Dear Judge Patrick:
This office is counsel to E-Built LLC, James Maransky, Kevin Baird, and other entities associated with the development of 412-24 Moyer Street. Pursuant to our correspondence with Roberto A. Fernandez, City Solicitor, we submit this letter to express our objection to permitting any access by Mr. Scott to copies of building plans relevant to the development of 412-24 Moyer, which we understand to be the central issue in the above-captioned appeal.
Although my clients could provide voluminous detail regarding Mr. Scott’s conduct relevant to my clients and the development at issue, in the interest of efficiency we will incorporate by reference the details contained in the attached Criminal Complaint and Indictment issued by the Philadelphia District Attorney – charges to which Mr. Scott accepted an ARD outcome (See Docket attached hereto). Although the conduct for which Mr. Scott was charged spanned several development projects, a portion of the indictment directly relates to his conduct regarding development of the parcels for which he now seeks access to the building plans.
By way of specific additional detail relevant to our security concerns regarding the release of information to Mr. Scott, during the last 7 years Mr. Scott has repeatedly attempted to involve third-parties in his litigation against Mr. Maransky, including writing letters to purchasers of units in Mr. Maransky’ s properties making misleading claims about pending legal action1, and filing a lis pendens against all units in a condominium development which Mr. Maransky had to have stricken via emergency motion. It is my client’s belief that Mr. Scott is utilizing the Right to Know process to continue his pattern of bad faith and harassment towards them – conduct that the Commonwealth felt was a sufficient basis for criminal charges. With all

due respect to the Right to Know laws of this Commonwealth, it seems thoroughly inappropriate that Mr. Scott be granted access to documents relevant to a development project in which the requester has been charged criminally for conduct stemming from his interaction with the development at issue.
Moreover, Mr. Scott sought copies of this information in the pending state court action
captioned Maransky et al. v Scott et al, Philadelphia Court of Common Pleas Docket No. 17030079. Attached hereto are the Plaintiffs’ responses to Mr. Scott’s discovery requests wherein Mr. Scott asked for copies of the construction plans relevant to 412-24 Moyer Street. Mr. Maransky responded with an incorporation of his general objections and reference to the Philadelphia Zoning Archive. As I am sure you are aware, "[t]he primary purpose of the FOIA was not to benefit private litigants or to serve as a substitute for civil discovery," Baldrige v. Shapiro, 455 U.S. 345, 360 n.14 (1982), see also Miller v. Bell, 661 F. 2d 623, 626 (7th Cir. 1981), cert. denied, 456 U.S. 960 (1982). Although Mr. Maransky’s litigation strategy relevant to the civil action is protected by attorney-client privilege, I can represent that it is our intention to object to future requests for copies of these plans based on relevance to the action and based on the copyright held by the architect for the plans at issue, and Mr. Scott’s use of the Right to Know law to circumvent the discovery process is an abuse of the Right to Know law itself.
In summary, my clients respectfully object to Mr. Scott being afforded any opportunity to
review the plans at issue on the basis of our security concerns as identified herein, and specifically based on Mr. Scott’s own prior conduct relevant to the Moyer Street development for which he was criminally charged. If the Court is inclined to permit Mr. Scott to review the plans in person, we urge the Court to impose strict limitations on such access to ensure that Mr. Scott does not photograph or otherwise copy the plans due to the security concerns listed herein and the copyright held by the architect on those plans.

Dear Roberto A. Fernandez, Esq.:
I am a long-time resident of Philadelphia, specifically the Fishtown neighborhood. I understand the concerns fellow
neighbors express to the changing neighborhood, whether it is potential building plans, rezoning, variances, etc. I get it
and welcome the concern. Just not years after the building is built, fully occupied and passed all inspections concerning
the property. I am writing expressing my concern with the request to view our building plans (412-424 Moyer St) on
behalf of all the 11 units. My role is President and I have spoken to our neighbors on this request.
The concern centers around the person making the request. A quick internet search on John R. Scott reveals he has been
in and out of the courts regarding the same building for over a decade. As a result of this on going feud he has been
charged with and found guilty of extortion to commit a crime, extortion to accuse, obstr uction, false swearing testimony,
unsworn falsification to authorities, perjury, and the list continues all related to FT Holdings and their principals. He is
currently on probation finishing his ARD program. This information was obtained from the Court of Common Pleas,
criminal docket number CP-51-CR-0003380-2016.
There are 11 units in this complex and a total of 6 children. We do not want to give any access to our building plans to a
someone who engaged in this activity for over a decade or someone he hires. We stand with L& I on the original denial of
access. We are already uncomfortable now that we know this man’s history with the builder and are discussing installing
cameras and other safety measures. Access to our building plans would leave us vulnerable to someone knowing where
key utilities and access points can be breached.
We would kindly ask the City of Philadelphia to respect our wishes on the grounds of safety concerns. Giving his history
and propensity of a known felon to do anything at all cost, we are concerned for our safety with releasing the records.
