Featured Real Estate Article: Ground Rent: New Legislation

What is ground rent? Ground rent is a regular payment required under a lease from the owner of leasehold property, payable to the freeholder. In laymanʼsʼ terms, a ground rent exists when, at some point in the past, the owner of a property separated the structure/building from land upon which it sits. Essentially, the current owner of the structure leases the land below their home, and pays the ground rent holder in two installments yearly (usually between $60 and $120 a year). When the owner of the structure sells the property, the new owner then assumes the payments to the ground rent holder. Since many of the ground rents are 100+ years old, you can imagine how many lay languishing, and what a nightmare this created for title companies and owners alike! What has changed? As of September 29th, 2010 all ground rents were required by law to be registered with the Department of Assessments and Taxation. Failure to register ground rents by that date caused them, in most cases, to be extinguished by operation of law. Owners of improved property located on land subject to an unregistered ground lease will no longer be responsible for paying the associated ground rent. They will also be able to seek a declaration from the Department stating that the ground rent is no longer valid. However, this may create tax implications so owners seeking this declaration should check with their financial advisors before hand.

Does this apply to all ground rents? No. Owners of so-called “irredeemable ground rents” or ground leases that were created prior to April 9, 1884 have until December 31, 2010 to register their intent to keep their ground lease irredeemable. Additionally, the statute allows for a ground lease owner who is under a legal disability (under the age of 18 or mentally incapacitated) to register the ground rent within three years after the termination of the disability. In other words, the statute allows for an otherwise extinguished ground lease to be resurrected in this one narrow circumstance.
