The 192nd

Meeting of the Eastern Regional Committee (ERC), National Council for Teacher

Education (NCTE) was convened on 27th – 28

th July, 2015 at Conference Hall, ERC, NCTE, 15, Neelakantha

Nagar, Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the

time of the 192nd

ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them

about the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the

permission of Chairperson, Shri Chandrapida Neelap (Convener) presented the Agenda before the Committee

for its due consideration and appropriate decision.

While confirming the minutes of 191st meeting the Committee decided that the file

Code No.ERCAPP1687 be rectified and be considered as per 192nd

meeting minutes

of Sl.No.5 and item No.192.5.2.

(i) The Committee has suggested to prepare Data Bank of the Teachers.

(ii) Further the Committee has suggested that all the institutions be

informed to install the Fire Safety Equipment and submit the Fire

Safety Certificate if not submitted earlier.

ATTENTION!

1. The committee unanimously decided that the institution may reply in response to

the decision of the committee uploaded on the ERC website without waiting formal

letters from the office of ERC. The replies so received will also be considered by

the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website for detail).

3. The institution need to submit list of 10 schools for internship and school based

activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of units

either one or two if it was not submitted earlier.

5. The institution shall comply with the additional facilities required (additional built-

up area, additional staff, additional funds etc) for the SECOND UNIT as

prescribed in NCTE (Recognition Norms and Procedure) Regulations 2014 before

31.10.2015.

6. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers any

course or training in Teacher Education without obtaining recognition or

permission under this Act, the qualification in teacher education obtained pursuant

to such course or training or after undertaking a course or training in such

institution, shall not be treated as a valid qualification for purposes of employment

under the Central Government, any State Government or University, or in any

school, college or other educational body aided by the Central Government or any

State Government.

Regulations and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed

as under:

The ERC in its 181st meeting held on 18-19 February 2015 considered the case of the said

institution and as decided a letter was issued to the institution vide no.30622 dated 01.03.2015 on the

following grounds.

(i) Letter to the institution was issued on 20.12.2013 regarding constitution of VT after

submission of original FDRs of Rs. 5 lakhs and Rs. 3 lakhs. No reply received from

the institution till date.

(ii) The institution has not submitted an affidavit and willingness to adhere to the new

Regulation 2014 along with the balance amount of Rs. 4 lakhs towards Reserve fund.

The committee was decided that VT be constituted after the institution submits an affidavit &

willingness for required units of the proposed B.Ed. course and the balance amount of Rs. 4.00 lakh

towards reserve fund.

No reply received from the institution till date so far.


Show cause notice be issued to the institution as a last chance.

The ERC in its 189th meeting held on 27-28 May 2015 considered the matter of the said

institution and as decided by ERC, a show cause notice to the institution was issued

vide no. 32892 dated 19.06.2015 on the following grounds.

“As per decision of 181st ERC Meeting, a letter to the institution was issued

vide No.30633 dated 01.03.2015 on the following grounds:

“VT be constituted after the institution submits an affidavit and willingness

for required units of the proposed B.Ed. course as per new Regulation 2014

along with the balance amount of Rs.4 lakhs towards Reserve fund”.

Reply from the institution in response to ERC’s letter dated 01.03.2015 not received till date”.

Reply from the institution in response to ERC’s SCN dated 19.06.2015 not received till date.


Show cause notice be issued to the institution as last chance.

Lalit Narayan Janta College, Plot No.-5577, Vill/PO/City- Jhanjharpur,

Tehsil/Taluka- Jhanjharpur, Dist.- Madhubani, Bihar- 847404 (B.Ed.)

After considering the records available in the file, and relevant provisions of the NCTE Act 1993, Rules, Regulations

and guidelines issued by NCTE Hqrs., the Committee discussed the matter in detail and observed as under:

The ERC in its 179th

meeting held on 22-23 January 2015 considered the matter of the said

institution and as decided by ERC, a letter to the institution was issued vide No.30145

dated 31.01.2015.

“As per decision of 169th

ERC meeting, VT will be constituted after

receiving NOC from the State Govt. or completion of

recommendation/reminder period.

As per record, letter to State Govt. for recommendation of the

institution was issued on 28.11.2013 and followed by reminder was issued on

10.02.2014. The recommendation from the State Government has not been

received so far and the stipulated period has already been over.

The institution has not submitted its consent/willingness to process the

application as per NCTE Regulation 2014 till date.

In view of the above, the committee decided VT be constituted after

receiving the consent/willingness in the stamp paper of Rs.100/- and balance

amount of Rs. 4.00 lakh towards reserve fund in the name of the institution”.

No reply received from the institution in response to letter dated 31.01.2015 till date.

The Principal of the institution has submitted a representation dated 11.02.2015 received in

this office on 24.02.2015 stated that the institution is unable to pay such a heavy/raised amount and

requested to refund the deposited F.D. amount and the importance papers and documents at the

earliest.


As per the request of the Principal, the file be closed and documents / FDRs be returned.

The ERC in its 185th

meeting held on 10-11 April 2015 considered the matter of the said

institution and as decided by ERC, a show cause notice to the institution was issued

vide No.31319 dated 22.04.2015.

“As per decision of 167th

ERC Meeting, deficiency letter to the institution was

issued vide no.23626 dated 07.02.2014 on the following grounds.

(a) Documents related to land not submitted by the institution. The institution

is required to submit the original certified copy of registered land

document.

(b) Building plan duly approved by Govt. Engineer mentioning the plot No.,

Khata No., total area & showing the extended built up area for proposed

additional intake of D.El.Ed Course in the existing institution -Not

submitted.

(c) As per application form, it is mentioned that the total built up area is 1790

Sq. Mts. for additional intake of existing D.El.Ed. Course, which is less

than the required 2000 Sq. Mts. as per NCTE norms.

(d) In response to ERC letter dated 29.12.2014, the institution has not

conveyed its willingness for processing of the application for the proposed

D.El.Ed. (Addl. Intake) course.

Reply from the institution in response to show cause notice dated 22.04.2015

not received till date.

In view of the above time Committee decided as under:

Final show cause notice be issued to the institution to comply the above within 30 days and copies be endorsed

to the Director, SCERT and MHRD for information and necessary action.

existing D.El.Ed. Course with an additional intake 50 (additional one basic unit) from the academic session

2016-2017 may be issued to the institution.

Letter to state Govt. to improve infrastructural facilities, instructional facilities, library facilities and

appointment of staff on regular basis as per new Regulations 2014 before the commencement of the

programme.

The institution has submitted its reply dated 08.07.2015 in response to ERC show cause notice

dated 19.06.2015. However the following deficiencies are not complied by the institution:

(i) Certified copy of the registered land documents from the competent authority not

submitted.

(ii) Approved building plan by the competent Govt. civil authority for proposed course

mentioning the plot no., total area, built up area and sizes of rooms, class rooms, and

multipurpose hall and other details not submitted.

(iii) Affidavit in the prescribed form on Rs.100/- stamp paper duly attested by Oath

Commissioner or Notary Public stating the precise location of the land (village, district,

state etc), the total area in possession, the permission of the competent authority to use the

land for educational purposes and mode of possession i.e. ownership or lease not

submitted.

(iv) Enclosure as per col. 5 of the affidavit regarding use of land for educational purpose from

the competent Govt. authority not submitted.


Reminder letter be issued to the institution to comply the deficiencies within 30 days.

Copy of the letter be sent to the State Govt. for information and necessary action.

Ranaghat Teachers Training College, Plot No. 38, 43, St. No.-Monmohini,

and as decided show cause notice was issued vide No.32843 dated 11/06/2015 for the following

points.:

“As per the decision of 181st meeting Show Cause Notice issued

vide No. 30619 dated 01.03.2015 to the institution on the following grounds:

1) Land possession/ Mutation certificate from the competent Govt. authority not

submitted.

2) Approved building plan by the competent Govt. civil authority for proposed

course mentioning the plot no., total area, built up area and sizes of rooms, class

rooms, and multipurpose hall and other details not submitted.

3) Site plan showing the contiguity of the plots and issued by Land Revenue Officer

not submitted.

4) Notarized copy of change of land use certificate issued by the competent

5) Non- encumbrance certificate issued by Prodhan, Nawapara Masunda Gram

Panchayat on 27.02.2014 and not from the competent authority.

6) The institution has not submitted the balance amount of Rs. 4 lakhs towards

reserve fund as per new Regulation 2014.

The ERC in its 189th meeting held on 27-28 May 2015, considered the case of the institution

and as decided by ERC, a show cause notice was issued vide No.32845 dated 11/06/2015 for the

following points:

“As the letter dtd. 31.01.2014 from the Additional District Magistrate regarding the

field verification report of lands of both institution namely Renuka Debi B.Ed. college and

D.Ed. college stated that:

“The lands in question for both of the institution are not well demarcated by the

college authority by fencing or boundary wall plot no. 255 of mouza – Shyamanagar, J.L. No.

47, P.S. Tehatta measuring an area of 43 decimal and the plot no. 256 of the aforesaid mouza

measuring an area of 57 decimal have been recorded in favour of Secretary. Renukadevi

Memorial trust. But Plot no. 254 has not been recorded in favour of the two institutions or

trust. The name of some “Raiyats”are found recorded on the land in question.

1) Certified copy of the registered land document not submitted.

2) Land possession Certificate/Mutation certificate by the competent authority/

SDO: Not submitted.

3) Approved building plan by the competent civil authority/ SDO: Not submitted
