Purpose of this documentThe Mackay-Whitsunday Healthy Rivers to Reef Partnership (MWHR2RP) governance charter outlines the purpose, objectives, key committees and their operational responsibilities and proposed input of regional working groups.

It outlines areas of agreement following the endorsement of proposed arrangements by the inaugural Partnership meeting (30 September 2014). It aims to ensure that all partners have a common understanding on the governance and operation of the Partnership. This Charter will be reviewed on an annual basis to ensure membership is current and Partnership processes are current.

Purpose of the MWHR2RPThe initial purpose of the Mackay-Whitsunday Healthy Rivers to Reef Partnership is to develop a Mackay-Whitsunday regional waterway health report card which will inform whole of catchment management in the region from the catchments to the rivers to the outer Great Barrier Reef.

For the purpose of this partnership the Mackay Whitsunday Region includes the catchments of the Don, Proserpine, O’Connell, Pioneer and Plane basins, the urban area of Mackay, the ports of Abbot Point, Mackay and Hay Point, marinas and the coastal and marine area to the eastern boundary of the Great Barrier Reef Marine Park.

The Mackay-Whitsundays Healthy Rivers to Reef Partnership will develop and implement a partnership approach to report on the health of freshwater rivers, wetlands, estuaries, near shore coastal and marine environments, as well as management efforts and outcomes.

The Partnership will establish collaborative approaches that seek to integrate environmental, social, economic and cultural information and catchment health knowledge; and build upon and integrate existing monitoring, modelling, recording and reporting efforts at the sub-catchment, catchment and reef wide scale.

A range of reporting products are produced for the Great Barrier Reef that complement each other and respond to different drivers (see Attachment A). The intent is to have a reef wide approach to reporting, with nested regional models that provide finer scale information. The program will collect similar core indicators that can then be rolled up into reef wide or state wide reporting, and will deliver products at a scale that communities can relate to.

Objectives of MWHR2RPThe members are committed to delivering the following objectives through the Mackay-Whitsundays Healthy Rivers to Reef Partnership:

communicate information effectively and at a relevant scale to the broader community on waterway health issues with scientific integrity, independence and transparency

support decision making for management activities and interventions, model outcomes and report on effectiveness of those interventions

be specific to the Mackay-Whitsunday region and consistent with other regional waterway report cards including South East Queensland (SEQ), Gladstone and Fitzroy

provide effective, coordinated, strategic and transparent investment to ensure cost effective development of an annual report card and associated catchment improvement solutions

consolidate and integrate outputs from ambient and event monitoring programs as well as different modelling platforms

provide scientific information that may assist in improving or maintaining the environmental, social and economic values of the Don, Proserpine, O’Connell, Pioneer and Plane catchments, rivers and adjacent reef

deliver more innovative approaches to understanding catchment wide cumulative impacts and communicating that more effectively to the broader community

inform planning and delivery activities of the Partners in response to the findings of the report card.

build upon, complement and enhance existing efforts of members.

Overall governance structure

MWHR2RP Partner responsibilities

PartnershipOne of the key objectives of any partnership model is to ensure commitment and participation from all members. Commitment to the partnership will be through a Memorandum of Understanding (MOU) signed by all partners. It is expected that the Partnership would meet twice a year and provide updates to all partners on progress. It will be independently chaired by Ms Di Tarte.

PanelThe Mackay-Whitsunday Healthy Rivers to Reef Panel (the Panel) is a sub-set of the Partnership and provides more of an operational role for the Partnership. It is expected that the Panel will meet every 6-8 weeks and oversee management of the report card program design, budget, communication plans etc. It will be independently chaired by Ms Di Tarte.

The recommended structure and membership of the Panel seeks to ensure adequate representation across the partners but not necessarily all.

Representation will be up to: 6 industry, 6 community, 3 government, 1 research, the Technical Working Group chair, and Panel Chair.

The Panel membership may be reviewed as more partners come on board to ensure representation is adequate for the region.

MWHR2RP Technical Working Group responsibilitiesThe Technical Working Group (TWG) is established to identify and coordinate available monitoring data and modelling information, identify critical gaps and develop the report card methodology and design. The TWG will be supported by technical officers in Reef Catchments and NQ Dry Tropics.

Membership of the technical working group includes experts and data custodians across different organisations (e.g. Department of Agriculture, Fisheries and Forestry; North Queensland Bulk Ports; Department of Natural Resources and Mines; Great Barrier Reef Marine Park Authority; Department of Science, Information Technology, Innovation and the Arts; Australian Institute of Marine Science) and is skills-based. The technical officers will work closely with officers from these organisations to identify datasets, develop an agreed methodology for report card grades and report card design.

Independent Science PanelTo ensure the report card is based on best available independent science the Reef Water Quality Protection Plan Independent Science Panel (Reef Plan ISP) will provide advice and review and endorse methodologies, systems and processes used for the development of the report card.

The Reef Plan ISP has agreed to this expanded role and will provide advice on how best to nest regional report cards within the wider context of Great Barrier Reef report cards.

The Chair of the TWG will be present at Reef Plan ISP meetings when MWHR2RP business is on the agenda. It is the responsibility of the TWG Chair to liaise with the Partnership/ Panel Chair to convey Reef Plan ISP decisions to the Panel and Partnership.

Updated terms of reference have been provided to the Reef Plan ISP for consideration as at 30 September 2014. Once endorsed by the Reef Plan ISP and Intergovernmental Operating Committee (IOC) they will form part of this charter.

Regional NRM BodiesThe role of the Regional NRM bodies within the Partnership is to provide technical and communication support to develop the Mackay-Whitsunday Report Card. The two regional NRM bodies for the MWHR2RP are Reef Catchments and NQ Dry Tropics.

The technical officers in Reef Catchments and NQ Dry Tropics are the link to the existing NRM regional working groups who provide a strong knowledge base for the region. The technical officers will liaise with the officers servicing these working groups or participate in the working groups when possible.

Knowledge and information obtained through these regional working groups will be made available via the technical officers to the TWG and ISP when required.

The operational structure of the MWHR2RP is presented and discussed later in this document.

MWHR2RP Secretariat and Project Team ResponsibilitiesThe project team includes two technical officers - one based in Reef Catchments and one in NQ Dry Tropics. Secretariat support will be provided by the Department of Environment and Heritage Protection along with the technical officer from Reef Catchments for the first twelve months of the project. NQ Dry Tropics will provide technical and communication support as outlined in the project funding agreement. Long term arrangements will be scoped for the continuation of the Partnership post October 2015.

The secretariat will:

Organise meeting venues, catering, presentations, agendas and minutes. Collate and report on partners’ views. Ensure MWHR2RP data and information is collected and collated in a format agreed by the

Partnership Develop agenda papers for the Partnership, Panel, Technical Working Group and Reef Plan

Independent Science Panel in consultation with the respective chairs of these committees

Follow up agreed actions Ensure project deliverables from funding providers are met

The project team will deliver the milestones as outlined in the work program, which is available upon request.

Operational structure of MWHR2RPThe following figure shows the operational structure of the Partnership.

Support from Regional Working Groups

The Regional Working Groups (RWGs) for the MWHR2RP will be the existing “Think Tanks” established in the region, including (but not limited to) grazing, horticulture, cane, coastal development, urban development, LMACs, Landcare groups, and ecosystem health groups. New/other groups may be drawn on as needed for regional knowledge and expertise.

The RWGs will provide locally relevant expertise and knowledge for the region, representing local stakeholders, community groups, and industry. The RWGs will provide knowledge and guidance on current activities occurring in the region, results of implementation of such activities, and opportunities for improvements. The RWGs will also provide key information to the report card regarding ABCD Management Practice Frameworks relevant to each RWG.

1. Objective1.1 The Mackay-Whitsunday Healthy Rivers to Reef Partnership: The Partnership aims to bring

together Partnership representatives interested in the health of the five regional catchments (the Don, Proserpine, Pioneer, O’Connell and Plane), the urban area of Mackay, the ports of Abbot Point, Mackay and Hay Point, marinas and the adjacent coastal marine areas of the Great Barrier Reef through open and honest communication built on rigorous scientific based decisions to continuously improve the regional report card and informing the community with up-to-date information.

2. Membership2.1 Partners

2.1.1 Partners are listed in Appendix A. As new members join, this list will be updated.2.2 Joining the Partnership

2.2.1 Membership of the Partnership is open to organisations with an interest in maintaining, and where necessary improving the health of the five catchments, the urban area of Mackay, the ports of Abbot Point, Mackay and Hay Point, marinas and the adjacent coastal marine areas of the Great Barrier Reef by reporting on the health and if necessary making recommendations for improvement. To become a member of the Partnership, an interested party must:

Read, understand and sign the Memorandum of Understanding and Partnership Terms of Reference,

Be approved by the Panel or the broader Partnership.2.2.2 Organisations who become partners may nominate one representative to participate in

Partnership meetings.

3. Role 3.1 Partners should:

Genuinely work together and engage with other Mackay-Whitsunday Healthy Rivers to Reef partners, the Partnership Panel, the Reef Water Quality Protection Plan Independent Science Panel, and the Technical Working Group in a positive and proactive manner.

Prepare for, attend and contribute to Partnership meetings: at least two times each year.

Report back to own organisation about Partnership progress and actions Take into account partnership panel, reef plan independent science panel and

community advisory recommendations, requests and concerns. Progress actions form Partnership meetings relevant to their own organisation Raise concerns (if any) immediately as they arise with the Independent Chair, Reef

Catchments Project Leader or the Department of Environment and Heritage Protection. Provide data and information to the Technical Working Group and Reef Plan

Independent Science Panel, subject to commercial-in-confidence and a ‘to be negotiated’ data sharing agreement.

Provide information at Partnership meetings on initiatives and activities relevant to the objectives of the MWHR2RP.

Make decisions using an evidence based approach.

4. Operation4.1 All members of the Partnership may participate in Partnership meetings to receive performance

reports, elect the Partnership Panel and contribute to forward planning.4.2 The Partnership Panel provides program oversight of Partnership activities4.3 The Partnership Panel will be made up of representatives from the community partners,

industry partners, government partners and research partners.

5. Conflict of Interest5.1 Panel members must disclose material personal and professional interests which may constitute

any conflict of interest.5.2 Declaration of interests will be recorded in the Minutes of the meeting.5.3 Subsequent involvement in the matter concerned shall be at the discretion of the Panel.

6. Partnership Meetings6.1 Partnership meetings are comprised of the representatives of Partnership member

organisations.6.2 The full Partnership shall meet at least twice per year to receive performance reports, elect a

Chair and contribute to forward planning. 6.3 Decision-making process

6.3.1 The Partnership will make decisions by consensus. A 70% majority will be used in the event of an impasse.

6.3.2 It is the responsibility of the Chair to manage the decision-making process.6.4 Absences and alternates

6.4.1 The Partnership members are expected to attend Partnership meetings. If unable to attend a meeting, Partnership members may propose alternate members or proxies, at the discretion of the Chair.

6.4.2 If a Partnership member can’t attend there is an obligation to provide a proxy and to ensure proxies and the organisation are briefed and proxies can speak for their organisation.

6.4.3 Nomination of a proxy from the absentee Partnership member’s organisation or another organisation from the same sector is encouraged.

6.5 Observers

6.5.1 One observer per Partnership member may attend a Partnership meeting to assist the member. They are passive observers, not able to vote and may have to leave the room for some discussions.

7. Partnership Chair7.1 Selection

7.1.1 Ms Di Tarte will be the inaugural Chair of the Mackay-Whitsunday Healthy Rivers to Reef Partnership.

7.1.2 Chair arrangements will be reviewed every year by the Partnership and Panel and elected by the Partnership.

The Panel supports the Partnership objective of bringing together Partnership representatives interested in the health of the five regional catchments (the Don, Proserpine, Pioneer, O’Connell and Plane), the urban area of Mackay, the ports of Abbot Point, Mackay and Hay Point, marinas and the adjacent coastal marine areas of the Great Barrier Reef through open and honest communication built on rigorous scientific based decisions to continuously improve the regional report card informing the community with up-to-date information.

10. Chair10.1 Selection

10.1.1 Ms Di Tarte will be the inaugural Chair of the Mackay-Whitsunday Healthy Rivers to Reef Partnership Panel.

10.1.2 Chair arrangements will be reviewed every year by the Panel and elected by the Panel.10.2 Role

The Chair will: Develop (with assistance from the Department of Environment and Heritage Protection

(EHP)) and manage the agenda and conduct the Partnership and Panel meetings; and Facilitate contact between the Panel, the Partnership and host organisations.

3 Membership3.1 The Panel comprises of 17 members including the Chair.3.2 The Panel members are selected by the Partnership, to represent the Partners and are

comprised of up to 6 community, 6 industry, 3 government and 1 research representative. Community Partnership members will elect the community representatives on the Panel, and representation will include Traditional Owners, regional NRM bodies, conservation groups, and recreational fishers. Industry Partnership members will elect the industry representatives on the Panel, and representation will include the resource industry, ports, agriculture, marine tourism and commercial fishers. Government Partnership members will elect the government representatives on the Panel. Research Partnership members will elect the research representative on the Panel. A ballot will be used if consensus between sector partners is unable to be reached.

3.3 The Chair of the Technical Working Group is a member of the Panel.3.4 The Chair of the Reef Water Quality Protection Plan Independent Science Panel is not a

member of the Mackay-Whitsunday Healthy Rivers to Reef Partnership Panel.3.5 Panel members will not be remunerated by the Mackay-Whitsunday Healthy Rivers to Reef

Partnership for their time.

4 RoleThe role of the Panel is to:

4.1 Genuinely work together and engage with other Mackay-Whitsunday Healthy Rivers to Reef Partnership partners, the Technical Working Group, the Reef Water Quality Protection Plan Independent Scientific Panel.

4.2 Implement Partnership decisions e.g. work program, communication plan etc.4.3 Address matters raised by or affecting partners.4.4 Preparation for, attendance at and contribution to Panel meetings.4.5 Report back to own organisations about partnership progress and actions.4.6 Make decisions using an evidence based approach.4.7 Provide data and information to the Reef Plan Independent Science Panel and Technical

Working group, subject to commercial-in-confidence and a ‘to be negotiated’ data sharing agreement.

4.8 When required, prepare documentation (assisted by EHP) for Panel meetings, implementing Partnership decisions or for making operational decisions.

4.9 Communicate and promote (‘champion’) the MWHR2RP Program in relevant stakeholder and regional forums and with other related programs.

5 Conflict of Interest5.1 Panel members must disclose material personal and professional interests which may

constitute any conflict of interest.5.2 Declaration of interests will be recorded in the Minutes of the meeting.5.3 Subsequent involvement in the matter concerned shall be at the discretion of the Panel.

6 Meetings6.1 Meeting frequency

6.1.1 Unless otherwise agreed, the Panel will meet at least once every six to eight weeks in Mackay or via teleconference.

6.2 Meeting notice6.2.1 Notice of at least five working days must be given in advance of each Panel meeting

6.3 Absences and alternates6.3.1 The Panel members are expected to attend Panel meetings. If unable to attend a

meeting, Panel members may propose alternate members or proxies, at the discretion of the Chair.

6.3.2 If a Panel member can’t attend there is an obligation to provide a proxy and to ensure proxies and the organisation are briefed and proxies can speak for their organisation.

6.4 Nomination of a proxy from the absentee Panel member’s organisation or another organisation from the same sector is encouraged. Observers

6.6.1 EHP will assist the Chair, in consultation with the Panel members to develop the agenda6.6.2 The agenda will generally include the following:

- Minutes and actions of the previous meeting- Reporting on progress of Partnership activities- Report from the Chair of the Reef Plan Independent Science Panel- Any other general business

6.7 Papers6.7.1 EHP will circulate Panel meeting papers. Whenever possible, papers will be circulated at

least five working days prior to the meeting. 6.8 Minutes

6.8.1 Minutes will contain decisions made by the Panel. Minutes will be distributed to the Panel and Partnership.

7 Leaving the Panel7.1 Panel members may withdraw from the panel at any time by written notice to the Chair of

the Mackay-Whitsunday Healthy Rivers to Reef Partnership Panel and must provide details of the replacement representative.

11. RoleReview and provide technical monitoring, modelling and reporting advice on the Mackay-Whitsunday Healthy Rivers to Reef Partnership (MWHR2RP) Program including the following:11.1 Program review and continuous improvement (integration, gaps and priorities)11.2 Program implementation11.3 Knowledge of data sets and ability to interpret data sets for integration into report card.11.4 Reporting framework and Report Card material.11.5 Other relevant technical issues as identified by the Partnership Panel.11.6 Provide peer support to the MWHR2RP technical officers housed in Reef Catchments and

NQ Dry Tropics.11.7 Participate in relevant MWHR2RP program meetings and workshops.11.8 Communicate and promote (‘champion’) the MWHR2RP Program in relevant stakeholder

and regional forums and with other related programs 11.9 Encourage whole of program coordination.

12. OperationThe TWG will: 12.1 be co-chaired by members of the group*. 12.2 report to the MWHR2RP Panel through the co-chairs.12.3 work closely (& meet regularly) with MWHR2RP Program technical officers and the Reef

Water Quality Protection Plan Independent Science Panel12.4 be provided with review material at least 2 weeks before the due date for comments.12.5 provide Report Card material for review as confidential drafts, not for distribution.

* The co-chairs are required to run the meeting and secretariat to record key decisions and recommendations.

13. Membership

13.1 Members are nominated and invited by the Mackay-Whitsunday Healthy Rivers to Reef Partnership Panel.

13.2 The Technical working group is a skills-based membership.13.3 If a member is unable to attend a meeting, proxies must have the expertise the member

represents; representation by organisation will not be permitted. 13.4 The Technical Working Group will comprise of members with skill/program expertise on

one or more of the following; Estuarine and loads Catchments modelling Paddock to Reef Management Practice Adoption Status and management of fish species Marine monitoring (inshore and offshore) eReefs and modelling Status and management of seagrass Status and management of marine - mega fauna Marine – port monitoring Urban Social Economic Regional Specialists

14. Leaving the Working Group14.1 Members may withdraw from the technical working group at any time by written notice

to the co-chairs of the Technical Working Group. 14.2 A replacement representative will be approved by the Partnership Panel.
