notification

dated 14/9/2006 for development of a project namely 'Eco City' in the

revenue estate of Village Mullanpur, District S.A.S Nagar. The project is

covered under category 8 (b) of the Schedule appended to the said

notification.

2. The case was considered by the EAC of MoEF in its 96th meeting held on

25.01.2011 and the 'Terms of Reference' were issued by the MoEF vide

letter dated 07.02.2011. The MoEF returned the case file to SEIAA, Punjab

on its re-constitution and the case was placed in the 44th meeting of SEAC,

held on 19.03.2011, wherein, it was decided to remind the project

proponent to submit the Rapid EIA / EMP report. The said decision of the

Committee was conveyed to the project proponent vide letter no. 1104

dated 04.04.2011. The GMADA has submitted the Rapid EIA study report

and EMP vide letter dated 19.12.2011.

3. The case was considered by the SEAC in its 54th meeting held on

30.12.2011, which was attended by the following on behalf of GMADA:

i) Sh. Devinder Singh, Executive Engineer (PH), GMADA

ii) Sh. Sandeep Garg, Environmental Advisor, GMADA

iii) Sh. Krishna Kumar, Environmental Consultant of M/s IRGSSA

iv) Sh. Mohd Arif, Environmental Consultant of M/s IRGSSA

Sh. Krishna Kumar, who is the Environmental Consultant of the

GMADA, presented the case before the SEAC as under:

The application submitted by GMADA mentions that the area of

residential project is 450 acres, out of which 412 acres is to be developed

at present and remaining 38 acres area is yet to be acquired /

purchased, as such, environmental clearance is required only to develop

412 acres of land area. Out of 412 acres, green area will be developed in

36 acres.

The total water requirement for the project will be 7425 KLD, out of

which 30 percent (2227.5 KLD) will be met from groundwater by

installing tubewells and remaining 70 percent (5197.5 KLD) will be met

from surface water source.

The total wastewater generation from the proposed project will be about

5198 KLD, which will be treated in a STP of capacity 6 MLD to be

installed based on aerobic biological system consisting of oil/grease trap,

collection tank, grit chamber, FAB reactor, pressure sand filter, activated

carbon filter, UV disinfection unit and filter press. Out of 5198 KLD of

treated wastewater, about 743 KLD will be used for irrigation purpose,

4455 KLD will be used for flushing purpose in monsoon season. In winter

season, 1120 KLD will be used onto land for plantation and remaining

4078 KLD will be used for flushing purpose. In summer season, 1493

KLD will be used onto land for plantation and remaining 3705 KLD will be

used for flushing purpose.

The total quantity of MSW has been estimated as 24.75 MT/day, which

will be collected and sent to the Integrated Municipal Solid Waste

Management facility to be developed at Village Samgauli, Tehsil Dera

Bassi, District SAS Nagar.

About 200 kg/day of sludge will be generated from the STP, which will be

used as manure in the horticulture area to be developed within the

project site.

In all the residential houses / buildings to be constructed in a plot area

more than 400 sqm, it will be made mandatory to provide rain water

harvesting system to recharge the rainwater of roof top into

groundwater.

The total power requirement will be 20 MVA on the consumption criteria

of 1.35 watt/sq. feet. The required energy demand will be sourced from

66 KVA Grid Substation located at Mullanpur. There is no proposal to

install D.G sets.

Parking area will be provided @ 1.50 ECS for every 120 sq. yards of

built-up area of all floors by each plot holder.

The monitoring of ambient noise levels was carried out at project site

and the equivalent noise levels during day & night times were found to

be 53.7 dB(A) and 42.9 dB(A), respectively, against the prescribed

standards of 55 dB(A) leq and 45 dB(A) leq. Similarly, at Kurali Road, the

equivalent noise levels during day & night times were found to be 58.8

dB(A) and 46 dB(A), respectively, against the prescribed standards of 55

dB(A) leq and 45 dB(A) leq. As far as the noise of the vehicular traffic

moving on the Kurali-Mullanpur road is concerned, the residential plots

are located at a distance of about 200 m from the said road. Therefore,

the anticipated impact of noise due to vehicular movement on the said

road at the residential houses will not be too high, however, to attenuate

the same a green buffer will be provided.

Each plot holder will be imposed a condition in the allotment letter that

he/she will comply with the Energy Conservation Building Code (ECBC)

guidelines.

For the proper handling/managing the hazardous material, if any,

including electronic waste will be sent to existing hazardous waste

management facility located at Nimbua in Dera Bassi Block.

EMP has been prepared for construction as well as operation phase of

the project.

GMADA will assume the powers and responsibilities for overall

environmental monitoring and management plan both during

construction & operation phase of the project.

The baseline Environmental Quality Monitoring (soil, surface water,

groundwater, noise and meteorological) was carried out in the month of

March, 2011.

Samples of groundwater were collected near from the project site and

the quality of water is found potable in nature.

As per topographical map, there is a level difference of 7 m and the

natural terrain of the site is towards the Jayanti Devi Ki Choe passing

along the site. The surface runoff from this project site has been

proposed to be drained off into this choe through properly designed

storm water drainage system along the major roads. Further, this project

is part of Mullanpur Town and there will be no boundary wall around the

project site. The site will be integrated with the peripheral services.

Therefore, there will be no hindrance to the natural surface runoff.

The SEAC in the said meeting observed that GMADA has not

addressed the following observations in the final rapid EIA report:

1. No land has been earmarked in the layout plan for construction of a

guard pond to be used in case of failure of STP in compliance to TOR.

2. No green buffer has been proposed between the project site and TT site

in compliance to TOR.

3. In compliance to TOR, no possibility has been explored to produce bio-

gas from biodegradable solid waste.

4. How much land has been earmarked for installation of STP has not been

prescribed in the EIA study report so as to ascertain as to whether

adequate land area has been kept for installation of STP or not ?

5. No details have been given about house to house collection of solid

waste as per the provisions of Municipal Solid Waste (Management &

Handling) Rules, 2000. Furthermore, no area has been earmarked in the

layout plan for primary collection centres of solid waste and waste

storage depot. No synchronization of the waste storage depot with

primary collection centres and transportation system has been made.

6. No ambient air monitoring has been carried out at the nearest residential

plot from Kurali Road (i.e. at a distance of about 200 m) to assess the

impact of vehicular movement.

After detailed deliberations, the Committee observed that the

GMADA is required to incorporate the reply of above noted observations

in the rapid EIA study report and is required to submit the final EIA

report. The SEAC, therefore, decided to defer the case till the GMADA

submits final rapid EIA report containing the reply of above noted

observations. The decision of the Committee was conveyed to GMADA

vide letter no. 782 dated 09.01.2012.

7. Thereafter, the GMADA vide letter dated 10.01.2012 has informed that

the reply of the observations of the SEAC is being prepared and final EIA

report after incorporating the reply of the same will be submitted by

17.01.2012.

8. The GMADA was requested by the SEAC vide letter No. 5172 dated

28.12.2011 to attend its 55th meeting on 30.12.2011. Accordingly,

following were present in the meeting on 20.01.2012 on behalf of the

project proponent to present the reply of the observations of the SEAC:

i) Sh. Devinder Singh, Executive Engineer (PH), GMADA

ii) Sh. Sandeep Garg, Environmental Advisor, GMADA

iii) Sh. Sanjeev Satyanarayan, Environmental Consultant of M/s Krishna Ganga Enviro System Pvt. Ltd.,

Sh. Devinder Singh, Executive Engineer (PH), GMADA, presented

pointwise reply of the observations of the SEAC as under:

1. The estimated quantity of wastewater is 5198 KLD, for the treatment of

which three modules of STP of total capacity 6 MLD will be installed. The

treated wastewater from this STP will be utilized for Horticulture & Flushing

purposes in residential as well as Commercial area, public/semi-public areas

of Eco City. Besides this, Greater Mohali Area Development Authority

(GMADA) being responsible for city level development activities on behalf of

Govt. of Punjab, has proposed a city level Sewage Treatment Plant for

Master Plan of Mullanpur, along which the provision of guard pond will be

kept. He also stated that it has been proposed to construct a treated

wastewater storage tank of capacity 6 MLD and the same will be divided into

appropriate size to use it as a guard pond.

2. A 30 m wide green buffer will be provided between the project site and

Truck Terminal site on the side of Truck Terminal since the same is to be

developed by GMADA.

3. The estimated generation of MSW is 24.75 MT/Day (450 gms/person/day),

which will be collected from house to house and segregated at source. Two

sites have been earmarked in the layout plan for temporary storage of the

same. The GMADA is in the process of developing Integrated Municipal Solid

Waste Management facility in the revenue estate of Village Samgauli, District

SAS Nagar. In the said facility the solid waste will be converted into RDF,

compost, recyclable waste and inert waste. The proposal for generation of

bio-gas from municipal solid waste at site was looked into and not found

feasible. Further, there is already a proposal to produce compost from the

biodegradable component of the solid waste at the Integrated Municipal

Solid Waste Facility to be developed at Village Samgauli, Tehsil Dera Bassi,

District SAS Nagar.

4. About 1.5 acre of land area has been earmarked for installation of STP of 6

MLD capacity.

5. The ultimate MSW generation from Eco city is estimated to be 24.75 MT/Day

(450gms/person/day), which will be collected from door to door and waste

will be segregated at source itself. The MSW collection in the Eco-city is

proposed to be conducted in a two stage process. The primary collection

system will take care of collecting solid waste from street sweepings and

door to door waste collection from Residential and Commercial areas by

Municipal workers/private workers and disposed off in near by dustbins or

secondary collection point. GMADA has proposed two secondary collection

points, which have been shown in the layout plan.

6. Ambient Air Monitoring has been carried out at a distance of about 200 m

from Kurali Road, the analysis results of which reveal that the concentration

of various parameters, such as PM2.5, PM10, SO2, NO2, CO and NH3 is within

the prescribed standards. The ambient noise level was also monitored during

day time at the said site and the same has been measured as 54.8 dB(A) leq

against the prescribed standards of 55 dB(A) leq.

The Committee further observed that the project proponent has

provided adequate and satisfactory clarifications of the observations raised by it,

therefore, the Committee awarded 'Silver Grading' to the project proposal and

decided to forward the case to the SEIAA, with the recommendation to grant

environmental clearance to the project proponent for plotted accommodation in an

area of 412 acres, subject to the following conditions in addition to the proposed

measures:

PART A – Specific conditions

I. Construction Phase

I. “Consent to establish” shall be obtained from Punjab Pollution Control Board under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974 and a copy of the same shall be submitted to the Ministry of Environment & Forests / State Level Environment Impact Assessment Authority before the start of any construction work at site.

II. All required sanitary and hygienic measures should be in place before starting construction activities and to be maintained throughout the construction phase.

III. A first aid room will be provided in the project both during construction and operation phase of the project.

IV. All the topsoil excavated during construction activities should be stored for use in horticulture / landscape development within the project site.

V. Disposal of muck during construction phase should not create any adverse effect on the neighboring communities and be disposed off after taking the necessary precautions for general safety and health aspects of people with the approval of competent authority.

VI. Construction spoils, including bituminous material and other hazardous material, must not be allowed to contaminate watercourses and the dump sites for such material must be secured, so that they should not leach into the ground water.

VII. The diesel generator sets to be used during construction phase should be of low sulphur diesel type and should conform to the provisions of Environment (Protection) Act, 1986 prescribed for air and noise emission standards.

VIII. Vehicles hired for bringing construction material to the site and other machinery to be used during construction should be in good condition and should conform to applicable air and noise emission standards.

IX. Ambient noise levels should conform to prescribed standards both during day and night. Incremental pollution loads on the ambient air and noise quality should be closely monitored during construction phase.

X. Fly ash should be used as construction material in the construction as per the provisions of Fly Ash Notification of September, 1999 and as amended on August, 2003 (This condition is applicable only if the project is within 100 Km of Thermal Power Station).

XI. Ready mixed concrete should be used in building construction as far as possible.

XII. Water demand during construction should be reduced by use of premixed concrete, curing agents and other best practices.

XIII. Separation of drinking water supply and treated sewage supply should be done by the use of different colours.

XIV. Adequate steps shall be taken to conserve energy by limiting the use of glass, provision of proper thermal insulation and taking measures as prescribed under the Energy Conservation Building Code.

XV. The approval of competent authority shall be obtained for structural safety of the buildings due to earthquakes, adequacy of fire fighting equipments etc. as per National Building Code including protection measures from lightning.

XVI. Provision shall be made for the housing of construction labour within the site with all necessary infrastructure and facilities such as fuel for cooking, mobile toilets, mobile STP, disposal of waste water & solid waste in an environmentally sound manner, safe drinking water, medical health care, crèche etc. The housing may be in the form of temporary structures to be removed after the completion of the project.

II. Operation Phase

I. The installation of sewage treatment plant (STP) and adequacy of disposal system should be certified by Punjab Pollution Control Board and a report in

this regard should be submitted to the Ministry of Environment & Forests/State Level Environment Impact Assessment Authority before the project is commissioned for operation. The discharge of treated sewage shall conform to the norms and standards prescribed by Punjab Pollution Control Board for such discharges. The project proponent shall not discharge any treated/untreated wastewater outside its premises under any circumstances.

II. The project proponent shall provide electromagnetic flow meter at the outlet of the water supply, outlet of the STP and any pipeline to be used for re-using the treated wastewater back into the system for flushing and for horticulture purpose/green etc. and shall maintain a record of readings of each such meter on daily basis.

III. Adequate & appropriate pollution control measures should be provided to control fugitive emissions to be emitted within the commercial complex.

IV. Adequate treatment facility for drinking water shall be provided, if required.

V. Rainwater harvesting for roof run-off should be implemented. Before recharging the roof run-off, pretreatment must be done to remove suspended matter, oil and grease. However, no run off from gardens/green area/roads/pavements shall be connected with the ground water recharging system.

VI. The solid waste generated should be properly collected and segregated. The recyclable solid waste shall be sold out to the authorized vendors and inerts shall be sent to disposal facility. The Bio-degradable solid waste shall be adequately treated as per the scheme submitted by the project proponent. Prior approval of competent authority should be obtained, if required.

VII. Hazardous waste/E-waste should be disposed off as per Rules applicable and with the necessary approval of the Punjab Pollution Control Board.

VIII. The green belt design along the periphery of the plot shall achieve attenuation factor conforming to the day and night noise standards prescribed for residential land use. The open spaces inside the plot should be suitably landscaped and covered with vegetation of indigenous species/variety.

IX. The project proponent should take adequate and appropriate measures to contain the ambient air quality with in the prescribed standards. The proposal regarding mitigation measures to be taken at site should be submitted to the Ministry of Environment & Forests/ State Level Environment Impact Assessment Authority within three months.

X. Incremental pollution loads on the ambient air quality, noise and water quality should be periodically monitored after commissioning of the project.

XI. Application of solar energy should be incorporated for illumination of common areas, lighting for gardens and street lighting in addition to provision for solar water heating.

XII. Traffic congestion near the entry and exit points from the roads adjoining the proposed project site must be avoided. Parking should be fully internalized and no public space should be utilized.

XIII. A report on the energy conservation measures conforming to energy conservation norms finalized by Bureau of Energy Efficiency should be prepared incorporating details about machinery of air conditioning, lifts, lighting, building materials, R & U Factors etc. and submitted to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA in three months time.

XIV. Environment Management Cell shall be formed during operation phase which will supervise and monitor the environment related aspects of the project.

PART B – General Conditions : i) This environmental clearance will be valid for a period of five years from the

date of its issue or till the completion of the project, whichever is earlier.

ii) The environmental safeguards contained in the application of the promoter / mentioned during the presentation before State Level Environment Impact Assessment Authority/State Expert Appraisal Committee should be implemented in letter and spirit.

iii) The entire cost of the environmental management plan (i.e. capital cost as well as recurring cost) will continue to be borne by the project proponent until the responsibility of environmental management plan is transferred to the occupier/residents society under proper MOU after obtaining prior permission of the Punjab Pollution Control Board.

iv) The project proponent shall also submit six monthly reports on the status of compliance of the stipulated EC conditions including results of monitored data (both in hard copies as well as by mail) to the respective Regional office of MoEF, the Zonal Office of CPCB and the SPCB/SEIAA.

v) Officials from the Regional Office of Ministry of Environment & Forests, Chandigarh / State Level Environment Impact Assessment Authority / State Level Expert Appraisal Committee / Punjab Pollution Control Board who would be monitoring the implementation of environmental safeguards should be given full cooperation, facilities and documents / data by the project proponents during their inspection. A complete set of all the documents submitted to State Environment Impact Assessment Authority should be forwarded to the CCF, Regional Office of Ministry of Environment & Forests, Chandigarh/State Level Environment Impact Assessment Authority.

vi) In the case of any change(s) in the scope of the project, the project would require a fresh appraisal by State Environment Impact Assessment Authority.

vii) Separate distribution pipelines be laid down for use of treated effluent / raw water for horticultural/gardening purposes with different colour coding.

viii) All other statutory clearances such as the approvals for storage of diesel from Chief Controller of Explosives, Fire Department, Civil Aviation Department, Forest (Conservation) Act, 1980 and Wildlife (Protection) Act, 1972 etc. shall be obtained, by project proponents from the competent

authorities including Punjab Pollution Control Board and from other statutory bodies as applicable.

ix) The project proponent should advertise in at least two local newspapers widely circulated in the region, one of which shall be in the vernacular language informing that the project has been accorded environmental clearance and copies of clearance letters are available with the Punjab Pollution Control Board. The advertisement should be made within seven days from the day of issue of the clearance letter and a copy of the same should be forwarded to the Regional Office, Ministry of Environment & Forests, Chandigarh.

x) These stipulations would be enforced among others under the provisions of Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environmental (Protection) Act, 1986, the Public Liability (Insurance) Act, 1991 and EIA Notification, 2006.

xi) Environmental clearance is subject to final order of the Hon'ble Supreme Court of India in the matter of Goa Foundation Vs. Union of India in Writ Petition (Civil) No. 460 of 2004 as may be applicable to this project and decisions of any competent court, to the extent applicable.

xii) A copy of the clearance letter shall be sent by the proponent to concerned Panchayat, Zilla Parishad/ Municipal Corporation, Urban local body and the local NGO, if any, from whom suggestions / representations, if any, were received while processing the proposal. The clearance letter shall also be put on the website of the Company by the proponent.

xiii) The proponent shall upload the status of compliance of the stipulated EC conditions, including results of monitored data on their website and shall update the same periodically. It shall simultaneously be sent to the Regional Office of MoEF, the respective Zonal Office of CPCB and the SPCB. The criteria pollutant levels namely; PM2.5, PM10, SO2, NOx , CO, Pb, Ozone (ambient air as well as stack emissions) shall be monitored and displayed at a convenient location near the main gate of the company in the public domain.

xiv) The project proponent shall adhere to the commitments made in the Environment Management Plan and Corporate Social Responsibility.

xv) The GMADA shall construct proper drainage system for the surface run-off and no sewerage system will be connected with the storm water drain.

xvi) The guard pond shall be constructed as proposed in the project proposal and its capacity shall be decided by the Punjab Pollution Control Board.

xvii) The allotment letter to the individuals must contain the proposal regarding use of treated wastewater for flushing purpose and horticulture within their premises.

xviii) The GMADA shall construct 30 m wide green buffer between the project and Truck Terminal site.

xix) Fixtures for showers, toilet flushing and drinking should be of low flow either by use of aerators or pressure reducing devices or sensor based control in

commercial area and the residents will also be motivated to adopt the said technique in their residential houses.

xx) The State Environment Impact Assessment Authority reserves the right to add additional safeguards/ measures subsequently, if found necessary, and to take action including revoking of the environmental clearance under the provisions of the Environmental (Protection) Act, 1986, to ensure effective implementation of the suggested safeguards/ measures in a time bound and satisfactory manner.

xxi) Any appeal against this environmental clearance shall lie with the National Environment Appellate Authority, if preferred, within a period of 30 days as prescribed under section 11 of the National Environment Appellate Act, 1987.

Item No. 55.10: Application for obtaining Environmental Clearance to

establish an "Integrated Municipal Solid Waste Management Facility" at Village Jamsher, District Jalandhar and 'Engineered Sanitary Landfill Facility' in the revenue estate of Village Piplanwali, District Hoshiarpur by Municipal Corporation, Jalandhar.

The facts of the case are that:

1. The Municipal Corporation, Jalandhar has applied for obtaining Environmental

Clearance to establish an "Integrated Municipal Solid Waste Management

Facility" at Village Jamsher, District Jalandhar and 'Engineered Sanitary Landfill

Facility' in the revenue estate of Village Piplanwali, District Hoshiarpur by

Municipal Corporation, Jalandhar.

2. The case of the Municipal Corporation, Jalandhar was considered by the SEAC in

its 35th meeting held on 13.03.2010, wherein, the Committee finalized the

'Terms of Reference' and decided to convey the same to the Municipal

Corporation for preparation of the draft rapid EIA study report. Accordingly,

'Terms of Reference' were conveyed to Municipal Corporation, Jalandhar by the

SEAC vide letter no. 18464 dated 16.04.2010 after approval of the Competent

Authority.

3. The Municipal Corporation, Jalandhar vide letter no. CE/2099 dated 03.01.2012

has submitted the draft rapid EIA study report alongwith its summary report to

the Punjab Pollution Control Board for conducting public hearing. Accordingly,

the public hearings of 'Engineered Landfill Facility and Integrated Municipal

Solid Waste facility were conducted by the Punjab Pollution Control Board on

27.09.2011 and 30.09.2011, respectively. The Board has sent the proceedings

of both the public hearings to the SEIAA, Punjab vide letter no. 41032 dated

18.10.2011 and letter No. 41038 dated 18.10.2011.

4. The Municipal Corporation, Jalandhar has submitted 20 copies of final EIA

report.

5. The Commissioner, Municipal Corporation was requested by the SEAC vide letter

No. 2049 dated 16.01.2012 to attend its 55th meeting on 20.01.2012 to present

the project proposal.

6. The Commissioner, Municipal Corporation, Jalandhar vide letter dated

19.01.2012 has informed that the Corporation is in the process of preparing

presentation and collecting relevant information, due to which the Corporation

will not be in a position to present its case in the meeting fixed for 20th January,

2012 and requested to defer the case to the next meeting of SEAC.

After discussions in the matter, the SEAC agreed to accept the

request of the Commissioner, Municipal Corporation, Jalandhar made vide letter

dated 19.01.2012 and decided to defer the case to the next meeting.
