    I write to you today in my position as Chairman of the House TransportationCommittee of the Virginia House of Delegates where we have legislative overview of alltransportation issues in the Commonwealth.MWAA is presently managing the construction of Rail to Dulles which is the largesttransportation project in the Commonwealth and is of vital importance to the economicwell being and quality of life in Northern Virginia. Equally, proper management andoperation of the Dulles Toll Road remains critical to all of Northern Virginia.Over the past several months, numerous issues regarding governance by the

    MWAA Board and operational decisions made at a number of levels have surfaced in themedia. We are certain that some of the reports are overstated, but there is sufficientsubstance to some of them to warrant further examination.Accordingly, we are formally requesting that you, as Chairman of the MWAABoard, and/or your staff and representatives appear before the House of DelegatesTransportation Committee for the purpose of satisfying the committee that the Board ofDirectors is properly constituted and operating within the specifications laid out in theFederal Code which created it. There are several important examples of areas where theBoard may be not performing within it's specified role . One is that there three directorswhose terms have iapsed yet appear to be exercising voting privileges and secondly,

    key personnel decisions are being contemplated with less than a fully constituted Board.As a major partner in the Rail to Dulles project, the Commonwealth has a stronglyvested interest in ensuring that all facets of the operation are properly implemented andmanaged, and are able to withstand the strongest critics. !t would be particularlyunfortunate if certain Board decisions did not stand up to later scrutiny by outsideoversight groups. "
