Hess Club starting in March. We will no longer be meeting on the 3rd
Wednesday of the month, but on the SECOND WEDNESDAY OF THE
MONTH. That means the luncheon will be on March 14th, NOT the 21st.

Texas Association of Health Underwriters 24th Annual Convention
This year’s TAHU Convention is scheduled for April 26th and 27th in Corpus Christi. The
venue is the beautiful Omni Bayfront Hotel. You will want to attend this event for many rea-
sons. Members will have the opportunity to earn a total of 8 hours Continuing Education (CE).
Anyone who currently has the Small Group Specialist designation (SGS) should plan on taking
the 5 hour renewal CE; SB79 Certification Renewal will be provided for the first time since the
original course was given here in Houston at the 2010 Convention. There will be exhibitors, gen-
eral sessions, Chapter Leadership Training, the Hollis Robertson Award Dinner, and Casino
Night.
Potential Sponsors/Exhibitors are able to have a booth for $850. You get an 8 x 10 booth and
tickets for two attendees. The convention expects the attendance to be north of 350 brokers and
carriers from all areas of Texas.
Corpus Christi is a family oriented town with plenty of other sites to see. Plan on bringing your
family and stay an extra night or two to take in the sights or relax on the beach. The weather is
going to be great. Houston needs to pony up and ride down the trail to the Annual State Con-
vention.

Essential Health Benefits – What are they? While this may seem to be pretty simple to define, in De-
cember HHS issued a bulletin giving states the authority in setting these for its residents. HHS has de-
cided that each state must establish a benchmark plan that includes services in 10 specific categories:
Ambulatory patient services
Emergency services
Hospitalization
Maternity and Newborn Care
Mental Health and Substance Abuse
Prescription drugs
Rehabilitative and habilitative services and devices
Laboratory services
Preventive/wellness services
Pediatric services (including oral & vision care)
The wise ones have decreed in PPACA that HHS define essential health
benefits to reflect the “typical” employer plan. As agents representing
tens of thousands of employers, I am sure we can agree that there is no “typical” employer plan. The benefit plan in place
for the “typical” law firm is drastically different from the “typical” plan in place for a machine shop or dentist’s office or oil
field supply company. So, IMHO, it’s no wonder HHS is passing the buck to the states.
HHS’s suggestion for a default plan? The benchmark will become the largest plan by enrollment in the largest product in
the state’s small group market. I suppose that is as good as anything else they could have used.
I’m sure we can all see potential problems similar to what has been going on recently with the HHS requirement that all
plans include “free” (don’t ya love that word?) contraceptives. I confess that I didn’t see this as a religious issue, I saw it as
an inclusion of coverage that many of us don’t need or want, but are now forced to pay for. And as our population ages
(10,000 baby boomers turn 65 each day), I am confident there are quite a few people who will share my opinion. So,
what’s next? I can’t imagine what the “typical” premium will be if all of the above “essential” services are “free”.

Association CE Credit
Many agents may not know that up to four hours of continuing education credit can be earned by an agent who is an active member of a state or national insurance association. For information about how the credit can be earned, you can review Chapter 4004.0535 of the Texas Insurance Code and §19.1011 and new §19.1020 of the Texas Administrative Code. REMINDER:
You must have your Agent’s License Number and Renewal Date to receive credit for CE. Agents are supposed
to carry their licenses at all times, so please carry your license or at least place your number and renewal
date in your cell phone so you can retrieve it. “NO number and renewal date, NO CE Credit!”. We will not
look up your number for you!

A financial advisor goes out to a small business owner and presents three options for a 401(k) record-keeper. He talks about
each of the record-keepers’ due diligence on the funds, the investment fees, the enrollment material, and the website. There is a
lengthy and robust discussion about the pros and cons of each record-keeper. At some point in the process, the financial advisor
explains that a third party administrator (TPA) will do the plan document, Form 5500/Form 5500-SF, and the IRS-required nondis-
crimination testing. Usually the time spent on the choice of TPA is minimal, but sometimes a representative of the TPA attends the
meeting.
How did that 401(k) TPA come to be proposed to that particular business owner? Did the financial advisor complete due diligence
on multiple third party administrators and choose the TPA best-equipped to meet that particular business owner’s needs? That cer-
tainly happens sometimes, but it is usually not nearly that scientific. In some cases, the financial advisor has a single TPA he pre-
fers and whom he has used for years. In other cases, the record-keeper dropped a fee sheet into their proposal for a TPA without
consulting the financial advisor at all.
Did the record-keeper complete due diligence on the TPA’s in their TPA database? Did they match the TPA to the client? Most
record-keepers complete at least some minimal due diligence when a TPA is added to their database, but in most cases, the scope
of the due diligence is extremely limited, and frequently the due diligence is not updated. As far as the record-keeper’s selection of
TPA, sometimes there indeed was a real effort to match the business owner’s need to the appropriate TPA. In other cases, the re-
cord-keeper’s recommendation may be influenced by their preferred TPA relationships. Sadly in some cases, the record-keeper’s
selection may be influenced by their desire to sell a minimum number of cases with multiple TPAs, and they need to place plans
with a certain TPA to get them to that minimum.
The choice of 401(k) TPA does matter. The TPA works with the client on important compliance issues, and when the relationship
is bad, the business owner does not get the advice and services he needs in a way he can understand. Some plan sponsors only get
concerned about the selection of the TPA after there has been a meltdown with their TPA. At the point of meltdown, the business
owner is furious, and the financial advisor looks bad for recommending the current TPA. Nationally, there are a lot of great
TPAs. Business owners need to ask questions to make sure that they are getting one of these great TPAs and that the specific
TPA’s personality is a good fit for the business owner’s personality and needs.

It is time to start thinking about becoming involved in this year’s annual golf tournament. We have con-
tracted with Sweetwater Country Club to be the course for this year’s event and are very excited about
the opportunity to have a day of fun with our carriers, vendors, clients, and friends, while at the same
time raising money for our chosen charity. As most of you know, we traditionally donate a portion of the
proceeds to fund scholarships and this year have chosen to support the Ken Martin Scholarship Fund and
Hope Village.
Please put on your thinking caps and decide how you would like to support our scholarship funds,
HAHU, and all that it participates in and supports on the local, state, and national levels. We are actively
seeking volunteers to help with the event and, of course, asking for sponsorships and participants. We
look forward to your participation and we thank you for your support of our industry and the the Houston
