New York City Transit Coney Island Rail Yard Boiler Plant Upgrade Public Participation Plan ~ 1 ~ May 2012 CERTIFICATION DOCUMENT Introduction New York City Transit (NYCT), an agency of the Metropolitan Transportation Authority (MTA), is proposing to replace three existing boilers located at the Coney Island Rail Yard in Brooklyn, New York. The existing dual-fuel fired boilers (natural gas and #2 fuel oil) are old and beyond repair. NYCT is proposing to replace the existing boilers with three new factory- built dual-fuel fired 24.5 million BTU/hour rated boilers (2 operating, 1 spare). The proposed new units have higher energy efficiency, lower emissions and higher reliability. As part of NYCT’s permitting application to the New York State Department of Environmental Conservation (NYSDEC) to modify the existing Title V Facility Air Permit— to include the operation of the three new permanent boilers as well as the temporary and portable boilers to be used at the Coney Island Rail Yard boiler plant during the construction and installation of the new permanent boilers—a draft Public Participation Plan (PPP) was prepared in accordance with Commissioner Policy-29 Environmental Justice and Permitting (CP-29). The draft PPP was submitted to NYSDEC for review in March 2012 (further updated in April 2012) and NYCT was directed to proceed with the outreach plan pursuant to the submitted draft PPP. By issuing this Public Participation Plan Certification Document, NYCT concludes the public participation aspect of the Title V Facility Air Permit Modification Application, and certifies that the requirements and tasks described in the project’s draft PPP have been completed. The remainder of this document describes how the public participation and outreach tasks outlined in the draft PPP (April 2012) were completed. CERTIFICATION DOCUMENT Introduction New York City Transit (NYCT), an agency of the Metropolitan Transportation Authority (MTA), is proposing to replace three existing boilers located at the Coney Island Rail Yard in Brooklyn, New York. As part of NYCT’s permitting application to the New York State Department of Environmental Conservation (NYSDEC) to modify the existing Title V Facility Air Permit—to include the operation of the three new permanent boilers as well as the temporary and portable boilers to be used at the Coney Island Rail Yard boiler plant during the construction and installation of the new permanent boilers—a draft Public Participation Plan (PPP) was prepared in accordance with Commissioner Policy-29 Environmental Justice and Permitting (CP-29). Task #2 -- Identify Stakeholders and Create an Outreach Contact List Stakeholders who would potentially be affected by the operation of the upgraded boiler plant at the NYCT Coney Island Rail Yard were identified. This was done in coordination with Community Board 13 representatives, NYCT, and the consultant team. Stakeholders identified included the following groups:

• NYCT employees who work at or visit portions of the Coney Island Rail Yard facility;

• Residents/neighborhood groups who reside or are active in the vicinity of the proposed project;

• Community Boards (CBs)—Brooklyn CB11, CB13, and CB15; • Local community and civic organizations, and environmental and business

groups; • Neighborhood religious establishments; • Elected officials; and • Appropriate state and local government representatives.

The outreach contact list for the project was assembled, including names, addresses, telephone numbers and e-mail addresses (if available) of individuals and organizations (as described above) with potential interest in the proposed boiler replacement project and Title V Air Facility Permit Modification application. Appendix A: PPP, Attachment A shows the outreach contact list that was developed for this project’s draft PPP.

Task #3 -- Prepare Written Information Written information about the proposed project and the environmental permit review process was prepared for posting and distribution to the public and area stakeholders. The following written materials were prepared and made available to the public as part of this outreach effort via one or more of the following methods: postings to the NYCT project webpage, general project mailings, and hard copies for public review at the project’s seven local Document Repositories (see Task #4, below):

• Draft Public Participation Plan (PPP), April 2012 (see Appendix A) • Project Fact Sheet (bilingual—English/Spanish, see Appendix B) • Project Notice mailing and NYCT webpage Meeting Notice (see Appendix C) • Title V Permit Modification Application • Draft Title V Modification Permit • Environmental Justice Analysis • Responses to Questions/Comments made at the April 25, 2012 Public

Information Meeting (see Appendix D).

Task #4 -- Establish Document Repositories/Distribute Project Information In accordance with the April 2012 draft PPP, easily accessible document repositories were established within or near the outreach area (defined as part of Task 1, above), which are locations close to the proposed project. The locations of the project’s Document Repositories are shown in Appendix A, Attachment C, and included four (4) local libraries, the offices of Brooklyn CB11, CB13, and CB15, and the NYCT project webpage (http://www.mta.info/nyct). Additionally, project information was made

available at the Coney Island Rail Yard facility office and flyers were posted in employee meeting and notice areas.

The locations of the document repositories were included in the Project Fact Sheet that was distributed and posted on the NYCT project webpage, as well as in the Project Notice mailings. The contents of the repositories were updated regularly, and were checked to ensure that no documents were missing. A list of document contents was prepared and updated, to help keep the repositories organized.

The draft PPP (April 2012), bilingual Project Fact Sheet, Project Notice letter, Title V Air Facility Permit Modification Application, and Draft Title V Air Facility Permit Modification, and the Environmental Justice Analysis prepared for this project were all made available in advance of the April 25, 2012 Public Information Meeting, on the NYCT project webpage and at the project’s seven local Document Repositories. These project materials, in outreach binders, were hand delivered to the Document Repositories on April 13, 2012. The project mailing also occurred on April 13, 2012, and included a Project Notice letter and the bilingual (English/Spanish) Project Fact Sheet.

These materials have all been made available for public review in outreach binders at each of the project’s seven local Document Repositories, as well as on the NYCT project webpage, and will remain available until 4 months after the issuance of the Final Title V Air Facility Permit Modification, as required by NYSDEC. Responses to questions/comments made at the April 25, 2012 Public Information Meeting, as well as the Final Title V Air Facility Permit Modification, and this PPP Certification Document will also be included in the materials available for public review on the NYCT project webpage and at the Document Repositories once NYSDEC has issued the Final Title V Air Facility Permit Modification, and this PPP Certification Document has been submitted to, and accepted by, NYSDEC.

Task #5 -- Conduct Public Information Meeting/Informational Briefings In accordance with the PPP, a Public Information Meeting was held to provide information about the boiler plant upgrade project and the associated NYSDEC permitting process.

The Public Information Meeting was held on April 25, 2012 at 7 PM, at the Coney Island Hospital, 2nd Floor Auditorium, located at 2601 Ocean Parkway, Brooklyn, New York 11235, a local indoor venue that is a familiar location to area residents. While this meeting was a distinct stand alone information session, it was held during a regular Community Board 13 meeting to encourage attendance by the public.

Stakeholders were invited to both of the Public Information Meetings, and NYCT and consultant team staff members were available to receive and answer questions from the public about the boiler replacement project and Title V Air Facility Permit Modification application.

Meeting logistics were publicized more than 10 days in advance of the meeting date, in order to give the public reasonable notification. The meeting notices for the April 25, 2012 meeting were published on the NYCT project webpage on April 13, 2012. A copy of the NYCT project webpage posting is included in Appendix C.

In addition, and as specified in the PPP (and described above in Task #4), Project Notices were sent to all interested stakeholders on the Contact List announcing the project’s

Public Information Meeting, and availability of information. The Project Fact Sheet (written in English and Spanish) was also sent to the local organizations and all other stakeholders identified on the Contact List for posting at those locations as part of the general mailing. Copies of the Project Notice and Project Fact Sheet were also distributed by hand, in accordance with the draft PPP, to the Coney Island Rail Yard facility office in advance of the April 25, 2012 meeting. A copy of the Project Notice for the meeting is included in Appendix C.

As specified in the draft PPP, an agenda (bilingual English/Spanish) was prepared and available for attendees at the public information meeting. The public information session for the project also appeared as the first agenda item on the CB13 general meeting agenda.

Task #6 - Prepare Participation Plan Outreach Summary/Certification Document This report satisfies Task #6 of the PPP, and serves as the public participation plan’s Certification Document, confirming that the permit applicant (in this case NYCT) has complied with the provisions of the draft PPP, and includes a written summary of the outreach conducted under the PPP.

Appendix D contains written summaries of the substantive questions/comments raised during the Public Information Meeting, and provides corresponding responses to those comments. In some cases, the responses provided at the meeting were modified or expanded upon in the summary in order to provide the public with clear and comprehensive information about the project (as indicated in Task #4, these responses to comments/questions will be made available at the Document Repositories and on the NYCT project webpage). No additional questions/comments were received by the NYCT contact person during the open comment period, which ended on May 9, 2012. Appendix D also contains the names of attendees at the Public Information Meeting (see copies of the meeting sign-in sheets). In addition, Appendix D contains copies of the Meeting Agendas for the Public Information Meeting that were prepared for the meeting attendees.

This Certification Document, including its Appendices, will become part of the permit application and will be made available to the public at the local Document Repositories and on the NYCT project webpage upon its completion, and will remain at the seven local project Document Repositories and on the NYCT project webpage for a period of 4 months after the Final SPDES Construction Dewatering and Discharge Permit is issued by NYSDEC, in compliance with NYSDEC policy.

Introduction New York City Transit (NYCT), an agency of the Metropolitan Transportation Authority (MTA), is proposing to replace three existing boilers located at the Coney Island Rail Yard in Brooklyn, New York. The existing dual-fuel fired boilers (natural gas and #2 fuel oil) are old and beyond repair. In fact, two of the three existing boilers have failed as they are beyond their useful life, and are inoperable. As a result, the boiler plant is currently being supplemented by a temporary portable boiler. NYCT would replace the existing boilers with three new factory-built dual-fuel fired 24.5 million BTU/hour rated boilers (2 operating, 1 spare). The proposed new units have higher energy efficiency, lower emissions and higher reliability.

The goals of the project are supportive of Mayor Michael Bloomberg’s goals for New York City outlined in PlaNYC, and include:

Decreasing CO2, particulate, and greenhouse gas (GHG) emissions;

Improving local air quality; and

Achieving energy efficiencies and cost savings.

The project is currently in the process of finalizing the construction contract for the installation of the new boilers. During the construction period, a 24.5 million BTU/hour rated temporary boiler and a 32.7 million BTU/hour rated temporary portable boiler would be used to provide the heat and steam needed at the yard. Once the permanent boilers are installed and being operating, the temporary and portable boilers would be shut down and removed from the site. Construction and equipment installation is slated to begin in mid-2012 with the startup of the new replacement boilers targeted for the Fall of 2012. This Public Participation Plan (PPP) is part of NYCT’s permitting application to the New York State Department of Environmental Conservation (NYSDEC) to modify the existing Title V Facility Air Permit to include the operation of the three new permanent boilers as well as the temporary and portable boilers to be used at the Coney Island Rail Yard boiler plant during the construction and installation of the new permanent boilers. In accordance with Commissioner Policy-29 Environmental Justice and Permitting (CP-29), NYSDEC requires the permit applicant to develop and execute a public participation plan targeting the local community, and conduct outreach as part of the environmental permit review process.

In contrast to the existing boilers, which do not have an NOx permit cap, the potential NOx emissions from the new replacement boilers would be capped to 24.5 tons/year. In addition, the new boilers will be equipped with low- NOx burners and will comply with all applicable air quality regulations and requirements. Total CO2 emissions from the new boilers will be less than the 25,000 metric tons per year GHG reporting threshold, and much less than the 100,000 tons per year Prevention of Signification Determination (PSD)/Title V threshold.

Public Participation Plan The draft PPP for this permit application includes a number of activities and tasks that will be undertaken to inform stakeholders about the proposed project and the Title V Permit Modification being sought from NYSDEC. This will provide stakeholders access to information about the project and permit and encourage dialogue.

Task # 1 -- Identify Affected Area

Because of the project’s location (in the existing Boiler House, off of Shell Road within the larger NYCT Coney Island Rail Yard transit property in Brooklyn), a 1-mile radius from the proposed boiler replacement site has been selected in consultation with NYSDEC staff, to ensure that outreach to an appropriate area and interested entities (stakeholders) is undertaken. This is shown in Figure 1, attached. This area will serve as an initial component in identifying stakeholders. Particular emphasis will be placed on identifying stakeholders representing the area’s minority and low-income populations for outreach during the public participation process.

Within this 1-mile radius of the proposed project site lies the entire Coney Island Rail Yard facility, an approximately 1-mile section of the Belt Parkway, and portions of the following Brooklyn neighborhoods: Homecrest in the northeastern portion, Gravesend in the northwestern portion, Brighton Beach in the southeastern portion, and Coney Island in the southwestern portion. South of the Belt Parkway and west of Ocean Parkway, the Coney Island portion of the study area is largely characterized by auto-related and parking uses, and residential uses. The Luna Park Houses are in this area, comprising a 5-building Mitchell-Lama residential cooperative complex of almost 1,600 apartments, making it one of the largest Mitchell Lama developments in the state. Additional large tracts of residential uses are located in the southwestern portion of the study area, including housing operated by the New York City Housing Authority (NYCHA). NYCT operates a subway along Stillwell Avenue. The communities of Homecrest, Gravesend, and Brighton Beach are largely residential.

Task #2 -- Identify Stakeholders and Create an Outreach Contact List

Stakeholders who may be affected by the operation of the upgraded boiler plant at the NYCT Coney Island Rail Yard will be identified. This will be done in coordination with Community Board representatives and with input from NYCT. It is expected that the stakeholders for this plan will include, but may not be limited to:

• NYCT employees who work at or visit portions of the Coney Island Rail Yard facility,

• Residents/neighborhood groups who reside or are active in the vicinity of the proposed project

• Community boards, local community and civic organizations, environmental and business groups, and any entities recommended by these groups

• Neighborhood religious establishments • Elected officials

A preliminary outreach contact list of stakeholders is being assembled, including names, addresses, telephone numbers and e-mail addresses (if available) of individuals and organizations (as described above) with a possible interest in the proposed project. This list will be updated regularly to include new stakeholders identified as the public participation process continues. The preliminary outreach contact list that has been developed to date for this plan is included in Attachment A.

Task #3 -- Prepare Written Information

Written information on the proposed action and the environmental permit review process will be prepared for posting and distribution. The following written materials will be prepared and made available to the public as part of this outreach effort:

• Project Fact Sheet (An outline of the contents of the Fact Sheet has been developed, and is included in the draft PPP as Attachment B.)

• Information Availability Notices • Title V Permit Modification Application • Draft Title V Modification Permit • Environmental Justice Analysis • Draft Public Participation Plan

Prepared materials will be written in clear, concise language, avoiding legal or overly technical terminology. Materials will be prepared in English; translation into Spanish will be undertaken if necessary, to the extent possible and practical.

Task #4 -- Establish Document Repositories/Distribute Project Information

Easily accessible public Document Repositories will be established at locations close to the proposed project and easily accessible to stakeholders. It is anticipated that these will include local Libraries and Community Board offices in or near the outreach area (defined above), as well as at the Coney Island Rail Yard facility office, and postings on the MTA-NYCT website (http://www.mta.info/nyct). The proposed locations of these repositories are shown in Attachment C. The availability of any additional public Document Repositories, if they are established, will be noted on NYCT website, when they become active.

The repositories will contain a copy of the written information prepared for the proposed project’s PPP, (as outlined above in Task #3) as well as copies of the permit applications, and draft permits, once they are available. The contents of the repositories will be checked and updated regularly to ensure that no documents are missing. A list of document contents will be prepared and updated, to help keep the repositories organized.

The locations and web address of the physical and web-based Document Repositories will be included in the Project Fact Sheet and in any project notices and/or flyers distributed publicly.

It is envisioned that information will be distributed or made available to NYCT staff by the following means: i) an official memorandum would be circulated at the Coney Island Rail Yard facility containing a brief explanation of the project to provide information to on-site staff; and ii) flyers could be posted in employee meeting and notice areas. With the implementation of these measures, adequate notification would be provided to NYCT Coney Island Rail Yard staff to learn about the proposed project, and thus afford them the opportunity to provide comments.

Task #5 -- Conduct Public Information Meeting/Informational Briefings

One Public Information Meeting will be held at a publicly accessible location in the outreach area to provide information about the proposed boiler replacement and upgrade project, and the associated NYSDEC permitting process. In addition, project information will be sent to elected officials and the Brooklyn Community Boards, to provide information about the proposed Coney Island Rail Yard Boiler Plant Upgrade project and the associated NYSDEC permitting process. Stakeholders will also be invited to the Public Information Meeting and will be invited to provide comments on project materials and the draft PPP, in writing to a specified NYCT representative. NYCT and consultant team staff members will be available to receive and answer questions about the project at the Public Information Meeting and/or at any project briefings held.

The meeting (and any briefings requested) will be scheduled after consulting Community Board calendars and with municipal and agency officials. This will help to avoid conflicts with important meetings or events that are regularly held or already scheduled within the community. The Public Information Meeting will be held after the draft permit application has been submitted to NYSDEC for review.

Meeting logistics will be publicized approximately ten (10) days ahead of the meeting date, in order to give stakeholders reasonable notification.

A general mailing will be prepared for the project for delivery to all interested parties on the Contact List (see Attachment A). This mailing will include Project Notices announcing the project’s Public Information Meeting, as well as a copy of the Project Fact Sheet (written in English and Spanish), which will also be sent to the local organizations and all other stakeholders identified on the Contact List for posting at those locations. These Project Information Notices will include:

• the name of the project sponsor; • the name and address of the proposed project; • a brief description about the project information available for review; • the description of why the project information is being sent; • the comment period being provided for submitting comments on the project,

and when the comment period will end; • contact information for any questions about the project information, or how

and where to provide comments (written or via website); and

Task #6 - Prepare Participation Plan Outreach Summary/Certification Document

A written summary of the outreach conducted under the PPP will be prepared and submitted to the NYSDEC. This report will serve as the participation plan’s Certification Document, and will include:

• A summary of PPP milestones, outlining plan implementation; • Methods used to engage the public and solicit outreach; • Time and date of the Public Information Meeting; • Time and date of project informational briefings undertaken (if any); • Any substantive concerns/issues raised during outreach activities or received

during the public comment period from stakeholders or the public at large: • Descriptions of how the issues raised were addressed; and • A description of any unresolved or outstanding issues.

The written Certification Document will confirm that the applicant has complied with the PPP, and will include a summary detailing the activities that occurred pursuant to the plan. The Certification Document will become part of the permit application and will be made available to the public at the document repositories. The Certification Document will also include several appendices as follows:

• Copies of written information such as notices, flyers, and briefing invitations; • Copies of meeting agendas • Meeting summary of the Public Information Meetings; and • Names of attendees at the Public Information Meeting and at any other project

informational briefings, if any are held (copies of sign-in sheets).

A Public Information Meeting was held as part of the Public Participation Plan being undertaken for this project and its associated permit application, by MTA-New York City Transit (NYCT). No additional questions or comments about the project or the Title V Permit Modification being sought from NYSDEC for this project were received during the open comment period, which ran from the date of the Public Information Meeting on April 25, 2012, until the close of business on May 9, 2012. Questions and/or comments and the corresponding Responses may have been modified and/or or expanded upon in the summaries in order to provide the public with clear and comprehensive information about the project.

Comment 1: What is the construction schedule for the project, how many workers and trucks are anticipated, and what will be the impact on local traffic?

The anticipated construction schedule is approximately 6 months from the date of construction kickoff. There will be minimal impact to traffic, as all materials and equipment will be stored onsite. Because of the proximity of the boiler house in the Coney Island Yard near subway stations of the F and N lines, it is anticipated that many construction workers would choose to access the site by mass transit.

As indicated in the Environmental Justice analysis prepared for the project (contained in the Public Outreach Package, available at the project’s local Document Repositories—libraries and Community Board

Offices of CB 11, CB 13, and CB15, as well as on the project webpage at: www.mta.info/nyct), it is anticipated that there would be a peak of approximately 6 trucks per day traveling to and from the site during demolition to cart away debris. During construction of the new boilers, it is anticipated that there would be between two and four trucks per day for deliveries. It is anticipated that the construction deliveries or debris/rubbish removal would make use of the Shell Road entrance to the Coney Island Rail Yard, and take 86th street to the BQE, or take Avenue U to Ocean Parkway to 27 to the BQE. The small numbers of daily trucks anticipated to be traveling to and from the site on these roads and the nearby highway system during the construction period will be insignificant (less than one truck per hour) in comparison to the existing volumes of vehicles (trucks and autos) that are found on these roadways. Similarly, the numbers of construction workers would vary during different parts of the project’s construction. During demolition, there could be as many as 20 to 25 workers at the site; during construction it is estimated that there would be an average of 10 to 15 workers at the site. There may be some isolated days with higher peak numbers of workers, such as rigging days, but those would be very rare instances. With the anticipated levels of trucking and worker activity during construction, any potential off-site effects would not be expected to be significant.

Materials will be delivered in bulk shipments, and will occur infrequently during the construction phase. Most construction at the site will be occurring within the existing boiler house, except for the demolition of the adjacent existing stack, and for construction of the new shorter stacks that will serve the three new boilers that will perforate the existing boiler house roof.

Comment 2: Is the plant Steam or Hot Water? What is meant by process loads?

Response: The plant is Steam, High pressure at 125 psi max, normal working pressure 70 psi. Steam is used for general heat of the various building on the site, as well as process loads. The process loads include uses for maintenance and cleaning of subway trains. Steam is distributed around the facility at high pressure and is stepped down to low pressure where necessary for specific purposes (i.e. heating). Condensate is collected and returned to the facility to lower the need for city make-up water.

Comment 3: What is the fuel used at the facility #6, #2, #4, Natural Gas?

Response: The new plant will be duel fueled by #2 distillate fuel oil and natural gas. The existing plant is duel fuel, using #2 fuel oil and Natural gas; much of the existing fuel delivery infrastructure is being maintained for the new project. The existing Natural gas service is from National Grid, and the existing #2 fuel oil tanks are to be re-used. Natural gas is the primary fuel source, and #2 fuel oil shall be used in the event of an emergency or if the gas company has an issue with the supply grid and calls for a load reduction under the interruptible tariff provision.

Comment 4: Why are we modifying the existing NYSDEC Title V permit?

Response: The existing NYSDEC Title V Facility permit is for the specific equipment currently installed at the facility. This equipment will be removed, and new equipment installed. By law the air permit must be amended.

Comment 5: Is there any asbestos, and any chance that asbestos will be released into the community?

Response: A New York City-certified asbestos investigator has inspected the existing boiler house for asbestos-containing materials (ACMs) and minor ACMs have been discovered. The amount of ACM is limited, but will be fully abated prior to the demolition of the existing plant. The limited ACMs identified must be removed by a NYCDOL-licensed asbestos abatement contractor prior to interior demolition. Asbestos abatement is strictly regulated by NYCDEP, NYCDOL, EPA, and OSHA to protect the health and safety of construction workers and nearby residents and workers. The regulations of the various agencies specify abatement methods, including wet removal of ACMs that minimize asbestos fibers from becoming airborne, and containment measures. The areas of the building with ACMs would be isolated from the surrounding area with a containment system and a decontamination system. Specially trained and certified workers, wearing personal protective equipment, would remove the ACMs and place them in bags or containers lined with plastic sheeting for disposal at an asbestos-permitted landfill. After the abatement is completed and the work areas have passed a visual inspection and monitoring, if applicable, general demolition work would begin.

Comment 6: Will the new boilers in the upgraded boiler plant emit dioxins?

Response: Dioxin emissions from boilers firing natural gas or #2 distillate fuel oil are nil and therefore, are of no public concern and are not regulated by the NYSDEC. Therefore, dioxin emissions are not required to be reported or included in the NYSDEC Title V facility permit. Dioxin emissions are relevant only for coal fired boilers and incinerators burning municipal and industrial wastes.

Comment 7: Are any Women or Minority owned business being used on this project?

Response: It is the project team's goal to use 25% women and/or minority owned business. There was a public bid for the project, and a large number of responses were received. No women or minority owned businesses submitted a bid on the project. The team noted the concern of the Community Board, and works to bolster its bid list with additional qualified minority and women owned business construction firms. Contact information was provided to the community board member to submit relevant contractor names and contact information for future submissions.

As part of its general policies, the MTA and its agencies (which includes NYCT that operates the Coney Island Rail Yard and its Boiler Plant) provide disadvantaged, minority and women-owned businesses with equal access to procurement and contracting opportunities. The MTA Department of Diversity and Civil Rights, Division of Business Programs, administers two programs that encourage and assist such firms wishing to do business with the MTA and its agencies. The Disadvantaged Business Enterprise (DBE) Program applies federal guidelines for providing eligible firms with these opportunities, and the Minority and Women-Owned Business Enterprise (M/WBE) Program applies New York State guidelines

Any business may compete for any MTA headquarters or agency contract, either as a prime contractor or as a subcontractor, whether or not they are certified as a DBE, MBE or WBE. However, if a firm is seeking to perform work on a contract as a DBE it must first obtain DBE certification from a Certifying Partner in the New York State Unified Certification Program (NYSUCP). If a firm is seeking to perform work on a contract as a MBE or WBE it must first obtain the appropriate certification from Empire State Development
