On June 27th, 2010 the Cincinnati Enquirer reported about how the Ohio Public Defender Commission

(OPDC) is forcing change to public defense services in Hamilton County, by withholding state

reimbursements and potentially suing the county over failure to provide an adequate right to counsel.

As_ backround, Ohio was the first state to adopt what has come to be known as "the Indiana Model" for

providing public defense. In 1976, the Ohio Legislature created a centralized state oversight system,

designed primarily for the purpose of administering state assistance grants to local jurisdictions to improve

standards of representation. Though funding remained predominantly a county function, the state was to

reimburse counties up to 50% of their cost. The statute established the OPDC - a nine-member board

empowered to set the standards of performance for existing county public defender offices and to set

statewide criteria for determining indigency, reasonable caseloads, and attorney qualifications. OPDC

oversees and appoints the Director of the Ohio Public Defender Office (OPDO) - a centralized public

defender office that serves as the administrative and reimbursement funding agency for the counties, and

provides: limited direct tria}-IeVel client representation to those counties that cede local control; death penalty

appellate and habeas representation; appellate representation in non-capital cases; juvenile appellate

representation; and mitigation and investigation services.

Unti12009, OPDC had never established any meaningful standards for attornQy_Qr-system performance, and__- _therefore there was no measure by which thecentra( office could judge the effectiveness of the counties'

delivery systems. And, during this same time period, the state had consistently retreated from their financial

commitment - in 2008 counties were reimbursed for only 23% of their public defense costs. The impact was

such that county governments had little incentive to consider^^^ej^iinqrbudget concerns.

On July 10, 2008, NLADA published a report on indigent defense in Hamilton County (Cincinnati), to the

Hamilton County Commission. NLADA found that, while services were constitutionally inadequate, many of

the problems identified are beyond the ability of the County and the Public Defender Office to solve on its

own. Solutions require statutory authority from the state legislature, funding beyond what the county can

provide, and the cooperation of the courts, the prosecutors, law enforcement, and the private bar. On the

heels of the report, local advocates pushed for changes, resulting in a stunning victory whereby the governor

added $35 million to the State Public Defender budget to bring the state funding closer to the promised 50%

level,

Unfortunately, that new funding did not come with enough restrictions or instructions for how it must be

used. Hamilton County's portion of the new funds amounted to $1.2 million. Rather than give that money

entirely to the public defender system in Cincinnati, the county last year reduced the public defender county

budget by $700K and increased the sheriffs budget by $700K. Effectively this meant that the $1.2 million of

new money resulted in oniy $500K go^ to pubiic defense and the other $700K going to law enforcement.

Such blatant disregard for the intent of the new funding has encouraged the OPDC to put Hamilton County

on notice. Hamilton County has until July 23, 2010 to submit a reform plan or face defunding. The plan

must include a new office with appropriate space for confidential attorney-client discussions, appropriate

technology (Cincinnati is yet another example of a major urban jurisdiction that expects public defenders to

share computers!), and 42 additional staff.

Prominent members of the legal community are pressuring the Obama administration to do more to ensure that

poor criminal defendants have access to a lawyer, a situation that Attorney General Eric Holder has already

likened to a national crisis.

Calls to create a bipartisan White House commission began earlier this year

Associate Attorney General Tony West to push the idea of the commission beyond the talking stage, NPR has

learned.

Former Alabama Supreme Court Justice Sue Bell Cobb, former Vice President Walter Mondale, New York

indigent legal services director William Leahy, and Equal Justice Initiative Director Bryan Stevenson wrote a

letter to the Justice Department earlier this year expressing concern that many defendants charged with minor

offenses were not getting legal counsel and that others were not being properly served by overworked and

underpaid public defenders.

"The right to counsel is a precious right that goes to the core of who we are as a people," the letter said.

They said work needs to be done in the areas of reducing the use of cash bail, which can be unaffordable for

the poor, appointing a lawyer earlier in the criminal process, ensuring defenders are truly independent from

judges who appoint them, getting rid of some low level and non-violent cases through treatment and other

programs, counseling defendants on the impact of waiving their rights and studying the fiscal and psychological

costs of over-incarceration.(They want the Obama administration to establish a National Commission on the

Fair Administration of Justice for the Indigent Aecused)

David Carroll, executive director of the Sixth Amendment Foundation, describes the scope of the problem this

way. "The most prevalent form of right to counsel services in America is for an attorney to handle an unlimitqd

number of cases for a single flat fee under contract to a judge or county manager. This model produces a

financial conflict of interest in.which the less amount of resources or effort the attorney puts into the case, the

more he puts in his own pocket. And, judges often appoint only those attorneys who contribute to their political

reelection campaigns. Over 64% of counties (1,900 of 3,033) in the U.S. operate under this model:"

Attomey General Eric Holder has given a series of speeches on reorienting the Justice Department away

reform-qains-momentum), making use of compassionate release programs for sick and elderiy inmates, and

other steps to reduce the nation's overcrowded prisons. But advocates say one issue that cuts across all those

problems is the )ack of defense attorneys for people facing criminal charges..

States already have been moving to try to address that concern. Texas overhauled its system for defending the

poor more than 10 years ago. Earlier this summer, Michigan's Republican Gov. Rick Snyder signed bipartisan

legislation in that state to create an indigent defense commission

by Tea Party state lawmakers and the Texas branch of the American Civil Liberties Union.

And public defenders in 47 out of 50 states have been writing Holder all summer to urge the Justice

Department to take a broader role. For instarice, Carlos Martinez, a public defender in Miami, wrote "for

hundreds of thousands of Florida residents, the right to counsel is a hollow right."

Martinez said many misdemeanor defendants get no legal assistance at alt, and in other cases, defendants run

through an "assembly line" guilty plea mill with little of the "adversarial testing of the evidence" that undergirds^ .- -^-_

Ahe American justice system.

It's a familiar as far away as South Dakota.

"The fact that we do not have a statewide public defender system leaves us with no support when it comes to

advocating for equal funding," wrote Traci Smith, the chief public defender in Minnehaha County, South

Dakota. "Due to excessive caseloads and staffing shortages, it has become incredibly difficult to keep qualified

attorneys on staff. ... Urifortunately whenever there is a shortfall, the Public Defender education and training is

always the first line item that gets cut."

In Missouri, whose indigent defense system has long.been cited for its triage-level workloads, Cat Kelly'of the

state public defender's office and Chief Justice Richard Teitelman of the Missouri Supreme Court wrote this

plea: "As a nation, we daily pledge our allegiance to 'liberty and justice for all' whiie collectively closing our eyes

to the horrific gap between that ideal and the reality of our jusficesystem."

Earlier this year, in what officials at the National Association of Criminal Defense Lawyers called a milestone,

the Justice Departmentweiaheci irt to affirm a federal interest in the smooth and fair operations of pub1defQnder functions ( http°/lwww npr ora/2013/OS/03/216809388/justice-dept-tackles-Aualitv of defense for the-

oor in two towns near Seattle.

The issue is drawing attention on Capitol Hill; too. Florida Democratic Rep. Ted'Deutch is preparing to

introduce legislation that would create a permanent, national center for the right to counsel, a nonprofit group

that would provide financial support and training for public defense systems. The idea is modeled on the LegalServices Corporation, which helps provide legal aid in civil cases, according to a draft summary of the billobtained by NPR.

Update at 10 a.m. on Oct. 3: 'Time To Stop Studying These Problems'

Not everyone who works on public defense for the poor thinks spending time and money to study the problem

is a good idea. A group of lawyers and activists told the Justice Department earlier this week there's virtually no

debate on the key point: that more money and training need to be provided to public defenders nationwide.

"We believe it is time to stop studying these problems and to do something about them," wrote a group that

-irrcludes Stephen Bright of the Southern Center for Human Rights, David Bruck of the Washington and Lee

University School of Law, Sherrilyn lfill of the NAACP Legal Defense & Educational Fund and Virginia Sloan of

the Constitution Project.

"Whatever resources the federal government is willing to commit to the right to counsel for poor people

accused of crimes should be immediately spent funding people and programs working in states and

communities where there is the greatest need to make Gideon a reality," they added.

Shaun Enright, an unsuccessfu12011 council candidate, was convicted in 1999 of

illegally carrving a concealed handgun. In 2004 he declared personal bankruptcy.

Mr. Enright and his supporters say he has niatured and that he would bring a needed

labor voice to city council,

"It happened over 14 years ago, and since then I put tnyself througli college, put

niyself through an apprenticeship, started a family, and I would hope thatwouldn'tbe

held against me;" Mr. Enright said.8niarge ;

Phil Copeland, business maiiager for the Laborers Local 500, will soon resign his at-

large seat on council to become Lucas County recorder, a job he Aon in the,Nov. 6 election.

The Lucas County Deinocratic Party is expected tc> endorse a candidate for the council vacancy Dec. 3.

In September; 1999, Mr. Enrightwas charged }uith carrying a concealed wea on and was sentenced to six months in jail, but the--- . ..

entire sentenee was suspended. He was placed on inactive probation for one year:

According to a complaint filed in Toledo Municipal Court in Ju1y, 1999, Mr. Enright "had concealed afid ready at hand the loaded

Lorcin 2-5-cal. automatic pistol found underneath the driver's seat" of a car he was driving. The court record indicates he was

pulled over for failure to display a license, not wearing a seat belt, and slow speed.

In November, 1998, he was charged with having an open container in a stopped vehicle, menacing, resisting arrest, and disorderly

conduct-t ntoxFcatton.

told a sheriffs dc.putv "that he would remember his face and take care oE'him when he got out of jail," records .show.

Mr. Enright, 33, an organizer with International Brotherhood of Electrical Workers Local 8, said all ofhis criminal charges were

the result of youthful indiscretion --- "just being dutnb and making mistakes."

Mr. Enright has lrad lnorerecent financial troubles. The Ohio Department of Taxation filed a personal incorne tax lien in Lucas

County Common Pleas Court against him and his wife in August for $3,447. He said he has paid that debt and the licn is in the

removal process. `I'he couple filed for Chapter 7 batrkruptey in November, 2004, listing credit-card debt of nearly$13,700.

T'he criminal history became an issue during Mr. Enright's campaign last year againstDemocratic Councilman ivlike Craig, who

won re-election to Council District 3, which includes East Toledo and part of South "l"oledo.

"Mike Craig put out a mailer about [the charges]," Mr. Enright said. "I don't know if that affected the campaign,"

according to campaign tinanee reports for 2011 on file with the Lucas County Board of Elections. He also had a fund-raiser that

To ward off Mr. L;nright's challenge, Mr. Craig raised $20,090 for Itis cantpaign, including a $2,000 loan from his wife, Karen

Craig. He received contributions of $500 each from political action committees representing dock workers, the utilities industry,

Mr. Craig reported to police that two fan»ly cars werevandali2cd on May 31, 20l1, just hours after he voted to sell a 69-acre

portion of the Marina District in East Toledo to Chinese investment firm Dashing Pacific Group Ltd. for $3.8 rnillion. Five tires

were slashed on his and his wife's vehicles in front of their Consaul Street hotne. No arrests were made.

The Nortllwest Ohio Building and Construction Trades C:ouncil objected to that transaction because the buyers would not cornmit

in writing to hiring union labor for the project, although the group said a verbal commitment given by the cotnpany's construction

manager before council's vote allayed some of the concerns.

Nine days after the incident, Mr. Craig received an anonynious letter suggesting Mr. Enright as the culprit based on a"history,"

but without offering any evidence,

Mr. Enright on Friday denied any role in vandalizing Mr. Craig's cars. "I don't condone that behavior and we don't do that

behavior," Mr. Enright said. "I'm not the type that wishes harm on anybody."

Mr. Craig did not discount as a reason for the vandalism bis support the previous year of an "exigent circumstances" declaration to

force concessions trom most city labor unions, which also aroused union opposition.

Mr: Craig said the party's endorsement "doesn't cany a thing for me, because thev didn't endorse me last tinie," and he liad no

intention of voting to appoint Mr. Enright.

"I don't believe he is qualified," Mr. Craig said. "I know all there is to know about his criminal history. ... There are tons of people

out there who are qualifred and who don't have criminal records. This is the best they could come up with?"

The Northwest Ohio }3uildingand Construction Trades Council is trying to line up support for hi m within the party and on couneil.

"I'bc council of 16unions, representing as many as 12,000 workers, contends that council needsa labor representative to replace

Mr. Copeland.

"We'd support him for that seat. We would like to see Shaun appointed," said John Sehlagheck, executive secretary of the

organization that represents area unions, including electricians, ironworkers, pipefitters, laborers, painters, tnasous, and carpenters.

Mr. Selilagheck said Mr. Enright has experience as a conimunity activist.

"We're just trying to get a guy wlro thinks like us on council. He shows interest in being in council because he ran for the district

from East Toledo. IIe was unsuecessful, but he didn't have a bad run," Mr. Schlagheck said.

Lucas County Democratic Chairman Ron Rothenbuhler, a former director of the Northwest Ohio Council of Carpenters, said he

supports Mr. Enright for the vacancy.

"I believe in giving people a chance to recover and beconie what theyreally want to be. He really wants to do that and I'm willing

to give him a chance and I support that," Mr. Rothenbuhler said. "I do believe that he would be a good replacement for Phil

Copeland, because we feel that the labor eommttnity needs a representative to watch out for issues that are near and dear to their

heart."

Councilman Lindsay Webb said the party's endorsement would cany significant weight, tmd she would "most assuredly" vote for

the person receiving the endorsement.

"There is a process that the Democrats use to 97elp determine who is the best person to serve, campaign, and retain theseat after the

appointment as with Paula Hicks-Hudson and Steven Steel," Ms. Webb said.

Ms. I-Iicks-Hudson, w'ho like Mr. Steel was appointed to council after getting the party's endorsentent and later won election, said

Mr. Enright's past does uot disqttalify him.

"I know there is a lot of interest in whoever is in that seat has an interest in labor," Ms. Hicks-Hudson said.

Councilman Tom Waniewski, one of the three Republicans on council, said he would not support Mr. Enright or fortner mayor

Jack Ford, who has also expressed interest.

"I can't seehow someone could adequately perform public servicc when they violate it so oftei) based on a criminairecord," he

sa'rd.

Mr. Waniewski ran a rtewspaper ad seeking people intet-ested in the endorsernent,

"I had a retired CEO inqiiire about the position," he said. "If you look at what we have, it seems to be a political career ladder and

the public is cheated when we get that."

Council President Joe MeNaniara, a Democrat who supported Mr. Craig's re-election in 2011, wants the party to endorse someone

all the Democrats will support.

"I think the party should be working with all Democrats to find a candidate we can all support and who the voters will elect," he

said. "At the end of the day, as a Democrat, I want to see Democrats elected, and part of that goal is to find a candidate who will

vti<in and be supported by the voters."

Former Mayor Carty );%inkbeiner, who defeated Mr. Ford in 2005, said Mr. Ford's inte(lect and knowledge of city issues, inciuding

finances and developme3rt, are too valuable to pass up.

"Almost annually there is an opportunity for an appointment to be made. It should go to the person who can contribute

immediately to dealingwith budget issues, public safety issues, and job creation issues,"Mr. Finkbeiner said.

Lucas County Republican Chairman Jon Stainbrook said that in light of the Democratic Party's eouncil majority, there isn't

anything the Repiiblican Party can do to derail the appointment.

"Obviously this guy has turned his life around and it happened over a decade ago. If the Democratic Party is picking Mr. Enright,

then Mr. Enright is going to get the nod. It's jirst the way it is; "Mr. Stainbrook said,

Whoever isappointed to the vacancy v.'ould be expected to run for election in tiie Septemberprunary and in the general election

tlext November with other at-large counc'rl candidates.

During the exterior examination smoke and heat damage was noted around the master bedroom windows on both the westand north elevations. Damage was noted to the front 7nain entrance and was confirmed to bave been done by the fixe crews.It was also confirmed that the overhead garage door was opened by the fire crews using the door opener frorn the inside.

The unattached shed in the back yard was also searched as was the yard. Nothing was collected from these areas.

The exterior of the structure was eliminated as an area of fre origin.

The interior examination began in the attached garage on the south end of the structure. There was no fire damage in thegarage.

It was noted that two nlastic grocery bags of meat, still partially frozen were sitting on the garage floor i.n front of the chestfreezer. The silver BMW, Ohio tags- HELPWTD, vras towed from the garage to the police station for storage and forensicevidence proces.sing. Other items of evidence collected from the garage will be documented on the evidence log.

The main alarnz panel and furnace were intact in the crawl space. Access to the crawl space was made f om-the garage.

The garage and crawl space were eliminated as areas of fire oriain.

The examination of the interior of the living area of th'e structure began in the south hallway from the garage. The hallwayhad moderate smoke damage. The bathroom/laundry room had liglit snloke damage. The electrical panel was located in thebathroom/ laundry room. It was intact with the main breaker turned to the off position by the fire crews. Only one 20 ampbreaker was in the tripped position. The ledger indicated the breaker was for the master bedroom. It was noted that the twosingle pole light switches in tlle hallway were in the on position. They are believed to be for the hallway and the garage.

The south hallway and bathroom/ laundry room were eliminated as areas of fire origin.

The kitchenlfamily room had sustained moderate smoke damaae. There were two distinct and separate areas of fire originnote . e irs on the island counter top. The second was on the walking belt surface of the treadmill.

The living room/foyer had sustained moderate smoke damage. There was one distinct area of fire or^gin on a chair in thefoyer. It was noted that the smoke detector was on the floor of the foyer. It wasconfzrmed that the fu•e crews had rernouedffie detector to silence it.

The north hallway and bathroona had sustained heav-y smoke daniage. The closets off the hallway had sustained light smokedamage. The electric t^ater^ieaier ivas intact a-d7ocated iri tlie-TiaMcloset.

The southeast and northeast bedrooms had sustained light srn.oke damage. 'I'he doors to both rooms were found closed by firecrews. The door to the southeast room was locked-ani^sacTto be fcirced open. The wholehouse water filtering system waslocated intact in the closet of the southeast bedroom. ^ ------ -- -- -----^w. - ------------- --__._-,The north hallway, north hallway closets, north bathroom, northeast and southeast bedrooms were eliminated as areas of fireorigin.

T'he master bedroom suite consisted of the bedroom, toilet rooni, shower/tub roon1 and walk in closet. The toilet roomsustained heavy smoke damage. The shower/tub room and walk in closet had moderate ssnoke damage.

The toilet room, shower/tub room and walk in closet were eliminated as areas of fire origin.

The bedroom area had heavy snioke, heat and flame darnage, There were two distinct and separate areas of fire origin. Onewas in the southwest c"oi^^o^ttl^^^wTere a p astic tote was sittiiig on top of a cabiriet. The other was on the north halfof the bed.

It was therefore determined that there were five separate and unconnected areas of fire origi

This fire was determined to be incendiary.

It was caused by person(s) starting five separate and uncon.raect.ed fires within the i-esidence, The fres were caused asfollows:

1. The top of the countertop for the kitchen island. - Caused by the ignition of papers and a towel with an open flame.2. The treadmill in the family room. - Caused by the ignition of papers with an open flanle.3. The chair in the foyer. - Caused by the ignition of the clothes lying on the chair cushion with ar open flame.4; The plastic tote in the southwest corner of the master bedroom. - Caused by the ignition of papers in the plastic totewith an open flame.5. The north half of the bed in the master bedroom. - Caused by igniting tlie linerl on the bed with an open flame.

During the scene examination an unburned wood stick match with a green tip was located in the fam.ily room attached to theside of a shelf. Another wood stick match with a green tip was located among the debris from the master bedroom. Bothitems were collected as evidence.

Investigator Peterman deployed K-9 Lacey at the scene. The results will be documented in his report.

The following items were collected as fire evidence and will be taken to the SFM. Forensic Laboratory for analysis:Burned debris from the kitchen island countertop.Burned debris from the tread mill.Clotliing from the floor of the floor,Burned clothing from foyer chair.Burned cushion from foyer chair.Burned debris from southwest corner of master bedroom.
