I. I A meeting of the Committee Constituted under Rule 90 of DCS Rules, 2007 was held on

15.05.2013 at 03:00 P.M. in the chamber of Secretary Cum Registrar, Cooperative

Societies, Office of Registrar Cooperative societies, Parliament Street, New Delhi -110001

to consider the proposal for draw of lots of one member in Pawittra Cooperative Group

1 lousing Society Ltd., 12, Vasundhra Enclave, New Delhi -110096 bearing registration

number 579-GH. Meeting was attended by the following members of the Committee.

The freeze strength of the society is 246 out of which 241 members have already

been cleared by this office in phases i.e. 237 members were cleared in August, 2002. 03

I The membership of Late Brindaban Gupta and Late Tarawati Gupta was detained at

the time of main draw due to not submission of requisite documents. Thereafter, Late

Bri idaban Gupta expired on 25.12.2000 and Late Tara Wati Gupta expired on 28.09.2006.

-41 A Writ petition was filed by Smt. Sarita Gupta W/o Late Naveen Chancier Gupta

bet re Hon'ble High Court of Delhi. lion'ble Court vide order dated 15.04.2013 ; gassed the

following directions, the operative part of order dated 15.04.2013 is as under: -

"The petitioner who is the legal heir is entitled to the flat buthas been running from pillar to post to get the said flat. We thus

put a specific query to learned counsel for the RCS as to what is theimpediment. Learned counsel on instructions. from 41,. R.K.tiludgil, Inspector (RCS), states that the following documents arerequired: -

Death certificate of Late Sh. Naveen Chander Guinn.Death certificates of Late Sint. Tarawati Gupta and her

husband, Late Sh. Brindaban Gupta.

Qtg Insofar as the first document is concerned, the copy of the same isavailable as it nnexure-P16 at page 52 of the paper book. The two

documents mentioned at serial number (ii) have already beenforwarded by Late Naveen Channel- Gupta to the Society under thecover of the letter dated 13.09.2008. The same should .forth with beforwarded by the Society to the RCS within three days from today.As far as the last aspect is concerned, learned counsel for the Societystates that there arc no dues towards the cost of construction of flatand that the Society has in filet been corresponding with the I?CS.

In view of aforesaid, there is no impediment now in the RCSclearing the name of' the petitioner and forwarding the same to theDDA for holding draw of lots subject to the society forwarding theaforesaid two documents within three days as directed. The RCSshould thus process the case within ten days from today and forwardthe nuune to the DDA for holding draw of lots. The DIM will do theneedful within fifteen days of the receipt of the name."

Further it is submitted that Smt. Sarita Gupta have dual citizenship of U.S.A. as well

as of India and the documents regarding eligibility of membership as per schedule-VII of

DCS Rules, 2007 viz.- Affidavit, Verification, Managing Committee resolution,

membership register, share certificate and share money receipt has been seen and are placed

on the record. The membership in the name of Sarita Gupta has been approved by the

Secretary-Cum-Registrar, Cooperative Societies.
