Generalitat de Catalunya announced last November 20 th, 2012 that the Decree that regulates Touristic economical activities including “Touristic Home´s” has been approved. That Decree tries to regulate the economical activity related by renting private villas, houses and/or apartments for tourist. The new regulation includes new obligations for the owners that are renting their properties temporarily, mainly in summer season. Inform about the economical activity to the Council, include a maintenance company, “claims book” available for customers, inform police about the occupancy register, be included in a Public Register in Direcció General Turisme, pay the “Touristic Tax”, etc. The management companies will be come jointly liable of those obligations on behalf of the property owner. The aim of the new regulation is dual, preserve a high and homogeneous standard quality service to the customers and regulate the economical activity.

Last October 30 th, 2012, The new Antifraud Measures Law was approved by Gobierno de España. One of the new obligation from that law is declaring the payments in cash over 2.500 € (15.000 € for Non Tax Residents).
The declaration can be made trough Internet within the next 90 days after the payment. The fine will be 25% of the amount paid. The obligation to declare will only start when any of the parties is acting as a business or individual professional.

According to Spanish law, income derived directly or indirectly from property assets in Spanish territory or rights relating to them is considered to be obtained in Spanish territory.
REMEMBER that the 2011 Income Tax from Real Estate
as a Non Tax Resident should be declared before
December 31 st 2012
