CBJ Land Sale No. 20-124 CBJ Lottery and Land Sale for Pederson Hill Phase 1A The City & Borough of Juneau is pleased to offer 17 single‐family lots for sale in the Pederson Hill Subdivision. These Mendenhall Valley lots are accessed via Karl Reishus Boulevard, across Glacier Highway from Sherwood Lane. The lots will be sold by a fixed price lottery and a sealed competitive bid. The City & Borough of Juneau is pleased to offer 17 single‐family lots for sale in the Pederson Hill Subdivision. These Mendenhall Valley lots are accessed via Karl Reishus Boulevard, across Glacier Highway from Sherwood Lane. The lots will be sold by a fixed price lottery and a sealed competitive bid. GENERAL CONDITIONS

The CBJ received final plat approval from the Planning Commission on October 10, 2017. Plat number 2019‐34, recorded document number

2019‐004503‐0.

All the lots being sold in this sale will be conveyed via Quitclaim Deed.

The CBJ will convey its property subject to all exis ng reserva ons of record (for example easements).

The CBJ received a Army Corps of Engineers fill permit, POA‐2016‐206 (Casa Del Sol Creek), for the Pederson Hill development. The permit is available online at www.juneau.org/lands, under “Land Sales.” The permit allows fill to be placed anywhere on all lots being sold in this land sale. Most of the lots have already been filled in accordance with this permit.

Purchasers are responsible for properly loca ng improvements on their property and obtaining all necessary permits. Improvements must comply with all building setback requirements and all other applicable federal, state, and local regula ons and permit requirements. Contact the CBJ’s Community Development Department at (907) 586‐0715 for informa on about setbacks and zoning regula ons that apply to individual parcels.

IMPROVEMENTS

Poten al bidders should physically inspect the property, prior to placing their bids, to ensure the property sa sfactorily meets their needs and development goals.

As apart of this subdivision’s development, the CBJ installed water, electric, sewer, cable, and telephone u li es to each lot.

Purchasers of CBJ property in this sale will be responsible for paying all closing costs.

Purchasers of CBJ land are required to obtain tle insurance. The CBJ will provide a list of tle insurance companies upon a successful bid or winning a lo ery lot.

The CBJ has made its best effort to include descrip ons of condi ons and restric ons that might be of interest to poten al bidders. There might be other restric ons and condi ons not included in the list below that apply to the subdivision lots. Poten al bidders are encouraged to consult tle and legal specialists for any advice on these ma ers.

Lot 1: There is an access easement that runs through Lot 1 which serves the neighboring lot occupied by Christ Evangelical Lutheran Church. The curb cut for the access easement shall be used as the driveway access for this lot.

WETLANDS

The CBJ applied for and received a wetlands fill permit for the en rety of Pederson Hill phases 1A through 1C, no addi onal fill permits will be re‐quired. With this fill permit, the parcels being offered in this land sale do not need any addi onal approval to place fill on these lots. As part of this per‐mit, the CBJ has set aside Phase 1A, Lot 9 for habitat conserva on. Lot 9 consists of high value wetlands with stunted shore pine, western hemlock and Sitka spruce, deer cabbage and skunk cabbage. The water table is within 12 inches of the surface and there is more than 16 inches of saturated peat over the en re lot. As part of the conserva on strategy of this lot, the City will con nue to monitor this property and enforce the conserva on status.

Purchasers may elect to either make a lump sum payment for parcels bought in the sale or elect to use CBJ financing.

Under CBJ financing, purchasers must make a down payment equal to at least 10% of their bid which will be due at closing, paying the balance owed over a period of 10 years in annual, quarterly, or monthly payments at an interest rate of 10%. There is no prepayment penalty but loans will not be re‐amor zed with extra payments.

The CBJ reserves the right to direct loan payments to a bank of its choice. In that event, purchasers using the CBJ’s financing op on will be responsible for paying the bank service fees, if any.

The CBJ will not subordinate its security interest to other lenders. No purchaser may sell or assign his or her interest in a parcel un l the CBJ has been paid in full. 

 

Purchasers are responsible for all costs at closing and obtaining tle insurance.

The CBJ will be responsible for recording the deeds and deed of trust documents.

1. All par cipants must submit the CBJ “Registra on Form” provided for this sale. Registra on forms must be received the day before the lo ery by 4 p.m. on December 9th.  The form must be filled out in its en rety. Photocopies of the form are acceptable.

2. More than one name may appear on a registra on form, but all of those named on the bid must meet the bidder qualifica ons. All names appearing on the registra on form must be the same as those names that will, ul mately, appear on the deed issued by the CBJ. No names may be added to or deleted from the deed. For example, if a par cipant wants a spouse’s name to be included on the deed, the bidder must ensure that the spouse’s name is on the registra on form.

3. Each registra on form must be accompanied by a registra on fee of $15.00

4. Registra on forms will be accepted only at the CBJ Lands Office. Registra on forms may be mailed or hand‐delivered. Mailed registra on forms must be date and me stamped in the CBJ Land Office the day before the lo ery by 4 p.m. on December 9th, and may be sent to CBJ Lands Office at 155 S. Seward Street, Juneau, Alaska 99801. To hand‐deliver a registra on form, go to the CBJ Office located at 105 Municipal Way, 3rd floor, Room 305. Note: the CBJ Lands Office is located in the building across the alley from City Hall, above Capital Copy.

5. Par cipates in the lo ery sale must be present at the  me of the lo ery, December 10th, 2019.  The lo ery will begin promptly at 5:30pm in Assembly Chambers located at 155 S. Seward Street

Both individuals and businesses may par cipate the CBJ lo ery sale. Individuals must be at least 18 years of age by the date of the lo ery, December  10,  2019. There is no Alaskan residency requirement for non‐business par cipants.

A business or a business en ty wan ng to par cipate in this land sale must be licensed to do business in the State of Alaska.

Those who have defaulted on a prior lo ery, auc on, over‐the‐counter or other purchases of CBJ property within the past 5 years cannot par cipate in this sale.

Par cipants in all previous land sales may par cipate in this land sale.

Any CBJ employee who performed work for the CBJ on the Pederson Hill Subdivision may not par cipate in this land sale in accordance with CBJ§01.45.040. This prohibi on extends to the employee’s spouse, dependents, and any regular member of the employee’s household. CBJ employees who are interested in par cipa ng in the land sale and are uncertain whether they might have a conflict of interest are advised to consult with the CBJ A orney prior to submi ng a bid.

Lo ery par cipants must submit lo ery registra on forms the day before the lo ery to the CBJ Lands and Resources Office on December  9th  by 4:00pm. Requirements for registering for the lo ery are described in detail on the previous page.

On December  10th  the lo ery will be held at City Hall in the CBJ Assembly Chambers located downtown at 155 South Seward Street. Parking in the City garages is free a er 5:00pm.

The lo ery will begin promptly at 5:30pm Alaska Time.

All preregistered Par cipants will be entered in the lo ery.

Par cipants must be present to win.

Married couples may par cipate as individuals but both must be present if they are par cipa ng as individuals. If a married couple is par cipa ng as a joint entry, only one person must be present to win.

Businesses par cipa ng in the lo ery must have a representa ve with signature authority present in order to par cipate.

Par cipants names will be drawn one at a me from a pool of all registered Par cipants.

When an par cipant is drawn, they will have the opportunity to select from any of the available lots.

Once an par cipant’s name is drawn, they will be taken out of the pool.

Only one lot may be awarded per Par cipant.

If a Par cipant declines to select one of the remaining lots, they will be withdrawn from the lo ery.

Once an par cipant is drawn and they have selected a lot, they will receive an Award No fica on Le er, Declara on of Intent and Agreement to Purchase.

Successful par cipants will be required to pay the appraised value listed in this brochure within 30 days. City financing is available, see page 9 of this brochure for more informa on.

The lo ery will con nue un l all lots have been selected. If there are more par cipants than lots available, two alternates will be drawn.

In the event that a winner is unable to pay for a lot, alternates will be contacted in the order they were drawn, using informa on provided on the registra on form, and given an opportunity to purchase the lot.

An alternate will have 30 days from the date of no fica on to pay for a lot .

If lots remain a er the lo ery, the City Manager will have the op on of including these proper es in future lot sales or by making them available over the counter.

The bidder must affix the bid label provided to the outside of the envelope. Please see envelope examples on page 33.  If one applicant is bidding on mul ple lots, one sealed envelope can be used to hold all the bid forms and personal checks.

7. Bids will be accepted only at the CBJ Purchasing Office. Bids may be mailed or hand‐delivered. Apparent high bidders must respond to the CBJ by 4:00 p.m., Alaska Time, 

March 20, 2018 with their down payments,

administra on fees, and completed paperwork.

For each parcel, the qualified bidder having the highest bid amount will be named the apparent high bidder. Acceptable bids must be for at least the minimum bid price listed for each parcel in this sales brochure. If there are two or more iden ‐cal high bids, the apparent high bidder will be determined by lo ery.

Apparent high bidders will be sent an “Award No fica on” le er by cer fied mail. The le er shall provide the successful bidders un l Tuesday, January 21, 2020, 4:00 p.m., Alaska Time, to submit the following:

Completed Declara on of Intent and Agreement to Purchase form;

A non‐refundable $150 document handling fee in the form of a personal check;

A down payment equal to at least ten percent of the bid amount. The $500 ear‐nest money submi ed with the bid shall be applied toward the down payment;

If a business or business en ty: proof of current license in the State of Alaska, and signatory authority of the person submi ng the bid; and

Any other documents or items required in the Award No fica on le er.

If an apparent high bidder fails to comply with the requirements in the award no fica‐

on le er, or complies a er the January  21,  2020  deadline, the bidder shall forfeit the $500 earnest money and all rights to the parcel, and the second highest bidder will then be awarded the opportunity to purchase the parcel for the amount stated in his/her bid. The same bid award procedure and requirements will apply.
