RES.#B178/13 - APPOINTMENT OF ENFORCEMENT OFFICER AND DESIGNATION AS PROVINCIAL OFFENCES OFFICERApproval to appoint a Toronto and Region Conservation Authority staff member as an Officer and Provincial Offences Officer.

THAT the appointment of Michael Brestansky as an Officer under the Conservation Authorities Act, as per Section 28(1)(d)(e), and as a Provincial Offences Officer be approved for the purposes of:

i) Enforcing Regulations made by Toronto and Region Conservation Authority (TRCA) pursuant to Section 28 and 29 of the Conservation Authorities Act; and

ii) Enforcing the Trespass to Property Act.CARRIED

BACKGROUNDThe Conservation Authorities Act provides for a conservation authority to appoint officers to enforce its regulations. Furthermore, the Minister of Natural Resources has implemented, under the authority of Subsection 1(3) of the Provincial Offences Act R.S.O. 1990, a class designation process for all conservation authorities whereby any conservation authority officer appointed under Section 28 (1)(d)(e) of the Conservation Authorities Act shall be designated by the Minister simultaneously as a Provincial Offences Officer. Once appointed, officers have the authority to enforce all offences and Regulations under the Conservation Authorities Act, in addition to the Trespass to Property Act, when carrying out their duties within the jurisdiction of the conservation authority.

The prerequisite to the Minister’s Provincial Offences Officer appointment is that all candidate officers:

be adequately trained in the legislation to be enforced, including the Provincial Offences

Act;have proof of a clean criminal record check, and;

be appointed as an officer to enforce conservation authority legislation at an official

board meeting.

Pursuant to the approval of the above noted appointment, the Minister’s requirements will have been addressed.

RATIONALEMr. Michael Brestansky has been employed with TRCA since 2007 and has recently joined the Enforcement and Compliance section as a Compliance Officer. He has successfully completed the Natural Resources Law Enforcement Program from Sir Sandford Fleming College. His appointment as an Officer will enable him to assist with TRCA's regulatory requirements and compliance objectives.

THAT TRCA staff be authorized to approve additional expenditures to a maximum of 10% of the total contract price as a contingency allowance, if deemed necessary;

BACKGROUNDThe proposed Claireville Trail connection forms part of the Humber Inter-Regional Trail system, linking established pedestrian trail systems in the City of Toronto with those currently envisioned and/or under construction in the City of Brampton. This linkage opens up a safe and accessible connection from an existing multi-use pedestrian trail at Humberwood Park (to the south) to the Claireville Conservation Area, in the vicinity of Indian Line Campground, just west of the Claireville Dam. The trail will extend north following the old Indian Line Road connecting to Albion Road.

In 2009, SNC-Lavalin was contracted to prepare a design for the trail connection under Highway 427 as well as two local connections to Finch Avenue to facilitate pedestrian and cyclist access to the valley trail. As a result of provincial budget constraints the Ontario Ministry of Transportation (MTO) highway widening and rehabilitation work had been rescheduled several times and in 2011 was deferred indefinitely. At that point, City of Toronto staff requested that Toronto and Region Conservation Authority (TRCA) proceed with the completion of the design work initiated in 2009 in an effort to build the spine trail connection (Segment 1) independent of the deferred MTO work.

In 2012, City of Toronto staff advised of their intention to pursue all three of the trail segment connections and requested that TRCA proceed independent of the MTO project to finalize agreements, designs and approvals with a view to implementing the project in 2013-2014 period. This trail connection fills a key "missing link" of the Pan Am Path project and the City has committed to completion in advance of the 2015 Pan Am Games.

In December 2013, MTO announced the approval of the highway widening and rehabilitation contract to proceed with tendering and construction in 2014-2016. As a result, the City has now requested TRCA to have SNC-Lavalin re-integrate the trail design drawings and specifications as a component of the MTO construction tender package. SNC-Lavalin is MTO's consultant on the Hwy 427 Widening and Rehabilitation (Campus/Fasken to Steeles) project. MTO will, under agreement with TRCA and City of Toronto, tender and construct the trail segments as part of their highway improvements contract.

RATIONALEThe 2012 contract was awarded to SNC-Lavalin on a sole source basis ($25,000 to $50,000 CEO Approval) in accordance with the TRCA Purchasing Policy as they had intimate knowledge of the project site, history and the workings of MTO in establishing and approving an encroachment agreement. The extension of this contract is now recommended as a preferred source purchase under terms of section 9.3.3 of TRCA's new Purchasing Policy as follows:

The required goods and services are to be supplied by a vendor or supplier having specialized knowledge, skills, expertise or experience that cannot be reasonably provided by any other supplier.

City of Toronto staff has incorporated the implementation of these trail segments into their 2013/14 capital budget. Timely completion of the integrated MTO tender design package, and finalization of the MTO Encroachment Permit approvals will allow TRCA to tender for construction to proceed in early 2014.

PERMISSION FOR ROUTINE INFRASTRUCTURE WORKS

Permission for Routine Infrastructure Works Letter of Approval are implemented by Planning and Development Division staff and are received monthly by the Executive Committee. The permission of routine infrastructure works is subject to authorization by the Director, Planning and Development and signed by an appointed enforcement officer. All routine infrastructure works are located within a Regulated Area, generally within or adjacent to the hazard or natural feature and in the opinion of staff do not affect the control of flooding, erosion, dynamic beaches, pollution or the conservation of land.
