A. Consider scheduling a Public Hearing on December 6, 2016, for a
proposed Amendment to the Comprehensive Community Plan for changes
to the Housing Section - Low and Moderate Income Housing Strategies.
B. Conduct a Public Hearing to consider approving the transfer of a B-
Victualler Beverage License (to include outdoor seating and bar service)
from The Continental Restaurant, LLC d/b/a "The Continental
Restaurant", located at 332 Famum Pike, to Plymouth Realty, LLC, with
the hours of operation to be Monday through Sunday, 6:00 a.m. to 1:00
a.m., as listed, as applied, subject to compliance with all State regulations,
local ordinances, and a Certificate of Good Standing from the Rhode
Island Division of Taxation.

A. Consider approving a new Victualling License for Plymouth Realty, LLC,

C. Consider approving a One-Day Beer/Wine License for the Smithfield
Senior Center, 1 William J. Hawkins Jr. Trail, to hold a Beer and Wine
Tasting, to be held on Friday, November 4, 2016, from 7:00 p.m. to 9:00
p.m., as listed, as applied, subject to compliance with all State regulations
and local ordinances.
D. Consider approving the annual renewal of one (1) Private Detective
License, as listed, as applied, subject to compliance with all State
regulations and local ordinances:

E. Schedule a Show Cause Hearing on Tuesday, November 15, 2016, to
consider the possible suspension, revocation, or other sanctions regarding
a Massage Establishment/Massage Therapy License on the following
listed establishment due to non-renewal or non-compliance with
conditions of renewal:
1. Advanced Muscle and Bodyworks of RI, LLC d/b/a "Advanced

backboards at the Smithfield High School through the State of Rhode
Island Master Price Agreement.
B. Consider, discuss, and act upon the reimbursement of capital expenditures
for the School Department.
C. Consider authorizing a request for proposals through the State of Rhode
Island Pre-Approved Vendor List for installation of 120 feet of galvanized
steel guardrail along the Log Road causeway.
D. Consider authorizing a bid award for winter road salt for the Department
of Public Works in the amount of $62.48 per ton per the new Rhode Island
Master Price Agreement effective October 1, 2016.
E. Consider authorizing Contract Amendment #1 with Veolia Water for the
sum of $116,206.16 annually to the 10-year Operations & Maintenance
Contract for the cost and risk of consumables relative to the new Actiflo
equipment at the Waste Water Treatment Facility.
F. Consider authorizing a Request for Proposals for repair of Town Hall
windows funded through a Rhode Island Historical Grant.
0. Consider, discuss and act upon authorizing a Request for Proposals on
behalf of the School Department for Snow Plowing Services.

SUBJECT: Public Hearing on the transfer of a Class B-Victualler Beverage License from TheContinental Restaurant, LLC d/b/a "The Continental Restaurant" to Plymouth RealtyLLC for the October 18'"' Town Council Meeting.
BACKGROUND:
Conduct a Public Hearing to consider approving the transfer of a Class B-Victualler Beverage License (toinclude outdoor seating and bar service) from The Continental Restaurant, LLC d/b/a "The ContinentalRestaurant", located at 332 Farnum Pike to Plymouth Realty, LLC, same location.
The owner of the propeity and former owner of "Box Seats", James Casciano, has evicted the owners of"The Continental Restaurant" for failing to remit payment for rent, taxes, etc., therefore; this Class B-Victualler Beverage License will be transferred to him.
Mr. Casciano will not re-open the restaurant himself, but instead, will look for a new owner. Since theestablishment will not re-open, this application does not contain TIP cards, a Rhode Island Permit toMake Sales at Retail, or final approval from the Rhode Island Department of Health.
TOWN REVENUE:
Fee for Liquor License is $600.00, there is no fee for this transfer.

Plymouth Realty, LLC has applied for a new Victualling License for their business located at
332 Famum Pike. Although Mr. Casciano will not be re-opening this establishment himself, he
must apply for a new Victualling License as this is part of the B-Victualler Beverage License
application.
TOWN REVENUE:

BACKGROUND:
Request approval to use State of Rhode Island, Pre-approved Vendor listing naming COSCOINC. to install 160 foot of Guardrail on Log Road causeway..
FINANCIAL IMPACT:
Funding for the Guardrail improvement projects was approved in the 2017 Capitol ImprovementBudget. The Guardrail that is presently in place poses a risk to public safety and needs to beprofessionally replaced.
RECOMMENDATION:
MOVED: That the Smithfleld Town Council authorize the Public Works Director to utilize the State of
Rhode Island Pre Approved Vendor listing naming COSCO Steei as the State vendor for installing
Guardrrail to install 120 feet of new galvanized steel guardrail along the Log Rd causeway. Cost of the
project is 28,000.00. Request that 120 feet be replaced this year to make this road safer.

The Actiflo treatment tedinology was originally known to have upfiont costs, (derations costs andutility costs ass(^ated wxtfa romung the equipment fin: treatment purposes. Since the equipmentcame online in 3 quarter, 2014, Veolia has been ke^nng tabulation of op^onal stadstics tonm diis eqmpm^ mainly cfamni^, matmials and shid^ production, hi early 2015fiom Veolia and the Town Engineer discussed ways to characterize die costs associated withoperating the equipment and as such Veolia was able to invoice the Town diiecdy finr itemizedconsumables for the new equipment Veolia Water was requested to tabulate costs for approximately15 months to better undostand the response of consumables over a fiill cycle of seasons. You cansee fiom the enclosed data, provided by the Town Engineer, the equipment's effectiveness is shownthrough the removal of 970 lbs of Zinc fiom the wastewater during this period of time, which hasbeoi prohibited fiom entering the waters of the State.
