Navi Mumbai Municipal Corporation invites sealed tenders for Supply of Larvicide for Antilarval spaying and Fogging for
NMMC from reputed manufacturer / authorized agency.
Navi Mumbai Municipal Corporation has adopted Next Tendering Sify Technologie E-tendering system. Tenderers shall register
their firm on https://maharashtra.etenders.in for tender process. For works of Rs. 3.00 Lacs and above the Suppliers/Contractors shall buy
the tender form through E-tendering system only.
The detail of the work is as under:
Blank tender form will be available from Dt. 24.05.2018 at 11.00 a.m. to Dt.06.06.2018 up to 02.30 p.m. on the E-tendering
Website https://nmmc.maharashtra.etenders.in and NMMC’s official website www.nmmc.gov.in to download,
Tenderers will be required to do payment for blank tender form, EMD, and service fee through online payment gateway. All these payments can be made by debit/credit card of any bank or net banking. Please note that fee for blank tender form will not be accepted at NMMC account Dept.

DETAILED TENDER NOTICE
1. Definitions
Following definitions which have been used in this document shall have the meeting as indicated below.
1.1 “Purchaser” means the organization purchasing goods & services (in the tender enquiry documents,
(Bidding documents))
1.2 “Tenderer” Means bidder/ the individual or firm submitting bids/ quotation/tender.
1.3 “Supplier” means individual or the firm supplying the goods & services as incorporated in the contract.
1.4 “Goods” mean the articles, materials, commodities, live stock, furniture, fixtures, raw materials,
spares, instruments, machinery, equipment, laboratory equipment, industrial material etc. which the
supplier is required to supply to purchaser under the contract.
1.5 “Services” means services allied and incidental to the supply of goods. Such as transportation,
installation, commissioning, provision of technical assistance, training, after sales service, maintenance
service and other such obligation of the supplier covered under the contract.
1.6 “Earnest Money deposit” (EMD) means bid security/ monitory or financial guarantee to be furnished
by a tenderer along with its tender Technical bid documents.
1.7 “Contract” means the written agreement entered in to between the purchaser/ or Consignee and the
supplier, together with all the documents mentioned therein and including all attachment, annexure
etc. therein.
1.8 “Security” means monitory or financial guarantee to be furnished by the successful tenderer for due
performance of the contract place on it. Performance security is also kwon as Security Deposit.
1.9 “Specification” means the document /standard that prescribes the requirement with which goods or
services have to confirm.
1.10 “Day” means calendar day.
1.11 “Week” means seven calendar days.
1.12 “Commencement Date” means the date on which contract is approved by competent authority of
NMMC.
1.13 “Similar Work” means work experience for Engaging Entomological Outsourcing Work for Vector
Borne Diseases & Vector Control Operations as mentioned in the price bid.

2. Notice Inviting Tenders
2.1 Sealed Tenders invited by and on behalf of Commissioner, Navi Mumbai Municipal Corporation
(NMMC) from eligible Tenderers for the proposed work specified in Schedule ‘A’.
3. Issue of Tender
3.1. For work of Estimate amount less than Rs. 3 lacs, Tender copy will be made available at E-tendering
cell, Ground Floor, NMMC Head Office, Govardhani Chowk, Plot No.1, Sector-15A, NERUL-I, Belapur
from date of publish of Tender Notice or Operator may buy tender book from E- tendering website
www.nmmc.maharashtra.etenders.in or www.nmmconline.com.
3.2 For work of tender amount Rs. 3 lacs & above, tender book will be issued online only though E-
tendering Website www.nmmc.maharashtra.etenders.in or www.nmmconline.com.
3.3 For work of tender amount Rs. 3 lacs & above Price of Blank Tender form must be paid by Net
Banking/any bank credit or debit card.
3.4 The Tender Document is non-transferable. Only the Tenderer who has purchased the tender form shall
be entitled to bid in the Tender.
4. Language of Tender/Contract
4.1 The language of the Tender shall be in English/Marathi and all correspondence, drawings, etc. shall
conform to the English/Marathi language.
5. Pre-bid meeting and Clarifications by Tenderer
5.1 A Pre-Tender conference of all intending Tenderers will be held at the scheduled date and time
indicated in tender notice or Schedule ‘A’ of the Tender. Intending Tenderers will be allowed to seek
clarification, in specifications, Conditions of Contract, etc. The Corporation will communicate such
changes that are accepted by it, to all the intending Tenderers who have purchased the Tender
Document from the Corporation. Only such changes that are so communicated shall be binding on
the Corporation and all the Tenderers.
6. Earnest Money
6.1 The tenderer shall deposit the amounts indicated in the tender notice as Earnest Money Deposit
(EMD)., The payment for earnest money shall be done through online payment gateway. The
payment can be made by debit/credit card of any bank or net banking. Please note EMD amount will
not be accepted at NMMC account dept.The failure or omission to deposit the Earnest Money shall
disqualify the tender and the corporation shall exclude from its consideration such disqualified
Tender(s). No interest shall be payable by the Corporation in respect of such deposited Earnest
Money.

6.2 The tenderer should refer user’s guide while depositing EMD through the E-tendering website
https://nmmc.maharashtra.etenders.in
7. Validity of Tenders
7.1 The Tenders will be valid for a period of 120 days from the date of Tender opening.
8. Forfeiture of EMD
8.1 The Tenderer shall not revoke his Tender or vary its terms and conditions without the consent of the
Corporation during the validity period of Tender. If the Tenderer revokes the Tender or varies its terms
or condition contrary to its promise to abide by this condition, the Earnest Money deposited by it shall
stand forfeited to the Corporation without prejudice to its other rights and remedies and the Tenderer
shall be disentitled to submit a tender to the Corporation for execution of any work during the next
twenty-four (24) months effective from the date of such revocation.
8.2 If the successful Tenderer does not pay the Security Deposit in the prescribed time limit or fails to sign
the agreement bond, its Earnest Money Deposit will be forfeited by the Corporation.
9. Refund of Earnest Money
9.1 The Earnest Money of tenderers shall be refunded without any interest after the successful tenderer furnishes
the required Initial security deposit to the corporation and signs the contract agreement.
10. Cost of Tender
10.1 The Tenderer shall bear all costs associated with the preparation and submission of its Tender. The Corporation
shall in no case be responsible or liable for these costs, regardless of the conduct or the outcome of the
Tendering Process.
11. Eligible Tenderers
11.1 Only those Tenderers who fulfill the eligibility criteria as mentioned in Schedule A of the Tender Notice are
eligible to submit their Tenders for this work. The documents indicated against each of the eligibility criteria
shall be required to be submitted along with the technical bid to establish the eligibility of the Tenderer.
12. Relationship with Corporator (s)
12.1 The Tenderer shall not be associated presently or in the past with any of the office bearers of Corporators of
Navi Mumbai Municipal Corporation, either directly or indirectly as specified in the section 10(f), (g) of
Maharashtra Municipal Corporation, Act 1949. The Tenderer shall furnish an affidavit on a Non-Judicial stamp
paper of Rs.100/-. If any information so furnished shall be found to be untrue or false, the Tenderer shall be
liable to be disqualified and the Earnest Money Deposit accompanying such Tender shall stand forfeited to the
Corporation. If the Information so furnished shall be found to be untrue or false during the currency of the

contract, the Tenderer shall be held to be in default and the Contract if any awarded to it shall be liable to be
terminated with its consequences.
13. Manner of Submission of Tender
13.1 The tender should be submitted through E-tendering system only on the website
https://nmmc.maharashtra.etenders.in.
14. Last Date for Submission
14.1 Tenders shall be received at the web site specified above not later than the time and date specified in the tender
notice.
14.2 The Corporation may, at its discretion, extend this deadline for submission of tenders by amending the tender
documents, in which case all rights and obligations of the Corporation and tenderer will thereafter are subject to
the deadline as extended.
14.3 Any tender received by the Corporation after the deadline for submission of tender prescribed by the
Corporation, pursuant to the clause above, will be rejected and/or returned unopened to the tenderer.
15. Submission of Tenders (Two Bid system)
Tenders should be submitted in two separate sheets. One sheets should contain the Technical
documents and documents related to eligibility criteria duly subscribed as “Technical Bid”. Second
sheets should contain the price details duly subscribed as “Price Bid”. Both subscribed Sheets should
be filled up on available online at the E-tendering portal during the online Bid submission.
The two submission Sheets shall contain the following:
Sheet no.1 (Technical Bid): As per Schedule ‘A’.
(Tenderer is advised to submit online all the required documents in the technical bid sheet )
(A) Technical Bid should contain following documents.
1. EMD paid receipt/screen shot (as per clause 6 )
2. Receipt of purchase of Tender Copy (as per clause no 3)
3. Firm details as per Annexure – 1.
4. Audited financial statement/Turnover certificate certified by Chartered accountant of subsequent last 3
years
5. Undertaking (Annexure-2)
6. Affidavit on a Non-Judicial Stamp paper of Rs.100/- as per Annexure-3.
7. List of Works in hand as on the date of submission of this Tender in Annexure 4.
8. List of Works tendered as on the date of submission of this Tender in Annexure 5.
9. List of machinery and plant immediately available with the Tenderer for use on this Work and list of
machinery proposed to be utilised on this Work but not immediately available and the manner in which
it is proposed to be procured in Annexure 6.

10. Details of Technical staff with educational qualification (B. Sc. Biology or Entomology) in
Annexure 7.
11. Valid Firm/ company Registration (Shop establishment certificate/S.S.I. Certificates /Certificates In
corporation etc)
12. GST registration certificates
13. PAN card / Income Tax Number
14. Copy of Partnership deed, in case of partnership concern (if any)
15. Valid Pest Control license from Maharashtra State Govt ’s Agricultural Dept.
16. Provident Fund Registration Account No. and Certificate.
17. MOU with Manufacturers / Authorised Dealers / Authorised Distributors for purchase of Larvicide /
Insecticide as mentioned in Annexure- 18. Documents submitted by the tenderer must be attested, clear and readable. If not so.It will be treated as
non submission of document
15.2 Sheet no.2 (Financial Bid)
This Sheet shall only contain the Commercial bid. The price bid should be filled as per original enclosed
Schedule-B and should be typed or written in words and figures at appropriate places.
Rates
1) Rate should be quoted inclusive of all state/central/local government taxes,local body tax, duties and other
expenses to carry out the scope of work as mentioned above and otherwise the rates quoted shall be treated as
inclusive of all.Corrections/Alterations/Over writing, if any, shall also be initialled with date.
16. Important Points to be Noted by the Tenderer
16.1 The Price Bid shall be inclusive of all State / Central / Local Government taxes, duties and other
expenses etc. to be claimed by the Tenderer for the work and claim for extra payment on any such
account shall not be entertained.
16.2 Price Bid should be written both in words & figures in the price schedule at appropriate places.
16.3 No alterations and additions anywhere in the tender documents are permitted. If any of these are
found, the Tender will be summarily rejected.
16.4 In case of firm each partner or power of attorney holder shall sign the Tender and the signature shall
be attested as witness by the reputed person in the space provided for the purpose. The attested
copies of power of attorney shall be signed by all partners. In case of Private Ltd. or Public Ltd.
companies the Power of Attorney shall be supported by Board Resolutions and appropriated and
adequate evidence in support of the same shall be given.
All pages and pasted slips should be signed by the Tenderer.
16.5 No pages shall be added or removed from the Tender Document.

16.6 The Tenderer shall be deemed to have studied the schedule of work, terms and conditions, scope of
work and shall satisfy himself before submitting the Tender and an undertaking to this effect should
be signed by the Tenderer in the form attached as UNDERTAKING. (Annexure 2)
16.7 The Tenderer shall submit the Tender which satisfies each and every condition laid down in this
Tender notice failing which, the Tender will be rejected. The conditional Tenders will also be
rejected.
16.8 It is obligatory to fill tender for antilarval and fogging activity inclusive of larvicide for the entire area
of the Urban Primary Health Centre.
16.9 All Xerox copies should be attested.
16.10 Documents uploaded in E Tender submission only, will be considered for eligibility
17. Corrupt or Fraudulent Practices
17.1 The Corporation requires that the Tenderers under this Tender observe the highest standards of
ethics during the procurement and execution of such Contracts. In pursuance of this policy, the
Corporation defines for the purposes of this provision, the terms set forth as follows:
(a) “corrupt practice” means the offering, giving, receiving or soliciting of anything of value to
influence the action of the public official in the procurement process or in contract execution;
and
(b) “fraudulent practice” means a misrepresentation of facts in order to influence a procurement
process or a execution of a contract to the detriment of the Corporation, and includes collusive
practice among Tenderers (prior to or after Tender submission) designed to establish Contract
Prices at artificial non-competitive levels and to deprive the Corporation of the benefits of the
free and open competition.
17.2 The Corporation will reject a proposal for award if it determines that the Tenderer recommended for
award has engaged in corrupt or fraudulent practices in competing for the Contract in question. The
Corporation will deem a firm ineligible, either indefinitely or for a stated period of time, to be
awarded a contract if it at any time determines that the firm has engaged in corrupt and fraudulent
practices in competing for, or in executing, a contract.
18. Manner of Opening of Tender
18.1 The Tender received before the time and date specified vide Schedule ‘A’ above will be opened as per
the specified program in the office as mentioned in the Tender notice (if possible).
18.2 The Tenders will be opened in the presence of Tenderers or their authorized representatives who
choose to remain present on the opening day, at the scheduled time.

19. Process to be Confidential
19.1 Information relating to the examination, clarification, evaluation and comparison of Tenders and the
award of a Contract shall not be disclosed to Tenderers or any other person not officially concerned
with such process until the award to the successful Tenderer has been announced.
20. Preliminary Scrutiny
20.1 The Corporation will scrutinize the offers to determine whether they are complete, whether any
errors have been made, whether required technical documentation have been furnished, whether
the documents have been properly signed, and whether the offers are generally in order.
20.2 Prior to the detailed evaluation, the Corporation will determine the substantial responsiveness of
each offer to the Tender Documents. For purposes of these clauses, a substantially responsive bid is
one that confirms to all the terms and conditions of the Tender Documents without material
deviations. The Corporation’s determination of an offer’s responsiveness is to be based on the
contents of the Tender offer itself without recourse to extrinsic evidence.
20.3 A Tender offer determined as not substantially responsive will be rejected by the Corporation and
may not subsequently be made responsive by the Tenderer by correction of the non-conformity.
20.4 The Corporation may waive any minor infirmity or irregularity in a Tender offer, which does not
constitute a material deviation. This shall be binding on all Tenderers and the Corporation reserves
the right of such waivers.
21. Clarification of Offers
21.1 To assist in the scrutiny, evaluation and comparison of offers, the Corporation may, at its discretion,
ask some or all Tenderers for technical clarification of their offer. The request for such clarifications
and the response shall be in writing. To speed up the Tender process, the Corporation, at its
discretion, may ask for any technical clarification to be submitted by means of facsimile by the
Tenderer. In such cases, original copy of the document describing the technical clarifications must be
sent to the Corporation by means of courier/in person.
22. Short listing of Tender(s)
22.1 The Corporation will short-list technically qualifying Tenderers and Financial Bids of only these
Tenderers will be opened at a date and time to be intimated therefore tenderer must note no further
time will be granted for submitting document.
23. Opening of Financial Bids
23.1 The Corporation shall notify the date of opening of the Financial Bids to all the Tenderers.
23.2 On such notified date, the Envelope No. 2 will be opened and the rates in Schedule ‘B’.

24. Acceptance of Tender
24.1 Acceptance of Tender on behalf of the Corporation shall be done by an officer(s) to whom the powers
are delegated by the Municipal Commissioner.
24.2 The Corporation is not bound to accept the lowest or any tender. The right to split up the
Work/Service in two or more parts is reserved by the Corporation and also the right to award the
Work/Service to more than one Operator is reserved.
24.3 The Municipal Commissioner reserves the right to reject any or all Tenders received without assigning
any reason whatsoever.
25. Intimation to Successful Tenderers
25.1 The acceptance of Tender may be communicated to the successful Tenderer in writing or otherwise
either by the Tender opening authority or any designated authority in the Corporation.
26. Agreement with Competent Authority
The successful tenderer has to make an agreement with Competent Authority as per the provision
laid down in the Maharashtra Municipal Corporation, Act 1949.
27. Security Deposit
27.1 The Operator shall pay a security deposit equal to Five percent of the contract sum as security for due
fulfillment of the contract, unless otherwise stated in the tender documents. The mode of making
this deposit as under.
i) In cash or,
ii) In form of National Saving Certificate pledged in favour of the Corporation or Bank Guarantees /
Fixed Deposit from the Nationalised / Scheduled Banks in the enclosed format or
iii) Partly in cash and partly in form of National Saving Certificate pledged in favour of the
Corporation or Bank Guarantees / Fixed Deposit from the Nationalised / Scheduled Banks in the
enclosed format.
27.2 All compensations or other sums of money payable by the Operator under the terms of this contract
or any penalty for damages, the amount of such penalty or damages and the deposit to be forfeited if
not previously paid to the Commissioner shall immediately on demand be paid by the said Operator
to the Corporation.
27.3 Return of Security Deposit.
Security Deposit will be returned to the Supplier by the Corporation at the end of twelve months
after the completion date or termination date of this contract provided that there are no outstanding
claims of the Corporation on the supplier.

28. Execution of Contract Document
28.1 The successful Tenderer after furnishing Initial Security Deposit, is required to execute an Agreement
in duplicate in the form attached with the Tender Documents on a stamp paper of proper value. The
proper value at present is Rs. 100/-. The Agreement should be signed within Fifteen (15) days from
the date of acceptance of the Tender. The Contract will be governed by the Contract Agreement, the
Conditions of the Contract (CoC) and other documents as specified in the CoC.
29. LICENSES
The successful Tenderer should comply the statutory instructions of contract labour and will be
required to produce a valid licences issued in his favour under the provision of the Contract Labour
Licences before starting the work. He has to submit other licences which are statutory.
Some of the Rules & Law that may be applicable are annexed (Annexure 1)
30. RIGHTS OF THE CORPORATION
30.1 The Corporation reserves the rights to suitably increase or reduce the Scope of Work put to this
Tender.
30.2 The right to split up the work in two or more parts is reserved by the Corporation and also right to
award the work to more than one Operator is reserved.
30.3 In case if found that the tenderer has submitted forged documents the following actions will be taken
against the tenderers.
a) The extra expenditure incurred because of risk purchase shall be recovered from the tenderer.
b) The police case will be filed against the tenderers.
c) His Registration will be cancelled.
d) The tenderer’s EMD / Security deposit amount, Bank Guarantee will forfeited.
e) The tenderer will be debarred from participating in the tender for next three years.
31. Interpretation of the Clauses in the Tender Document
31.1 In case of any ambiguity in the interpretation of any of the clauses in Tender Document or the
Contract Document, interpretation of the clauses by the Corporation shall be final and binding on all
Parties.
32. Notice to form Part of Contract
32.1 Tender notice and these instructions shall form part of the Contract.

33. HYGIENE STANDARDS
a. The employees should be in proper uniform at the time of work.
b. They should be presentable in appearance i.e. well cut hairs, properly combed, neat shaved, etc.
34. CONTRACTORS RESPONSIBILITIES
34.1 Material cost and outgoing: The cost of labour wages according to the semi skilled as per the govt or corporation
rules and regulations, anti larval and fogging activities inclusive of required equipments and required larvicide
and adulticide needed for the said operations, maintenance of equipment and any other expenses including fuels,
any taxes, local or otherwise required by the Contractor for the purpose of this contract shall be borne by the
Contractor.
34.2 The Operator shall provide its staff, a minimum of two sets of uniforms, shoes, chappals, umbrella, raincoats and
Safety Gears wherever required. The color of uniform shall be decided by NMMC. The employees shall also
display a photo identity card on their person clipped to the shirt at all times
34.3 Every employee medical check-up will be done once in a year for fitness.
34.4 If the Competent Authority asks the Operator to remove a person who is a member of the Operator's staff stating
the reasons, the Operator shall ensure that the person leaves the on the same day and has no further connection
with Services under this Contract.
34.5 The Operator shall be responsible and liable for payment of salaries, wages and other legal dues like Provident
Fund, Gratuity etc. of the employees who are employed by the Operator for the purposes of carrying out the
Services undertaken by the Operator under this Agreement and shall maintain proper books of accounts, records
and documents, and comply with all statutes, rules and regulation which are applicable to the Operator or the
Operator's employees.
34.6 At the times during continuance of the Contract, the Operator shall abide by all existing and future labour
enactment and rules made there under, regulations, notifications and bye-laws of the Central, State or Local
Government. The Operator shall keep the Corporation indemnified in case any action is taken against the
Corporation by any Authority on account of contravention of any of the provisions of any Act or rules made there
under, regulations or notifications including amendments.
34.7 If the Corporation is caused to pay or reimburse, such amounts as may be necessary to cause or observe, or for
non-observance of the provisions stipulated in the notifications/bye-Iaws/acts/rules/regulations including
amendments if any, on the part of the Operator and in connection with labour enactment, the Competent Authority
shall have the right to deduct any money due to the Operator including its amount of Security Deposit. The
Competent Authority shall also have the right to recover, from the Operator, any sum required or estimated to be
required for making good the loss or damage suffered by the Corporation.
34.7 The Operator is responsible to pay monthly wages as declare under the provision of minimum wages Act 1948
34.8 As per NMMC policy Operator responsible to pay to each Antilarval Worker as mention below.

35.1 Levy amount will be reimbursement after submission of valid documentary proof by the contractor.
36.0 DISPUTES AND ARBITRATION:
The corporation and the contractor shall make every effort to resolve amicably by direct informal negotiation, any
disagreement or dispute arising between them under or in connection with the contract.
If a dispute of any kind whatsoever that cannot be resolved the same shall be referred to the sole arbitration of the
Municipal Commissioner and if the Municipal Commissioner is unable or unwilling to act as such, then the matter in
dispute shall be referred to sole arbitration or such other person appointed by the Municipal Commissioner who is
willing to act as such Arbitrator, it is also a term of this contract that no person other than a person appointed by the
Municipal Commissioner as aforesaid should act as an Arbitrator.
As aforesaid the provisions of the Arbitration and Conciliation Act, 1996 or any statutory modification or re-
enactment thereof and the rules made there under and for the time being in force shall apply to the arbitration
proceedings under this clause.
37.0 MODE OF SERVING NOTICE:
Communications between the parties which are referred to in the Contract are effective only when in writing. A
notice shall be effective only when it is delivered (in terms of Indian Contract Act).
Subject to as otherwise provided in this contract all notices to be issued on behalf of the corporation and all other
actions to be taken on its behalf may be given or taken by the competent authority. If sent by registered post to the
last known place or abode or business of the contractor shall be deemed to have been served on the date when in the
ordinary course of post that would have been served on or delivered to it.
38.0 PUBLICITY:Any publicity by the contractor in which the name of the corporation is to be used should be done
only with the explicit written permission of the corporation.
39.0 GOVERNING LANGUAGE: Governing language for the entire contract and communications thereof shall be in
English or Marathi only.
40.0 LAW:The contract shall be governed and construed in accordance with the law in India.
41.0 LEGAL JURISDICTION:
No suit or other proceedings relating to performance or breach of contract shall be filed or taken by the contractor in
any court of law except principal court of Ordinary Civil Jurisdiction at Navi Mumbai which shall have exclusive
jurisdiction to the exclusion of any outside court.
42.0 STAMP DUTY:
The contractor shall bear and pay any stamp duty and registration charges of the contract.
43.0 TERMINATION of Contract
If the Operator is deemed by Law unable to pay his debts as they fall due or enters into voluntary or involuntary
bankruptcy, liquidation or dissolution (other than a Voluntary liquidation for the purpose of amalgamation or

reconstruction), or becomes insolvent or makes an arrangement with, or assignment in favors of his creditors, or agrees
to carry out the Contract under a committee of inspection of his creditors or if a receiver, administrator, trustee or
liquidator is appointed over any substantial part of his assets or if under any Law or regulation relating to
reorganization, arrangement or readjustment of debts, proceedings are commenced against the Operator or resolutions
passed in connection with dissolution or liquidation or if any steps are taken to enforce any security deposit over a
substantial part of the assets of the Operator, or if an act is done or even occurs with respect to the Operator of his assets
which, under any applicable law has substantially similar effect to any of the foregoing events or
a) Has repudiated the Contract or,
b) Without reasonable excuse has failed to commence the work, or
c) Has failed to comply with the instructions issued by Corporation or his authorized officer, or
d) Despite previous warning is otherwise persistently or flagrantly neglecting to comply with any of the obligations
under the Contract, or
e) Committed any breach of any of the terms of the Contract, or
f) Has given false or untrue information regarding eligibility to offer, as revealed at the selection process is over or
even earlier, or
g) Breach of any of the terms and Conditions of the Contract for any reason whatsoever, or
Then the Corporation may after giving notice to the Operator enter upon the site and terminate the Contract at
Operator's risk without thereby releasing the Operator from any of his obligations or liabilities under the Contract,
or affecting the rights remedies or / authorities conferred on the Corporation under the Contract and no
compensation shall be payable by the Corporation

TECHNICAL AND OPERATIONAL SPECIFICATIONS
FOR CONTRACT ASSIGNMENT
1. Introduction:
Navi Mumbai Municipal Corporation encorporates Malaria / Dengue etc. vector borne diseases & Mosquito Control
by adopting Integrated Vector Management as per the National Vector Borne Diseases Control Programme¸Govt of
India guidelines, which comprises of source reduction of vectors-anopheles, aedes etc by utilizing combination of
larvicide, biological method, adulticide (thermal fogging) by using necessary equipments; Indoor breeding
checking, Malaria/Dengue case investigation and Awareness Activities throughout the year.
2. Period of Contract :

Note: –
The Operator may note that the potential sites for mosquito breeding are likely to change seasonally, and it will be
the duty of the successful Operator to identify new sites and to eliminate existing sites which are prone for
mosquito breeding and provide the manpower / work accordingly. The prime objective is to achieve
Malarial/Dengue etc vector borne diseases / mosquito nuisance free zone which is expected from the Operator.
4. Scope of wok :
Service 1 :- Prevention of Mosquito Breeding (Souce reduction by antilarval measures)
4.1.1 The Operator must survey the UPHC areas and identify variety of mosquito breeding places of all vector borne
diseases (Malaria, Dengue etc) and nuisance mosquito species, ecological features, social conditions, operational
problems and also for determining the resource inputs required to eliminate mosquito menace in the area of
operation. The operator shall be required to work out a detailed program for operation should write Code No.
for Breeding Places in Black and for Guppy Fish in Red in the area with paint and show direction with Chalk
directing daily Oiling and Fogging Activities, and updated concerned documents, Reports of the same should be
submitted with approval from respective M.O. UPHC within one month of execution of contract in the UPHC
area based on the above survey.
4.1.2 UPHC area should be divided into suitable zones and sub-zones for proper allocation to the field staff to ensure
complete coverage of anti-larval work at weekly frequency. The objective is to prevent the breeding of
mosquitoes anywhere in the area of operation. This will usually include anti-larval spraying at all the points

where stagnation of water takes place either in the open areas, gutters, storm water drains, septic tanks,
unhabitated building, quarry sites etc.
4.1.3 The Operator will also be required to undertake minor civil works to prevent stagnation of water in open Spaces,
gutters, storm water drains, so that the number of breeding site can be drastically reduced. The Operator shall
also do minor engineering work with removal and eradication of aquatic vegetation wherever necessary, by
applying weedicide which has to be supplied by the Operator.
4.1.4 The Operator shall introduce larvivorous fish in all suitable breeding places wherever necessary.
4.1.5 The Operator has to maintain Guppy fish hatchery tank as well as natural hatcheries.
4.1.6 The Operator shall arrange for special intensive anti-larval activities for additional breeding places during rainy
season or as required.
4.1.7 Weekly Frequency of Larvicide application. All potential breeding places of malaria Vector and mosquito
nuisance species are required to be treated by suitable larvicides with weekly frequency. Larvicide are required
to be used in recommended dosages and frequency of application. The choice of larvicide (Temephos, Pyrosene
Oil, B. thuringnesis) should depend upon the characteristics of water bodies and the application should be as per
the instruction of Competent Authority Larvicide application is required to be done over entire allotted area
including ½ Km width of peripheral area and all building construction sites from ground floor to the top, all
villages, slums and nodal township, MIDC area, stone quarries and inhabited open area etc.
4.1.8 Operator should do inspection of overhead tanks and drums as & when as per instruction of the Medical Officer
in the area given for contract.
4.1.9 Work is required to be done throughout the year except Sundays.
Service 2 : -Elimination of Mosquitoes (Fogging)
4.2.1 The Operator shall also draw out a weekly program for fogging at all location where mosquitoes are present.
This will usually include all the covered drains, meter rooms in build up premises, inhabited buildings etc.
Monthly fogging programme with weekly frequency should be prepared by the Operator and got approved from
M.O., UPHC’s. The number of fillings and area to be covered will be approved by M.O., UPHC.
4.2.2 Insecticide fogging: Fogging shall be done on all days except Sundays. Operator has to purchase diesel, petrol
for fogging operation. Insecticide and no. of fillings will be decided by Competent Authority. Bidder has to
provide required manpower and fogging equipment & other essential equipment, diesel, petrol is to be resorted
to as an adjunct to larviciding, simultaneously in allotted UPHC’s.
4.2.3 Fogging areas need to be prioritized as per VBD prone localities, building construction sites, covered drains and
areas of high mosquito infestation technically. Deltamethrin ULV 1.25% shall be the insecticide of Choice for
outdoor fogging.

4.2.4 Mosquito Density –
Operator will do adult mosquito collection using suction tube from catching stations and density
will then be calculated as the average no. of mosquitoes collected by one person per hour for
Anopheles, Aedes and Culex separately. This will be monitored strictly by HA & or MPW
Mosquito density to be done every VBD case area and at mosquito nuisance area
The Operator will do mosquito collection, density under the supervision of HA, UPHC and submit
weekly report to MO, UPHC.
Service 3 :- Indoor Breeding checking.
4.3.1 The operator shall do the indoor breeding checking compulsory during pre monsoon, monsoon and post monsoon
and as an when required.
4.3.2 The operator shall submit the action plan for the same covering the whole area under given.
4.3.3 The Operator shall submit the daily Indoor Breeding checking report by controlling the entomological indices (HI,
BI, CI) to concern UPHC MO through HA.
Service 4 :- Case Investigation Activities for Vector Borne Diseases like Malaria, Dengue etc.
∗ Case Investigation activity means if any vector borne diseases case - Malaria, suspected / confirmed dengue case
or any other found in the concerned UPHC area the operator has to do the following activity as a part of it..
4.4.1 The Operator shall investigate all VBD's like malaria, suspected / confirmed Dengue cases etc & carry out
intensive vector control activities in the following way.
(i) Each & every case should be investigated & investigation action should start within 24 hrs of reporting &
should be completed by third day. This should be done without disturbing the routine activity as per the
weekly schedule.
(ii) The Operator shall search compulsory for breeding places in and around 100 houses surrounding of
positive malaria/ suspected or confirmed dengue case.
(iii) The Operator shall arrange indoor residual spray in the above houses.
(iv) Thermal fogging with pyrethrum extract / Cyphnothrine shall also be done in the above houses.
(v) The Operator shall also carry out health education for public awareness in the vicinity so as to prevent
mosquito breeding in and around the houses.

Service 5 :- Routine weekly scheduled Anti Larval & Fogging Activities
4.5.1 The Operator shall do inspection of overhead tanks, drums etc. in the habituated buildings in the area of
operation as & when suggested by Medical Officer.
4.5.2 Anti-larval & fogging is required to be done throughout the year except on Sundays at weekly frequency.
4.5.3 Antilarval activities at construction sites shall be carried out by the Operator as & when required, as suggested
by MO, UPHC.
4.5.4 This service includes the malaria /Dengue control Special team.
4.5.5 The operator shall chalk out the programme to search for the breeding places in and around houses at weekly
intervals.
Service 6 :- Community Awareness & Motivation.
4.6.1 The operator shall also carry out health education for public awareness and motivation in the area to prevent
mosquito breeding in & around houses.
4.6.2 All necessary action should be taken to educate and motivate the community for positive action towards vector
borne disease control as per instructions of H.A. and M.O. of concerned UPHC.
Service 7 :- Supply of Larvicides & their specification/quality according to NVBDCP guidelines.
4.7.1 Operator shall purchase All Larvicides, Adulticides & Synthetic Pyrethroid to be used as per Annexure -A
4.7.2 The operator shall submit the Mou signed between Larvicide Supplier and Operator.
4.7.3 The operator shall get Larvicides tested in Govt. Lab and submit the report to Medical Officer of Health, Health
Dept. NMMC before using it in concerned UPHC Area.
4.7.4 Medical Officer of Health, Health Dept. NMMC, Medical Officer (NVBDCP Programme Officer), concerned UPHC
Medical Officer shall randomly collect samples at any instance and send for Lab testing for which operator will
have to bear the expenses.
4.7.5 If the qualitative and quantative analysis of larvicide tested as above is not upto the mark, the available whole lot
of the operator will be sealed at that moment.
4.7.6 Stock-in, lab test report and stock-out to be informed regularly every month to Medical Officer of Health, Health
Dept. NMMC through concerned UPHC Medical Officer.
4.7.7 The operator shall maintain daily stock register which will be monitor by concerned UPHC Medical Officer
directly or through concerned UPHC Health Assistant.
4.7.8 The operator shall have atleast three (3) months buffer stock in their concerned UPHC godown.

Service 8 :- Spray Pumps & other equipments
4.8.1 The Operator should ensure that the appropriate equipments in sufficient quantity is available with the
employees. All equipments should be in good working conditions at all times for smooth and regular functioning
of antilarval activities. All appropriate equipments & Fogging machines shall also be procured and provided by
the Operator.
4.8.2 The Operator can hire fogging machines, foot pumps and knapsack sprayer if available with NMMC if
equipments of Operator is not working. The equipment should be returned to NMMC immediately in working
condition after repair of Operators equipments. Mean time fogging machine charges will be applied at the rate
of Rs.2000/- per month per piece respectively. Upkeep and maintenance of such machines and spray pumps
shall be the responsibility of the Operator and the same may be returned at the end of the contract period in
good working condition.
4.8.3 UPHC wise godown / stores should be established for storage of equipments, insecticides and larvicides within a
period of 15 days from allotment of work order and it is mandatory.
Service 9 :- Staff to be appointed
4.9.1 The Operator should appoint Technical supervisor and other staff as per NVBDCP guidelines.
5. General
5.1 All field workers in mosquito control programme should have in depth training on the cause of mosquito
breeding and be able to educate the general public about the measures necessary for the prevention of
mosquitoes/malaria.
5.2 Operator has a freedom to employ staff of his choice. It is the right of Competent Authority to ask for removal
of any person.
5.3 All field workers should have Khaki uniforms mentioning clearly the work name, and also I card should be issued
to workers.
5.4 It is obligatory on Operator to pay monthly salary by 5th of every month and various other type of payments and
benefits to the staff as per Govt. rules and regulation.
5.5 It is obligatory on Operator to implement activities like Indoor Spraying, Searching positive breeding places
indoor as well as outdoor etc .
5.6 The Operator shall have liaison with Medical Officer, UPHC for effective anti-larval and surveillance work with a
view to bring down malaria incidence.
5.7 The Operator will attend periodical meetings to be held by Medical Officer of Health for reviewing the progress
of the work..

5.8 Medical Officer, Urban Health Post shall supervise the muster, attendance and anti-larval / fogging activity in the
field, all field workers should obey the orders of Medical Officer, UPHC from time to time. In the same way,
Operator should follow the orders of Medical Officer and take necessary action against the worker.
5.9 The Operator shall follow instructions given to him by Competent Authority from time to time.
6. Work Assessment
6.1 The H.A. of concerned UPHC will be required to get all work done under their supervision and also assess the
work done in each of the zone / sub-zone of the concerned UPHC area of operators operation under Service
1,2,3,4 & 5 as mentioned in detail as per Scope of Work as per directions and approval from concerned UPHC
M.O.
6.2 The Operator should do the submission of required reports, updating, concerned documents etc. in prescribed
formats, registers to Medical Officer, UPHC through the HA of concerned UPHC in given stipulated time.
7. Evaluation / Penalties / Bonus
Services
The services are based on following Performance based indicators
a) Zero tolerance of existing Breeding spots and Zero temporary breeding spots
b) After 48 hours of monitoring no Pupa stage and or Larval density should be less than 5-10 larva
(1st - 2nd stage) which should be destroyed immidietly

Service 1
a) Operator has to search for potential breeding places and update the list of breeding places regularly.
The Officers/staff of Competent Authority shall survey for potential breeding places. If the breeding
places are not enlisted, then the MO, UPHC shall impose penalty of Rs.100/- for each undetected
breeding place.
b) The operator is expected to carry out anti-larval work with appropriate use of Lavicide, use of guppy
fishes and covering by net and such work must be reported every day with utmost honesty. A penalty of
Rs.500/- shall be imposed for every site in case of false activity by the Operator.
c) Larval count –
d) Officers/Staff of Competent Authority shall inspect the permanent and temporary breeding site treated
by the operator. If the breeding showing instar larvae is observed then a fine of Rs.300/- for every
Aedes site, Rs.200/- for each anopheles site and Rs.100/- for each Culex site shall be imposed by MO,
UPHC. In case of mixed breeding, higher penalty as per species will be considered. Compounding fine
will be imposed as double the amount if the same site is found to have breeding.
The Operator has to inspect all breeding places under the supervision of HA, UPHC and submit weekly
report to MO, UPHC.
e) The Operator has to undertake minor civil works to prevent stagnation of water in open spaces, gutters
and storm water drains. If breeding site is found where minor civil works is not undertaken then penalty
of Rs.200/- per site shall be imposed by MO, UPHC.
f) In case of non maintenance of hatcheries a penalty of Rs.1000/- per hatchery per month in case of
artificial hatchery and Rs.100/- per hatchery per month in case of natural hatchery will be imposed by
Medical Officer, UPHC.
g) Guppy Fish
The operator will has to maintained the guppy fish sites and the hatcheries for total contract period and
if not maintained then Rs.200/- per site will be penalized per occurrence.

h) If workers found absent in their working area a penalty of Rs.500/- per worker per incident will be
imposed.
i) If worker found without equipments & larvicides then penalty of Rs.500/- per day will be imposed.
j) If the worker found without Breeding Places list and map of working area, penalty of Rs. 500/- will be
imposed.
k) Every Operator has to submit Master file, map file & updated list of breeding places after receiving work
order, otherwise fine of Rs.100/- will be imposed per day.
l) If Technical Supervisor of Operator found absent, Rs.500/- fine will be imposed per day.
m) If the Marking of daily Spraying & Fogging, Code no. of Guppy Fish Hatchery and numbering Breeding
Spots not found, then penalty of Rs. 100/-, 100/-, 50/- and Rs.200/- will be imposed per occurrence
respectively.
Service 2
Imposing penalty and offering bonus shall be worked out on the basis of increase or decrease of
mosquito density respectively as follows:

b) Fogging:
The team of 2 persons with fogging machines are expected to carry out fogging activities as suggested
by Medical Officer, UPHC in the specified area regularly without fail, MO, UPHC will impose penalty of
Rs.100/- per filling that is not carried out as suggested by Medical Officer, UPHC.
Service 3 Case Investigation Activity.
a) The operator is expected to start case investigation of every Malaria / suspected Dengue etc Vector
borne diseases case within 24 hours of reporting and should be completed within two working days. A
delay fine of Rs.250/- per day and Rs.1000/- per case per day, after 2 working days additional penalty
shall be imposed by MO, UPHC.

b) The operator is expected to do complete investigation of any Malaria/ Suspected Dengue case by doing
indoor breeding checking, indoor residual spraying, indoor fogging & IEC in the concerned area. M.O.,
UPHC will impose Rs.2500/- per case for incomplete case investigation activity.
c) The Operator has to check for the breeding present in an around the houses. If indoor breeding is found
during case investigation activity Rs. 150/- for aedes, Rs. 100/- for Anopheles and Rs. 50/- for Culex site
shall be imposed by M.O. U.H.P.
Service-4 Vector Borne Disease Case burden
The operator should bring down malaria to Zero Indigenous case and dengue incidence substantially.
The operator should bring down malaria/Dengue/Chikungunya etc incidence substantially.
Any of VBD case found indigenous case on investigation by Medical Officer UPHC would have penalty of
Rs. 1000/- per indigenous case.
General :
a) The operator has to pay wages to contract workers by 5th
of every month, otherwise a penalty equal to
25% of the unpaid amount per month will be recovered from the monthly bill.
b) If workers are found in the field without clean and proper full uniform then the penalty of Rs.50/- per
worker per occurence will be imposed.
c) If workers are found in the field without equipment or idle equipment then penalty of Rs.50/- per
worker per day will be imposed.
d) The work done by the operator will be supervise and monitor by the Medical Officers, UPHC as well as
by the Head Office Officers.
If overall performance found unsatisfactory then a penalty minimum 0.5 % per incidence and maximum
up to 10% of the total Annual Amount will be imposed from Head Office.
e) The operator has to keep all equipments in working condition and repairs should be carried out
within 48 hours of its breakdown. If equipments are found to be not in working conditions after
48 hours, then penalty of Rs.250/- per fogging machine per day and of Rs.50/- per spray pump
per day will be imposed till the equipments are repaired.
f) Larvicide consumption
Larvicide should be used according to the NVBDCP guidelines and as per the Competant Authority's
instruction preference to be given more the biological methods like introduction of guppy fish,
Gambusia fish etc. and use of Biolarvicide.

Service 5: Indoor Residual Spraying(IRS).
The Operator shall do the IRS in the high risk & sensitive areas where API is more than 1.
A Scheduled Microplanning to be made for such areas according to the MO UPHC
This shall be done in two phases; first in the second week of June Followed by second spraying to be
done in second week of September.
The Operator shall do the IRS as planned by MO UPHC for the educational institutions in the UPHC area
in the last week of May & should complete by the end of 7th June.
Submission of Bills
Operator should submit the monthly bill on 5th
of every succeeding month. The bill should be submitted to
concerned Medical Officer, UPHC in triplicate.
Following documents should be submitted along with the bills.
Xerox copy of the attendance muster as per Biometric.
Xerox copy of the Payment muster.
Daily report of all activities carried.
DISPUTES AND ARBITRATION:
The corporation and the contractor shall make every effort to resolve amicably by direct informal
negotiation, any disagreement or dispute arising between them under or in connection with the contract.
If a dispute of any kind whatsoever that cannot be resolved the same shall be referred to the sole arbitration of
the Municipal Commissioner and if the Municipal Commissioner is unable or unwilling to act as such, then the
matter in dispute shall be referred to sole arbitration or such other person appointed by the Municipal
Commissioner who is willing to act as such Arbitrator, it is also a term of this contract that no person other than
a person appointed by the Municipal Commissioner as aforesaid should act as an Arbitrator.
As aforesaid the provisions of the Arbitration and Conciliation Act, 1996 or any statutory modification or
re-enactment thereof and the rules made there under and for the time being in force shall apply to the
arbitration
proceedings under this clause.

16.0 MODE OF SERVING NOTICE:
Communications between the parties which are referred to in the Contract are effective only when in writing. A
notice shall be effective only when it is delivered (in terms of Indian Contract Act).
Subject to as otherwise provided in this contract all notices to be issued on behalf of the corporation and all other
actions to be taken on its behalf may be given or taken by the competent authority. If sent by registered post to the
last known place or abode or business of the contractor shall be deemed to have been served on the date when in
the ordinary course of post that would have been served on or delivered to it.
17.0 PUBLICITY:Any publicity by the contractor in which the name of the corporation is to be used should be done only
with the explicit written permission of the corporation.
18.0 GOVERNING LANGUAGE: Governing language for the entire contract and communications thereof shall be in
English or Marathi only.
19.0 LAW:The contract shall be governed and construed in accordance with the law in India.
20.0 LEGAL JURISDICTION:
No suit or other proceedings relating to performance or breach of contract shall be filed or taken by the contractor
in any court of law except principal court of Ordinary Civil Jurisdiction at Navi Mumbai which shall have exclusive
jurisdiction to the exclusion of any outside court.
21.0 STAMP DUTY:
The contractor shall bear and pay any stamp duty and registration charges of the contract.
Extension of contract period-
The Operator should not stop the work ever after completion of contract period or in between unless
specifically informed by Competent Authority in writing.
TERMINATION of Contract
If the Operator is deemed by Law unable to pay his debts as they fall due or enters into voluntary or involuntary
bankruptcy, liquidation or dissolution (other than a Voluntary liquidation for the purpose of amalgamation or
reconstruction), or becomes insolvent or makes an arrangement with, or assignment in favors of his creditors, or
agrees to carry out the Contract under a committee of inspection of his creditors or if a receiver, administrator,
trustee or liquidator is appointed over any substantial part of his assets or if under any Law or regulation relating to
reorganization, arrangement or readjustment of debts, proceedings are commenced against the Operator or
resolutions passed in connection with dissolution or liquidation or if any steps are taken to enforce any security
deposit over a substantial part of the assets of the Operator, or if an act is done or even occurs with respect to the

Operator of his assets which, under any applicable law has substantially similar effect to any of the foregoing events
or
a) Has repudiated the Contract or,
b) Without reasonable excuse has failed to commence the work, or
c) Has failed to comply with the instructions issued by Corporation or his authorized officer, or
d) Despite previous warning is otherwise persistently or flagrantly neglecting to comply with any of the
obligations under the Contract, or
e) Committed any breach of any of the terms of the Contract, or
f) Has given false or untrue information regarding eligibility to offer, as revealed at the selection process is over
or even earlier, or
g) Breach of any of the terms and Conditions of the Contract for any reason whatsoever, or
Then the Corporation may after giving notice to the Operator enter upon the site and terminate the Contract at
Operator's risk without thereby releasing the Operator from any of his obligations or liabilities under the Contract, or
affecting the rights remedies or / authorities conferred on the Corporation under the Contract and no compensation
shall be payable by the Corporation.

SALIENT FEATURES OF SOME MAJOR LABOUR LAWS APPLICABLE TO ESTABLISHMENT ENGAGED IN FOR MECHANISED
HOUSEKEEPING & MULTIPURPOSE(PATIENT CARE) SERVICES.
I) Workman Comper,sation Act 1923 The Act provides for compensation in case of injury by accident arising out of and during the course of employment. Iii) Payment of Gratuity Act 1972 Gratuity is payable to an employee under the Act on satisfaction of certain conditions on separation if an employee has completed 5 years service or more or on death at the rate of 15 days wages for every completed year of service. The Act is applicable to all establishment employing 10 or more employees. ) iii) Employee PF and Miscellaneous Provision Act,1952 The Act provides for monthly contribution by the employer plus Workers @ 10 % or 8.33 %. The benefits payable under the Act are
a) Pension or family pension on retirement or death as the case may be. b) Deposit linked insurance on the death in harness of the Worker.
c) Payment of PF accumulation on retirement / death etc. iv) Maternity Benefit Act 1951 Act provides for leave and some other benefits to women employees in case of confinement or miscarriage etc. v) Contract labour (Regulation and Abolition) Act 1970 The Act provides for certain welfare measures to be provided by the contractor to contract labour and in case the contractor fails to provide, the same are required to be provided by the Principal Employer by law. The principle employer is required to take Certificate of Registration and the Contractor is required to take a Licence from the designed Officer The Act is applicable to the establishments or contractor of principle employer if they employee 20 or more contract labour. vi) Minimum Wages Act 1970 The contractor shall see that the provisions set for under the Minimum Wages Act and contract regulation and abolition Act 1970 with the Maharashtra Contract Labour (Regulation and Abolition) Rules 1971 as amended from time to time are fully complied with by him and shall maintain necessary registers and records for payment of wages, overtime etc., made to his workmen as required by the Conciliation Officer (Central), Ministry of Labour, Government of India, or such other authorized person appointed by the Central or State Government. Vii) Payment of Wages Act 1936 It lays down as to by what date the wages ate to be paid, when it will be paid and what deductions can be
made from the wages of the workers. Viii) Payment of Bonus Act 1965 The Act is applicable to al establishment employing 20 or more Workmen. The Act provide for payment of annual bonus subject to a minimum of 8.33% wages and maximum of 200 % of wages to employees drawing Rs.35,OOO/- P.M. or less. The bonus to be paid to or employees getting Rs.2500/- P.M. above upto 3500/- P.M. shaII be worked out by taking wages as Rs.2500/- P.M. only. The Act does not apply to certain establishments. The newly set up establishment are exempted or fiver years in certain circumstances . Some of the State Government have reduced the employment size from 20 to 10 for the purpose of applicability of the Act. ix) Industrial Disputes Act 1947 The Act lays down the machinery and procedure for resolution of industrial disputes in what situations a strike or lock out becomes illegal and what are the requirements for laying off or retrenching the employees or closing cown the establishment. x) Industrial Employment (Standing Orders) Act 1946. It is applicable to all establishment employing 1 (l00 or more workmen (employment size reduced by some of the states and Central Government ot 50). The Act provides for laying down ruler governing the conditions of employment by the employer or matters provided in the Act and get the same certified by the designated Authority.

xi) Trade Unions Act 1926 The Act lays down the procedure for registration of trade unions of Workmen and employers. The trade unions registered under the Act have been given certain immunities from civil and criminal liabilities. xii) Child labour (Prohibition and regulation) Act 1986. The Act prohibits employment of children below 14 years of age in certain occupation and processes and provides for regulation of employment of children in all other occupations and processes .Employment of child labour is prohibited in Building and Construction lnsustry. xiii) Inter State Migrant Workmen's (Regulation of Employment and Conditions of Service) Act 1979. The Act is applicable to an establishment which employees 5 or more interstate migrant Workmen through an intermediary ( who has recruited Workmen in one state for employment in the establishment to another state) . The inter state migrant Workmen, in an establishment to which this Act becomes applicable are required to be provided certain facilities such as housing medical ald traveling expenses from home upto the establishment and back. 8. Nature of contract It is a Service contract on performance basis for providing Services as mentioned in scope of work and
