No.(GN-114) PARACH -2001 -0-3454- GOI-1 4 (2006)-P.- In exercise of the powers conferred bythe proviso to article -309 of the C onstitution of India , the G overnor ofGujarathereby m akes the followingrules further to am end the G ujatattivil Services (Leave) Rules, 2002 namely:-

se rites may be called the Gujarat Civil Services (Leave) (Amendment ) Rules, 2006.(2) Theyshall come into force on the-d ate of their publication in the Off icial Gaze t t e2. In the Gujarat Civil Services (Leave) Rules, 2002, after the ryle 69 , the following rule shall be inserted,namely:-"69 A Child Adoption Leave (1) A Com petent Authority may, subject to the pr ovisions of this rule,

grant to a female Government`employee , with fewer then two surv iving children, on valid adoption of achild below the age of one year, Chiild Adoption Leave for a period of one hundred and thirty-five daysinnediatelyafter thedateofvalid`ad taignotttlltlmesofmatemity leaveadmissible tonatural mother .(2) The L eave salary . adm issible dur ing the period of child adoption leave shall be equal to the paydraw n im ncdintety before proceeding on leave.(3) (a) Child A ti& L eave may be com bined with any other land of leave.

(b) tis of Te Child Adoption Leave granted under sub -rule (1 ), a female Governmentem ployee on validadoptibaofa child may also be graine d, if applied for, leave of the kind du e andadm issible (including leave not due - and cotimnutedleave not exceeding sixtydays w ith out pr oduction9f m edical certificate) for a - period up to one year reduced bythe age of the adopted child on thedateofvalid adop i, lpithouttak ngintoaccot Chi dAdoptionLeave:

Provided that this thcihtyshall not be admissible in case she is already having two survivingchilderan at the time of ad option.(4) Ch ild Ad optionlitave shall not bed ebited against the leave account.".

CONSTITUTION OF INDIANo. . (GN-114) RJA-2006-0-877 P :- In exercise of the powers conferred by the proviso toa 3ti9 offlie Constitution of India , the G overner of Gujarat hereby makes the following rulesfurther to amend the G ujarat Civil Services (L eave) Rules , 2002 namely:-

1 (1) These rules maybe called the G ujarat CivifServices (Leave) (Second Am endment) Rules,2006(2) They sh all come into force at once.

2 In the Gu jarat Civil Services (Leave)Rules, 2002 , for rule 16, the following shall be substituted,namely"16, Maximum Period of Cogtmuoes Leave, ( 1) No Governm ent employee shall be grantedleave of any kind for a continuous period exceeding five years.

(2) A Governm ent employee shall be deemed to h ave resigned from the service if he;(a) is absent without authorization for a period of one year from the date of expiryof sanctioned leave or perm ission; or(b) is absent from the duty for a continuous period exceeding five years even if theperiod of the unauth orized absence is for less than a year.

Provided that a resonable opportunity to explain the reason for such absence shallbe given to the Government employee before the pr ovisions of sub -rule (2) are invokedBy order and in the name of the G overnor of G ujarat,

(ii) for twenty years of continuous qualifying service , maximum twenty-fourmonths:(14) for thirty years or more continuous qualifying service, maximum thirty-sixmonths;

Provided the aforesaid provisions shall not apply to the cases which falls under sub-rule (2), " .In the said rules, in rile 65, in sub-rule (1), for the words and b rackets "provided e venif this period (i.e. earned leave plus half pay leave) excee ds the period" the wo rds andbrats, "provided this period (ie. earned leave plus half pay leave) dose not exceedthe period" shall be substittood.
