OrdinanceNo.AN ORDINANCEOF THECITY OF OLYMPIAV WASHINGTON,RELATINGTOCREATIONOF THEOLYMPIAMETROPOLITANPARK DISTRICTWITHBOUNDARIESCOEXTENSIVEWITH THECITY; REQUESTINGTHAT ANELECTION BE HELDCONCURRENTWITHTHE NOVEMBER3, 201,5GENERALELECTION,FORSUBMISSIONTO THE VOTERS RESIDING WITHIN THECITY, APROPOSITIONTOFORMTHE OLYMPIAMETROPOLITANPARK DISTRICT.WHEREAS,the OlympiaCity Councilfinds there is a needto createa stablefundingsource for themaintenanceand acquisitionof parksandother recreation facilities andprogramsto servethe residentsof Olympia; andWHEREAS,Chapter35,61RCW andotherstatelaw providesthat a metropolitan park district(MPD)maybe createdupon voter approvalof a ballotpropositionsubmittedto the votersof the proposeddistrict,andthat a metropolitanparkdistricthas ceftainstatutorypowers,includingthe powerto levy andimposevarious taxes and fees to generaterevenuesto provide ongoingfundingto maintain,operate, construct,improveandacquire parks,communitycenters,athletic fieldsandotherrecreationfacilities;andWHEREAS,the OlympiaCityCouncil finds thatit is in thebestinterestsof residentsof Olympiato submitto the voters a ballotpropositionto createa metropolitanpark district, to be called theOlympiaMetropolitan Park District, that includes the entire areawithinthe boundariesof the City of Olympia;NOW,THEREFORE,THEOLYMPIA CITY COUNCILORDAINSAS FOLLOWS:Section 1.Election - Ballot Title. TheOlympia City Council directs theCity Clerkto file thisOrdinance with theAuditor of ThurstonCounty, Washington I as ex officiosupervisor of elections' TheCityClerkshall request that theAuditor calland conductin the City of Olympiaan electionto be heldonNovember3, 201i,for the purposeof submitting to the voterswithin the boundariesof the City ofOlympia (whichare the boundariesof the proposeddistrict)a propostion to formthe Olympiautropolitn park District as authorizedunderChapter35.61 RCW.The CiW Clerkis directedto cedifytotheAuditorof Thurston County, Washington, a ballottitle in substantially the followingform, withsuchchangesas may be approved by theCityAttorney:THECITY OF OLYMPIAPROPOSMONNUMBER 1OLYMPIAMETROPOLITANPARKDISTRICTTheCity of Olympia PropositionNumber1 concernsformationof the OlympiaMetropolitan ParkDistrict,a metropolitan parkdistrict.This propositioncreates the OlympiaMetropolitanParkDistrictto provideongoingfunding to acquire, maintain,operateand improve parks,Percival Landing,andotherrecreation facilitiesand programs.The District has thesame boundariesas theCityofOlympia,be governedby a Board composedof OlympiaCity Councilmembers, andexercises powersgivento metropolitan park districtsin statelaw, includinglevyingpropefitaxes andcontracting withtheCityof Olympiato performDistrictfunctions'1[ ] Forthe formationof a metropolitanpark districtto be governedby themembersofthe OlympiaCityCouncilservingin an ex officiocapacityas the BoardofCommissionersof the OlympiaMetropolitan ParkDistrict.[ ] Againstthe formationof a metropolitanpark district.Section2.Boundariesof the OlympiaMetropolitanPark Districtand CompositionofGoverninqBoard.The boundariesof the Olympia MetropolitanParkDistrictwill be coterminouswiththe boundariesof the City of Olympia, Initiallythe Board will be composedof theelectedCityCouncilmembersof the Cityof Olympia, who willbe designatedto serve in an ex officio capacityas theBoard of metropolitanpark districtcommissioners,Section 3. Ratification.TheCityClerk's certification to the Auditor of ThurstonCounty,Washingtonofthe propositionin Section1 aboveand anyotheractstaken afterthe passageof thisOrdinance andconsistentwithits authority,are herebyratified andconfirmed.Section 4. SeverabiliW. If any provisionof this Ordinanceor its applicationto any person orcircumstanceis heldinvalid,the remainderof theOrdinanceor applicationof the provisions to otherpersons or circumstancesshallremain unaffected.Section5.EffectiveDate.
