Recommendation In accordance with the Governing Board Policy 6.3, it is recommended that the Governing Board may upon, recommendation by the Chancellor, award Emeritus Distinction to Dr. Ann Ewing for her meritorious contributions to the students of the Maricopa County Community College District. Justification Dr. Ann Ewing was a faculty member of the department of Psychological Science for 31 years. She served on many college and district committees including Faculty Senate, CRCC (College Research Review Committee), IRB (Institutional Review Board), Honors, and MIL (Maricopa Institute for Learning). She chartered the Psi Beta National Honor Society Chapter at Mesa Community College (MCC) and was club advisor for 27 years. Dr. Ewing served as Western Regional Vice President and as National President of Psi Beta. Ann chaired the National APA Community College Working Group and was the inaugural chair of PTACC (Psychology Teachers at Community Colleges), an APA affiliate designed for community college faculty. Dr. Ewing authored three book chapters, six research publications, and presented eight invited lectures, and 13 research papers. She was a Fellow of WPA and served as an officer on their regional board for 6 years. She was recognized for service with the WPA Outstanding Service Award, the National Psi Beta Faculty Advisor award, the MCC Advisor of the Year award and the Association of College Honor Societies Significant Contribution Award. Dr. Ewing was awarded numerous local, regional, and national teaching awards including Mesa Chamber of Commerce Professor of the Year; MCC Distinguished Faculty Award; Western Psychological Association Outstanding Teaching Award; Arizona Psychological Association Outstanding Teaching Award; and the MCC Faculty Excellence in Teaching Award.

Recommendation In accordance with the Governing Board Policy 6.3, it is recommended that the Governing Board may upon, recommendation by the Chancellor, award Emeritus Distinction to Mr. Harold Cranswick for his meritorious contributions to the students of the Maricopa County Community College District. Justification Contributions: Mr. Cranswick was hired in 1989 and served the Maricopa Community Colleges as a residential faculty member for the next 28 years. He spent his entire career at Mesa Community College where he taught Economics as well as some Math, Leadership, and Volleyball classes. Harold was asked by the Vice President to chair the first Student Outcomes Committee (SOC) in response to an HLC directive. Mr. Cranswick served the college in many other ways including Chair of the Social Science Department for 11 years, Faculty Senate President, Chair of Department Chair Association (twice) and Faculty Executive Council President. He also served as the advisor to MCC’s Phi Theta Kappa Omicron Beta Chapter for ten years and as Assistant Coach for the MCC Women’s Volleyball Team. Leadership: As Chair of the Department Chair Association, Mr. Cranswick led the charge to revise the Final Exam Schedule to make it consistent with regular class times. Up to that point, the time for a Final Exam was different from the time the class was scheduled. Honors and Awards: Students nominated Mr. Cranswick for a number of awards. As a result of his love of economics and his passion for teaching, Harold has had a number of his students stay in touch over the years to thank him and to let him know that his classes influenced them. Many of his students went on to earn advanced degrees and experience success in their field.

Recommendation It is recommended that the Governing Board accept $100,000.00 from the Salt River Pima-Maricopa Indian Community 12% Fund that will be used between January 1, 2019, and December 31, 2019. These funds will be used for the Maricopa Community Colleges Student Success Initiatives.

Justification These initiatives will be used at all 10 colleges in an effort to strengthen retention, completion, and success with our students, as well as building stronger community partners that will aide in supporting higher education. Use of these funds will increase support services to provide outreach, recruitment, and retention initiatives to support underserved and vulnerable populations within the college service areas. The College President has approved the application for funding. The Foundation President & CEO has approved the use of the Foundation’s 501C3 designation to apply for and receive the funding.

Mr. Elliott Hibbs Recommendation It is recommended that the Governing Board approve an extension of the District Office’s existing contract with Blackboard (IT Helpdesk Support, Financial Aid student support) to include a District-wide Contact Center service and expansion plan. The total amount requested for approval is $1,416.955.00 and is part of the Transformation funds approved by the Governing Board in May for FY19. Justification The centralized Contact Center is the facility identified to receive student interest calls as part of the marketing campaign presented to the Governing Board and underway for FY19. The colleges have all agreed to allow the District-wide Contact Center to handle the “Make It Happen” calls. With an additional $2.1 in Transformation marketing dollars expected to be spent in FY19, this capacity to handle an influx of calls is timely and necessary. Since piloting the Contact Center with the Make It Happen campaign, we estimate a current response rate between 20-30% to calls directed to the Center. Augmenting our team with an experienced contract vendor will move us closer to a desired 90% response rate. The Contact Center is experiencing a 25% conversion rate from interest to enrollment, while the industry standard is 40%. Blackboard’s contract will include an expectation of at least a 40% conversion rate for renewal. The ROI for this minimum increase is $2.7 million or more in additional revenue. Mesa Community College is currently using Blackboard with good results. Rio Salado College desires to execute a contract for full student contact support, and Phoenix College also employs Blackboard’s services for targeted outreach campaigns. Since the District does have an existing contract that establishes a vetted relationship and proven performance results with this vendor, we are confident that Blackboard can meet and exceed the immediate 12-month operational support needed for the District-wide Contact Center. We intend to provide strong management oversight to ensure they perform as expected and meet our goals. Any additions or expansion of services across Maricopa will be fully vetted with CEC, the Chancellor, and the Governing Board, as appropriate, before any additional requests are made.

Recommendation It is recommended that the Governing Board approve an increase not to exceed $250,000 to complete the implementation of the Alertus emergency messaging system. The increase in funding is needed for additional consulting, hardware, engineering analyses, operational support start-up, and includes a small contingency necessary to complete the project.

Initial project approval was provided by the Governing Board on 11/24/15 in the amount of $3,250,000 and the increase in funding results from changes to college campuses, buildings, and requirements since the original estimate in 2015. Approval of this increase brings the total project budget to $3,500,000.

Justification The Alertus indoor and outdoor notification devices disseminate emergency messaging to students, faculty and staff at each college. This messaging also supports delivery for vision impaired, hearing impaired or mobility impaired individuals who are inside buildings as well as persons who are outdoors in common areas, parking lots, athletic fields, etc. The installations and implementations are underway at all District-owned properties. This project fulfills a mandatory Federal obligation under the Clery Act.

Recent emergencies and violent situations on college and university campuses have made a robust central Mass Notification System a necessity for Maricopa County Community College District (MCCCD) to notify students, staff and visitors of an imminent or impending threat. Under the Clery Act, MCCCD is required to immediately notify the campus community on confirmation of a significant emergency or dangerous situation involving an immediate threat. Notification must be disseminated in multiple modes so as to reach the entire college community, as noted above.

Justification This license agreement continues the cooperative relationship that has existed between Phoenix College and Southwest Human Development, Inc. for over 13 years. SWHD offers two Head Start classrooms at PC for children ages 3-5 for a total preschool-aged child enrollment of 34 children. Additionally, SWHD offers two Early Head Start Child Care classrooms for infants and toddlers. The total enrollment capacity would be 50 children, birth to age 5.

Virtualized Call Center renewal contract in the amount of $455,072.32 for Mesa Community College. Justification Mesa Community College has experienced a successful partnership with Blackboard Inc. over the past 3 years during which time they have supported the Student Affairs Virtualized Call Center. Approval of the contract is a renewal for FY18-19. These contractual services allow MCC Student Affairs employees to focus on enrollment services, advising, and financial aid. Blackboard offers students, staff, and faculty the following cost effective services:

• 24 hours/7 days a week Call Support • Tier 1 Advising, Enrollment, and Financial Aid Support • Spanish Speaking Agents • Call Ticketing System Management • Self-Help Portal • Weekly/Monthly Call Metrics (average call time, resolution rate,

customer satisfaction, response times) Blackboard provides a degree of services the college would not be able to replicate in a cost effective way. Blackboard provides the ability to scale-up services to deal with periods of high call volumes, and then scale-down during periods of low service requests. The college would have to increase our human resources in the local Call Center by 300 percent or more to meet peak volumes. The elasticity in available human resources, coupled with the round the clock, and multi-lingual service, cannot be replicated by the college with the current budget or available manpower. The loss of the Call Center would greatly impact services provided by Student Affairs and would negatively impact student outcomes. Not having access to the virtualized call center would result in internal call screening, manual processing, and a much more time consuming process for students trying to work with the administrative functions of going to college at MCC.

The lease term is for 60 months and the monthly rate will be at $2,420.83 or $14.00 per square foot and escalates 2.5% each year thereafter. Monthly common area maintenance charges will be $432.29. A standard reimbursement of $1.50 per square foot per year will be allowed for tenant to complete tenant improvements and upgrades for the new lease term. Per the District’s approved broker, CBRE, these rates exceed the estimate of full market rate for triple net leases in the east Tempe area for this type of facility. Tenant shall have one (1) option to extend the lease term for an additional three (3) years at the then current market rate with 2.5% annual increases.

Recommendation It is recommended that the Maricopa County Community College District Governing Board approve renewal of the lease to the Arizona Swimming Gauchos (ASG), under which it will continue to operate the swimming pool at Glendale Community College. The lease renewal term runs from January 1, 2019 through December 31, 2021. The ASG will pay an annual rent of $25,200.00, which is unchanged from the prior 3 years. Justification In 1967, the City of Glendale and MCCCD joined together to construct a swimming pool at the GCC campus for use by both parties. In the spring of 2009, due in large part to budget cuts by both the City and MCCCD, it became apparent that continuing to operate the pool was not financially viable for either the City or MCCCD. Rather than closing or demolishing the pool, MCCCD entered into a lease agreement in December of 2009, with a non-profit youth swimming club, the Arizona Swimming Gauchos (ASG). ASG agrees to continue to lease the pool and to be responsible for its management and operation. For instance, ASG will service the pool and purchase supplies and chemicals at its cost. In addition, ASG will pay GCC a monthly rent, representing a shared cost for utilities consumed. The lease will permit ASG under limited circumstances to rent the pool to outside parties under the restrictions and conditions to which GCC would be subject if it were renting the pool. GCC will continue to use the pool for classes and fitness programming.

(CWI) and Maricopa Community Colleges on behalf of Rio Salado College for the amendment of an existing contract to purchase and track digital marketing advertisement for Rio Salado College’s programs nationally. The purpose of this amendment is to market RioNational programs to targeted individuals via a digital marketing campaign that allows for Rio Salado College to track targeted students and to determine if potential students enroll. Approval of this amendment for up to $2 million is requested for a start date of January 1, 2019 and the agreement shall terminate on June 30, 2019 with an option for an extension by written agreement for up to two (2) additional one (1) year terms beginning on July 1st of each year. Justification The amendment with a continued service agreement with DXM provides Rio Salado College a proprietary method to target, distribute, and measure online display advertising using the blend of offline and online data. By utilizing this micro-targeted approach, Rio Salado College can maximize its marketing dollars to reach potential students. DXM has built a range of models and algorithms in collaboration with CWI for RioNational using target market data and data on potential students. CWI through its subcontractor, Inputs & Outcomes, used the same algorithms to identify, segment, and understand the target personas as well as to build the core brand platform/pillars and overarching messaging to reach these targets. The data garnered from the original marketing campaign will be used to continually refine and expand the target student personas as well as to track and optimize marketing efforts and digital marketing expenditures.

Ms. Leslie Cooper Recommendation It is recommended that the Board authorize the Chancellor or her designee to prepare and execute documents necessary to settle claims between GCNA and the District in GCNA v. MCCCD, Maricopa County Superior Court [CV2016-011492 and CV2016-015343]. The District contracted for three construction projects at Scottsdale Community College and Mesa Community College. GCNA issued certain performance bonds to guaranty the contractor’s performance of that work. When the contractor defaulted, the District and GCNA entered into Takeover Agreements by which GCNA became responsible for the completion of that work. After substantial work was completed under the Takeover Agreements, GCNA filed suit against the District, alleging that the District had failed to pay sums required under the agreements. The District counterclaimed, asserting that GCNA had breached the agreements and that the District was entitled to recover costs it incurred to complete the projects. The parties entered into mediation on November 8, 2018, and have agreed that the matter will be settled, with a mutual release of claims and payment by the District to the GCNA of $1 million. Justification With the assistance of outside counsel, the District has negotiated an amicable resolution of the matter, subject to approval of the Governing Board. Explanation of the proposed agreement, its background and counsel’s recommendation have been provided in attorney-client privileged communication.

The analysis and reporting of variances will continue to be refined over the next several months as more data become available. Expenditure Summary: $254.7M year to date; projected expenditure at year-end: $686.8M • Expenses for Personal Services and Employee Benefits are generally consistent throughout the

academic year (August through May) as faculty expenses are primarily recognized during this period. Expenses in July and June of each fiscal year are typically lower.

• 37.1% of projected expenditures have been recognized year to date Revenue Summary: $423.9M year to date; projected revenue at year-end: $708.6M • The two major revenues, property taxes and tuition, are collected in cycles. Tuition revenue is

generally collected at the beginning of each semester while property tax revenue is mostly collected in the fall and spring when semi-annual payments are due from property owners.

• 59.8% of projected revenue has been recognized year to date

Fund Balance and Financial Stability Requirements • Projections are for the Fund 1 balance to increase by $21.8M (from $180.3M to $202.2M) in FY

18/19. • MCCCD is required to maintain a financial stability balance equal to 10% of the annual projected

revenue. This currently equates to $67.5M. The remaining fund balance of $134.7M is comprised of college/DO division carryforward, allowance for student bad debt, potential uncollected tax levy, reserves for potential claims, Campus Works investment, and a projected undesignated balance of $97.8M.

• While the projected undesignated fund balance is expected to be more than $97M, there are ongoing expenses that may potentially impact these balances (i.e., capital needs, transformation, etc.).

• Financial activities of the District comply with the Governing Board Policies, Chancellor Interpretations 2.4 and 2.6, though Restricted Fund revenue collection often lags behind expenditures given that the nature of grants and financial aid is one of reimbursement for expenditures and awards.

• The Governing Board contingency beginning balance is $900,000. The remaining balance as of 11/30/18 is $900,000.

Expenditure Summary: $667.5M (year to date) • Typically evenly spread across each month, as the majority is payroll and benefits which are recorded

every two weeks. • 91.0% of expenditures have been recognized year to date (versus 89.3% in 16/17, 89.3% in 15/16,

and 84.7% in 14/15). • 9.0% of the budget remains unexpended or unencumbered (versus 10.7% in 16/17, 10.7% in 15/16,

and 15.3% in 14/15). Revenue Summary: $669.9M (year to date) • The two major revenues, property taxes and tuition, are collected in cycles. Tuition revenue is

generally collected at the beginning of each semester while property tax revenue is mostly collected in the fall and spring when semi-annual payments are due from property owners.

• 97.7% of the budgeted revenue has been recognized year to date (versus 95.6% in 16/17, 95.7% in 15/16, and 95.4% in 14/15).

Fund Balance and Financial Stability Requirements • The Fund 1 balance increased by ~$2.4M (from $177.9M to $180.3M) in FY 17/18. • MCCCD is required to maintain a financial stability balance equal to 8% of the annual projected

revenue. This currently equates to $53.6M. The remaining fund balance of $126.7M is comprised of college and program carryforwards, allowance for student bad debt, priority initiatives, uncollected property tax levy, reserves for potential claims, and a projected undesignated balance of $77.3M.

• Financial activities of the District comply with the Governing Board Policies, Chancellor Interpretations 2.4 and 2.6, though Restricted Fund revenue collection often lags behind expenditures given that the nature of grants and financial aid is one of reimbursement for expenditures and awards.

• The Governing Board contingency beginning balance is $900,000. The remaining balance as of 6/30/2018 is $900,000.
