    Okay, so no one is explicitlycalling for body cavity searchesfor all airline travelers yet. But

    the logic of those pushing forbody scanners for all airlinepassengers, and criticizing theACLU for opposing that, leads tothe inescapable conclusion thatthese critics would support such apolicy. Consider:

    1. When Richard Reid broughtexplosives onto an airlinerhidden in his shoes, theauthorities made everyoneremove their shoes. Whensecurity experts and othercritics pointed out that thiswas "silly security,"

    defenders argued that wemust put up with it in orderto block that particular kindof plot.

    2. Now that a disturbed personhas brought explosives ontoan airliner in his underwear,panicked voices want theTSA to essentially viewnaked pictures of everypassenger who boards anairline that's up to 2.5million people per day ondomestic flights alone.When the ACLU andmembers of Congress

    object, critics cry that wemust abandon our personaldignity and privacy in orderto block that particular kind

    of plot.

    States Dont Have Rights!

    In my monthlycolumn, I havetried to avoiddiscussion ofpolitical issuesand insteadfocus onpoliticalstrategy. This

    issue, however,is both a political issue and a strategicissue.

    States do not have rights overindividuals. You are born withinalienable rights and the Americanpeople, through the Constitution, havegranted government permission to useforce to protect those inalienable rights.The belief in the inalienable rights of

    individuals is what makes us libertariansand not conservatives or liberals. It iswhat differentiates us from any otherpolitical philosophy. It truly is our mostsignificant benefit to sell to theAmerican public. When libertarians andLibertarian candidates talk about statesrights we are giving people the false

    impression that we believe that groups ofpeople can somehow vote away therights you are born with. By focusing onstates rights we are also destroying ourmost significant benefit to sell to the

    American people.

    When America was founded, ourfounders separated our nation from thebelief in the Divine Right of Kingstheory which proposed that God grantedall rights to the king and the king madeall the decisions. The founding fathersheld a belief that God grants rightsdirectly to the people and people grantpermission to the government to uphold

    and protect those rights.

    Of course, many of our founding fathersdid not believe black people were

    granted God given rights which bringsus to another topic. States rights, tomany people, means segregation. Dostates have rights to allow someone toown another as property? Do states haverights to force businesses to discriminateagainst someone because of the color oftheir skin? Of course not! On the otherhand, many supporters of states rightshistorically were supporters of statesrights because they wanted to keepslavery legal so they could rape, torture,and abuse black men, women, andchildren. Years later, the same argumentof states rights was used to defend thesegregation of white and black people.Thankfully, today, most people realizethat blacks and whites can live together,

    defend segregation and even slaverywhy do some libertarians insist ontalking about states rights? Dont get mewrong, I think the state governmentsshould have more power over moreissues than the federal government does;however, the ninth amendment whichstates that The enumeration in theConstitution, of certain rights, shall notbe construed to deny or disparage othersretained by the people is just as

    important as the tenth amendment whichstates that The powers not delegated tothe United States by the Constitution,nor prohibited by it to the States, arereserved to the States respectively, or tothe people. Please notice that the tenthamendment says powers are reserved tostates. It says absolutely nothing aboutstates rights.

    When I moved my family from

    Michigan to Nashville three years agoone of the decisions we had to make waswhere we were going to live. We couldhave chosen to live in the heart of theaction and moved to a loft in down townNashville. We chose to spend half asmuch and move to a neighborhood. Sure,when we go to see a ball game or attenda play we have to fight traffic and drivedowntown. In the long run, by livingaway from downtown we free up

    thousands of dollars a year to spend onother things.

    If you run a business or run a householdyou know that we make economicdecisions daily. Often the issue is nothow much you spend; it is how you are

    spending it. By spending money on onething you now have less to spend onother things. This is a lesson Libertarianshave been trying to teach government foryears.

    In order for the Libertarian Party to havemoral authority to teach this lesson it is

    imperative that we make sure as a partywe are wisely spending our own money.Federal Election Commission Decemberreport shows the LNC pays $10,928.89a month for office space. To put this

    into some perspective, a sustainingmember pays $25.00 annually for theirmembership; it takes over 437 sustainingmembers a month to pay the rent on ourWashington, D.C office. If you are asustaining member, it took you and5,245 others to pay the rent on ournational office in 2009.

    Just like that loft in Nashville, theWatergate office puts us right in the

    heart of the action. But, could thismoney have been spent more wisely? Ifthe Ron Paul campaign taught usanything, it has taught us that donorscare more about your web address thenthey do your office address. The MilkenInstitute publishes a cost of doingbusiness index every year. Recentfindings by the institute showed theaverage cost of office rentals in all fiftystates and ranked the state of Virginia inthe exact middle. The average monthlyoffice rent in the State of Virginia is$1.72 a square foot. The monthly cost ofour Washington, D.C. office is $4.00 persquare foot. If you were to move theD.C. office into Virginia (which iswithin driving distance to WashingtonD.C.) the party could conceivable freeup close to $80,000 annually to spend onother things.

    The FEC December report also showsthe LNC spent a total of $0 oncandidates in 2009. Several states grantautomatic ballot access for the party if acandidate for a state wide office obtainsa certain percentage of the vote. We canlose an election and win a campaign.When our state candidates gain a certain

    percentage, the national party is oftenrewarded with ballot access for ourpresidential candidate. What if the partyspends less on an office and more on ourcandidates, on ballot access and

    outreach? It is within the realm ofbelievability that by financiallysupporting state wide candidates wecould end up spending less on ballotaccess in some states. By having tospending less on ballot access in somestates we could spend more oncandidates campaigns and ballot accessin other states. You can imagine howthis ripple effect could turn out.

    I am not advocating moving the nationaloffice into Virginia. In the electronic agewe live in, the national office couldconceivable be located anywhere. SouthDakota ranked the cheapest place tohave an office at a monthly rate of $1.15a square foot. I am advocating a seriouslook into the expensive cost of runningan office out of Washington, D.C. I amadvocating that we as a party look athow we spend our money. Mostimportantly I am advocating we spendmore on the real work of a politicalparty, outreach and campaigns, and lesson having an office in Washington D.C.

    Tasks for State

    Committees

    As I have previously said, I am

    advancing astrategy for theLibertarian Party.

    Part of theproposed strategyrefers to whatyour communityand state partiesare doing. Persuading your local groupand your state party to support the Local

    Organization Strategy is up to you andyour friends. I can point the way, butimplementing the Strategy in yourcommunity is in the end something youmust do for yourself.

    However, part of the proposed strategyrefers to changes that need to be madethrough the National Committee,changes in emphasis, changes inapproach, and changes in objectives. If

    you support the Local Organizationstrategy, your help is needed to populatethe National Committee with dedicatedLibertarians who will support thestrategy. That is why I will be runningfor office, and why the Clean SlateAction Program Committee is lookingfor fellow Libertarians to us in runningan adequate slate of candidates for otherparty offices.

    Now, back to state committees:

    Tasks for State Committees

    In a previous letter, I discussed activitiesparticularly appropriate for performanceby national groups. In addition to thislist, some activities such as incitement

    are appropriate for every Libertariangroup, as discussed separately.

    In this letter, I consider activities mostappropriate for statewide Libertarian

    groups.

    A good state organization developsresources to support local groups andcandidates. A good state organizationdevelops expertise to help local groupsto develop their own people andresources. A good state committee andchair work primarily as facilitators andmotivators. A good state chair asks "howcan we help you?" And, indeed, why

    should we spend our limited libertariandollars on a state organization that is notsupporting our Party's candidatesthroughout the state?

    Candidates come and go. Statecommittees usually persist. An importantstate activity -- procedures depend onstate law in each state -- is fundraisingand fundraising support for localcandidates. In some states there are no

    complications. In other states, the statecommittee must incite its members toform multiple PACs, each able to givelocal candidates specific financial orother support.

    All but the smallest state organizationscan effectivelypublish two newsletters:The Activist Newsletter covers politicalactivities, petitioning deadlines,background for key issues, andcampaigning methods -- information forcommitted party workers. The StateLiberty News, priced to the bare bones,targets prospective voters, inciting themto Vote Libertarian! and take the firstsmall steps toward activism. InMassachusetts, Liberty forMassachusetts is performing precisely

    this task, deploying an activistNewsletter for party activists and anInformational Monthly Newsmagazinefor public outreach.

    Our resources are limited. A keyquestion that we should ask of anyproposed state activity is "how does thisinvestment justify its expense?" Thisissue shows up with every start-up firm.All too many new firms fail becausethey spend money on looking like asuccessful firm rather than spending themoney on being a successful firm: Theybegin operations by renting space andhiring an office manager, without asking

    how the square footage and the non-manufacturing staff are contributing tocorporate earnings.

    Correspondingly, as a state organizationgets larger and larger, at some point it isno longer convenient to assembleenough activists to perform some regulartasks: Collating, stamping, and mailingthe state news letter becomes a majoroperation. Membership renewals are alarge stack of mail every day. At somepoint, it is more efficient to use aprofessional mailing house. It becomesefficient to hire a clerk-typist to enter themembership renewals in the database.Eventually there are multiple full timeclericals, database personnel,webmasters, or whatever, more than thestate chair can monitor in his spare time,and an office manager is needed.

    [Aside: You can also imagine a situationin which you have masses of members,and almost no activists, so that the fewavailable activists cannot cope withmailing the newsletter, opening mail,...because the activist-to-member ratio istoo low. This situation is an indicatorthat you have spent too much time

    recruiting subscribers and too little timeinciting them to become activists.Members create burdens as well asbenefits that must be balanced againsteach other.]

    In some states, ballot access issubstantially affected by the party'smajor party status or lack thereof.Depending on the state, party status isfixed on a statewide basis, byCongressional District, by County,... Itmay be affected by voter Registration (inthe 28 states with voter Registration byParty), or by vote totals in particularelections. In most cases, manipulation of

    the party's major party status -- as with avoter registration drive -- is a burden forthe state party. You may want to run acandidate for Governor. You may wantto make sure that no one runs for anyoffice above State Weigher of Cod. Youmay want to recruit registeredLibertarian voters, if you can.

    Regardless of the task, activists shouldremember thatthe party's paramount

    objective is running candidates foroffice. The purpose of seeking (oravoiding) major party status is making iteasier to get candidates on the ballot andto elect them to office, not to inflate theegos of state committee members.Keepthe mission in mind, and policy

    decisions will become clear.

    Joe Kennedy, the

    Former NewMexico Governor,Gary Johnson, has

    announced a 501c4 political advocacycommittee called the Our AmericanInitiative which has the followingmission statement:

    OUR America Initiative seeks tobroaden the parameters of thepublic policy debate of currenttopics in the national arena. Welook to enlighten the populationabout civil liberties, freeenterprise, limited government,and traditional American values.It is our aim to increase theamount of discussion andinvolvement regarding all-

    Gary Johnson has been mentioned as apotential candidate for President in 2012possibly as either a Republican or as aLibertarian. Becoming the HonoraryChairman of Our America could be astep to lay the groundwork for apotential Presidential run.     What is thepremise for thelegalization ofmarijuana? Couldyou explain to uswhy we should wantthis drug legalized?Also, what is the status on thelegalization front?

    That's a great question. The War onDrugs has become an emotional issue formany people, but let's try to look at theproblem rationally.

    First, let's look at why drugs werecriminalized. Before 1914, marijuana,

    heroin, and cocaine were available overthe counter at your local drug store.Heroin was sold as a cough and coldremedy. Cocaine was extremely popularwith athletes, especially baseball players,and was sold as an energy-booster inproducts like Coca-Cola.

    At the turn of the century, the medicalcommunity began to reach a concensusthat these drugs were addictive and

    caused health and social problems for itsusers. It was estimated that 1.3% of thepopulation was addicted to various drugsin 1914 when the first drug prohibitionwas approved.

    In 1970, after nearly 56 years of drugprohibition, 1.3% of the population was

    still addicted to drugs. The Federalgovernment became more involved,spending $100 million that year in theWar on Drugs. In 2003, the Federalgovernment spent $70 Billion in the War

    on Drugs. What was the result? 1.3% ofthe population was still addicted, thesame number as 1914 when drugs werelegal.

    What we have seen in the last 100 yearsis that a certain element of ourpopulation, roughly 1.3%, will becomedrug addicts whether or not they arelegal, whether or not the drugs areexpensive, whether or not the users are

    thrown into prison.

    So what are the results of the War onDrugs? In order to evade lawenforcement, the purity of drugs hasgone up. Deaths from overdose havetripled since 1970. In 1914, legitimatedrug companies made profits. In 2009,gangsters and terror groups like AlQaeda and Osama bin Laden make theprofits. Annually, there are almost 2million arrests on drug-related offenses.Each arrest creates economic and socialproblems for the families, and renewsthe addiction cycle for the nextgeneration.

    We have a limited amount of policeresources. When those resources arefocused on drugs, other offenses can fallthrough cracks in the system. Currently,in the US, 40% of all murders, 60% ofall rapes and arsons, 75% of allrobberies, 46% of all assaults, and 83%of property crimes are unsolved.Unsolved!

    So here's the question we all need to askourselves. We spend $70 Billion peryear to put drug addicts and dealers in

    prison, with no noticeable results in theoverall addiction rate. Wouldn't it bebetter to spend this money on solvingreal crimes like murder, rape, arson,robbery, assault, and theft?

    Drug addiction is still a serious problemfor the users, their families, and societyas a whole. But we now know thatjailing offenders has not solved theproblem. We need to develop betterapproaches. We need to focus onaddiction as a medical problem, not acriminal matter. We need to help addictsfight their disease, not toss them in jail.

    Currently, marijuana use has shownactual medical benefits for some people.Many doctors agree that marijuana is notphysically addictive like heroin orcocaine. The Federal government hasrecently agreed to stop prosecuting casesof medical marijuana use in the 13 stateslike California where medical use islegal.

    Dr. Phillies is a former Chair of theLibertarian Party of Massachusetts andwas a candidate for the Libertarian PartyPresidential nomination in 2008.

    Anyway, the LNC did approve a budget,(a budget that only Rachel Hawkridge,Lee Wrights, and Jake Porter votedagainst) established a committee to assiststate organizations, and adopted a few ofDr. Larks goals that he had been tryingto get the LNC to adopt since early inthis LNC term. Additionally, thefactional fighting appears to have dieddown since the St. Louis meeting back in

    July.

    Bill Redpath announced, during the LNCmeeting, that he would not seek a thirdterm as LNC Chair, but may run anotherposition on the LNC which manyinsiders believe would most likely be anAt-Large position.

    It is the year 2010 and Noah lives

    in the United States.

    The Lord speaks to Noah andsays: "In one year I am going tomake it rain and cover the wholeearth with water until all isdestroyed.

    But I want you to save therighteous people and two ofevery kind of living thing on the

    earth.

    Therefore, I am commanding youto build an Ark."

    In a flash of lightning, Goddelivered the specifications foran Ark.

    Fearful and trembling, Noah tookthe plans and agreed to build theArk.

    "Remember," said the Lord,"You must complete the Ark andbring everything aboard in oneyear."

    Exactly one year later, a fiercestorm cloud covered the earthand all the seas of the earth wentinto a tumult.

    The Lord saw Noah sitting in hisfront yard weeping.

    "Noah." He shouted, "Where isthe Ark?"

    "Lord please forgive me!" cried

    Noah. "I did my best, but therewere big problems. First, I had toget a permit for construction andyour plans did not comply withthe codes. I had to hire an

    engineering firm and redraw theplans.

    Then I got into a fight withOSHA over whether or not theArk needed a fire sprinklersystem and floatation devices.

    Then my neighbor objected,claiming I was violating zoningordinances by building the Ark in

    my front yard, so I had to get avariance from the city planningcommission.

    I had problems getting enoughwood for the Ark, because therewas a ban on cutting trees toprotect the Spotted Owl.

    I finally convinced the U.S.Forest Service that I needed thewood to save the owls. However,the Fish and Wildlife Servicewon't let me catch any owls. So,no owls.

    The carpenters formed a unionand went out on strike. I had tonegotiate a settlement with theNational Labor Union. Now Ihave 16 carpenters on the Ark,but still no owls.

    When I started rounding up theother animals, I got sued by ananimal rights group. Theyobjected to me only taking two ofeach kind aboard.

    dismissed, the EPA notified methat I could not complete the Arkwithout filing an environmentalimpact statement on yourproposed flood. They didn't take

    very kindly to the idea that theyhad no jurisdiction over theconduct of the Creator of theuniverse.

    Then the Army Corps ofEngineers demanded a map ofthe proposed new flood plain. Isent them a globe.

    Right now, I am trying to resolve

    a complaint filed with the EqualEmployment OpportunityCommission that I am practicingdiscrimination by not takinggodless, unbelieving peopleaboard!

    The IRS has seized all my assets,claiming that I'm building theArk in preparation to flee thecountry to avoid paying taxes.

    I just got a notice from the statethat I owe some kind of user taxand failed to register the Ark as arecreational water craft."

    Finally the ACLU got the courtsto issue an injunction againstfurther construction of the Ark,saying that since God is floodingthe earth, it is a religious event,therefore unconstitutional.

    I really don't think I can finishthe Ark for another 5 or 6 years!"Noah wailed.

    The sky began to clear, the sunbegan to shine and the seas began

    to calm.

    A rainbow arched across the sky.Noah looked up hopefully.

    "You mean you are not going todestroy the earth, Lord?"

    "No," said the Lord sadly. . ."Thegovernment already has."

    Perhaps you saw last nightsairing of the Atlanta PressClub/WPBA-TV debate on theproposed amendment to bansame-sex unions. Barr was one of

    six panelists and the only one toupset audience expectations. Theman who nearly chased BillClinton out of the White Housedeclared Georgias gay-marriageamendment to be so poorlydrafted that it should be kickedback to the Legislature for a re-write.............................

    The former federal prosecutor is

    as conservative as ever. But nolonger does he feel obliged tocarry Republican water. Gaymarriage is one bucket hesdeclined an issue of nourgency, he says. And GeorgeW. Bush is another.

    He wont vote for Bush. But hewont vote for John Kerry, either.I have serious questions aboutboth presidential candidates, hesaid.

    Does that mean hes votingLibertarian?

    Yep, Barr said Thursday. Thatwould be MichaelBadnarik.

    In the final weeks of thecampaign, Bush the Rancher hasbeen roping in the hardconservatives who have strayedover issues such as the deficit,the Patriot Act, even the war inIraq. On Tuesday, Pat Buchanangave his blessing, however

    unenthusiastic, toBush..

    The Patriot Act isnt Barrs sole

    disagreement with the Bushadministration. But its the mostemblematic. Conservatives ofall people ought to stand up forthe belief that there needs to belimits on executive power. [TheBush administration] says thatterror trumps everything. To me,nothing should trump the Bill ofRights.

    Barr doesnt like the way thePatriot Act whittles away at theprobable cause standard thatjustifies government snooping oncitizens. He doesnt like thecircumventing of judges viaadministrative subpoenas.

    This last point is where Barradmits a link between the fightover gay marriage and the Patriot

    Act. Republicans assert the needfor a constitutional ban on gaymarriage with cries of activistjudges. And Barr admits hesseen more than a few of thatkind. But to demand that judgesshould be subservient to alegislature or an executive oneverything is just as dangerous,he said.
