Application #0898/09/TOR for a permit under Ontario Regulation 166/06, by CSBI Group Ltd., for permission to develop within a Regulated Area of the Don River watershed to facilitate construction of two decks below top-of-bank on the wall of a well defined valley, at the property described as 102 Banbury Road, City of Toronto (North York Community Council).

The applicants propose to construct, reconstruct, erect or place a building or structure within a Regulated Area of the Don River watershed. The owner of 102 Banbury Road has applied to Toronto and Region Conservation Authority (TRCA), under Ontario Regulation 166/06, to develop within a Regulated Area to facilitate construction of two decks below top of bank on the wall of a well defined valley. The works were substantially completed prior to application for an Ontario Regulation 166/06 permit. Staff do not support the application on the basis that it impacts the conservation of land.

A written staff report was submitted and a presentation was made by Mr. Steven Heuchert, Manager, Development, Planning and Regulation, TRCA.

BACKGROUNDThis proposal was submitted for the approval of works after they were constructed. The proposal asks for permission to, in effect, "regularize" the construction of two wooden decks connected by a staircase, in the rear yard. An inspection of the premises took place on September 14, 2009, in response to a complaint from a neighbour. TRCA enforcement staff issued a Notice of Violation September 18, 2009 in response to the construction of the two decks without approval by permit from TRCA in accordance with Ontario Regulation 166/06. TRCA staff received the permit application and associated materials on October 23, 2009, following the enforcement activity. Legal proceedings in the form of charges before Provincial Court commenced January 6, 2010 with summons served February 1, 2010.

The proposal is also subject to a Notice of Infraction issued by the City of Toronto Urban Forestry Services on September 18, 2009, for unauthorized tree injury and removal in a ravine associated with deck construction, subject to the Toronto Ravine and Natural Feature Protection By-Law.

In addition, a municipal building permit was required for the construction of the deck structures but was not obtained. If a TRCA permit is similarly not obtained, then the City of Toronto Buildings Department will not be able to issue a building permit under the applicable law provisions of the Building Code.

PROPERTY LOCATION AND DESCRIPTIONThe subject property is located on the west side of Banbury Road, adjacent to Wilket Creek and Windfields Park, within a Regulated Area of the Don River watershed (Attachment 1). Banbury Road is located in a residential neighborhood east of Bayview Avenue, north of Lawrence Avenue East, in the City of Toronto's North York Community Council Area. There is an existing single family dwelling located between 10 metres to 15 metres from the top of the bank of the valley. In 2001, TRCA issued the current owner a letter clearing the construction of the dwelling as the proposed dwelling was located just outside of the former "Fill Regulated" area. At the time, the rear yard and the remainder of the valley was regulated by TRCA. This portion of the property continues to be regulated under Ontario Regulation 166/06.

TRCA JURISDICTIONPursuant to Ontario Regulation 166/06, a permit is required from TRCA prior to any development, if in the opinion of TRCA, the control of flooding, erosion, dynamic beaches or pollution or the conservation of land may be affected by the development.

Development is defined as:i) the construction, reconstruction, erection or placing of a building or structure of

any kind,ii) any change to a building or structure that would have the effect of altering the

use or potential use of the building or structure, increasing the size of the building or structure or increasing the number of dwelling units in the building or structure,

iii) site grading,iv) the temporary or permanent placing, dumping or removal of any material,

originating on the site or elsewhere.

An Ontario Regulation 166/06 permit must be applied for and obtained before a municipal building permit can be issued. In the case of 102 Banbury Road, an application for an Ontario Regulation 166/06 permit was submitted to TRCA after substantial completion of construction of the two deck structures following the initial investigation by TRCA Enforcement staff. A permit is required as the works fit the definition of development, and are located within a Regulated Area of the Don River watershed.

In the case of the proposal for approval of works "after the fact" for 102 Banbury Road, TRCA staff conclude that the conservation of land has been affected. For an application to be refused, Section 28(12) of the Conservation Authorities Act requires that the applicant be given the opportunity for a hearing.

It should be noted that TRCA reviews all permitting requirements in concert with our Valley and Stream Corridor Management Program (VSCMP, 2004) policies. VSCMP integrates TRCA's public safety responsibilities and reaffirms its commitment to ecosystem planning at a watershed level. VSCMP outlines policies for new development, including property improvements and ancillary structures, within highly urbanized areas such as the area surrounding and including the subject property.

THE PROPOSALThe submission is for the prior construction of two connected deck structures within the Regulated Area of the Don River watershed (Attachment 2). The decks are built on a vegetated portion of the valley wall, approximately one to four metres below top-of-bank. The upper deck is approximately 18 feet x 18 feet and the lower deck is approximately 13 feet x 13 feet. The total area of the two decks is approximately 490 square feet, and they are located between 2 feet and 7 feet above the grade of the valley slope. The works are not located within the Regional Storm floodplain.

STAFF REVIEW OF THE PROPOSAL

Conservation of LandThe submission impacts the conservation of land as it negatively impacts a portion of the valley corridor and degrades the habitat function of the valley system. The proposal is also inconsistent with the following policies in the Valley and Stream Corridor Management Program.

1. Policy 4.1, New Development, of VSCMP “emphasizes the need to protect and rehabilitate valley and stream corridor landforms, features and functions while being sensitive to the development characteristics and needs of the… Region as a whole and to the use of these important resources by the… community.” The addition of the proposed decks to the valley portion of the subject property is for the private use by the owner at the cost of the local environmental feature.

Policy 4.1 further states that “(T)he main thrust of the Authority’s policies and procedures for undeveloped valley and stream corridors is to prevent new development that would introduce risk to life and property associated with flooding, erosion and slope stability and/or is not compatible with the protection and rehabilitation of these natural resources in their natural state” (underline added). The valley wall where the proposed decks are located hosted a variety of vegetation that has been removed. Although the slope is stable at this point in time, the additional development on the subject property may increase the risk of erosion from overland flow of stormwater. Additionally, the structures have the impact of diminishing the environmental resources on the site “in their natural state.”

2. Policy 4.2.2.E.5 of VSCMP outlines that ancillary structures, such as the proposed decks, may be permitted “where development exists within valley and stream corridors…however, it must be recognized that property improvements and ancillary structures can negatively impact valley and stream corridor landforms, features and functions.” There is no precedent of decks located on the valley wall in this section of Wilket Creek, therefore staff consider this proposal to be new development in the valley. If the development is reviewed as a property improvement, Subsection 3 requires that ancillary structures “minimize any impacts on the vegetation communities or functions of a Significant Area and… not result in the loss of its significant features.” TRCA Ecology staff concludes that the proposed works have resulted in removals of and injuries to trees and other vegetation. The area beneath the constructed decks will not support any vegetative cover, and may be more susceptible to erosion. TRCA staff is of the opinion that the valley feature functions at a high level given its urban context.

The proponent submitted an Arborist Report along with the permit application. The Report was initiated after the construction of the decks. Based on the Report, the proposed works may have resulted in removal of eight small trees (5-11cm in diameter), injury to 24 trees in moderate to good health, the removal of approximately 490 square feet of vegetation, and a precedent whereby the developed urban edge is extended further into the valley, all of which result in a loss to the overall habitat value.

CUMULATIVE IMPACTS AND THE PRECEDENTThe submission is also not supported because it contributes to the impact created by cumulative loss and degradation of natural areas and biodiversity within the Don River valley system, and indeed within the City of Toronto and other urban areas in the TRCA jurisdiction. Permitting this intrusion could be argued by future applicants to have established a precedent which will lead to similar proposals within the TRCA jurisdiction, given the constant pressure for more land use intensification. TRCA's Planning and Development staff receive inquiries for similar works such as amenity structures within the valley corridor where none existed before on a frequent, regular basis. Most inquiries for such works do not progress beyond the inquiry stage in part because staff can fall back on the precedent of TRCA not having permitted similar works in the past.

There is sufficient tableland between the existing house and the top of bank to construct a deck that would meet TRCA policy (Attachment 2). There is between 10 and 15 metres of open tableland available and TRCA staff would work with the applicant to facilitate a permit to allow for the relocation of the existing deck. There is no need for a deck of this size to be located on the valley wall at this particular site given the option to relocate the deck above the top of bank, and the lack of precedent within the area.

If this application is approved, then staff will have difficulty in opposing other applications for structures and/or fill within the valley corridors, which will result in additional negative impacts to our more urbanized watersheds. Indeed, the TRCA's position before the Mining and Lands Commissioner on future appeals will become less defensible, especially given the recent Mining and Lands Commissioner decision regarding 119R Glen Road. This decision resulted in the dismissal of an appeal of TRCA’s refusal to issue a permit based, in part, on the following:1. recognizing that TRCA policy has, as its basis, a concern for the "conservation of

land";2. accepting that the loss of a piece of the natural heritage system within the valley

corridor has an impact on the “conservation of land” through the effect on the overall ecosystem of the valley corridor;

3. recognizing that new development over the top of bank is prohibited under TRCA's policies; and

4. upholding the ability of TRCA to consider the impacts of a precedent when considering permit applications (Russell v. TRCA, File No. CA 003-05, May 27, 2009).

This application, in the view of staff, does not have merit and potentially, if approved, could be argued by future applicants to have created a significant and negative precedent for TRCA and undermine the legitimacy of TRCA's policies which have also been upheld by the Mining and Lands Commissioner.

CONCLUSION AND RECOMMENDATION In summary, staff recommends that the application be denied for the following reasons:

1. The submission does not comply with the overall objective of TRCA's Valley and Stream Corridor Management Program. Specifically, it does not conform with Sections 4.1, New Development, or 4.2.2.E.5., Property Improvements and Ancillary Structures.

2. The submission will affect the conservation of land as it:(i) results in negative impacts to a portion of the Don River valley corridor for

the purpose of creating amenity structures within the undeveloped valley portion of the property;

(ii) results in removal of eight trees likely due to construction, probable injury to twenty-four trees, the removal of ground cover, and pushes the urban edge further into the valley, resulting in a loss to overall habitat value; and

(iii) has a detrimental impact due to the cumulative loss of natural cover within the City of Toronto.

Even if a deck is permitted, it is not necessary to locate it in the valley corridor as the subject property has sufficient tableland to locate a deck in an alternative location or configuration to mitigate the loss of valley lands, therefore reducing the impacts to the environmental features.

3. The submission could be argued by future applicants to have created a precedent that will:

(i) result in future consideration of similar proposals within the City of Toronto and other urbanized areas of the TRCA’s jurisdiction;

(ii) undermine TRCA's policies; and(iii) reduce TRCA's ability to defend such policies at the Mining and Lands

Commissioner.

BACKGROUNDA request was received on February 9, 2010 from Piero Carbone, requesting the sale of a fragment of TRCA-owned land situated east of Regional Road 27, north of Major Mackenzie Drive, for an addition to his residential lot.

Through the subdivision approval process, TRCA acquired the valley corridor behind Mr. Carbone's lot and the neighbouring residential properties at the end of July in 2009. Shortly after the transaction was completed, Mr. Carbone enclosed a strip of TRCA-owned land with a chain link fence, measuring approximately two metres deep along the entire width of the rear yard. The area of TRCA-owned land enclosed by the fence, which is part of the tableland buffer of the valley corridor, has been landscaped with ledge rock gardens, a sunken fire pit, trees and a manicured lawn area. A letter was sent to the owner, requesting removal of the encroachment by April 15, 2010; at the request of the owner, an extension to June 30, 2010 was agreed to by TRCA staff. Subsequently, Mr. Carbone has requested to purchase the occupied TRCA property rather than remove the encroached area.

TRCA's Valley and Stream Corridor Management Program (VSCMP) sets out the program framework for staff's review of proposed development applications adjacent to valley corridors. One of the principles in the VSCMP states: "the successful management of valley and stream corridors is dependent on good tableland management". As part of the approval of residential subdivision 19T-98V04, the subject valley lands (i.e. Block 68 on Plan 65M-3738) were brought into public ownership. The acquisition of this valley land Block included a buffer for additional protection of the valley corridor behind the subject residential lots. Mr. Carbone proceeded to landscape his property and extended the landscaping into the buffer area. The purpose of the buffer is to protect the valley edge from this type of landscaping and loading of the slope. Removing lands that are included as buffers, as is the case in this request, does not meet the criteria of good tableland management. Therefore, the removal of tableland buffers would be contrary to TRCA's VSCMP policies as well as TRCA's mandate to conserve natural areas and protect adjacent, developed lands from natural hazards.

The TRCA valley lands in this vicinity were acquired from Jofian Holdings Limited on July 27, 2009, originally under the "Natural Heritage Lands Protection and Acquisition Project 2001-2005", Flood Plain and Conservation Component, Humber River Watershed.

RATIONALEThe acquisition and retention of tableland buffers are essential to the protection of the ecological features/functions of stream and valley corridors as well as providing additional protection to abutting private lands, particularly those situated in erosion prone locations. The lack of tableland buffers has resulted in substantially greater risks to private properties and human habitation and the potential for costly remediation projects as is presently being experienced in the case of the Royal Rouge Trail and Troutbrooke Drive erosion sites.

TAXES AND MAINTENANCEBased on TRCA's preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the Provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2011 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

CARRIEDBACKGROUNDToronto and Region Conservation Authority (TRCA) and the City of Toronto’s Parks, Forestry and Recreation Division (PF&R) intends to undertake a revitalization of Marie Curtis Park (West and East) on the waterfront. The park revitalization is being carried out in conjunction with the City of Mississauga’s and TRCA’s development of a new park on the former Arsenal Lands which is located immediately adjacent to the Marie Curtis West site. The intent is that Marie Curtis Park West and the Arsenal Lands site will be developed as a regional destination park, while Marie Curtis Park East will continue to serve as a local park. Taken together the site comprises 41-hectares of prime waterfront parkland (Marie Curtis Park 25.4 hectares/Arsenal Lands 15.7 hectare) at the western edge of the City of Toronto. This Request for Proposals (RFP) is limited to the design and construction of Marie Curtis Park. Together with TRCA and City of Toronto PF&R, the selected proponent will work collaboratively with all partners to ensure a functional and aesthetic continuity between the two parkland sites.

Summary of Required WorkThe proponent is required to provide full professional and technical services, including stakeholder and community consultation and facilitation, design, contract document development (drawings and specifications), permit application, construction supervision and contract administration to carry out the following tasks:

1. review and assess the existing site conditions, maintenance practices, traffic movement, pedestrian and cyclist activity, existing site activities and uses (including seasonal patterns and variations);

Mississauga Community Services staff and representatives from the local Councillor’s office;

6. prepare draft design concepts and alternatives for presentation and discussion and recommend activities or elements identified through the consultation process;

7. design refinement leading to a preferred approach; 8. review of preferred design with stakeholders and the public, complete with

assessment of capital budget, phasing and operating implications; 9. prepare quotation call documentation and conduct construction administration;10. prepare maintenance guidelines in consultation with Toronto PF&R and Mississauga

Community Services staff to ensure consistent maintenance throughout the larger parkland site;

11. apply for and obtain any necessary permits; 12. facilitate and record all meetings as required, including regular administrative

meeting with TRCA/City of Toronto staff, design meetings with stakeholders and two public meetings;

13. provide graphic or written information for web page content as set up by TRCA/City to communicate the intent, schedule and scope of the project to the community as needed;

14. construction and quotation call documents will be prepared to the level of detail, standard and quality required by TRCA/City staff, and the park quotation call will be issued through the City of Toronto’s Finance Department, Purchasing and Materials Management Division; and

15. develop a phased construction plan that will allow for public parking and vehicular access to the site at all times.

Description of Work Phases The work as described above shall be divided into five phases:1. Site Inventory, Assessment and Concept Design Phase.2. Design Development Phase.3. Contract Documents Phase.4. Bidding and Quotation Phase.5 . Contract Administration Phase and Commissioning including Warranty Period

Review.

TRCA will be the lead for the Site Inventory, Assessment and Concept Design Phase and the Design Development Phase. At the start of the Contract Documents Phase, a City of Toronto PF&R senior project co-ordinator will be assigned to the project to ensure that all documents and processes meet the City of Toronto’s accepted standards.

RATIONALEOn April 15, 2010, TRCA initiated a Request for Proposals. The RFP was published on the Ontario Association of Landscape Architects website. Fifteen RFP packages were picked up. A mandatory site visit was held on April 23, 2010 and was attended by 15 representatives of consulting firms. On May 5, 2010, six proposal packages were received by TRCA as directed in the RFP. Several firms advised TRCA that due to time constraints and the aggressive schedule put forward in the RFP, they would not be submitting a proposal. The six proposals received were evaluated through a detailed review by a Selection Committee, which was made up of staff from TRCA, the City of Toronto’s Parks, Forestry and Recreation Division, and the City of Mississauga Parks and Recreation. The aim of the Selection Committee was to select one or more proposals which in its opinion meet the TRCA’s requirements under this RFP and provide the best overall value to TRCA.

BACKGROUNDOne of the recommendations in the Toronto and Region Conservation Authority (TRCA) Terrestrial Natural Heritage System Strategy in 2007, was to undertake urban forest studies and strategies across the TRCA jurisdiction. (Urban forests by definition include all treed and shrub cover in urban areas, ranging from street trees to natural spaces). At that time, TRCA staff canvassed municipalities and others to identify urban forest initiatives within our watersheds. Through this exercise we found that a number of municipalities were either planning or already had funding to conduct studies within their own jurisdictions.

TRCA staff took advantage of the coinciding studies by initiating an informal collaborative between the various municipal and conservation authority project managers, as well as academic and community stakeholders, to ensure that the outcome could be standardized across the GTA in order to facilitate comparisons between municipalities, the development of complementary strategies and ultimately the creation of a comprehensive regional report. The first consideration of the collaborative was choosing methods for data collection and analysis that would be used across the GTA, which resulted in selecting the USDA Forest Service methodology.

The USDA Forest Service suite of analytical tools is known as iTree (including the Urban Forest Effects or UFORE model) and is used to evaluate the structure and function of urban forests. Using field-collected forest data combined with local weather, pollution and hydrological data, iTree provides information on the forest's health and its capacity to contribute to better air quality, water management, reductions in energy costs, amongst other calculations. These findings are then used as the basis for urban forest management plans and policies related to designing healthy and sustainable communities. All sample plots are set up in a manner that allows revisiting their exact location and thus permits long-term monitoring.

Since 2008, TRCA has managed urban forest studies for the Region of Peel and the Town of Ajax, for which a contract was awarded to the USDA Forest Service for the analysis of data collected by TRCA staff (Executive Committee Meeting #3/09). At that time, other municipal partners in the Greater Toronto Area were not committed to their studies in terms of budget and scope and could not be included in that initial contract. However, since that time the City of Pickering and York Region (to date including Markham, Richmond Hill and Vaughan) were able to develop such partnerships with TRCA.

RATIONALEThe iTree suite of analytical tools was selected by project managers in the collaborative as the standard suite of tools for the urban forest studies in the Greater Toronto Area because iTree has been used successfully in city regions worldwide including Toronto, Oakville and, in 2009, the Town of Ajax study managed by TRCA. The USDA is the ideal source of urban forest analysis services because:

the level of involvement by municipalities and millions of dollars invested by the USDA and arboriculture industry in the U.S. in the development of the models; the transparency of the methodology and science behind iTree; the fact that pollution removal assessments are based on local hourly data; the fact that USDA staff provide a high level of technical support in the use of the model; and, their experience in conducting analyses of urban forests for municipalities worldwide.

Staff recommends award of the contract on a sole source basis as per section 1.14.5 of TRCA's Purchasing Policy as follows:

The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier.

The USDA continues to be widely recognized as such a supplier of urban forest analytical services. As well, all municipal and CA urban forest study partners desire to have comparable and complementary data and reports across the TRCA jurisdiction and GTA. For that reason, it is recommended to continue employing the USDA, who have already undertaken the analysis for the Ajax and Peel studies. Staff recommends that TRCA award the next phase of work to the USDA to undertake the iTree analysis component of the York Region (Vaughan, Markham and Richmond Hill) and City of Pickering between 2010 to 2012. The recommended contract is an addendum letter to the earlier contract awarded in 2009 that encompasses the new analyses to be undertaken by the USDA.

CARRIEDBACKGROUNDOn June 13, 2005 the Government of Ontario passed the Accessibility for Ontarians with Disabilities Act (AODA), which was created to implement and enforce mandatory accessibility standards. The AODA calls on the business community, public sector, not-for-profit sector and people with disabilities or their representatives to develop, implement and enforce mandatory accessibility standards. Accessibility standards are the rules that businesses and organizations in Ontario will have to follow to identify, remove and prevent barriers to accessibility. The purpose of the AODA is to achieve a fully accessible Ontario by 2025. Noncompliance could result in substantial financial penalties for organizations and/or individuals impeding compliance. The first standard came into effect on January 1, 2008 and is called the Accessibility Standard for Customer Service.Ontario is developing standards in the following five areas:

Customer Service;Built Environment;Employment;Information and Communications;Transportation.

DETAILS OF WORK TO BE DONE Prior to January 1, 2012, all TRCA staff will complete mandatory Accessibility for Ontarians with Disabilities Act training. All front line staff will participate in a training session presented by qualified TRCA trainers. This will include the legislated material as well as sensitivity training. Those who do not work with the public will participate in the online module on their own time before January 1, 2012. The e-learning module costs $6,825 for 500 employees. If further training is needed it is a cost of $13 per employee. A list of individuals that have completed the e-learning module is created by the company and is sent to Human Resources.

Accessibility Standards for Customer Service Policy

Rationale

The purpose of this Customer Service Standards Policy is to fulfill the requirements set out in regulation 429/07, of the Accessibility for Ontarians with Disabilities Act, to establish a policy for Toronto and Region Conservation Authority (TRCA) for governing the provision of its goods or services to persons with disabilities.

Policy

TRCA shall use reasonable efforts to ensure that its policies, practices and procedures are consistent with the following principles;

The goods or services will be provided in a manner that respects the dignity and independence of persons with disabilities.The provision of goods or services to persons with disabilities, and others will be integrated unless an alternate measure is necessary, whether temporarily or on a permanent basis, to enable a person with a disability to obtain, use or benefit from the goods or services.Persons with disabilities will be given an opportunity equal to that given to others to obtain, use and benefit from the goods or services.Persons with disabilities may use assistive devices and/or support persons in the access of goods and services.TRCA employees when communicating with a person with a disability shall do so in a manner that takes into account the person’s disability.

Application

This policy shall apply to every person who deals with members of the public or other third parties on behalf of TRCA, whether the person does so as an employee, agent, volunteer or otherwise.

Definitions

Disabilities – (a) any degree of physical disability, infirmity, malformation or disfigurement that

is caused by bodily injury, birth defect or illness and, without limiting the generality of the foregoing, includes diabetes mellitus, epilepsy, a brain injury, any degree of paralysis, amputation, lack of physical co-ordination, blindness or visual impediment, deafness or hearing impediment, muteness or speech impediment, or physical reliance on a guide dog or other animal or on a wheelchair or other remedial appliance or device,

(b) a condition of mental impairment or a developmental disability, (c) a learning disability, or a dysfunction in one or more of the processes

involved in understanding or using symbols or spoken language,(d) a mental disorder, or

Support Person – Any person whether a paid professional, volunteer, family member or friend that accompanies a person with a disability in order to help with communications, personal care of medical needs or with access to goods or services.

TRCA shall, upon request, supply a copy of the policy, practices and procedures required under the Ontario Regulation 429/07 – Accessibility Standards for Customer Service to any person.

Service Disruption – Notice

It is possible that from time to time there will be disruptions in service (e.g. an entrance way that is under repair, renovations that limit access to an area, or technology that is temporarily unavailable).In the event that a disruption in service is planned, and expected, it is important to provide reasonable notice. Notice will include the reason for the disruption, estimated duration, and any alternate services available.People with disabilities may often go to a lot of trouble to access services, such as booking transit or arranging a ride. By providing notice, you can save that person an unnecessary trip.Notice will be provided on the website, over the phone, or in writing.

Unexpected Disruption in Service – Notice

In the event of an unexpected disruption in service, notice may be provided in a variety of ways, and will be done as quickly as possible.In the event of a service disruption, alternative methods of service may be considered and those impacted by service interruption shall be informed of any alternative methods.

Training

Every person who participates in the development of the policy, practices and procedures under Ontario Regulation 429/07 – Accessibility Standards for Customer Service must be trained appropriately in relation to this Policy.Every person who deals with the public on behalf of TRCA, including 3

The Pearson Eco-Business Zone encompasses over 12,000 hectares of industrial and commercial land surrounding Toronto Pearson International Airport. The area falls under four municipal jurisdictions, including the Region of Peel, City of Toronto, City of Mississauga and the City of Brampton. The area consists primarily of employment areas bisected by a CN rail line and five major highways (401, 407, 409 and 427) with Toronto Pearson lying at the heart of the study area. The area contains over 12,500 businesses and 350,000 employees.

The Pearson Eco-Business Zone features over 500 accommodation and restaurant operations. A number of these operations have been involved with Partners in Project Green, including Woodbine Entertainment Group, while others have been engaged through events and workshops, such as the International Centre and the Toronto Congress Centre.

In 2009, the International Centre developed its corporate sustainability plan and engaged TRCA in a discussion about how it could work with its neighbours on sustainability issues. Their interest was two-fold – one to leverage the lessons and knowledge of their neighbours to drive sustainability deeper and quicker into their own organization; and, secondly, to develop a group of sustainability thought leaders that could be leveraged to generate new business opportunities.

TRCA brought together a number of other hospitality businesses that had been involved in Partners in Project Green, as well as the Greater Toronto Hotel Association, Tourism Toronto and the Ontario Restaurant, Hotel and Motel Association, to discuss how they might work together on sustainability issues. The outcome of that meeting was that all of the organizations were facing the same issues around energy and waste management, as well as training and engaging their staff in their sustainability measures.

Based on this discussion, TRCA suggested the development of a Sustainable Hospitality Consortium that would bring together leading hospitality organizations in the Pearson Eco-Business Zone to work together on sustainability issues.

A sustainability consortium is a facilitated team of organizations with a focus and commitment to attaining world class environmental sustainability through employee training and process improvements. This is realized by member companies leveraging each other’s strengths through sharing, learning and improving to achieve accelerated results. The effect is to push sustainability faster, deeper and at a lower-cost into each participating organization.

The main benefit of membership is the acceleration of a company’s journey towards environmental sustainability by leveraging the resources of a consortium and its members. Through a consortium, organizations get exposure to other members’ best practices and how to improve the implementation of these best practices in their own operation. Employees are provided opportunities to collaborate with their peers in other organizations, giving them the ability to learn, share and subsequently implement hands-on learning. Overall, the results are improvements in implementation time, levels of innovation, organization and personal performance, with the ability to sustain improvements. The consortium is made up of a team of 12 to 16 organizations that have a commitment to learn and share. Members have full ownership over the direction of the consortium, controlling both future membership and the agenda, while all administration is the responsibility of Partners in Project Green. Sharing, learning and improving are facilitated through consortium events, individual member company coaching days and assessments. Membership privileges include:

six days shared by all members to be used for learning and leveraging events; two individual coaching days to be used by the member company to directly apply the thinking through training, coaching or implementation events; and,a sustainability diagnostic for measurement and development of the individual member.

For individual coaching days, members are encouraged to allow other member companies to participate in training or implementation events. The result is additional training opportunities for all members and improved implementation by utilizing other member’s expertise.

The main membership requirement for the consortium is a commitment to environment sustainability and a willingness to openly share and learn. There is no contract for membership. This is done in order to ensure that the facilitator strives to create strong value for the member companies and the members strive for excellence through their commitment to the consortium.

RATIONALEThe utilization of the consortium model for Partners in Project Green will allow stronger business-to-business networks to develop in the Pearson Eco-Business Zone, while driving innovative sustainability thinking deeper into participating companies.

The consortium model being utilized for the hospitality sector is also being explored for the manufacturing, logistics and office sectors by TRCA staff. The potential model that may flow out of this is a spider web approach with Partners in Project Green in the middle facilitating learning and innovation within key sectors in the Pearson Eco-Business Zone, while cross-pollinating applicable ideas across sectors.

The consortium model is not seen as a solution for every company, but only those that have a deep commitment towards sustainability. Partners in Project Green will continue to deliver workshops and training for businesses across the Pearson Eco-Business Zone, while the consortiums will be a forum for leaders within each sector to drive innovation and sustainability deeper into their organizations, with some of their lessons being exported to others in the area and beyond.

This type of forum will not only help TRCA work towards the goals for Partners in Project Green, but identify and speed up the implementation of innovative ideas that are developed in partnership with sector leaders.

The membership fee for the consortium will be $500.00 plus applicable taxes per month.

Business ModelFor the development and delivery of the sustainable hospitality consortium, TRCA staff is recommending developing a collaboration with HPS who will manage the administration and delivery of the consortium (including training and facilitation), while TRCA, through Partners in Project Green, will play host to the consortium and help develop and expand the consortium’s reach. This collaboration will result in the development of a revenue sharing relationship between HPS and TRCA, with TRCA collecting and distributing revenues based on the number of companies involved and services rendered by HPS.

Revenues for TRCA and HPS will grow or decrease depending on how many businesses are involved with the consortium; however, the responsibilities of TRCA are greatly reduced as HPS’s experience in delivering consortiums will be utilized to manage the day-to-day administration, training and facilitation requirements, with TRCA sharing the business development responsibilities and ongoing client engagement.

For the development of the Sustainable Hospitality Consortium, HPS will assist in developing the consortium, providing facilitation and meeting time to help establish the consortium at no cost. In addition, given that it takes at least five companies to join in order to break-even, HPS will assume any losses if there are less than five companies who join the consortium at its start up.

Delivery PartnerThe development and delivery of the Sustainable Hospitality Consortium is proposed to be completed in partnership with HPS. HPS is a Kitchener, Ontario based company that specializes in developing and managing business consortiums across North America with over 100 different companies, including managing the High Performance Manufacturing Consortium and the Alliance for Enterprise Excellence. Their specialties focus on sustainability, continuous improvement, supply chain management and analysis, team building, and leadership development.

HPS’s role in the managing of consortiums involves the following:organizing and coordinating meeting requirements of the consortium;providing the training requirements identified by the consortium members;completing sustainability assessments for member companies; and,facilitating consortium meetings and training days.

Procurement ProcessA non-competitive procurement process was utilized to develop this program. Under TRCA’s Purchasing Policy, Section 1.14, Subsection 5, reads:

The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier.

HPS meets this criteria as it is the only vendor who provides the level of support outlined in the consortium model, including providing training, communications materials and administrative support to the members. Furthermore, HPS has agreed to provide access to its North American consortium network at no-cost, share in the development costs of the proposed consortium and share revenue generated from the consortium. This expertise, network and business development opportunity cannot be matched.

Public-Private Marketing Collaboration CriteriaIn accordance with the Partners in Project Green Public-Private Marketing Collaboration Criteria, this partnership meets the following items:

Contributes to Promote the Goals of Partners in Project Green – HPS and their consortium model provides a platform to reach the goals of Partners in Project Green, as it encourages companies to utilize lessons learned from their business peers to drive sustainability into their respective organizations.Established Relationship with Pearson Eco-Business Zone Companies – HPS has established relationships with companies from within the Pearson Eco-Business Zone through other consortiums they operate.Partners in Project Green Partner or Business Ambassador – HPS has become a Partners in Project Green partner and has been promoting the initiative to their clients in the Pearson Eco-Business Zone.

FINANCIAL DETAILSThe program will be run with no costs to TRCA and Partners in Project Green. The program aims to be a revenue generator to assist in funding other Partners in Project Green programming.

One of the goals of Partners in Project Green is to assist companies in the Pearson Eco-Business Zone to realize reduced costs on green technologies. Partners in Project Green also aims to reduce the release of toxic emissions and improve the working environments of employees within the Pearson Eco-Business Zone.

To assist in meeting these aims, Partners in Project Green proposed to develop a Green Cleaning Program Collaboration to help reduce the cost of green cleaning supplies, while providing the tools and support to improve working environments in the Pearson Eco-Business Zone.

Program OutlineThe Green Cleaning Program will be designed to assist companies in the Pearson Eco-Business Zone to reduce their use of toxic cleaning and office supplies, with the intent of improving indoor air quality, increasing worker productivity and decreasing toxic releases to the region’s sanitary sewer system.

The program will assist companies in reviewing their current cleaning processes, highlighting opportunities for the introduction of green cleaning supplies, setting standard operating procedures, implementing their program and promoting their green cleaning program.

The program will be administered by TRCA and Partners in Project Green and delivered via contract by Diversey and Unisource. After a business has made contact with Partners in Project Green and the Green Cleaning Program has been identified to meet their needs, Diversey and Unisource will contact the business to begin the following process:

Step 1 – Assemble a Green Cleaning Team:gather internal stakeholders;set objectives;agree on milestones;select pilot project.

Step 2 – Benchmark Facility:survey chemicals, tools and equipment;assess current operating procedures;survey of facility.

Step 3 – Implementation Planning:identify green chemical options for the facility;identify tools and equipment for conversion;identify personal health, safety and environmental benefits;develop new standard operating procedures that can be utilized internally or by external contractor.

Step 4 – Promote and Market:promote internally to create awareness and buy-in;promote externally to the community, customers and investors.

This process would be provided at no-cost to TRCA and Partners in Project Green. All products used in program will be Eco-Logo and/or Green Seal certified green cleaning products.

Collaboration OpportunityIn collaboration with Unisource and Diversey, TRCA staff has been developing a green cleaning marketing program for companies in the Pearson Eco-Business Zone.

Diversey is a green cleaning product manufacturer with a patented process to deliver and provide green cleaning and office audits, advice, products and promotion, through its Healthy High Performance Cleaning (HHPC) Program. It operates throughout North America and works with the public and private sector to deliver green cleaning options through its distribution network. Diversey is a division of S.C. Johnson, who has been in business for over 120 years. With sales in 170 countries, Diversey has clients including food service providers, food and beverage processing plants, building service contractors.

Unisource is a national distributor of office supplies, including green cleaning and office products, and operate a distribution facility within the Pearson Eco-Business Zone. They are also a distributor of Diversey green cleaning products.

RATIONALEThe rationale for working with both of these partners is that Diversey offers not only green cleaning products, but more importantly a process that ensures all aspects of a green cleaning program are implemented within an organization, including products, processes, education and marketing. Unisource is a distributor of Diversey products, but also other green cleaning and office supplies; this makes them an ideal outlet for connecting companies to a provider of a full-range of options.

There are a number of green cleaning providers; however, where Diversey adds value is through its HHPC Program that provides not only an assessment of green cleaning options, but also provides assistance in developing standard operating procedures and ongoing marketing and education materials for the client. The HHPC program is built upon a foundation of Leadership in Energy and Environmental Design (LEED) certification and will give a company the points they require if they decided to pursue certification.

Benefits for TRCA and Partners in Project GreenIn addition to helping TRCA reach its goals in the Pearson Eco-Business Zone, Diversey and Unisource have offered to provide reduced pricing for companies in the Pearson Eco-Business Zone on green cleaning supplies (up to 45 per cent), as well as licensing fees to Partners in Project Green for program referrals (ranging from two per cent for all sales totalling between $300,000 and $500,000 and three per cent on all sales after $500,000).

Benefits for Participating CompaniesThe Green Cleaning Program offers a one-stop solution for businesses looking to identify and reduce their impact on the local environment from their cleaning programs. In particular it will provide businesses:

a free-assessment of green cleaning options for the company;

Businesses utilizing the Green Cleaning Program will not be obligated to purchase products produced by Diversey or distributed by Unisource, but by utilizing the HHPC process, companies will have a cost-free way to identify the tools they require to make an informed decision about how they can embrace green cleaning procedures for their facilities. They can decide to take this information and work with their existing product supplier and distributor.

The Green Cleaning Program is also not designed to require companies to change their cleaning contractors, but provide them with information on supplies and standard operating procedures that can enable their existing cleaning contractors to change their service delivery. This is an important element of the program as it helps to transform the cleaning contractor industry.

Procurement ProcessA non-competitive procurement process was utilized to develop this program. Under TRCA’s Purchasing Policy, Section 1.14, Subsection 5, reads:

The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier.

Diversey meets this criteria as it is the only vendor which provides the level of support provided by the HHPC program, including developing standard operating procedures and communications materials to support the clients’ shift to green cleaning.

Furthermore, Diversey is the only vendor that has their products GreenGuard certified in addition to Eco-logo and Green Seal certifications. GreenGuard is an industry-independent, third-party testing program for low-emitting products and materials, which ensures high indoor air quality (IAQ) standards.

CARRIEDBACKGROUNDBlack Creek Pioneer Village (BCPV) is a living historical attraction that is in transition in the 21st century. It is operated by TRCA. BCPV is committed to relevance, improving the quality of life in the community, to sustainable practices, to innovative initiatives and creative partnerships, to public engagement, education, and stewardship of cultural, heritage and natural resources.

BCPV consists of two substantial parcels of land, presently connected by an underpass at the intersection of Jane Street and Steeles Avenue. These two parcels were acquired by TRCA in the 1950s for the purpose of heritage preservation, public education, recreation and conservation. The properties consist of floodplain and adjacent tablelands of the Black Creek, on which stood a number of significant original heritage structures constructed between 1808 and 1832.

Currently, within the Municipal Servicing Master Plan Study process being conducted by the City Vaughan, a stormwater management pond located within Black Creek Pioneer Village is being considered for expansion. The City of Vaughan is undertaking an Environmental Assessment to assess what municipal servicing improvements and/or modifications to the stormwater, water and wastewater services will be required to implement the development objectives outlined in OPA 620.

The convergence of plans for the Toronto-York Spadina Subway extension, the Steeles West Station located within 500 metres of BCPV, and dramatic projected population growth as a result of the policies of OPA 620 and York University Secondary Plan, provide BCPV with the opportunity to develop a new master plan for Black Creek Pioneer Village North (BCPVN) to a level not previously envisioned.

As a follow-up to the Memorandum of Understanding being negotiated between the City of Vaughan and TRCA, TRCA is initiating the BCPVN Master Plan. The purpose of this plan is to determine future site usage and public programming for a significant cultural heritage resource, and to determine if the existing stormwater management pond is appropriate for retrofit to accommodate future development of BCPVN and OPA 620 lands.

Consulting services are required to undertake a comprehensive master plan for the BCPVN property which will incorporate innovative solutions and inspired concepts that reflect TRCA's core values, respect cultural heritage assets, reflect 21st century issues, and engage community, partners and stakeholders throughout the process. Timely completion of this study is required to facilitate development within a portion of the OPA 620 lands which are linked to planning and construction of the Spadina Subway Extension and associated infrastructure.

The BCPVN master plan will include:historical / cultural review of the property with the proposed pond concept;structural risk assessment for historic buildings;market research and environmental scan;concept development and refinement;

RATIONALEThe consultant selection process involved a Request for Proposal (RFP). The RFP contained detailed terms of reference for key tasks and deliverables, and identified an upset limit of $125,000 for consulting fees and expenses. The RFP was sent to 14 consulting firms and advertised more widely to the membership of Canadian Association of Heritage Professionals. Firms directly contacted included:

RATIONALEAt its meeting on April 30, 2010, the Long Term Office Accommodation Working Group accepted the staff recommendation of Option 6 as the option which best meets TRCA needs at the current time while leaving open opportunity to pursue options 1, 2, 2A, 4, 5 and 8. Attachment 1 is the staff report outlining this option.

Staff has concluded that the best long term solution to its office accommodation is to take advantage of the future value of the lands at 5 Shoreham Drive and the parking lot at Black Creek Pioneer Village (BCPV). This value will likely be realizable in 10 to 15 years as the subway is completed and the lands adjacent and at York University are fully built out.

In the interim, suitable office accommodation can be purchased in the range of $160 to $175 per square foot. The cost to build office space either at 5 Shoreham Drive or the BCPV parking lot would be in the range of $250 to $300 per square foot. Given the fact that the existing commercial office market is at a relative low point, the purchase price including the land base can be regarded as an investment which in 10 to 15 years can be sold to help finance the redevelopment of the lands at 5 Shoreham Drive and BCPV parking lot.

Staff has conducted initial analysis of various scenarios and believes the purchase of suitable office space can be achieved within the existing budget. Cash flow of TRCA is healthy and can sustain the investment.

DETAILS OF WORK TO BE DONEStaff has several properties under consideration with the help of CB Richard Ellis. Staff is meeting with representatives of the Royal Bank to consider establishment of a line of credit sufficient to ensure TRCA has future cash flow so as not to jeopardize any of its existing projects and programs. Upon conclusion of required due diligence, staff will bring to the Authority a proposal for acquisition of an office site.

Time is of the essence as the market opportunity to secure suitable office space will diminish as the economy improves and interest rates increase. Accordingly, staff will bring a recommendation to the Authority as soon as possible.

This is considered by the project team to be the most viable option at this time because of the following factors:

Favourable/existing market conditions within this sector of the marketplace. It is a buyers market as very limited demand in the marketplace currently exists for large scale facilities of this nature.This is the most affordable option, i.e. a project up to $10 million could be financed by municipal partners at $1 million annually over 10 years (less with longer term) which is likely to be within the capability of Toronto and Region Conservation Authority's (TRCA) partners.Can effectively meet TRCA's present, as well as future, needs.The most sustainable option is one where TRCA uses an existing structure.Cost effective i.e. 100,000 square feet @ $100.00 PSF = $10,000,000 vs $300+PSF for new building.Excess space (over and above TRCA's immediate requirements provides for additional revenue opportunities via sublease potential).Benefit from existing infrastructure/built out (i.e. lunchroom/cafeteria, computer rooms, back up generator, built out office components, lobby, board/meeting rooms, exercise facilities).With municipal partner support, TRCA could offer a cash deal; if TRCA must have financing, low borrowing rates can be secured.In the long term, such an investment could be sold and the proceeds used to facilitate redevelopment proposal (option 5).

Staff has yet to find a suitable facility that meets TRCA needs in terms of space, location, parking and cost. At the meeting, staff will do a short presentation of some of the sites which have been considered. This continues to be the option which meets immediate needs and provides potential cost benefit for future development

Staff has met with the President and representatives of the York Region Rapid Transit Corporation to discuss their development plans for the site on Steeles Avenue between Keele and Jane streets where the new subway station will be located. They described the preliminary plans for this area including potential office space. They were receptive to the idea of TRCA participating in the project as an investor taking space in condominium type office project. The build out time frame remains uncertain but is likely late 2014 or 2015. This remains a possible option and staff will continue to work with the Corporation.

3. ADAPTIVE REUSE OF INDUSTRIAL/INSTITUTIONAL SITE - 60,000 - 100,000 square feet - LEED rated, location to be determined$12 million - $15 million project

Staff asked for advice from Phil Goldsmith, TRCA's architectural advisor, on the potential cost of retrofitting an industrial building. Based on his estimates, staff believe that this option would only be considered if the location, parking and initial cost were such that the site met or exceeded TRCA needs. The cost to retrofit will be in the range of $150 to $200 PSF which when combined with purchase cost brings the per square foot cost close to the cost of building a new structure. This option has been put on hold.

NEW: JOINT VENTURE WITH TTCStaff has met with representatives of Build Toronto who are working with the TTC on their proposed new headquarters building at York Mills and Yonge Street. The TTC is proposing to build additional space to meet future needs. This might present an opportunity for TRCA to lease such space in the medium term. Such a leasing proposal would have to be competitive with leases in preferred locations. The timing of this project is unknown but would likely have occupancy in 2013.

DETAILS OF WORK TO BE DONEStaff will continue to pursue Option 6. Should a property be found which meets TRCA needs, staff will bring this forward to the Working Group and the Authority with recommendations. Staff will continue to meet with Region of York representatives to consider Option 4. Other options remain on the table but will be "on hold". Staff will continue to report to the Working Group as the project continues. FINANCIAL DETAILSTo date, costs have been limited to modest consulting fees. Funds are available in the 2010 capital budget.

CARRIEDBACKGROUNDIn 1981 Bluffer’s Park opened at the foot of Brimley Road as a waterfront park in the City of Toronto. Included within the park is a commercial marina as well as four boating clubs which access Lake Ontario by way of the entrance channel.

In early 2008, concerns of insufficient water depths in the entrance channel were brought to TRCA’s attention by members of the boating clubs. TRCA notified the City of Toronto (Parks, Forestry & Recreation) of the hazard, who in turn retained TRCA to undertake maintenance dredging later that summer. Upon completion of the 2008 dredging project, approximately 1,700 cubic metres of sediment was removed from the entrance channel; a relatively minor amount compared to the more than 70,000 cubic metres of sediment which is estimated to have accumulated over the past 29 years since the entrance channel was constructed. Recognizing that the maintenance work restored only the minimum depth required for safe passage through the channel, with no allowance provided for ongoing siltation, it was communicated by TRCA staff to the City of Toronto that future maintenance dredging would likely be required.

In recent months, insufficient water depths in the entrance channel were again brought to TRCA’s attention. In response, TRCA completed a hydrographic survey of the entrance channel in April 2010 to provide updated information to the City of Toronto and determine the appropriate course of action. The survey shows that a large sand bar is forming laterally across the entrance channel, reducing water depths to approximately 1.5 m and posing a risk to the members of the boating community who require a minimum draft of 1.8 m below chart datum for safe passage. As a result of shallow water in the entrance channel, a member of the Cathedral Bluffs Yacht Club got stranded on the sand bar on the evening of April 26, 2010, requiring rescue. Although no injuries were reported, it is noted that the draft on the stranded boat is 1.4 m. Hence, should larger boats with increased draft requirements attempt to enter the channel, it is very likely that additional groundings will result, increasing the likelihood of injury to person or property. Given that the boating season has recently commenced, it is recommended that this hazard to public safety be remedied as soon as possible, and that the proposed dredging be carried out as emergency works.

In light of the active siltation observed over the past few years, and to prevent another emergency situation from occurring, TRCA has recommended that the City of Toronto initiate a retrofit study of the entrance channel to identify a long-term solution to the siltation problem as an alternative to regular maintenance dredging, which is both costly and disruptive. TRCA will continue to recommend a long-term solution at this location, and assist the City with the development of a preferred alternative upon their request.

DETAILS OF WORKFurther to the sounding completed on April 6, 2010 by TRCA, it is estimated that approximately 1,900 cubic metres have accumulated in the channel since dredging was carried out in the summer of 2008. Recognizing that removing only the minimum amount does not provide any additional capacity in the channel to allow for ongoing siltation and fluctuations in water levels, 3,500 cubic metres (in situ) are proposed to be removed as part of the emergency works. The removal of this volume of material is anticipated to provide sufficient depth in the channel such that dredging should not be required until the summer of 2011 or 2012, although it is recommended that an updated hydrographic survey be completed in early spring 2011 before confirming whether dredging can be postponed until 2012.

Sediment will be removed using mechanical dredging, by way of a backhoe mounted on a barge, with temporary stockpiling to take place on the adjacent hardpoint for dewatering, until such time that the material can be hauled to its permanent disposal location.

Sediment samples were collected from the channel on April 22, 2010 and sent for laboratory analysis to determine disposal options for the dredgeate. Based on the results of these analyses, the sediment meets Ministry of the Environment’s Table 1 background data, meaning that the material is extremely clean and meets unconfined disposal guidelines. Given that onsite disposal is the most cost-effective solution and site disturbance is expected to be minimal, permanent disposal of the dredgeate is proposed along the East Beach at Bluffer’s Park along the backshore. Given that the relatively small volume of material will be graded out to match the existing profile, no adverse impacts to the beach are anticipated.

To assist with the dredging and disposal, TRCA held a site meeting with the following contractors, providing tender packages to the attendees at the meeting to solicit for quotations:

The Ontario Construction Company Limited;Galcon Marine Limited;Soderholm Maritime Services Incorporated; andRichardson Work Boats Incorporated.

Dredging is tentatively scheduled to commence the week of May 24, 2010 pending authorization to award Contract RSD10-12 and the receipt of all necessary approvals. Work is anticipated to take approximately four (4) weeks to complete, weather permitting.

TRCA staff reviewed the bids received against its own cost estimate and has determined that the lowest bid is of reasonable value. With respect to the difference in the quoted prices for disposal, that of the lowest bidder is comparable to the disposal cost for the maintenance dredging operations conducted at Bluffer’s Park in 2008.

Based on the bids received, staff recommend that The Ontario Construction Company Limited be awarded Contract RSD10-12 for a total amount not to exceed $193,720.00, plus GST, as they are the lowest bidder meeting TRCA specifications.

FINANCIAL DETAILSThe total project cost has an upset limit of $240,000 (plus GST), which includes the value of the dredging contract plus all project administration costs to secure the required approvals to undertake the work.

As funding for dredging was not identified in the City of Toronto’s 2010 budget, the City has provided their authorization to proceed with the work in a letter to TRCA dated April 30, 2010. TRCA will contribute $50,000 from its 2010 Toronto Waterfront Development Capital budget, from account 211-16, with the balance to be recovered from the City of Toronto under account 186-10.
