THEREFORE, BE IT ORDAINED that pursuant to In- diana Code §7.1-5-12-13(a) the Board of Commis- sioners of Dearborn County, Indiana hereby adopt this ordinance further restricting the acceptable ar- eas to smoke and said further restrictions are as follows: Smoking in County Vehicles: Smoking in a vehicle owned, leased, or operated by Dearborn County, In- diana is not permitted. Those employees found to have violated this Ordinance will be subject to dis- ciplinary action by their supervisor. Smoking on County Property: Smoking on real property owned, leased, or operated by Dearborn County, Indiana is only permitted in areas desig - nated with signage as a "Designated Smoking Area". Properties connected to the sewer line, as well as properties on which con- nection charges have been paid, are not subject to being assessed the availability fee. Properties on which connection charges have been paid, as well as on which the availability fees have been paid and are current in payment of said fees, shall be guaran- teed capacity in the sewage treatment plant that serves the subdivision. 2. Notwithstanding the above, the Dearborn County Regional Sewer District reserves the right to take any legal action available to impose, bill and collect delinquent availability fees and/ or the cost of col- lecting such fees, including but not limited to fore- closing on the lien to recover the availability fees and a reasonable attorney fee pursuant to Indiana law. 3. Each owner of property in Highridge EstatesSubdivision adjacent to public sewer facilities inDearborn County, Indiana that contains improve -ments which include any toilet, septic tank, cess-pool or other facility intended or used for the dis-posal of sewage shall pay a sewer availability fee of$15.00 per month to pay debt service for sewer lineand treatment facilities installed in said subdivision.Said fee shall be collected by the Dearborn CountyRegional Sewer District. Properties connected tothe sewer line, as well as properties on which con-nection charges have been paid, are not subject tobeing assessed the availability fee. Properties onwhich connection charges have been paid, as wellas on which the availability fees have been paid andare current in payment of said fees, shall be guaran-teed capacity in the sewage treatment plant thatserves the subdivision. 2. Notwithstanding the above, the Dearborn CountyRegional Sewer District reserves the right to takeany legal action available to impose, bill and collectdelinquent availability fees and/ or the cost of col-lecting such fees, including but not limited to fore-closing on the lien to recover the availability feesand a reasonable attorney fee pursuant to Indianalaw. 3. In the event of delinquency in the payment ofsaid fees, the Dearborn County Regional Sewer Dis-trict shall certify to the County Auditor a list of thedelinquent owner or owners of each and every par-cel of real estate or building involved, and a de -scription of the premises, and the Auditor will re-cord the same in the office of the County Recorder. HIGHRIDGE ESTATES SUBDIVISION WHEREAS, the Dearborn County Regional SewerDistrict constructed a sewage treatment plant andcollection system in Highridge Estates Subdivisionlocated in Clay and Washington Townships in Dear-born County, Indiana to meet sewage treatmentneeds in said Subdivision; NOW THEREFORE BE IT ORDAINED BY THEDEARBORN COUNTY REGIONAL SEWER DISTRICTas follows: 1.
