The 135th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education (NCTE) was convened on 17th – 18th June, 2012 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar, Nayapalli, Bhubaneswar.

The institution has applied online for D.E.C.Ed and changed the course name to D.El.Ed in its all replies without any request for the change of course. The VT was constituted for D.E.C.Ed programme. The VT team has also suggested to the institution to approach NCTE for the confirmation of the course. 2. The institution has not submitted any request for the change of course name to D.El.Ed, instead it started mentioning the D.El.Ed in place of D.E.C.Ed. As the Norms for the above courses are different, the decision of selected course is significant. In view of the above the committee decided as under:The institution should submit an affidavit regarding the change of course name to the committee for taking appropriate action.

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules,Regulations and guidelines issued by NCTE HQr and VTR Report the Committee discussed the matter in detail and observed as under:1. The application was rejected on the ground of negative recommendation of state government stating that building was not constructed as per building plan. The institution preferred appeal against the rejection order, the appeal committee remanded back the case to ERC for inspection. Inpection was conducted on 11 Jun 2012. The VT Report recommended for the grant of recognition.2. At the time of rejection on single ground of negative recommendation, the scruitiny for other deficiencies was not required. Now for further processing as per regulation the documents still required are as under:

a. The submitted Building Plan is approved by Pradhan which is to be approved by the government civil engineer.

b. The submitted Building completion certificate is issued by pradhan which is to be approved by the competent civil authority.

c. Non Encumbrance certificate issued by SDO or SD LRO not submitted.d. Land is in the name of individual (Miss Samapti Pramanik) as per land document. The Land should

be in the name of institution or society/truste. Notarized copy of Change of Land Use for Educational Purpose is not submitted.

In view of the above the committee decided as under:Showcause notice be issued to the institution as to why the Recognition of the institution for the applied course D.El.Ed be not refused on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 30 days before the Committee takes appropriate decision.

The applicant society filed a W.P. (C ) No. 2656/2012 befor the Hon’ble Orissa High Court, Cuttack challenging the letter No. 1526 dt. 17.01.2012 issued by the State Govt. Orissa whereby the proposal for grant of NOC by the State Government for opening B.Ed. Course was rejected. 1. ERC in its 111th meeting decided to send VT and inspection letter was issued to the institution on 27.09.2010.

2. One of the expert refused to visit to the institution due to some unavoidable circumstance, again inspection letter was issued to the institution on 21.01.2011.

3. An e-mail letter dated 28.10.2011 received from the one of VT Experts dated 28.10.2011 where the VT Expert has informed that there is some difficulties to visit the institution due to some unavoidable circumstances and the inspection was not conducted.

4. A letter dated 14.11.2011 to the institution was issued seeking clarification regarding clearance for inspection of the institution.

5. The institution vide its letter dated 10.12.2011 requested to Postpone the inspection as the President of Institution is suffering from the heart problem and needs 3 months rest.

6. A letter was issued to the institution dated 12.03.2012 informing the institution that the request of postponing inspection cannot be considered and the institution be ready for inspection at any timebut the inspection could not be conducted so far.

In view of the above the Committee is of the opinon that the delay appears to be deliberately done by institution. The postponing inspection from 21.1.2011 implies that institution is not facilitating the VT team for inspection and decided as under:Showcause notice be issued to the institution as to why the Recognition of the institution for the applied course be not refused on the above points. The committee observed that the institution has attached the same registered Sale Deed in the name of society (Code No. ERCAPP867) and (Code No. ERCAPP1048) for both the applications there by misleading the ERC.In view of the above the committee decided as under:The both the applications ERCAPP867 and ERCAPP1048 for the applied course B.Ed. be summarily rejected.

In view of the above the committee decided as under:Showcause notice be issued to the institution as to why the Recognition of the institution for the applied course be not refused on the above points. The Committee therefore, provides an opportunity under section 14(3)(b) of the NCTE Act 1993 to the institution to submit its reply within 30 days before the Committee takes final decision
