About Us

The Kerala State Legal Services Authority is a statutory body constituted under the Legal Services Authorities Act, 1987 for providing free and competent legal services to the weak and marginalised sections of the society, to ensure that opportunities for securing justice are not denied to any citizen by reason of economic or other disabilities and to organize Lok Adalat for the operation of legal system to promote justice on a basis of equal opportunity.

KeLSA is providing legal aid to poor, weak and marginalized sections of the society for establishing their constitutional and legal rights. This Authority has been effectively coordinating the activities of 14 District Legal Services Authorities and 63 Taluk Legal Services Committees in the State for the implementation of various schemes and programmes formulated by NALSA and KeLSA so as to fulfill the constitutional mandate of ‘Access to Justice for All’

Many path breaking programmes like legal literacy classes at School and College level, for Women and Children and all other sections of the society are conducted throughout the State. The poor and needy are given effective and competent legal aid through the panel of legal services lawyers. The service of panel lawyers is utilised for legal aid to the Under Trial Prisoners, as retainer lawyers and as resource persons in legal literacy programmes. All the DLSAs have appointed Remand Advocates to provide legal aid to the Under Trial Prisoners. Mediation activities are coordinated by the Kerala State Mediation and Conciliation Centre, the Mediation Monitoring Committee, under the umbrella of KeLSA. Permanent Lok Adalat for public utility services has been established at Thiruvananthapuram, Ernakulam and Kozhikode. Under the leadership of the Hon’ble Executive Chairman, KeLSA is marching forward to achieve the set goal of “Access to Justice for all”.

ACTIVITIES OF LEGAL SERVICES INSTITUTIONS IN KERALA

During the year 2016, KeLSA had initiated several projects which would go a long way in strengthening the liaison with common people. The Highlights are as follows:

• Full time Secretary for DLSAs: All the DLSAs have the service of Full time Secretary, a Sub Judge appointed on deputation.

• Revision of fee and honararium: The process to implement the proposal for revision of fee of panel lawyers in tune with the recommendations of NALSA, revision of honararium for judicial officers, staff of courts, and staff of Legal Services Institutions for duty in Lok Adalat on a holiday has been started by formation of a Sub-Committee. The report submitted by the Sub-Committee will be placed in the next Authority meeting.

• Training for Panel Lawyers [Module-I]: Thirteen [13] training programmes were conducted in 13 out of 14 districts for Panel

Lawyers as per the NALSA training Module-I utilising the service Sri. M.P. Bhadran and Sri. D. Premachandran, former District Judges and master trainers and the Member Secretary. The training programmes were conducted on different dates in the respective districts. The training for Module–I is expected to be completed by February 2017. KeLSA had communicated to NALSA the requirement of three additional Master trainers for conducting the training programmes throughout the State in addition to the present Master Trainers.

• Legal aid clinics in Jails: Legal Aid Clinics are functioning in all the jails in the State. Panel Lawyers along with PLVs generally visit the jails at least once or twice in a week. There are places where the panel lawyers and PLVs visit the jails daily.

• The Director General of Police (Prisons) has been requested to give necessary directions to all jails to put up permanent boards/hoardings displaying information about availability of free legal services inside the jails.

• The resolution to facilitate interview of inmates by panel lawyers and PLVs visiting the jail to provide easy access to legal services, has been communicated to DIG(Prisons)

• 49 legal awareness programmes have been conducted in jails throughout the State during the year 2016. Directions were issued to all DLSAs to select PLVs from among the long term prisoners or other inmates of jail.

• Legal Services clinics in Law Colleges: Legal Services Clinics are functioning in Law Colleges in most of the districts. A direction has been issued to all the DLSAs to set up Legal Services Clinic in every Law College/University wherever not opened so far.

• Help Desk: In connection with demonetization of Rs.500/- and Rs.1000/- currency notes, help desks were set up by deploying 45 PLVs and assisted 1774 persons.

• Para Legal Volunteers: There are 2374 PLVs in the state. All possible efforts are taken to monitor the performance of PLVs. The service of PLVs is utilized by DLSAs to the maximum possible extend to reach out persons, who are the targeted groups in programmes and schemes.

Two Day Mass Door to Door Campaign: In the “Two Day Mass Door to Door Campaign” conducted across the State on 2nd and 3rd November 2016 as requested by NALSA, DLSAs could spread the messages of Legal awareness through Panel Lawyers, PLVs and others to 4,81,516 persons.

• Legal Aid Clinic at Pamba and Sabarimala: Legal Aid Clinic was commenced at Sabarimala and Pamba during Mandalam’ and ‘Makaravilakku’ season 2016-17. These clinics were used to propagate the relevance and importance of services available through Legal Services Institutions to millions of pilgrims visited Sabarimala, by distribution of pamphlets, posters etc printed in different languages. The Legal Aid Clinics were managed by about 100 PLVs. The Legal aid clinics function now when the shrine is opened at Sabarimala for monthly pooja taking into account of the acceptance received from the public . The support received from other State Authorities is acknowledged with gratitude. Legal Aid Clinics were established by DLSAs during festivals in Temples, Churches, and Mosques and also in melas.

• Legal Awareness/ literacy programmes: 2,509 legal awareness programmes /Camps were conducted throughout the State benefitting 4,36,707 persons.

• State Level Quiz competition for KeLSA Trophy: KeLSA is regularly conducting a State Level Quiz Competition at the School, Taluk, district and State level on legal awareness for Higher Secondary School students based on the book ‘Lessons in Law’ published by KeLSA. The 6th State Level Quiz Competition was held on 28.1.2017.

• Publications of KeLSA: The Kerala State Legal Services Authority is the first in the country to introduce books on legal awareness for the students of Schools and Colleges namely ‘Niyamapadam’ (in vernacular language) and ‘Lessons in Law’ (in English). Classes were conducted in 2016 in all the schools in the State during September-October after orientation programmes for social sciences teachers.

• “Sthreeyum Niyamavum”, a booklet contain-ing information on various laws for the pro-tection of Rights of Women was distributed

throughout the state during legal awareness/ legal literacy programmes.

• Booklets on Fundamental Duties, ‘Ente Rajyam Ente Swargam’ in vernacular and ‘My Nation My Heaven’ in English, were released by the Hon’ble Governor of Kerala Mr. Justice P. Sathasivam on 14.11.2016.

• “Neethipoorvam” a compilation of the programme on ‘Constitutional Values’, aired by A.I.R., Kochi F.M., a unique programme was released by the Hon’ble Mr. Justice Mohan M. Shantanagoudar, Chief Justice, High Court of Kerala and the Patron-in Chief, Kerala State Legal Services Authority on 29.11.2016.

• Legal Services to Under Trial Prisoners: Di-rection has been issued to all DLSAs to com-ply with the Order of the Hon’ble Supreme Court of India in W.P[C]406/2013.

• Under Trial Review Committee [UTRC] were set up in all the districts. The UTRCs were convening quarterly meetings for mon-itoring and reviewing all eligible cases. 82 UTPs have been released so far pursuant to the direction of the Hon’ble Supreme Court in W.P(c) 406/2013.

• Special Adalat for the compoundable cases in-volving UTPs were conducted by the DLSAs.

• Mobile Lok Adalat: The Mobile Adalat Van completed its tour in six districts. The response from the public has been tremendous.

• Shortage of Staff: KeLSA and its co-ordinate institutions are facing shortage of staff. As per the decision taken in the 53rd Authority Meeting, a request has been made to the Government for conducting a work study on the staff pattern in KeLSA, HCLSC, various DLSAs and TLSCs. In the Audit Report of Accounts of KeLSA, the Accountant General has mentioned the urgent need to have a permanent internal audit wing in KeLSA. The Government has started study on both the proposals as a team of officials from Personal and Administration Department of Government of Kerala has visited KeLSA for discussion. z

VICTIM COMPENSATION SCHEME

The Government of Kerala has notified the Victim Compensation Scheme for the State, vide G.O. (Ms) No.37/2014/Home dated 24-2-2014 as provided in S. 357A [1] of Criminal Procedure Code, 1973. The Victim Compensation Fund is operated by the Member Secretary, Kerala State

Legal Services Authority. KeLSA could dispose several claims for compensation. KeLSA could disburse Rupees 1,17,60,614.

The proposal submitted by KeLSA for amendments to the Kerala Victim Compensation Scheme is pending with the Government.

1 INTER STATE TRANSIT OF MENTALLY ILL PERSONS (KeLSA and DLSAs)KeLSA and the DLSAs are actively involved in imparting legal aid for the rehabilitation of mentally sick persons, who are hailing from outside states, pursuant to the directions of the Hon’ble High Court in OP.16667/1996 and otherwise.

2 MASTER PLAN FOR MENTAL HEALTH CENTRE (DLSA, Kozhikode)The Government has approved the Master Plan prepared at the initiative of DLSA, Kozhikode for construction of a modern Psychiatric Research Centre at the Mental Health Centre, Kozhikode. The Government has set apart Rupees 100 Cr. for the project.

3 SHORT FILM-“KATHA KATHA KAARANAM” [REASON BEHIND THE STORY] (DLSA, Kozhikode) This short film deals with the issues relating to rehabilitation of mentally ill persons and to sensitise the society on the need to rehabilitate mentally ill patients in their family.

4 MENTALY ILL LADY SENT BACK HOME (DLSA, Thrissur)One Poonam Singh from Panipath, Haryana state, discharged from the Mental Health Centre, Thrissur, was sent to her native place by tracing out her relatives due to the initiative of Adv. Jockin. A. Pereira, a legal services lawyer and Smt Ammini. K.A, Para Legal Volunteer.

5 ADALAT AT THE MENTAL HEALTH CENTRE (DLSA, Kozhikode)DLSA, Kozhikode conducted discharge Adalats on all Fridays in Mental Health Centre and Ashabhavan through which about 100 inmates from MHC and 20 persons from Asha Bhavan could be rehabilitated

6 MOBILE LOK ADALAT AT ARALAM FARM (DLSA, Kannur) DLSA Kannur arranged a Mobile Lok Adalat on 11.1.2016 in association with various Government Departments in Aralam Farm, which is the largest tribal Re-Settlement Colony in Kerala, to resolve the issues relating to electoral identity card, ration card,

With the legal aid from District Legal Services Authority, Kannur a public interest litigation has been filed before the Honourable High Court of Kerala as some issues required intervention at the State Government level for timely action.

7 ALCOHOLISM AMONG YOUNG TRIBES (DLSA, Kozhikode) Addiction to alcoholism was a major issue among tribal youth in Kozhikode district. A volley ball team of tribal youth was formed and trained by DLSA, Kozhikode with the support from the teachers and students of Govt. College, Kodencherry to divert their interest to something creative. Most of them have recovered from alcoholic addiction. They have transformed into a good team of volley ball players.

8 INDUCTION OF ALL THE TRIBAL STUDENTS IN A COLLEGE AS PLVs – FIRST IN INDIA (DLSA, Wayanad) All the tribal students of Institute of Tribal Studies and Research Centre, Chethalayam were enrolled as PLV’s by DLSA, Wayanad so as to identify tribal issues and problems and to bring it for legal solutions through DLSA.

9 SUPPORT TO CHOLANAIKAN TRIBAL COMMUNITY (KeLSA/DLSA Wayanad)As directed by KeLSA , pursuant to a report in a newspaper, DLSA Wayanad took up the issue of lack of shelter, food and clothing to Cholanaikan Aadivasi community of Parappanpara tribal colony, where 13 families consisting of 54 members are living. Ration card was distributed to all the families within a week and solved their problems in getting food grains, cloth etc.

10 LEGAL AID TO THE TRIBALS IN EDAMALAKUDY-IDUKKI DISTRICT (KeLSA/ DLSA Thodupuzha) KeLSA could intervene by providing legal aid and support to the tribals in Edamalakkudy , Idukki district, based on reports in News papers regarding non receipt of ration articles at the tribal settlement area. The DLSA, Thodupuzha could solve the issues with regard to rationing system, working of Panchayath office, transportation facilities etc through an Adalat. A legal aid clinic was also established at Edamalakkudy.

11 LEGAL AWARENESS PROGRAMME WAS CONDUCTED AT URIYAMPETTY TRIBAL HAMLET (DLSA, Ernakulam/TLSC, Kothamangalam)DLSA, Ernakulam has conducted legal awareness programme at Uriyampetty tribal hamlet in association with the Taluk Legal Services Committee, Kothamangalam on 11.9.2016 to effectuate and publicise the NALSA Scheme of 2015 for protection of Tribal Rights.

On 1st September, 2016, DLSA conducted an Adalath of the pre-litigation cases in respect of the incomplete houses of tribals.

15 PREVENTION OF CHILD TRAFFICKING AND CHILD LABOUR (KeLSA/ DLSA, Kannur) The District Legal Services Authority, Kannur intervened in the issue of Child Trafficking and Child Labour at Panoor, on receipt of information from “Janakeeya Samithy that the Police did not investigate into a specific incident of Child Trafficking and Child Labour. Based on the report of enquiry by the Secretary, DLSA, the Hon’ble Executive Chairman issued directives to the District Collector, Superintendent of Police and the District Social Justice Officer, Kannur for urgent and immediate action. The problem could be solved to a large extent by the intervention of KeLSA and further activities against Child Trafficking are in progress.

18 AWARENESS PROGRAMME ON WASTE MANAGEMENT (DLSA, Kottayam) DLSA conducted an awareness program for the Waste Management System for the staffs of the District Court centre.

19 THE VRIDHA VIKALANKA SADANAM (GOVERNMENT OWNED OLD AGE HOME) (DLSA, Thodupuzha) The Secretary, DLSA Thodupuzha inspected the Old Age Home and complaints of the inmates were taken into consideration and a PLP was registered suo moto. Complaints on the lack of living conditions were addressed. 25 nos. of bed and pillows procured through sponsorship were distributed to the inmates.

20 LEGAL AID TO THE INJURED 7 YEAR OLD BOY AND HIS MOTHER. (DLSA, Kollam) They suffered serious injuries and heavy property damage, when the water tank of the public water supply scheme was collapsed over their family house at Kaithacode, near Puthoor. The authorities concerned were alerted for medical assistance and rehabilitation. Legal aid was provided to file a pre-litigation petition.

21 TRANSIT OF BANGLADESHI WOMEN- VICTIMS OF SEX TRAFFICKING (NALSA/KeLSA / SLSA, Karnataka / DLSAs Kozhikode and Manjeri )Based on the report in a Newspaper, KeLSA requested DLSA, Kozhikode, which had intervened in the issue, to provide adequate support to four Bangladeshi women, who were allegedly trapped in sex trafficking and not allowed to go to Bangladesh on the ground that investigation was not complete in one case and trial was not over in three cases. As requested by KeLSA, NALSA, SLSA, Karnataka and the Kerala Police intervened and provided adequate support. The investigation and trial were expedited with support from the SLSA, Karnataka and DLSAs Kozhikode and Manjeri. The DLSA, Kozhikode coordinated the legal and other formalities with Court, District Collector, Police Chief, FRRO and Department of Social Justice. All the four Bangladesh Nationals have reached their home safely. KeLSA places on record the support received from NALSA and SLSA, Karnataka.

22 LANDLESS INMATES OF PARAKODE (DLSA, Pathanamthitta)As per the directions of the Hon’ble Executive Chairman, Kerala State Legal Services Authority, based on a news paper report that many landless inmates are living in the Parakode KIP Canal Puramboke at Adoor, Secretary DLSA, Pathanamthitta visited there on 11.07.2016. A meeting of Revenue Divisional Officer, Deputy Superintendent of Police, Secretary, Municipality, Tahsildar, Executive Engineer (KIP), Executive Engineer (KSEB), Assistant Executive Engineer (Water Authority) and 10 family members of Parakode Puramboke was conducted and discussed the issues. 10 PLPs are pending before DLSA. An amicable solution is expected soon

23 RESCUE OF AN OLD COUPLE BY A PLV: (DLSA, Kannur)On 25.6.2016, Sri. Ajayan M., Para Legal Volunteer found a couple, aged 80 years and 75 years, respectively and abandoned by the children, residing in a temporary hut made of plastic sheets, in Ward No.3 of Dharmadam Grama Panchayat in Kannur District. They were leading a miserable life in the rainy season. Sri. Ajayan M. brought the matter to the attention of public and also the Police. The children arranged a rented house for the parents and agreed to pay monthly maintenance.

The Intensive awareness given against Domestic Violence made the people to intervene positively in Domestic Violence Cases with a view to settle such cases. 41 ANTI HUMAN TRAFFICKING CLUB (KeLSA / DLSAs Kottayam and Thrissur)Commenced Anti Human Trafficking Clubs, a novel concept, where the students group from colleges would act as facilitators to help the police to identify cases of human trafficking cases and rehabilitation of victims, simultaneous with ensuring the accountability of prosecuting agencies. • The State wide launch of ‘Anti Human Trafficking Clubs’ under the joint aegis of Kerala State Legal Services Authority (KeLSA) and the Anti Human Trafficking (AHT) Wing of the Kerala State Police was inaugurated on 06.02.2016.• As a joint venture of District Legal Service Authority, Kottayam and the Anti Human Trafficking Unit (AHTU) Kottayam District, Anti Human Trafficking Club was inaugurated at CMS College, Kottayam.• Anti human trafficking unit was set up at the Government Law College, Thrissur.• The guidelines formulated by the KeLSA and the Anti Human Trafficking (AHT) Wing of the Kerala State Police is pending before the Government for approval.

42 LEGAL SERVICES TO THE INMATES OF REHABILITATION CENTRE FOR BEGGARS (DLSA, Thiruvananthapuram) Based on a report in a news paper, DLSA took up the matter of Beggar Rehabilitation Centre, which was in a dilapidated and neglected condition. Thirty five [35] inmates living in two rooms were treated like animals. They were not provided with proper food, clothing, and other basic amenities. DLSA alerted the City Corporation and as a result sufficient staffs were deputed. The standard of food was improved. DLSA organised medical camps and supplied clothes, bags etc. to the inmates, who were shifted to a new building constructed under the scheme for National Urban Residence. Better facilities and amenities were ensured. A panel lawyer from DLSA initiated steps to rehabilitate some inmates to their native places by tracing out their relatives.

43 EMPOWERMENT OF TRANSGENDER COMMUNITY (DLSA, Manjeri) A programme was organised on 15.8.2016 for the empowerment of Transgender community. The representatives from the Transgender community shared the problems being faced by them.

44 WORKSHOP FOR LAWYERS ON THE ISSUES OF TRANSGENDERS (DLSA, Manjeri) DLSA Manjeri associated with Manjeri Involuntary Health Services, Multi-Country South Asia Diva project, Chennai and Kerala State Aids Control Society conducted a workshop for Advocates on the issues affecting Transgender community.

By persuading the tribes to file complaints and to resort DNA tests to make responsible the culprits accountable and trying to enable them to get proper victim compensation.

• Took steps to construct 36 toilets at Sreenipuram Colony with the help of Mata Amruthanandamayi Mutt.

• Helped to reunite two senior citizens with their family and to rehabilitate one senior citizen.

• Visited Mooshihar Tribal Colony in Bihar and involved District Legal Services Authority at Ara District in Bihar to better the conditions in that Colony.

6TH STATE LEVEL QUIZ COMPETITION ON LEGAL AWARENESS FOR STUDENTS OF HIGHER SECONDARY SCHOOLS- 2016

Kerala State legal Services Authority organized 6th State Level Quiz Competition on legal awareness for Higher Secondary School students on 28.01.2017 at Banquet Hall of the High Court for the KeLSA Ever Rolling Trophy. The Quiz competition is mainly based on Acts and Laws in the book ‘Lessons in Law’ published by this State Authority and general legal awareness including the current affairs.

Grace mark will be awarded to the winners of 1st and 2nd prize sas provided in G.O.(MS)121/12/Gl.Edn., dated 17.04.2012

The second prize winning team was awarded with a cash prize of Rs. 7,500/- and Certificates. The third prize winning team was awarded with a cash prize of Rs. 5,000/- and Certificates.

MEDIATIONThe Kerala State Mediation and Conciliation

Centre [KSMCC] , an initiative of High Court of Kerala and the Kerala State Legal Services Authority and was conceived as a project to promote mediation as an Alternative Dispute Resolution mechanism. The project is implemented with the support and the guidance of Mediation and Conciliation Project Committee (MCPC) of Supreme Court of India.

Working and management of Mediation CentresDistrict Mediation Centre has been established

at all the 14 District Head Quarters of Kerala State and also at North Paravur and Mavelikkara. That apart 47 Mediation Sub Centres are functioning at various places in Kerala . ADR Centres are also functioning in the new buildings, constructed by utilizing the funds provided by the 13th Finance Commission, at Thiruvananthapuram, Alappuzha, Ernakulam, Thalassery Mavelikkara and Thrissur. Construction of the building is in progress at Kottayam.

Training / Refresher course / awareness programmesOne to one interactive programme – 2016

One to One interactive refresher programme for mediators and refresher course for referral judges and mediators of all the fourteen districts were conducted at Alappuzha, Thalassery, Kasaragod, Kollam and Thiruvananthapuram. The programmes were conducted by the mediator trainers of MCPC and KSMCC, The Hon’ble Board of Governors interacted with Referral judges, mediators and lawyers.

conducted at Thiruvananthapuram, Alappuzha and Thrissur. Mediator trainers of KSMCC addressed the mediators who were trained in 2014 and 2015.

Awareness programme for the litigant public at Manjeri Co-operative Urban Bank, Manjeri on 20.08.2016

Awareness programmes Awareness programmes were conducted at

Manjeri, Thrissur, Ernakulam and Thiruvanantha-puram. Mediator trainers addressed lawyers, students and other stakeholders of mediation.ToT [Training of Trainers] Programme 2016

TOT programmes was conducted for seven [7] mediators who were selected for the programme by the Hon’ble Board of Governors thereby the total tally of Mediator Trainers of Kerala State Mediation and Conciliation Centre became twenty[20]. A twenty hour capsule course on mediation was conducted for these seven mediators at Kerala Judicial Academy, Ernakulam.

PERMANENT LOK ADALAT

Permanent Lok Adalat for Public Utility Services is another feature of Legal Services Authorities Act. It is a process of pre-litigation, conciliation and settlement. The Permanent Lok Adalat, established at Thiruvananthapuram, Ernakulam and Kozhikode, consists of a working Judicial Officer in the Cadre of District Judge and other Members having adequate experience in Public Utility Service. These Lok Adalats deal with cases pertaining to the following public utility Services at Pre-litigation stage :

• transport service for the carriage of passengers or goods by air, road or water; or

• postal, telegraph or telephone service; or

• supply of power, light or water to the public by any establishment; or

• system of public conservancy or sanitation; or

• service in hospital or dispensary; or

• postal, telegraph or telephone service; or
