pp. 294-5 To which at said October Term 1802, the defendants by John C. Hamilton & John B. Johnson esquires their attornies then appeared, and a rule of Court was made to plead and try at next Court, at which time to wit, the term first above mentioned the said defendants by their attornies aforesaid pleaded the general issue and of this they put themselves upon the country and the plaintiff likewise, whereupon came a Jury of good and lawful men, to wit, Edward Bradley, George Stubblefield, Patrick Barr, John Gillespie, George McGuire, Israel Moore, William Trigg, James Desha, Joseph Seawell, William Bradshaw, Robert Bratney & Henry Bradford, who being elected tried and sworn the truth to speak upon the issue joined, upon their oath do say that they defendants are guilty in manner and form as the plaintiff against them has complained and they do assess the plaintiffs damages by occasion thereof to three hundred and forty eight dollars and eighty cents - Therefore it is considered by the Court that the plaintiff recover against the defendants his damages aforesaid in form aforesaid assessed and his costs by him about his suit in that behalf expended.

An act for the relief of officers and soldiers of the Continental Line and in consideration of the services of William Bradshaw, one of the Commission Guards for laying of the lands, have granted unto Samuel Barton, assignee of said William Bradshaw, a tract of land containing 320 acres lying in the County of Sumner on Bartons Creek adjoining John Tapp's south east corner, running north with his line 78 poles, west 320 poles, north to beginning. This indenture made July 8, 1788 between Samuel Vernor of Davidson County of the one part and Hugh Bradshaw of same place of the other part. Samuel Vernor conveyed unto Hugh Bradshaw a tract of land containing 300 acres in Davidson Couty on the north side of Cumberland River about two miles and a half from Heatons Old Station. Adjoing James Hollis' Preemption. Said tract being granted to said Vernor by State of North Carolina Oct 8, 1787. Which deed of conveyance to said Bradshaw was executed acknowledged to him by Elizabeth Vernor and James Cooper administrators of the said Vernor, deceased, in court July 8, 1788. In consequence as appears of the sale of the said lands made an obligation for a conveyance thereof given by the said Vernor in his lifetime and was proven by John Thomas.

The General Assembly of the State of Tennessee at Knoxville in 1811 passed an act entitled Act for the Relief of Sheriffs: to wit; That John Spencer, late Sheriff of Maury Co., be allowed two years from the passage of this act to finish his collection of taxes for the years 1808 and 1809. Spencer made a report to the Maury County Court in March, 1812, that a tract of 1000 acres on Big Bigby Creek owned by John Dixon had not been listed for taxation for 1809 nor taxes paid thereon and that he could find no goods or chattels in said county to distrain for same, judged by the court that land be sold. John M. Taylor was the lowest bidder for cash and the only bidder offering to pay taxes and costs. More than a year has elapsed without the redemption of the land by payment of taxes. Now therefore April 19, 1815, William Bradshaw, now sheriff of Maury Co., make deed to John M. Taylor of Madison Co., Miss., for payment of taxes, land joins Anderson Hunt, four miles about due S. of Gen. Greene’s S.W. corner, joins Nicholas Long, James Pearsell and James Campbell.

In th name of God Amen I William Bradshaw, of the county of Maury and State of Tennessee being very sick and weak of boddy but of perfect mind and memory thanks be given unto God for the same calling into mind the mortality of my body and knowing that it is appointed for all men once to die do make and ordain this my last will and Testament that is to say principall and first of all I give and recommend my soul unto the hand of allmighty God that gave it and my body to the earth to be buried in a decent and Christian burial at the discretion of my friends nothing doubting but at the General resurrection but that I shall receive the same again by the mighty power of God, and as touching such world by estate wherewith is has pleased God to Bless me in this life. I give demise, and dispoe of the same in the following manner and form, (to wit) first, I give and bequeath to Sally my dearly beloved wife the whole of my real and personal estate (to wit) seven head of horse beast, thirteen head of cattle and eight head of hogs together with all my household and kitchen furniture likewise all my right tittle and intrust and claim to a certain improvement on what is called Congress land containing five acres of cleaned land with a good cabin on it lying and being in the county and State aforesaid on the waters of little Bigby, also all my right title of land lying and being in County of Bourbon and in the state of Kentucky, now in las and under management of Robert Trimble my true and lawful attorney in part in and about the management of said business it is further my will that said land when obtained shall be sold and the money arising from such sale shall be put out at interest for the use of my three beloved children to wit, my sons William Bradshaw, and James Bradshaw and my daughter Jane Bradshaw, to be equally divided amongst them &c it is further my will that at the death or marriage of my aforesaid beloved wife Sally that the whole of the aforesaid property &c be equally divided among my four beloved children, William Bradshaw, James Bradshaw and my daughter Jane Bradshaw, I likewise make and ordain my nephew William Bradshaw Jr., and my before named beloved Sally the executor and executrix of this my last will and testament all and singular lands messuages and tenements by them freely to be enjoyed and I do hereby utterly disallow revoke & disannul other former testaments wills bequeath and executors by me in any wise before named Willed and bequeathed ratifying and confirming this and no other to be my last will and testament sealed this fourth day of March in the year of our Lord on thousand eight hundred and fourteen signed sealed published pronounced and delivered and declared by the said William Bradshaw to be his last will and testament in the presence of us who in the presence of each other have here unto subscribed our names. Wright, Joseph McKean, Pleasant McQuerry, Absolom Hooper, John Phillips, Robert Johnston, Wm. Bradshaw, Lewis Cockrill, Daniel A. Dunnum Joseph Gray, Jesse Vkc and Jones Read who being elected tried and sworn well and truly to try according to evidence the issue joined between the plaintiffs and defendant has not paid the debt in the plaintiff declaration mentioned, and assess his damages sustained by reason of the non payment thereof to five dollars. Therefore it is considered by the Court that the plaintiff do recover of the defendant their debt in the declaration mentioned, the sum of two hundred and fifteen dollars and ninety eight cents together with their damages so assessed to them by the Jury as aforesaid in the whole debt and damages the sum of two hundred and twenty dollars and ninety eight cents also their costs of suit in this behalf expended etc. From which judgment the defendant prayed and obtained an appeal to the honorable Superior Court of law and Equity for the District of Mero having given bond & security as by law in such case is required and filed his reasons of appeal. County Court Costs $9.37 1/2.

Between Samuel Vernor of Davidson County and State of North Carolina of the one part and Hugh Bradshaw of the County and state aforesaid of the other part. Witnesseth that for and in consideration of the sum of £100 to the said Samuel Vernor in hand paid by the said Bradshaw the receipt whereof is hereby acknowledged. Hath granted bargained sold conveyed and confirmed and by these presents doth grant bargain sell convey and confirm unto the said Hugh Bradshaw his heirs and assigns forever a certain tract or parcel of land containing three hundred acres lying in Davidson County on the north side of Cumberland river about two miles and a half from Heatons old station. Beginning at two ash trees corner to a tract of land on the East boundary of a preemption granted to James Hollis. Thence South three hundred forty one poles and a half to a large hickory. Thence west one hundred and forty one poles to an oak. Thence North three hundred forty one poles and a half to a small ash. Thence east to the beginning, said tract being granted to said Vernor by the state of North Carolina grand dated Oct. 7, 1787, ,with the appurtenances With their and every of their appurtenances rights member and appurtenances and every part thereof and all rents issues services and profits to them or either of them belonging or appertaining. To hold to the said land and premises hereby granted with the appurtenances unto the said Hugh Bradshaw his heirs and assigns to the only proper use and behoof of him the said Hugh Bradshaw his heirs and assigns forever. And the said Samuel Vernor for himself his heirs executors and administrators doth hereby covenant promise and agree that the shall and will at all times hereafter warrant forever defend the land and premises to the said Hugh Bradshaw his heir s and assigns all other claims and demands whatsoever whereby the above mentioned premises may be affected or encumbered contrary to the true intent and meaning of these presents. In witness whereof the said Samuel Vernor has hereunto set his hand and seal the day and year above written. Which deed of conveyance to said Bradshaw was execute and acknowledged to him by Elizabeth Vernor and James Cooper administrators of the said Vernor deceased in Court held for Davidson County July 8, 1788. In consequence as appears of the sale of the said lands made and obligation for a conveyance thereof given by the said Vernor in his life time which obligation was proven by John Thomas in Court at the time of acknowledging the above deed and the same is likewise recorded verbatim.
