1. INTRODUCTION

“Phuoc An switching substation” is one of the subprojects of the Transmission

Efficiency Project (TEP) financed by the World Bank (WB). This subproject is in line

with the national Power Development Master Plan 7 (PDMP7), approved by the Prime

Minister in 2011. Moreover, it will contribute to meet the objectives of the National

Energy Development Strategy guiding the power sector up to 2020 (Prime Minister

Decision, December 2007) to reduce investment needs in the power sector, strengthen

energy security, control and mitigate environmental pollution by energy activities

and foster socioeconomic sustainable development. The proposed subproject will also

contribute to the implementation of the Socioeconomic Development Plan (SEDP) 2011-

2015, which aims for sustainable economic growth on the basis of improving quality,

effectiveness and competitiveness.

According to plans, Phuoc An 220kV switching station is going to be built to

connect the 220kV lines in Binh Dinh province for the period of 2015-2020. In future,

this station will be the load station to meet the load demand on the rise of Binh Dinh

province and to share the load for 220kV Quy Nhon substation (the existing station

cannot be expanded).

The subproject is planned to be located at Dai Hoi Village, Phuoc An commune,

Tuy Phuoc District, Binh Dinh Province.

Main works:

In the first phase (Phase 1): The switching substation only invests in 220kV

distribution system.

In future (Phase 2): upgrade to 220kV substation regarding additional load

situation, install 220/110/22kV transformers and 220kV, 110kV feeder bays.

* Accordingly, these activities may cause adverse impacts to environment and

local communities during the construction and operation period.

As regards the policies of the World Bank (WB), this subproject is categorized

into group B that have to prepare Environmental Monitoring Plan (EMP) based on

Environmental Social Management Framework (ESMF) of the TEP. In which, the EMP

is in line with the EIA established by the working team of the Engineering Consulting

Joint Stock Company 4 based on legislation and technical regulations of Vietnam.

This EMP report includes information about: subproject description, legal

framework of Vietnam and policies of WB, applicable legislations and environmental

technical regulations applied, potential positive and negative impacts, proposed

mitigation measures that are planning to be implemented during the preparation –

implementation – operation phase. The mitigation measures proposed in the EMP will be

integrated in the tender documents and contracts, together with environmental monitoring

during the implementation process.

Under the provisions of the Government of Vietnam, the "Phuoc An Switching

Station" subproject shall have to establish Environmental Impact assessment (EIA), and

the EIA of the subproject was approved in April 2014 by Decision No. 1176/QD-UBND

of the People's Committee of Binh Dinh province.

2.2 . World Bank Safeguard Policies

The environmental and social screening according to the criteria described in the

Bank’s policy on environmental assessment has been carried out, and the result shows

that the WB policies on Environmental Assessment (OP 4.01) and Involuntary

Resettlement (OP/BP 4.12) are triggered for this subproject. The subproject has also to

comply with the WB’s requirements on public consultation and Policy on Access to

Information. The implementation of the policy on Involuntary Resettlement (OP/BP

4.12) is addressed in the Resettlement Policy Framework (RPF) of the TEP project and

the Resettlement Plan (RP) of this subproject.

- Environmental Assessment (OP/BP 4.01):

- Environmental Assessment (EA) is an umbrella policy for the Bank’s safeguard

policies. The overarching objective is to ensure that Bank-financed projects are

environmentally sound and sustainable, and that decision-making is improved

through appropriate analysis of actions and of their likely environmental impacts.

The EA process is intended to identify, avoid and mitigate potential impacts of

Bank operations. EA takes into account the natural environment (air, water, and

land); human health and safety; social aspects (involuntary resettlement,

indigenous peoples, and physical cultural resources); and trans boundary and

global environmental aspects. EA considers natural and social aspects in an

integrated way.

- This subproject triggers OP 4.01 because it involves the rehabilitation, upgrading,

and operation of a high-voltage overhead transmission line, requiring the

identification, mitigation and monitoring of potential adverse environmental and

social impacts. As required by OP 4.01 and the government EA regulation, the

subproject has prepared an EIA and an EMP that meet the Government’s and the

World Bank’s safeguards requirements. By the TEP appraisal, the subproject’s

EIA and EMP have been disclosed locally at the subproject sites and at the

Bank’s InfoShop on January 24, 2014 as required by OP 4.01 and the Bank’s

policy on access to information. The final EIA and EMP were disclosed locally at

the subproject sites, at the Bank’s InfoShop, and the Vietnam Development

Information Center on April 18, 2014.

- Involuntary Resettlement (OP/BP 4.12)

- The Involuntary Resettlement policy seeks to prevent severe long-term hardship,

impoverishment, and environmental damage to the affected peoples during

involuntary resettlement. OP 4.12 applies whether or not affected persons must

move to another location.

- The Bank describes all these processes and outcomes as “involuntary

resettlement,” or simply resettlement, even when people are not forced to move.

Resettlement is involuntary when the government has the right to expropriate land

or other assets and when affected people do not have the option to retain the

livelihood situation that they have.

- This policy is triggered because the subproject would have impacts involving the

temporary and permanent involuntary taking of land and the loss of structures and

assets associated with the land for the power towers and the right-of-way of the

transmission line. By appraisal, the subproject has prepared and disclosed a RP

locally at the subproject sites and at the Bank’s InfoShop on January 24th

, 2014.

The RP includes the measures to ensure that displaced people are: (i) informed

about the options regarding resettlement; (ii) consulted and offered

alternative resettlement choices; and (iii) provided with effective

compensation and livelihood restoration. The final subproject final RP was

disclosed locally at the subproject sites, at the Bank’s InfoShop, and the Vietnam

Development Information Center on April 18th

, 2014.

3.1 Subproject objectives

The Phuoc An 220kV switching station is going to be built to connect the 220kV

transmission lines in Binh Dinh province for the period of 2015-2020. In future, this

substation will meet the load demand which is more and more rising of Binh Dinh

province and share the load for 220kV Quy Nhon substation (the existing station cannot

be expanded).

3.2 Location of the subproject

Proposed Phuoc An 220kV switching substation (An Nhon) is located in a land area

grown by mango and eucalyptus in Dai Hoi village, Phuoc An commune, Tuy Phuoc

district, Binh Dinh province. Its geographical location is as follows:

+ The North border is contiguous to the existing 220kV, 110kV transmission lines.

+ The South border is contiguous to eucalyptus land area and dry stream.

+ The East and Southeast borders are contiguous to the existing 220kV, 110kV

transmission lines.

+ The West and Southwest borders are contiguous to a mountain and eucalyptus land

area.

The distance between the subproject site and the People’s Committee of Phuoc An

3.3 Main specification of the subproject

3.3.1. The 220kV Phuoc An switching substation

Capacity and voltage level

In the first stage, the switching substation only invests a 220kV distribution system.

In the future will develop into a 220kV substation.

- Voltage level: the substation is designed with 3 voltage levels of 220/110/22kV.

- Capacity: Install 02 220/110/22kV transformers with installed capacity of

02x250MVA.

- Connection diagram

- 220kV side: is designed according to diagram of “two busbar systems with coupling

breaker”, and with contingency space for completing diagram of “two busbar systems

with ring busbar”.

- 110kV side: contingency space for designing according to diagram of “two busbar

3.3.2. The 220kV transmission lines connecting to the substation

a) TL section 1

+ Number of circuits: 02 circuits.

+ Length : 492m.

+ Conductor : steel aluminum conductor with code ACSR-400/51 (suspend 01

circuit ahead).

+ Lightning conductor: suspend 2 lightning conductors, including 01 lightning

conductor combined with optical cable, code OPGW-70 and 01 lightning

conductor, code GSW-70.

+ Insulator : Use ceramic or glass insulators according to standard IEC.

+ Tower : Use double circuit hot dip galvanized steel tower with screw-bolt.

Auxiliary work items are located within the scope of land acquisition of the

switching substation.

Main auxiliary work items:

* Roads:

- Road within the substation: road surface structure is unreinforced concrete with

the width of 4m, road sides is plaid concrete bar M150 and arranged rainwater collection

pits along roads.

- Road accessing to the substation with the length of 1,372.48m are upgraded from

the existing soil pathway (due to local people exploit soil, rock and crops in the area). Its

starting point is connected to the existing concrete road. Its ending point is the gate of

Phuoc An 220kV substation. Surface structure of the access road is ballast crushed stone,

the width of each roadside of 0.5m, the width of road surface of 6m. Slope towards 2

sides according to cross section is i=2%. Along the road, there are some culverts to avoid

blockage of the natural drainage system.

Currently, this dirt road are being using by several local people to visit their

production forest land (mostly planting Acacia) which is located near the project area

mainly by foot or rudimentary transportation means such as bicycle and motorcycle.

Moreover, due to characteristic of Acacia, the owner does not need to neither frequently

visit nor take much care over the land. In case resident needs to transport product from

their land, they normally use the two communal near the project area. Accordingly, the

traffic density in this road is quite low.

* Power and water supply for the subproject construction:

- Power for the substation construction will be bought from the existing power

source. Power supply for construction sites will be provided by cable and circuit-breakers

switches.

- Water for the substation construction will be provided from 50m-deep drilled

wells within the substation. In the future, it will be used for operating the substation.

Water will be pumped into water tanker and container. Then it is drained to the

construction sites by soft plastic pipes. In which, water will be treated to reach acceptable

quality before supplying to staff as drinking water. In practice, drinking water is often

filtered water bottled in 20-liter tanks which are supplied by nearby grocery store.

3.5 Main devices and equipment

- 220kV distribution system invested in the first stage:

+ 220kV breaker: type of 01-phase one, located outdoor, insulator SF6, with

Urated=245kV, Irated=2,500A for feeder bay connecting to Quang Ngai and coupling

breaker bay; Irated=1,250A for other feeder bays, Irated for switching in case of short

circuit=31.5kA/3s, implemented by hydraulic or compression spring drive motor.

+ 220kV isolator: type of 01-phase one and 03-phase one, located outdoor, with

Urated=245kV, Irated=2,500A for feeder bay connecting to Quang Ngai and coupling

breaker bay; Irated=1,250A for other feeder bays, Irated for switching in case of short

circuit=31.5kA/3s, implemented by motor /hand.

+ 220kV voltage transformer: type of 01-phase one, coupling capacitor, located

outdoor, with Urated=245kV; 4,400pF; voltage transformation ratio: 220/√3: 0.11/√3:

0.11/√3, degree of accuracy of 0.5/3P.

+ 220kV current transformer: type of 01-phase one, located outdoor, with

Urated=245kV, current transformation ratio: 800-1,200-2,000/1-1-1-1-1A for feeder

bay connecting to Quang Ngai and coupling breaker bay; 400-800-1,200/1-1-1-1-

1A for other feeder bays, degree of accuracy: 5P20/5P20/0.5/0.5/5P20.

+ 220kV valve type lightning arrester enclosed with lightning register: type of 01-

phase one, located outdoor, ZnO, with Urated=192kV.

Other equipment

- Controlling, protection, and measurement system: Computer, control cabinet.

- Auxiliary power system: 1 auxiliary transformer (22/0.4 kV-250KVA), 01 50KVA

diesel generators.

- Telecommunication systems

3.6. Fuels and materials for the subproject

a. Input fuel and materials for the construction phase

* Demand for construction materials

The construction materials, such as: cement, sand, stone, bricks ... will be purchased

nearby, and transported to the construction site by truck, distance: 20km.

The device electrode materials are expected to arrive Qui Nhon port, transported to

the construction site by truck with the distance of 35km.

According to the statement of the feasibility study, the material for ground leveling

will be purchased by the construction contractor from a licensed dealer near the

construction site.

However, during the construction phase, in case the contractor needs to exploit soil

from a new borrow pit, they will have to prepare an exploiting plan to submit to local

authority for approval. In that case, the plan will follow the environmental specifications

in Table 6.2 of the EMP.

* Demand for workforce

The construction of the switching station is performed by specialized units. Total

construction workforce is expected at 90 people, including:

- Technical staff and management: 5.

- Construction workers: 80 people.

- Cleaner: 5 people.

* The water supply demand

During the construction phase, the amount of water needed for construction

workforce is 10.8m3 / day-night. Water source is taken from wells at the average depth of

50m.

b. Input raw materials for the operational phase

The transformer contains a total of 90 m3 of coolant. This is a fixed amount of oil

in the transformer that only flows into the incident oil storage tank in case of

emergency.

The only fuel consumed is Diesel which is used to periodically check the water

pump for fire protection - prevention, around 2 liters / month.

In addition, during the operation of the station does not use any other chemicals.

Demand for water: Water should be provided to employees of the station on

averages of about 3m3/day (90m

3/month). The main water source is from wells.

This source of water will be treated to reach acceptable quality before being used

for domestic purpose. The contractor and operational unit will be responsible for

quality of water supplied to workers and staff. In practice, drinking water is often

provided to the staff from nearby grocery store.

Water used for fire prevention is stored in 02 storage tanks with a capacity of

100m3 located in the fire pump.

4. BACKGROUND INFORMATION

4.1 Topography

The terrain at Phuoc An 220kV switching sub-station area is relatively flat, the height

ranges from 0.5 m to 3.5 m. In the area of the connection TL, the height ranges from 10m

to 60m.

Vegetation is mainly cashew, mango, and eucalyptus of local people in the

surrounding area.

4.2 Meteorological conditions

Phuoc An 220kV switching stations and the connection transmission lines are

proposed to locate in Binh Dinh province which generally has features of the humid

tropical climate of Southeast Asia monsoon climate and the South Central coastal area

with the following characteristics

The lowest average temperature is 18.8°C (in January), the lowest absolute air

temperature is 10.2°C. The difference in term of the average temperature between the

hottest month and the coldest month is about 6-7 ° C.

The rainy season starts from September, and lasts until December. In which, the

two months have highest rainfall are October and November with the average rainfall

measured at 500-600 mm. Total rainfall in the rainy season accounts for 80-90% of the

total annual rainfall, the dry season lasts from January to August each year, accounting

for 10-20% of the annual rainfall.

The noticeable weather phenomena:

Some noticeable weather phenomena in this area include storms, thunderstorms

and Westerly hot-dry wind. The storm season lasts from September to November, with 1-

2 typhoons coming each year. Influences of typhoons in the area have been relatively

strong.

Thunderstorm is quite rare in this area, and mostly happens during the summer

monsoon season, from April - October, the average number of days having thunderstorms

is 50-80 days.

Westerly hot-dry wind normally appeared in the first half of the summer from

April to August every year, the effect is quite strong that causes extreme high air

temperatures exceeding 400C and low humidity (below 25-30%).

4.3. Hydrological conditions

Hydrological regime of the subproject area:

• Within the subproject area to construct the substation, there is a shallow spring that

only appear during the rainy season. Until now, there has been no record about any

landslides in the area. According to the survey results, the proposed substation area is

not affected by flooding.

• The area of 220kV An Khe - Quy Nhon transmission line connecting to the Phuoc

An 220kV switching sub-station and the 22kV distribution line are unaffected by

flood.

4.4. Current environmental quality in the subproject area

a) Ambient air quality

Ambient air quality is monitored and analyzed through the parameters include: noise,

dust, and typical emission gases (SO2, NO2, CO). The specific analyzing results are

demonstrated in the following table:

All the analyzing results are below the permissible standard. Manufacturing activity in the

subproject area is primarily agricultural activities, therefore noise monitored at all

locations is below maximum permissible limit of noise in common areas during daytime,

dust and the typical air pollutant concentrations are much below than the standard for

surrounding ambient air quality.

b) Water Environment

Water quality of the subproject area is monitored and analyzed by one sample of

surface water, because in the subproject area there is only one small spring. Results of

water quality analysis in the subproject area are demonstrated in the following table:

d) Current ecological conditions of the subproject area

Vegetation coverage in the subproject area is mainly artificial forest, including:

eucalyptus, acacia, vegetables and rice fields of the local farmers.

Animals are mainly livestock, such as: cattle (cattle, pigs), poultry (chicken, duck).

The fauna is poor due to human impact. Most of the recorded species are often the most

common species; there is no presence of the large mammal species and rare animals.

4.5 Socio-economic condition (Phuoc An commune)

a) Economic conditions

Cultivation

The main agricultural crops in the subproject area are rice and vegetables. The cultivated

area of crops in Phuoc An in 2012 is indicated in the following table:

Forestry (reforestation under WB projects)

In the subproject area, the forest are mainly assigned to people to manage, protect as

well as control-prevent pest, and prevent forest fire. The forest trees were planted from

2005 to 2011 with an area of 492.79 ha/230 households. In which, some areas are ready

to be exploited. In 2012, the forest area allocated to households have increase by 51.5

ha/21 households, including acacia and eucalyptus.

b) Social Conditions

* Health Care - Education:

Education: educational quality of the subproject area has been improved; the

commune has enough school at all levels from pre-school to higher education. The

number of drop out pupil at the secondary level has dropped.

Health Care: The commune’s health stations are equipped with enough equipment

and medical personnel are qualified to treat common ailments, to carry out activities for

public health and disease prevention, food poisoning; social diseases management and

treatment.

* Standard of living - Livelihood

The poverty rate of the commune's population fell to 5.8% in late 2012. Poverty

reduction program in the commune is applied over the years to help improve the lives of

people of the subproject area, including: job creation, issue policy to export labor; carry

out activities to help children in difficult circumstances. In 88 affected households, there

is no household that belong to famine – poverty group, primary income source of

households is from agriculture.

* Traffic - Transportation

Currently, there is a track of dirt road that connects the project location with the

communal road. This communal road is, actually, public roads for travelling purpose of

local people of Dai Hoi Village which is being managed by the People Committee of

Phuoc An commune.

The project will upgrade and expand a section on this communal road and the

existing dirt road to facilitate the construction and operation of projects, and

transportation of local people

5.1 Potential positive impacts

This subproject will contribute to meet the objectives of the National Energy

Development Strategy in period of 2011-2020 with consideration to 2030 (approved at

Decision No. 1208/QĐ-TTg dated 21 July 2011 of Prime Minister) to reduce investment

needs in the power sector, strengthen energy security, control and mitigate

environmental pollution in energy activities and foster socioeconomic sustainable

development. The proposed subproject will also contribute to the implementation of

the Socioeconomic Development Plan (SEDP) 2011-2015, which aims for sustainable

economic growth on the basis of improving quality, effectiveness and competitiveness.

The subproject will also bring positives changes to the local and regional economies,

creating favorable conditions for local production activities and other social benefits.

5.2 Potential negative impacts

The implementation of the subproject would mainly cause land acquisition, increased

dust generation, air pollution, domestic waste, and health and safety issues due to

construction activities and electrical magnetic field. Site investigation and document

review, hence, were conducted for identifying and assessing these potential negative

impacts, including consultation with the local communities and affected people.

However, these impacts are not significant, temporary, localized with available

mitigation measures.

The potential negative impacts of the subproject are identified in table 5.2:

Therefore, there is no household has to be displaced and resettled. The location of the

The access road will be upgraded from a dirt road which is being used by a few

households to access their land, this may lead to inconvenience to transportation of some

households but proper measure will be taken place to minimize the impact.

- As mentioned in the section 3.4.3, the area surrounding the substation is mainly

production forest land (milpa) of local people (mostly planting Acacia). Due to the

characteristic of Acacia, the owner does not need to visit their land frequently. In

addition, the existing road is quite small (1-1.5m) that cannot be use for transportation

of big and bulky vehicle. Instead, to transport with these transportation means (car,

truck, etc), local people usually use the two communal roads (see the annex 2).

Accordingly, the traffic density on this road is very low.

- During the construction, the PO will conduct appropriate measures to regulate the

traffic and minimize the risk of accident. In fact, the road is designed in accordance

with national standard, in which the width of 7m (including pavement) is suitable with

the expected traffic density of this road. In addition, the length of this road is relatively

short therefore the constructor can easily arrange measure to minimize impact of

material transporting and transportation of construction vehicles/machines.

Accordingly, there is no need for passing section or U turn along this road.

- Taking all of these reasons into consideration, the construction of the access road is

unlikely pose significant impact to transportation of local residents.

12 Risk of localized

flooding

- According to the design, there is a regularly dried stream at the proposed substation

location. Therefore, the construction of the substation will affect this stream that lead to

the risk of logging this water way. Likewise, the access road will pass through several

canals and small dried water streams that may cause localized flooding in this area.

local people include: accidents in the construction process, traffic accidents on

transportation roads, accidents due to landslide, rock collapse, fire and explosion,...

Thus, it needs to have labour safety measures for workers.

- Last but not least, untreated water if provide to workers of staff may affect their health.

In order to mitigate risks, accidents which can occurring during the operation

process, it needs to carry out and maintain well labor safety and sanitation

measures:

- Technical measures:

Requirement for operators that they must carry out in compliance with electric

safety technical process during the operation. Specifically:

+ Strictly forbid strange people to come in the substation. For people visiting,

studying, they must be guided by manager of the operation unit (or technician).

+ People going and working in the substation, they must have safety grade II

and above. Team leader must have safety grade II and above.

+ All people going in the substation to work or visit must respect substation

regulation. People going in the substation for the first time must be guided in

details.

+ If someone need to get in the substation to repair equipment, devices or

adjust relay,…, There should be 2 people at least and they can only work in

allowable area.

+ When working without barriers/fence, safe distance must ensure > 2.5m for

the voltage level of 220kV.

+ For long repair or bulky equipment/devices transportation, it needs to prepare

specific technical alternative and safety measures before carry out works.

+ When equipment in the substation are occurred risk, it needs to stand 5m far

from these equipment (if located indoor), 10m (if located outdoor).

+ Only approach after ensuring that these equipment is without electricity.

7. MONITORING PLAN

7.1 Objectives and Approaches

It is necessary to prepare an appropriate monitoring plan to demonstrate the overall

effectiveness of the sub-projects as well as short-term impacts due to construction

activities. Specifically, as an integral and important part of the EMP, the environmental

monitoring program shall have the following objectives:

- To determine the extent of the actual impact.

- To control the impacts from the construction process and indicate it in the EMP.

- To check and monitor the implementation of environmental protection measures

during the construction phase based on the EMP.

- To propose mitigation plan for unexpected situation.

- To evaluate the effectiveness of the mitigation measures in the different phases: pre-

construction, construction and operation; and suggestions for improvement.

Safety-environment officers shall have to refer some information/documents as

follows:

- Report on environmental performance of contractors, and implementation plan of the

EMP.

- To practice good environmental mitigation measures.

- Complying with the EMP requirements in accordance with the law.

- Protect sensitive sites, especial protected areas.

- Control soil erosion and landscape

- Measurement on atmospheric conditions.

- Mitigating measures to control pollution of the constructor to reduce impacts on

environment.

Contractors will update all the information related to the construction contract to carry

out site inspection for safety and the environmental staff. Test results and

recommendations related to improving environmental protection and pollution control

will be submitted to the CPPMB and contractors to immediately take appropriate action.

8. EMP IMPLEMENTATION

8.1 Responsibility to implement EMP

During the construction phase, the CPPMB will assign the construction

supervision consultants (CSC) and/or field supervision engineer that is responsible for

supervising contractors on the implementation of daily mitigation measures. Monitoring

results will be taken and reported, and staff that is responsible for safety regulations of

the CPPMB will have the responsibility to ensure that activities related to safety policies

are fully recorded and archived.

Environmental management during the construction process requires the

involvement of stakeholders and each of them has their own responsibilities, including:

NPT, Project Management Board, Department of Natural Resources and Environment of

Binh Dinh, contractors, consultants, construction supervision, and local communities.

The World Bank will conduct periodic monitoring, tracking and logistics control

at both the subproject level.

To ensure the implementation of the Environmental Management Plan to be

effective, the following activities will be carried out during the subproject

implementation:

a) During the detailed design stage and prepare bidding documents:

- During detailed engineering design and prepare bidding documentation for each

contract, design engineering consultant will integrate takes into Environmental Code

bidding documents and contracts and the specific measures proposed in the EMP of the

subproject.

- During the process of preparing bidding documents and contracts, contractors are

aware of the requirements to ensure safety and compliance commitments.

b) During the construction phase

The CPPMB will assign the Construction Supervision Consultant and/or Field

Engineer to be responsible for the daily oversight of contractor compliance on the

implementation of safety measures. General terms of reference for this task are presented

in the Appendix. Construction Supervision Consultant and/or field engineers will

perform, but not limited to, the following tasks:

- Before starting construction, the land compensation have to be carried out, the

removal and/or acquisition/donation of land has been completed.

- Review and approval of the environmental management plan is prepared on site

by the contractor prior to starting construction.

- Verify the compliance with commitments of the environmental management

plan, check for any damage caused by the contractors. If necessary, ask the contractor to

compensate/restore construction areas as required in the contract. The implementation of

9. Capacity building for the implementation of the EMP

* Training program held by the CPPMB (the subproject owner’s representative

in the construction phase): training content includes guideline on environmental

monitoring implementation methods in compliance with the EMP, and quarterly or

periodically report form on result of the implementation. It also guides on action plan

adjustment in case several activities mentioned in the EMP is impossible implemented.

It is held for staves of the subproject construction and management units, and the

presentatives of the relevant agencies and local authorities.

Trainning contents focus on:

- Trainning on safety: trainning on safety in the maintenance and operation phase.

- Trainning on measurment, monitoring implemetation methods and reporting of

the EMP implementation process. Trainning objects focus on the presentatives of the

relevant commune. It will guide the presentatives of the local authorities on role and

participating activity of the local authorities during the EMP implementation process. It

also guides the method of environmetal quality monitoring implementation at the

subproject site and filling in environmental monitoring report forms.

* Trainning program held by the subproject management and operation unit: It

11. EMP CONSULTATION AND DISCLOSURE

11.1. Public consultation

Public consultation consists of three phases:

Phase 1: Subproject Information Announcement: Conducting the survey,

investigation on the influence of the subproject, and notify authorities and local residents

on the content of the subproject (size, location, purpose and significance of the

subproject);

Phase 2: Public Consultation Meeting: The draft EMP report with collected data and

calculations was presented in Phuoc An Commune People's Committee. In this meeting,

the consultant presented the resettlement policy, impacts of the subproject on the natural

environment and social condition, and mitigation measures for these impacts.

Phase 3: Information Disclosure: The full EMP report which updated according to

the feedback of the affected people, People's Committee of Phuoc An Commune, and

comments of the World Bank will be widely published and notified to the affected people

by SPMB and local government.

APPENDIX 1: SAMPLE ON TERMS OF REFERENCE FOR CONSTRUCTION

SUPERVISION CONSULTANT (CSC)

General

In order to prevent harm and nuisances on local communities, and to minimize the

impacts on the environment during the construction of the civil works under the

Distribution Efficiency Project, Environmental Code of Practices (ECOPs) and

subproject EMP (if available) have been prepared and should be adhered to the

Contractors and his employees.

The Construction Supervision Consultant (CSC)) is to provide professional technical

services (“the Services”) to help ensure effective implementation of the ECOP and

subproject EMPs.

Scope of Services:

The general services to be provided by the CSC are to inspect, monitor the construction

activities to ensure that mitigation measures adopted in the ECOPs/EMP are properly

implemented, and that the negative environmental impacts of the project are minimized.

On behalf of the PMB, the CSC will conduct the following tasks:

- Conduct regular site inspections;

- Review the status of implementation of environmental protection measures against

the EMP and contract documents;

- Review the effectiveness of environmental mitigation measures and project

environmental performance;

- As needed, review the environmental acceptability of the construction methodology

(both temporary and permanent works), relevant design plans and submissions.

Where necessary, the CSC shall seek and recommend the least environmental impact

alternative in consultation with the designer, the Contractor(s), and PMB;

- Verify the investigation results of any non-compliance of the environmental quality

performance and the effectiveness of corrective measures; and

- Provide regular feedback audit results to the contractor’s Chief Engineer according to

the ECOP and site-specific mitigation measures;

- Instruct the Contractor(s) to take remedial actions within a specified timeframe, and

carry out additional monitoring, if required, according to the contractual requirements

and procedures in the event of non-compliances or complaints;

- Instruct the Contractor(s) to take actions to reduce impacts and follow the required

EMP procedures in case of non-compliance / discrepancies identified;

- Instruct the Contractor(s) to stop activities which generate adverse impacts, and/or

when the Contractor(s) fails to implement the EMP requirements / remedial actions.

- For contracts that Site Environmental Management Plan (SEMP) are required, the CSC shall provide the final review and recommend clearance of all Site

Environmental plans which may affect the environment. These include, but are not

limited to: dredging areas, borrow pits and disposal sites, worker’s camp plans. The

CSC will review and approve the SEMP presented by the Contractors. Where these

plans are found not to comply with the EMP, EIA or RAP, the CSC shall work with

the PMB and Contractor to establish suitable measures or remediation.

- Addressing Complaints: Complaints will be received by the Contractor’s Site Office

from local residents with regard to environmental infractions such as noise, dust,

traffic safety, etc. The Contractor’s Chief Engineer or his deputy, and the CSC shall

be responsible for processing, addressing or reaching solutions for complaints brought

to them. The CSC shall be provided with a copy of these complaints and shall

confirm that they are properly addressed by the Contractors in the same manner as

incidents identified during site inspections.

- Certification for Monthly Payments: The CSC shall confirm the monthly payments

for environmentally related activities implemented by the Contractor.

- Reporting: the CSC shall prepare the following written reports:

o Bi-weekly report of non-compliance issues

o Summary monthly report covering key issues and findings from reviewing

and supervision activities

At the end of the project the CSC shall prepare a final report summarizing the key

findings from their work, the number of infringements, resolutions, etc. as well as advice

and guidance for how such assignments should be conducted in the future.
