MINUTES OF JULY 16, 2015 BOARD MEETING Item 1- Call to order / roll call to determine the presence of a quorum. Louie Puentedura,

address the disciplinary action taken by the Kentucky Board of Physical Therapy.

Item 7- Applicant Spencer Earnest requests to be licensed. This appearance is necessary

to address the results of the applicant’s fingerprinting.

Motion to enter closed session: Menicucci. Second to motion: McKivigan. Passes unanimously.

After returning to open session: Motion to grant license, with requirement to be reprinted after 1 year of licensure and that must not reflect any activity: Smith. Second to motion: Menicucci. Passes unanimously.

Item 8- Applicant Nicole E. Lang requests to be licensed. This appearance is necessary to

address the results of the applicant’s fingerprinting.

Passes unanimously. Item 9- Update from Vice Chairman Baum and legal counsel Richard Dreitzer regarding

their attendance at the meeting of the State of Nevada Oriental Medicine Board regarding their Board’s assertion that dry needling by physical therapists is outside scope of practice.

Richard Dreitzer stated that he, Vice Chairman Baum and Janelle Lauchman, President of the Nevada Physical Therapy Association attended the meeting. Mr. Dreitzer stated that he reminded their Board they had been invited to the Physical Therapy Board meeting to discuss this topic. Mr. Dreitzer stated that their Board reported they did not think it was a good idea to attend and they are sticking with their opinion that dry needling is out of scope for physical therapists. He stated that their Board will need an Attorney General opinion on this to consider taking any type of action or making a reply in addition to what has been done. The Board noted that spending time and money now, not knowing what the AG opinion will be, if an opinion is even requested by the Oriental Medicine Board. Board member Smith noted the FSBPT had a policy on their website. It was noted that their Board had posted the name of a PT licensee as part of their exhibits on their website and that PT had not been notified his

name and company were part of the official documents of the Board meeting. It

was noted that was a clear violation of the Open Meeting Law, and their Board removed the document after the meeting. The Board noted a wait and see policy was the best course at this time.

Item 10- Review of draft policy regarding the professional reference requirements for all

applicants. The director suggested the Board consider lowering the requirements to two, and/or allowing for one of the references to be a PTA if the applicant is a physical therapist’s assistant. The director noted that the current requirement for three references can be very difficult for therapists coming from rural areas and those who have practiced at one location for many years.

Motion to change the policy to lower the professional reference requirement to

two physical therapists; and PTA applicants can have 2 PT references or can have one PT and one PTA reference; and it was noted that the references must be able to attest to observing the practice of the applicant: Puentedura.

Second to motion: McKivigan. Passes unanimously. Chairman Puentedura stated that this in no way decreases public protection but

allows the Board to continue to carefully vet applicants, and at the same time assist the applicants.

Item 11- Update from Paula Berkley, Board lobbyist, regarding the most recent legislative

session.

Paula Berkley stated that she was glad the session was over. She noted that it was an easier session than some others, as the bills were either easy to work

with, or so horrible they had no chance of passing. She noted she had to call the Board’s director only a few times to address matters immediately. She continued, stating that the majority of their communications were via email. She noted that the director provided the information she needed, and sought the guidance of the Chairman and/or legal counsel as needed. It was discussed that language passed which indicates that the voluntary surrender of a license is considered discipline and can be handled as such by the Boards. It was discussed that one bill was to basically get all Boards to offices in Carson City. The director noted that this Board has 5 schools in the south, none in the north, and having an office where the schools are and where the majority of licensees are, is more important than having the Board office near other Board offices. Ms. Berkley noted that a bill to allow for Board’s to basically issue citations did not pass. She also noted the Veterans bill was 88 pages long and sets rules for the Board to license endorsement candidates who are veterans. It was noted that the bill also requires the Boards to provide annual reports to the state as to how many veteran’s licenses were issued. The director noted that the PT board had implemented an application for veterans and their spouses in response to a Governor’s proclamation, and that has been well-received. Ms. Berkley stated it was probably time for the Board to again review their practice act for any suggestions and to get public input. She stated that compact licensure; will be an

issue next session.

Item 12- Review and approval of minutes for Board meeting of May 21, 2015.

Chairman Puentedura noted that he already sent his changes to the director in an email, and noted they were grammatical only. Motion to approve the minutes with the changes: Puentedura. Second to motion: McKivigan. Passes unanimously.

Item 13- Review and approval of executive session minutes for Board meeting of May 21, 2015.

Motion to approve: Menicucci. Second to motion: Smith. Passes unanimously. Item 14- Review and approval of Treasurer’s Report for period ending May 2015. Motion to approve: Puentedura. Second to motion: McKivigan. Passes unanimously. Item 15- Review and approval of Profit and Loss Report for period ending May 2015. Board member Smith asked the director how much income is received from the

review of courses. The director noted that the income from the course reviews is

to cover the costs of operating the committee in accordance with the regulations. She noted it was not a notable income item for the Board. Board member Smith noted that the FSBPT has a service to review and approve courses and asked if the Board had considered it. It was noted the Board had considered ProCert previously, and advised the licensees of it in a newsletter, however the Board did not want to give up their responsibility and authority to an outside entity. Chairman Puentedura stated that ProCert approvals would not be Nevada specified, and therefore courses and content would be approved by ProCert that are contrary to Nevada law. He also noted that the ACCE and the Board’s review is much more detailed. Board member Smith stated it is good the Board is informed on this and knows what is out there.

Item 17- Review and approval of Executive Director’s Report as of June 30, 2015.

Motion to approve: Smith. Second to motion: Puentedura. Passes unanimously. Item 18- Update of activities of Board office. The director noted that renewals are going

along as usual, with a lot of licensees waiting until the last 10 days to renew. It was noted that some employers require the licenses to be updated on the Board’s website by a particular day, and many employees are making special requests for the website to be updated immediately upon their renewal. It was noted the website cannot be updated with each individual renewal, as renewals are received throughout each day. The director also noted that the routine inspections had not been completed as directed, noting that some of the inspectors were not available to complete the inspections.

Item 20- Consideration of courses recommended by the Advisory Committee on Continuing

Education at their meetings of June 16, 2015 and June 23, 2015. Board member Smith, liaison to the Advisory Committee on Continuing

Education (ACCE), noted that the there was a generalized issue in that there are vendors that put in courses repeatedly. She stated that the ACCE will be making an effort to look closer at the courses, to be certain they are updated and current.

Item 21- Report from legal counsel regarding pending cases and other matters.

Item 22- Announcement of opening for Committee member for the Advisory Committee on

Continuing Education. The director advised the Board that Chad Bible, PT, has to resign due to work schedule. The director will post the notice to the Board’s website and will notify the NPTA.

Item 23- Items for future agendas. It was discussed that the Board will take suggestions

for changes to the NRS and the NAC at the September meeting. It was also discussed that the Board go on a retreat. The director noted that in her time with the Board, a retreat had never been discussed, and therefore she would seek guidance from other Boards to ensure the process was keeping with Nevada open meeting law and available for the public to attend.

Item 24- Public comment period. Chairman Puentedura and legal counsel Richard

Dreitzer advised the Board the appeared telephonically at the most recent meeting of the Chiropractic Physician’s Board. It was noted that their Board did not address the item the Chairman and legal were interested in.

Item 25- Confirm schedule of future Board meetings and their locations. The next

meetings of the Board will be as follows:
