1) Call to Order Meeting was called to order by John Steeb at 7:30 p.m. The Pledge of Allegiance was recited.
2) Roll Call of the Commission Present: Bunton, Foley, Shutes, Bauer, SteebAbsent: NoneOthers Present: Michael & Ann Vara, Tom & Kathy Barton
3) Approval of June 20, 2017 Meeting Minutes
There being no additions or corrections, Chair Steeb called for a motion to approve the June 20, 2017, minutes. Motion by Shutes, seconded by Foley, to approve the minutes. Motion passed 5-0.
4) Approval of April 19, 2016 Meeting Minute
There being no additions or corrections, Chair Steeb called for a motion to approve the April 19, 2016, minutes. Motion by Foley, seconded by Bunton, to approve the minutes. Motion passed 5-0.
5) Public hearing for Michael & Ann Vara
Public hearing for a variance of the side yard setback to 8’ for the purpose of construction of garage/barn - Lodi Township Zoning Ordinance 59.07. And also, variance of Ordinance 20.02A additional building on the property located at 3761 Textile Road, parcel #M-13-26-100-002.
Michael Vara made the presentation to replace his burned down garage/barn with a 24’x50’ building to duplicate the original structure. Discussion by the Board of Appeals
Findings of Fact:1. Owner would be deprived of a garage within easy walking distance from his
home and visual security of the back acreage which includes a pond large enough for swimming and is illegally accessible through the back of his parcel.
2. Owner wishes only to replace that of which was lost by the fire and made non-conforming by previous lot splits.
3. The T shape of the lot and placement of his home is unique and requires special consideration.
4. The existing placement of the well and engineered drain field was determined with consideration of the original destroyed garage/barn location.
5. Neighbors have no objections to this request – see application.
A motion to grant the variances and to accept the findings of fact was made by Foley, seconded by Shutes, and recommend approval. Motion passed 5-0.
