Polsinelli Recognized For Attorneys of Color Recruiting

Initiatives and Programming

t is often said that you have to know where you have been to know where you are

going. Accordingly, as a follow-up to the two and a half hours of diversity and

inclusion training that was provided in October 2017 to attorneys and members of

the administrative team at the all-attorney retreat, an overview of the firm’s 2017

diversity initiatives was shared on a firm-wide basis last December.

Highlights from 2017 include policy development driven by the Diversity & Inclusion

Committee; programming offered by the Women’s Initiative Committee; diversity

initiatives and programming touching on the firm’s diverse attorney recruiting,

The Diversity & Inclusion Committee added a new component to the firm’s diversity initiatives through the formation of attorney

resource groups that were established to help serve the interests of the firm’s African American, Asian Pacific American, Hispanic/

Latino, and LGBTQ+ attorneys. Upon formation of the groups, leaders were designated to help guide the efforts of each group, and

their members established mission statements that encompassed their group’s mission, values, goals and objectives.

Polsinelli was recently named Law Firm of the Year by

the Asian American Bar Association of Kansas

City (AABAKC). Recognized for its long history of sup-

port, and for the time and effort the firm and its attor-

neys have put into the organization, Polsinelli was cho-

sen as the recipient of the 2017 award, which was presented

at AABAKC’s 11th annual dinner on October 6.

“We are honored to be named Law Firm of the Year by AA-

BAKC, and recognized for our commitment to their organiza-

tion, which we deeply believe in and support their mission of

promoting diversity and inclusion in the legal industry,” said

Polsinelli Shareholder and former AABAKC President Judy Yi.

“This recognition would not be possible without the firm’s

core value to promote and address the needs of minorities

nationwide.”

AABAKC is a non-profit organization whose mission is to pro-

mote justice, equality and opportunity for Asian Americans,

and to foster professional development, legal scholarship,

advocacy and community involvement in the metropolitan

Kansas City area.

Polsinelli has been a longstanding supporter of the AABAKC.

Yi, a shareholder in Polsinelli’s national Labor & Employment

practice, was a member of AABAKC’s board of directors from

2005 to 2011, serving as treasurer from 2006 to 2009 and as

president in 2010. Polsinelli Associate Henry Thomas, also a

labor and employment attorney, currently serves as AA-

BAKC’s president of the board of directors and previously

served as treasurer, secretary and volunteer coordinator of

the organization.

Polsinelli Named Law Firm of the Year by Asian American Bar Association of Kansas

The Human Rights Campaign (HRC) is

America’s largest civil rights organization

dedicated to achieving LGBTQ+ equality.

Through its annual Corporate Equality

Index (CEI) Survey, HRC helps corpora-

tions and law firms identify their strengths and areas where im-

provement is still needed regarding internal policies and practices

affecting their LGBTQ+ employees. For the 2018 CEI Survey, a record

number (609) of the nation’s corporations and law firms earned per-

fect (100%) scores. Unfortunately, despite Polsinelli’s dedication to

advancing equality for the LGBTQ+ community at-large and within

our firm, we were not awarded a perfect score.

Polsinelli’s overall score was reduced to 85% because the firm did

not receive full credit for the gender reassignment surgery coverage

that was added to the firm’s health insurance benefits on January 1,

2017. The firm score was also reduced by an additional 5% because

full credit was not awarded for the firm’s LGBTQ+ community en-

gagement.

When submitting Polsinelli’s response to the 2019 HRC CEI Survey,

the firm’s Diversity and Inclusion team will work closely with HRC so

the firm’s financial support of PROMO, the LGBT Bar Association,

multiple local LGBT bar associations, plus a myriad of other commu-

nity involvement, that directly impacts the advancement of LGBTQ+

equal rights, is fully recognized.

While Polsinelli did not receive HRC perfect score honors, Polsinelli

did earn Illinois Equality distinction in 2016 and 2017 for its LGBTQ+

Best Practices.

Shareholder Jean Marie R. Pechette (CHI)

uses her 20 plus years of experience to

help clients in the health care and life

sciences industries move through complex

technology-related problems. Jean Marie

is touted as a creative and practical thinker

who strives to understand clients’ overall

business strategies to assist them in

reaching matter-specific goals.

She has authored numerous published articles on a wide variety

of cutting-edge industry issues. Long before the standardization

of electronic discovery, she published an article about it. Ahead

of her time, she also wrote about the usability of cloud-

computing before it became widely adopted in healthcare. Jean

Marie authored articles on and has presented at webinars about

the applicability of Internet of Things (IoT) technologies,

including information blocking, in core business processes.

When the American Bar sought “Insights from the Women of

Cybersecurity,” Jean Marie was tapped to share with readers

how women could distinguish themselves in the cybersecurity

market. Having started her career in a small boutique firm with

a focus on technology law, she realized the intrinsic value of

being committed to staying abreast of the evolutions occurring

in information technology, as well as the universe of law that

applies to it and that is continually developing around it.

One thing Jean Marie says is paramount to being successful in

advising clients on cybersecurity is having a passion about the

underlying science and technology. As this area of practice has

laws that are often unclear or not well-settled, a practitioner will

need to be excited about the chance to be a thought leader.

As Past President of the Asian American Bar Association of

Chicago, and the founding Chair and currently a Co-Chair of the

Healthcare Technology Committee of the American Bar

Association Science & Technology Section, being a leader is

nothing new to Jean Marie.

Attorney Spotlight

She was recently welcomed as a member of the invitation-only

International Women’s Forum (“IWF”), Chicago Chapter. This

international organization brings together women leaders in all

areas of business and community. Comprised of greater than

6,500 “diverse and accomplished women from 33 nations on six

continents,” IWF strives to build better leadership both locally

and globally.

The women of IWF are “trailblazers, innovators, and pioneers

united to advance women’s leadership locally and globally.”

Members of IWF, Chicago are accomplished women leaders in

the Chicago area who are preeminent in their professions.

The Forum serves as a vibrant reflector of women’s issues, as

well as a strong support system for members. Programs are held

throughout the year and are diverse in nature, covering a variety

of different topics. IWF convenes annually for two global

conferences where issues having global impact are examined

and solutions are sought through a women’s lens within a local

context.

“I am excited about becoming a member of IWF” Jean Marie

said, “and also this additional opportunity to further promote

Polsinelli, its women leaders and commitment to diversity

initiatives.”

Women In Science & Entrepreneurship (“WISE”) held a

panel discussion on Friday, September 8, 2017 where

women in the fields of science, technology and business

shared their experiences and challenges in what was a

lively and inspired conversation.

Data Privacy section of the firm’s Business Department

Surrounded by family, friends, and colleagues, Polsinelli’s Tara Nealey

(STL) was honored at the 37th Annual YWCA Women of Distinction Annu-

al Leader Lunch on Friday, December 15, 2017. This annual event recog-

nizes St. Louis area women who are making marked contributions to

business, community and racial justice. This amazing event was held in

the Grand Ballroom of St. Louis’ historic Union Station hotel.

YWCA Women of Distinction honorees are selected because they

demonstrate excellence and leadership in their field, are role models for

other women, and exhibit a commitment to community and philanthro-

py.

As articulated in her nomination form for this coveted award, Tara “is a

scientist turned registered patent attorney, who applies her scientific

and legal analytical skills to her professional work, mentoring work and

community work.” She is vice chair of the Biotech/Life Science/Patent/

Prosecution practice within the firm’s Intellectual Property Department.

The women of Polsinelli have undoubtedly benefited with Tara serving

as the St. Louis region liaison for the firm’s National Women’s Initiative

Committee. A strong and formidable advocate for women attorneys, she

has assisted in shaping firm policies and initiatives that positively impact

the workplace and the trajectory of women’s legal careers.

For well over a decade, Tara has made civic and charitable contributions

that have included activities and positions ranging from pro bono service

as a Guardian ad litem for the City of St. Louis to being board president

of Prison Performing Arts—a multi-disciplinary literacy and arts program

for incarcerated adults across Missouri.

Polsinelli Pro Bono Win Results in Statewide Smoking Ban

in Missouri Prisons

Michael Foster (KC) and Phillip Zeeck (KC) recently won a jury trial before the

Missouri Western District Federal Court, where they represented a two-time

convicted inmate in a Section 1983 suit against the Missouri Department of

Corrections. A federal jury ruled that it was cruel and unusual punishment to

pair the inmate, who suffers from chronic asthma, with a smoker. The trial

resulted in a statewide smoking ban throughout Missouri prisons and the

largest known verdict for a 1983 suit.

Polsinelli’s client has suffered from asthma since the age of 10 and claimed in

his lawsuit that he was being exposed to secondhand smoke in prison that

resulted in a worsening of his condition. Missouri was previously one of only

a few remaining states that allow inmates to smoke in designated outdoor

areas, meaning prisoners have access to cigarettes and lighters.

After the jury awarded damages, the Missouri Department of Corrections

took the next step and voluntarily agreed to change the smoking policy. The

signed order officially bans smoking in prison facilities as of April 1, 2018.

We congratulate our Polsinelli team on this positive outcome for the client

that resulted in a statewide policy shift.

Polsinelli Attorneys to Aid Missouri State Public

Defender System

Approximately twenty attorneys in Polsinelli’s St. Louis and Kansas City offic-

es have signed on to participate in the Missouri Coalition for the Right to

Counsel (MCRC). The MCRC, the only not-for-profit organization of its kind,

seeks to ease the caseload of the state’s public defenders by utilizing the vol-

unteer services of attorneys from private law firms like Polsinelli. Missouri is

the 49th worst funded public defender system in the country, leaving a large

gap that the MCRC seeks to close.

The coalition is supported by law firms across the state of Missouri to ensure

indigent defendants have qualified counsel. These cases are a great oppor-

tunity to help those that cannot afford legal representation, support our over

burdened public defenders, and provide an opportunity to give associates

trial experience. Polsinelli attorneys are handling cases that range from as-

sault to cases on appeal. Our attorneys work closely with the Missouri public

defender’s office to prepare matters for trial.

We are proud of all the hard volunteer work our attorneys are investing in

this outstanding cause and pleased to support this statewide effort.

works, was the keynote speaker at the scholarship banquet.

Women’s Flat Track Derby Association

(WFTDA). Described by WFTDA as “a

fast-paced contact team sport that

requires speed, strategy, and

athleticism,” flat track derby is

anything but low-key.

Carrie, an environmental attorney,

and Chelsea, a senior billing

coordinator, both of the St. Louis

office, have skated competitively for a combined 17 years.

Asked whether there are any characteristics they apply to

their work as well as their time on the rink, Carrie admitted

that her stubbornness and competitive nature drive her to be

the best. For Chelsea, it is her need to be thorough and think

positively that keeps her moving towards excellence

individually and as a team player.

Apparently the combination of Carrie’s stubbornness and

Chelsea’s need to be thorough is a perfect mix for their

team—Arch Rival Roller Derby All Stars—as they are ranked #6

in the world. With their team competing in a league of 340

teams around the globe, Carrie and Chelsea skated, jammed,

blocked, and slammed their way to the top.

These women are part of a sport that is reshaping the body

conscious notions of female athleticism while changing

perspectives of what it means to be a smart, healthy, athletic,

and strong woman.

Needless to say, Shimmy Hoffa and Smarty McFly are winning.

Week – Getting Comfortable with Growing Diversity.

On Thursday, September 28, 2017, the Women’s

Initiative Committee for the Denver Office showcased

Polsinelli’s beautiful space as over 50 attendees listened

to panelists instruct on and discuss “Inclusive

Excellence” — how to avoid getting caught behind in our

ethnically changing business and workplace environment

and how to move beyond socially engineered

perceptions of other cultures and races to achieve

collaboration and creativity.

Registration was complimentary and the event was

hosted by Denver Startup Week and Phoenix Affect Inc.

All Attorney Retreat D&I Presentations Were

Touted as “Stellar”

Sitting two hours at the 2017 annual all-attorney retreat for

anything may have been a challenge until the Diversity &

Inclusion (“D&I”) presentation. D&I’s Dan Cranshaw, Dani

Barnard, and J. Danielle Carr put on an excellent production

that included Dr. Arin Reeves’ interactive conversation about

“The Explicit Impact of Implicit Bias: Interrupting Implicit

Biases to Create More Inclusive Work Environments.”

Dr. Reeves, a neurobehavioral sociologist and attorney,

instructed on what bias is, what it is not, how implicit bias

impacts diversity and inclusion efforts in the workplace and a

number of other effects it has on our interactions with people

and the world around us.

Attendees were engaged in lively group discussions and

activities that explored their individual biases while learning

the science behind why they think as they do and how to

alter their thinking to be more inclusive.

The firm will complement Dr. Reeve’s training with next-step

D&I programs designed to encourage and inform the firm on

implicit bias and how to combat it for business success.

The Hispanic National Bar Association (HNBA) descended upon

Kansas City for the first time to hold its 42nd Annual

Convention and Polsinelli was pleased to welcome and

support it.

Held from September 6-9, 2017 at Kansas City Marriott

Downtown Hotel, the convention drew hundreds of attorneys,

judges, law students, public officials, business leaders, and

Fortune 100 General Counsels from across the country for

engaging comprehensive programming. The 2017 convention

theme was “Our Future Knows No Bounds.”

Shareholder Gabe Zorogastua (KC) (pictured top right) who

was a discussion panelist during the convention’s LGBT

Leadership Summit was instrumental in promoting Polsinelli’s

involvement with the convention. Associate, Gabrielle Ilaria

(KC) was a panelist for the “How and When to Break the Rules:

Effective Cross-Examinations” discussion. The Chair of the

firm’s Hispanic/Latino Resource Group, and appointee to the

American Bar Association Commission on Hispanic Legal Rights

and Responsibilities, Shareholder Henry Talavera (HOU),

worked closely with all involved to ensure the firm was well

represented.

Events and Sponsorship Spotlight

Polsinelli’s Diversity and Inclusion administrative team, J.

Danielle Carr and Jittaun Dill, was proud to have worked with

local and national HNBA staff and officers to organize, plan,

and host the Polsinelli sponsored VIP Reception where the

Midland Theatre Chandelier Room provided an intimately

elegant space for Polsinelli’s special guests to enjoy delicious

bites and signature cocktails before flowing to the main level

of the theatre to attend the awards reception where U.S.

Secretary of Labor, the Honorable R. Alexander Acosta was the

keynote speaker.

Polsinelli made a strong showing as guests of firm client Carghill

at the annual Minnesota Association of Black Lawyers

Foundation Scholarship Gala on Saturday, November 11,

2017. Held in the Grand Ballroom of the Marriott City Center in

Minneapolis, the gala, of which Carghill was a major sponsor,

recognizes and honors local law school students “who have

demonstrated outstanding academic achievement and who are

committed to addressing issues that impact the black

community.”

The keynote speaker was White House Correspondent April

Ryan, who also serves as the Washington, D.C. Bureau Chief

for American Urban Radio Networks.
