The City of West Hollywood has recognized the importance of preserving historic and cultural resources since its incorporation in 1984. The City, which adopted a Historic Preservation Ordinance in 1989, has designated more than 80 landmarks and six districts to date.

The cultural resources in West Hollywood embody the City’s unique cultural identity. Historic resources reveal important details about a community’s past and help answer broad questions about its history. The City and its constituents share a strong commitment to protecting historic buildings and local character, and will continue to work to preserve the historic and scenic assets of West Hollywood. The City’s next General Plan update will occur in or before the year 2035.

D. Review Responsibilities • Who takes responsibility for design review or Certificates of Appropriateness?

Some projects are reviewed at the staff level without commission review.

• What is the threshold between staff-only review and full-commission review?

Planning & Development Services Director: Certificates of Appropriateness are issued at the staff level when a project is determined to be minor in scope. Pursuant to Chapter 19.58.100 of the West Hollywood Municipal Code, staff-level review may occur for projects related to minor architectural elements and details, paint or other colorings or finishes, minor site improvements, signage, maintenance and ordinary repair may also be approved at the staff level. The Code states that minor changes or modifications to existing Certificates of Appropriateness may be approved at the staff level by the Director, even if they were not the approving body. The Director may refer any application for a Certificate of Appropriateness to the Historic Preservation Commission (HPC), and may also require that the proposed work be reviewed by a historic preservation architect. At the staff level, design review is provided by the assigned Planner and/or Urban Designer, who offer feedback and guidance to applicants during all stages of the application process. Staff-level Certificates of Appropriateness are administered by the Director or her/his designee. Commission: The HPC performs design review and issues Certificates of Appropriateness for projects not considered to be minor in scope, as defined above. The HPC also reviews requests for Certificates of Appropriateness that have been referred by the Director. Occasionally, some projects are also reviewed by the Planning Commission (PC), including applications for rehabilitation incentives which involve adaptive reuse. In such cases, the PC considers the HPC’s recommendation, if any, regarding the request.

California Environmental Quality Act

• What is the role of the staff and commission in providing input to CEQA documents prepared for or by the local government? What is the role of the staff and commission in reviewing CEQA documents for projects that are proposed within the jurisdiction of the local government?

Every requested discretionary permit is initially reviewed by staff pursuant to Section 15064.5 of the CEQA Guidelines: “Determining the Significance of Impacts on Historical and Unique Archaeological Resources.” HPC has the authority to provide comments on environmental documents per CEQA that consider historical properties or affect cultural resources. Regardless of whether or not the project is approved by staff, the HPC, the PC, or the City Council, a finding regarding CEQA is included in all discretionary approvals or adopted resolutions.

Section 106 of the National Historic Preservation Act

• What is the role of the staff and commission in providing input to Section 106 documents prepared for or by the local government? What is the role of the staff and commission in reviewing Section 106 documents for projects that are proposed within the jurisdiction of the local government?

The City did not prepare any Section 106 documents during this reporting period. When such review is needed, staff and the Historic Preservation Commission will provide input on Section 106 documents that

are prepared for or by the City in conformance with the standards and regulations articulated in the Advisory Council for Historic Preservation, 36 C.F.R. Part 800. In addition, staff and the HPC also review Section 106 documents as needed. Review of these documents also conforms to the standards and regulations articulated in the Advisory Council for Historic Preservation, 36 C.F.R. Part 800.

No new surveys were initiated, researched, or developed during the reporting year.

• How are you using survey data?

The three completed surveys including the 1987 Citywide Historic Resources Survey, 2008 Multi-Family Survey, and the 2016 Commercial Survey have been important tools for the City to facilitate the rehabilitation of significant historic and cultural resources and protect them from demolition and incompatible alteration. These surveys provide information needed to make informed planning decisions, prioritize preservation planning goals and objectives, develop and implement land use policies, perform environmental reviews pursuant to the California Environmental Quality Act, and educate the public about the built environment as a tangible reminder of the community’s history. The surveys also further the City’s economic development goals and policies by providing opportunities for businesses and professional groups to incorporate cultural resources into their promotions of business and heritage tourism.

C. Corrections or changes to Inventory

One property was removed from the 2016 Commercial Survey’s list of potential cultural resources.

IV. PROVIDE FOR PUBLIC PARTICIPATION IN THE LOCAL HISTORIC PRESERVATION PROGRAM

inventory? This is the total number of historic properties and contributors to districts (or your best estimate of the number) added to your inventory from all programs, local, state, and Federal, during the reporting year. These might include National Register, California Register, California Historic Landmarks, locally funded surveys, CLG surveys, and local designations.

Five properties were added to the CLG inventory during the reporting period.

Yes. Staff and the Historic Preservation Commission reviewed approximately 24 historic properties.

No. VII. IN ADDITION TO THE MINIMUM CLG REQUIREMENTS, OHP IS INTERESTED IN A SUMMARY OF LOCAL PRESERVATION PROGRAMS A. What are the most critical preservation planning issues?

Identifying and protecting the City’s cultural resources is increasingly critical as development pressures increase in the region. Completing historic resource surveys and updating context statements on a regular basis is a critical preservation planning strategy that will include a new multi-family historic resource survey beginning in 2020, followed by another commercial historic resource survey beginning in 2025. These surveys are important tools for understanding, identifying, evaluating, and preserving those properties that give West Hollywood its individual character and sense of place. They also provide information needed to make informed planning decisions, prioritize preservation planning goals and objectives, develop and implement land use policies, perform environmental reviews pursuant to the California Environmental Quality Act, and educate the public about the built environment as a tangible reminder of the community’s history.

B. What is the single accomplishment of your local government this year that has done the most to further preservation in your community?

The City’s most significant accomplishment to further preservation this year was to overcome the constraints placed by the Covid-19 pandemic to ensure the continued administration of the Cultural Heritage Preservation Ordinance and fulfill the duties of the Historic Preservation Commission.

C. What recognition are you providing for successful preservation projects or programs?

The City continues to provide recognition in several ways including granting successful projects and programs proclamations at City Council meetings and publicizing these projects and programs in City-sponsored media. Although the annual historic preservation celebration was cancelled this year due to the Covid-19 pandemic, the City intends to resume this important tradition once public health and safety is established. Finally, the Historic Preservation website features a gallery and interactive database that aims to increase engagement and awareness of the City’s historic building inventory and preservation efforts.

D. How did you meet or not meet the goals identified in your annual report for last year?

• Update the Cultural Heritage PreservationOrdinance to be consistent with bestpractices.

Staff has initiated this process with the City’s historic preservation consultant.

• Complete a new multi-family historicresource survey.

Staff has executed a consultant contract to complete a new multi-family historic resource survey, beginning with a historic context statement.

• Continue to develop the City’s Mills Actprocedures for both inspection andenforcement of contracts.

Staff is continuing to conduct Mills Act inspections and refine the standardized procedures for inspections, enforcement and updating work plans.

• Convert individual condominium Mills Actcontracts into those with the HomeownersAssociation.

Staff continues to correspond with Homeowners Association board members and work towards converting these contracts.

CATHY BLAIVAS, WEST HOLLYWOOD spoke on the success of the redesign of the proposed project at 1201 N. Vista Street and thanked the Commission and members of the community for their support. STEPHANIE HARKER, WEST HOLLYWOOD spoke about community involvement towards historic preservation and spoke in favor of the redesign of the proposed project at 1201 N. Vista Street. She thanked Jennifer Alkire and Staff for meeting with members of the community.

A. 9157-63 SUNSET BOULEVARD CULTURAL RESOURCE

DESIGNATION: Request for Cultural Resource Designation for property located at 9157-63 Sunset Boulevard, West Hollywood, California. STAFF ROGER RATH presented background information as listed in the October 02, 2019 staff report. He said the application was submitted by Andrew Goodrich of Architectural Resources Group (ARG) on May 23, 2019. He talked about information relating to location and scale of the nomination and said the building was constructed in 1938. He addressed previous and current uses of the commercial space and said a freestanding billboard structure was installed in the 1960’s. He said the building is considered an excellent example of the Streamline Moderne style, was designed by Ronald J. Webb and constructed by C. Ralph Sentney. He stated the character defining features of the building and said Staff believes that this nomination meets the City’s criteria for designating a cultural resource under Criterion A1, A3 and B. He said the building exemplifies or reflects special elements of the City’s architectural and economic history and possesses all the aspects of historic integrity. He said the building exemplifies the following criteria for Special Elements of The City:

Criteria A1: Distinctive characteristics of a period, method, style, or type of construction

Criteria A3: Geographical patterns, including those associated with

different eras of growth and settlement, particular transportation modes, or distinctive examples of community or parking planning

Criteria B: Example of distinguishing characteristics and one of the

few remaining examples of Streamline Moderne style

Therefore Staff recommends that the Commission adopt the draft resolution recommending that the City Council approve the proposed nomination.

B. 8901 SUNSET BOULEVARD CULTURAL RESOURCE DESIGNATION:

Request for Cultural Resource Designation for property located at 8901 Sunset Boulevard, West Hollywood, California (Whisky à Go Go). STAFF GURDEEP KAUR presented background information as listed in the October 02, 2019 staff report. She said the application was submitted by Historic Resources Group (HRG) on behalf of the property owner (M&M Media) on May 14, 2019. She stated the size, scale, characteristics of the art deco style building and said it retains sufficient levels of integrity and continues to convey its historic significance of: geographical location, design, setting, materials (with some exceptions), workmanship, feeling, and association. She said the building is associated with two periods of significance; the initial development of the Sunset Strip and the cultural revolution of Rock-n-Roll in the 1960s. She said the building meets the following criterion: Exemplifies Special Elements of the City:

Criterion A1, A3 and A5

Example of Distinguishing Characteristics: Criterion B

Therefore Staff recommends that the commission adopt the draft resolution recommending City Council approve the proposed nomination. C. 9009 W. SUNSET BOULEVARD CULTURAL RESOURCE DESIGNATION. (ROXY THEATRE): Request for Cultural Resource Designation of the Roxy Theatre Building at 9009 W. Sunset Boulevard, West Hollywood, California. DOUG VU, HPC LIAISON presented background information as listed in the October 02, 2019 staff report. He said the application was submitted on behalf of the owner by Christine Lazaretto and Heather Goers from Historic Resources Group (HRG) on May 14, 2019. He discussed location and size of the building and said it shares the 16,620 square-foot rectangular parcel with the Rainbow Bar & Grill building. He said the building, originally known as the Westside Market was constructed in 1936 and designed in the French Revival Style. In 1956 the building was converted into a nightclub known as the Largo, which became an established presence on the Strip that operated until 1972 and has undergone several alterations. He said the Roxy Theatre retains a majority of its character-defining features that conveys its historic identity during the 1973-1983 period of significance and listed the character defining features.

He discussed the nominations contributions to the Sunset Strip, its association with members of the entertainment industry, live plays and its impact on the musical development on the Sunset Strip. He said the nomination is eligible for designation as a cultural resource under Criterion C for its association with the history of music and live entertainment in West Hollywood. Therefore, Staff recommends that the Commission adopt Draft Resolution No. HPC 19-140, recommending that the City Council approve the proposed nomination. Item 8.C. Public Comment: APPLICANT, HEATHER GOERS, HISTORIC RESOURCES GROUP (HRG), WEST HOLLYWOOD provided a presentation on the history of the building and the Roxy Theatre nomination. She talked about designer and Architect Paul Ecke Sr., notable nightclub owner, Chuck Landis and associate investors and addressed information about the original use of the nomination later converted from the Westside Market to the Largo Nightclub. She talked about its neighboring nightclubs, music genres, comedy and adult entertainment venues, contributions by notable artists, its impact on rock-n-roll on the Sunset Strip and alterations to the building. COMMISSIONER DUBIN asked if the nomination was eligible for state or national designation. AARON GREEN, AFRIAT CONSULTING said local designation of the nomination was the only option of interest at this time. DAN MORIN, WEST HOLLYWOOD spoke in favor of Staff’s recommendation and briefly spoke about the buildings history in association with the Whisky à Go Go and the Rainbow Bar and Grill. He said the building was constructed in 1935, designed in the Tudor Revival Style and was originally home to several European style cafés until it closed in 1968.

He discussed several alterations to the building dating from 1939 – 1989 and said the nomination retains majority of its character defining features which convey historic identity during the 1972-1982 period of significance. He stated the buildings character defining features and discussed the buildings significance of association with the history of music in West Hollywood, particularly, rock-n-roll. He provided background information about owner, Bob Gibson and associate investors Elmer Valentine, and Mario Maglieri. He discussed historic events that were attended by numerous notable rock-n-roll artists and said Mikael Maglieri, present owner, continues to maintain a restaurant atmosphere conducive to today’s rock-n-roll artists. Staff finds that the nomination is eligible for designation as a cultural resource under Criterion C for its association with the history of music and live entertainment in West Hollywood. Therefore Staff recommends that the Commission adopt Draft Resolution No. HPC 19-141 recommending that The City Council approve the proposed nominiation. Item 8.D. Public Comment: APPLICANT, HEATHER GOERS, HISTORIC RESOURCES GROUP (HRG), WEST HOLLYWOOD gave a presentation on the time and events associated with restaurants, music and entertainment on the Sunset Strip as it related to the nomination, its location, past and present owners and a brief history of the Rainbow Bar and Grill restaurant. She said owner, Bob Gibson and associate investors Lou Adler, Elmer Valentine, and Mario Maglieri were determined to open a restaurant exclusively for the rock-n-roll industry and spoke about contributions from the owners to their local community. She said the nomination represents a distinctive position in the history of the Sunset Strip as a center for music and entertainment, and the developments impact to the music industry at a particular point in time and highlights the relational roll with Rock-n-roll artists of the entertainment industry. She said the Rainbow Bar and Grill has hosted notable artists for the past fifty years and has been a notable contributor since the inception of the Rock-n-roll genre. SHELIA LIGHTFOOT, WEST HOLLYWOOD, spoke in favor of Staff’s recommendation and the positive impact of the venue within the community and to generations past and present.

13. HISTORIC PRESERVATION COMMISSIONER COMMENTS:

COMMISSIONER DUBIN commented about support of the redesign for proposed project at 1201 Vista discussed at the August 26, 2019 HPC meeting and requested an update for designated resource, 7119 Hampton or agendize for future discussion. He thanked the members of the public for their attendance. STAFF JENNIFER ALKIRE provided an update about an existing COA for 7119 Hampton and said it does not have a Mills Act Contract. CHAIR LAJOIE thanked members of the public for their attendance, thanked the Applicants for their presentations and addressed Vice-Chair Charlie’s unexpected absence and his recusal.

A. 8901 SUNSET BOULEVARD CULTURAL RESOURCE DESIGNATION:

Continued from the October 2, 2019 special HPC meeting. Request for Cultural Resource Designation for property located at 8901 Sunset Boulevard, West Hollywood, California. CHAIR LAJOIE recused himself from discussion of the item; lives within 500-feet of the property. STAFF GURDEEP KAUR provided a presentation detailing information from the October 28, 2019 staff report that was also presented at the October 2, 2019 Special HPC meeting with public speaker comments. She addressed information relating to application submittal, zoning and the properties date of construction. She stated the distinctive characteristics of the building’s 1920’s Art Deco style and said its characteristics have been retained. She said the property remains as originally constructed, retains sufficient levels of all seven aspects of integrity and continues to convey its historic significance. She said Staff supports the applicant’s proposal that the building is eligible for designation under Criterion C, Identified with Persons or Events and Staff determined that the building is eligible for designation under the following criterion as well:

Criterion A1: It embodies distinctive characteristics of a period, method, style, or type of construction

Criterion A3: It reflects significant geographical patterns, including those associated with different eras of growth and settlement

Criterion A5: It has a unique location or singular physical characteristic or is a view or vista representing an established and familiar visual feature of a neighborhood, community, or the city.

Criterion B: It is one of the few remaining examples in the city, region, state or nation, possessing distinguishing characteristics of an architectural or historical type or specimen

She said Staff recommends that the HPC adopt the following resolution recommending that City Council approve to designate the property: DRAFT RESOLUTION NO. HPC 19-139: A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION OF THE CITY OF WEST HOLLYWOOD, RECOMMENDING THAT THE CITY COUNCIL DESIGNATE THE PROPERTY LOCATED AT 8901 SUNSET BOULEVARD, WEST HOLLYWOOD, CALIFORNIA AS A LOCAL CULTURAL RESOURCE. Item 9.A. Public Comment: APPLICANT HEATHER GOERS OF HISTORIC RESOURCES GROUP (HRG), provided an extensive, detailed presentation regarding the history of the Whisky à Go Go and said the venue is one of the most popular in the history of live performance entertainment on the Sunset Strip. She stated its significance in association with the development of the Sunset Strip and gave detailed information regarding the history of the Strip in relationship to restaurants and nightclubs and the Whisky. She provided a brief history of building owner/developer, Elmer Valentine and further discussed the history of the building and its construction. She talked about the opening date of the Whisky à Go Go and spoke about previous uses and themes within the nightclub’s venue. She said the Whisky à Go Go later became the destination of iconic up and coming artists from the rock-n-roll genre and said it was the first to book African American artists in a night club, particularly Motown artists during that era. She explained the impact and role of the Whisky à Go Go on the development of popular music, development of the Sunset Strip and its contributions to West Hollywood’s character and identity. DAN MORIN, WEST HOLLYWOOD said he fully supports the designation, reiterated previous comments and spoke about the building’s iconic presence in West Hollywood. SHELIA LIGHTFOOT WEST HOLLYWOOD reiterated previous comments in support of the designation. She stated names of previous public speakers and members of the public that previously completed citizen position slips in support of the designation. VICTOR OMELCZENKO WEST HOLLYWOOD/WEST HOLLYWOOD PRESERVATION ALLIANCE (WHPA) commented about public speakers that previously spoke in support of the designation, he spoke about the

building’s potential for designation on local, state and federal levels and said the WHPA supports the designation. Item 9.A. Public Comment Closed Item 9.A. Commissioner Comments: COMMISSIONER DUBIN thanked the public for their attendance and the applicant for the presentation. He recommended that HRG include elements of the presentation at the building and said he supports the designation. COMMISSIONER OSTERGREN spoke in favor of Staff’s recommendation. She commended HRG for the presentation and said she agrees with Commissioner Dubins recommendation regarding the presentation available at the site. COMMISSIONER GALLO spoke in favor of Staff’s recommendation. He said he would like more architectural details regarding the site but supports the designation. ACTING CHAIR LEVIN spoke in favor of Staffs recommendation. He said the Whisky à Go Go was significant in the development of the Sunset Strip and commented about various entertainers and genres of music previously at the venue. He recommended the following changes to the resolution: A. Exemplifies Special Elements of the City. Section 5: The position of the Whisky à Go Go building at 8901 Sunset Boulevard represents an established and familiar vista. San Vicente Boulevard climbs up the hillside and slightly angles after it crosses Sunset Boulevard. This slightly offsets the corner property at the northwest

intersection, drawing it further out into the intersection. The resulting asymmetry gives a highlighted prominence to the 8901 Sunset Boulevard building. Furthermore, the building is placed exceptionally close to the corner with zero setbacks. This is the view that the visitor catches, either coming northbound on San Vicente Boulevard or from west-bound on Sunset Boulevard has become an iconic image of the Sunset Strip, West Hollywood, Los Angeles, and Southern California. It has been featured in books, in movie and TV scenes depicting Los Angeles, and news articles to represent Los Angeles. The Whisky à Go Go establishes a fundamental sense of place. ^ The Whisky à Go Go represents a significant building forming the cultural memory of the City”. B. Example of Distinguishing Characteristics. The subject property is an excellent example of Art Deco architecture with a high degree of integrity. It is one of the few remaining examples in the city that embodies the character-defining features of the Art Deco style that defined the era of rapid urban growth of the booming 1920s. It is a rare example in West Hollywood of an Art Deco commercial building. Art Deco architecture generally focuses on verticality in design and this is a rare example of a building in the Art Deco style that is not exceptionally tall. This ^Its human scale allows the viewer to capture the entire design whether they are walking or driving by. The building maintains all its character-defining features and retains integrity of location, design, setting, materials and feeling to convey its significance. C: Identified with Persons or Events: The building at 8901 Sunset Boulevard has a long history of association with people and events significant to not only local and state, but national and international history as well. Its first significant association is to the founder of the Whisky à Go Go, Elmer Valentine. The owner and curator of the nightclub helped create the rock ’n’ roll era through his evaluation and support for the young merging ^emerging artists he booked to perform. SECTION 5. Based upon the foregoing criteria, the Historic Preservation Commission finds that the exterior of the building includes the following character defining features: Smooth stucco Scored cement plaster zigzags Chevrons Stylized floral and geometric motifs Fixed-sash windows Simple massing Flat roof with parapet Decorative cornice ^ Original Alcoves

Public Comment: DAN MORIN WEST HOLLYWOOD commented about the proposed changes, he said it will alter the structure but supports the project. Item 9.B. Public Comment Closed

C. 1251 N. DETROIT STREET: Continued from the August 26, HPC meeting. Request for Cultural Resource Designation of 1251 N. Detroit Street, West Hollywood, California. STAFF GURDEEP KAUR provided a presentation detailing information from the October 28, 2019 staff report; continued from the August 26, 2019 meeting. She addressed information relating to application submittal, style, scale location and construction of the property. She said there’s a two-story duplex at the rear of the structure that is not considered for designation because it does not contribute to the historical significance of the property. She said the 2008 Multi-Family Survey report states that the rare property type possesses all the character-defining features of West Hollywood’s Craftsman architecture and listed its architectural and character defining features. She said although the subject property has undergone interior and exterior alterations, the building continues to possess a high degree of integrity

therefore Staff believes that this nomination meets the City’s criteria for designating a cultural resource. She said the structure is eligible for designation under the following Criterion and said Staff recommends that the Commission adopt the draft resolution recommending City Council approve the proposed nomination: Criteria A1: Embodies distinctive characteristics of a period, method, style or type of construction. Criteria B: It is one of the few remaining examples in the city, region, state or nation, possessing distinguishing characteristics of an architectural or historical type or specimen. Item 9.C. Public Comment: APPLICANT REPRESENTATIVES MARK YEBER, EL SEGUNDO CA AND PAM O’CONNOR, KAPLAN CHAN KAPLAN provided a presentation of information as submitted in the application on behalf of the property owner, against Staff’s recommendation for designation as a cultural resource. He said the property has had three historic analysis/evaluations, one recommending designation and the others against designation. He said a Peer Review was also conducted by the City’s Historic Resources Consultant in August 2018 which supports designation of the property and introduced Pam O’Connor to complete the presentation. APPLICANT REPRESENTATIVE PAM O’CONNOR, KAPLAN CHAN KAPLAN and author of the Historic Resources Evaluation prepared December 15, 2017 further explained the purpose of the item before the Commission. She addressed information noted in the analysis and evaluations. She said the building does not merit designation based on the recommended criterion. She discussed information provided in previous Sanborn maps submitted in the application package and said the maps indicate that the area previously consisting of single-family and duplex structures now include commercial structures. She said the building does not meet criterion for a specific architectural style or location, said the building was built seventy years before West Hollywood Cityhood, the block or area does not maintain a historic district status and the existing duplexes have not been sufficiently determined as a rare property type in the City. She also said there’s no evidence that historic people or events were at the building, therefore the property does not merit designation and asked that the Commission deny the request.

Item 9.C. Questions from Commissioners to Applicant: COMMISSIONER LEVIN AND APPLICANT MARK YEBER discussed the purpose of the item which was to determine designation eligibility as a result of a conflict between competing authoritative opinions. COMMISSIONER DUBIN AND APPLICANT MARK YEBER discussed information relating to the original Historic Resources Assessment (HRA). APLICANT MARK YEBER said the original HRA, prepared by Leslie Heumann was obtained by the previous owner. The owner at that time did not go forward with a cultural resource designation. Item 9.C. Questions from Commissioners to Staff: COMMISSIONER LEVIN, STAFF AND CONSULTANT NELS YOUNGBORG discussed a potential conflict of interest as a result of Leslie Heumann, author of the original HRA and now associate with Chattel Inc, during the preparation of the Peer Review prepared August 30, 2018 COMMISSIONER LEVIN said he was concerned that there could be a conflict of interest if she in fact was an associate at that time. STAFF JENNIFER ALKIRE, CHPP MANAGER said although Staff was aware of Leslie Heumann’s possible employment with Chattel during the preparation of the Peer Review it will not be the only deciding factor concerning designation eligibility. She said Staff is required to review and assess all information once provided to the City as a whole of the record. DAN MORIN WEST HOLLYWOOD spoke in favor of Staff’s recommendation to designate the property. He addressed Pam O’Connor’s comments about the origin of the property and said it now exists within the confines of West Hollywood. LYNN RUSSEL WEST HOLLYWOOD spoke in favor of Staff’s recommendation to designate the property. She commented on the three reports, said she supports the Peer Review by Chattel, Inc and supports the designation. VICTOR OMELCZENKO WEST HOLLYWOOD/WHPA spoke in favor of Staff’s recommendation to designate the property as presented. He said the Alliance firmly supports designation, agrees with the 2017 HRA report by Leslie Heumann and the August 2018Peer Review by Chattel, Inc. DAVE MONKS HOLLYWOOD spoke in favor of Staffs recommendation. He thanked the Commission for their input on the property and said the building maintains the historic craftsman style and said he supports designation.

Item 9.C. APPLICANT RESPONSE: APPLICANT MARK YEBER said the Heumann and Chattel, Inc relationship dates to 2013 and said he recently provided a history for the business association to Staff. He said 1251 Detroit does not add to the narrative of the City. He questioned if there was evidence to support the building as a rare contributing craftsman bungalow in West Hollywood and requested that the Commission extensively review the information provided. Item 9.C. Public Comments closed Item 9.C Commissioner Comments: COMMISSIONER LEVIN spoke about the Commissions purview concerning an item, with owner requesting to deny an application of designation and reiterated his concerns about a potential conflict of interest with Leslie Heumann & Chattel, Inc’s association. COMMISSIONER OSTERGREN commented about the lack of information on the rarity of the craftsman duplex property type. COMMISSIONER DUBIN commented about the building maintaining sufficient integrity. COMMISSIONER GALLO said there was not enough information to determine a potential conflict of interest. CHAIR LAJOIE said he too has concerns with a potential conflict of interest with Leslie Heumann and Chattel Inc. He said the property possibly merits designation based rare property type but found that there have been alterations that question its integrity. COMMISSIONERS LEVIN, DUBIN, OSTERGREN AND CHAIR LAJOIE discussed the issues of designating the property as an individual resource on its merits and/or integrity and the conflict of interest with the process and concluded that the Commission’s vote is to be based on the integrity of the property solely. Motion by Commissioner Dubin to adopt Draft HPC Resolution HPC 19-137 and seconded by Commissioner Ostergren.

D. 8250 FOUNTAIN AVENUE: Request to enter into A Mills Act Contract for the rehabilitation of 8250 Fountain Avenue (Four Gables). STAFF, ROGER RATH provided a presentation detailing information in the October 28, 2019 staff report. He addressed information relating to the application, project location, zoning and its construction. He said the Four Gables is listed on the National Register of Historic Places and the City of West Hollywood’s Register of Cultural resources as part of the North Harper Avenue Historic District. He said the property largely retains its character defining features but needs restoration and discussed the process of preparing the proposed work plan. He said items in the work plan will be subject to a Certificate of Appropriateness and all work must be performed in accordance with the Secretary of the Interior’s Standards for Rehabilitation. He addressed required actions of the Commission relating to the application for completeness, the contract for adequacy and final recommendations to the City Council. He said the building is also privately owned and is not exempt from taxation; for these reasons, the property owner is eligible to receive rehabilitation incentives and benefits under the City’s Mills Act program.

COMMISSIONER LEVIN disclosed that he lives within 500-feet of the property but lives in a rent stabilized unit therefore he has no need to be recused. He also disclosed that his firm previously worked with the owner on a different property but is no longer under contract at this time. Item 9.D. Questions to Staff: MEMBERS OF THE COMMISSION, STAFF AND NELS YOUNGBORG discussed the annual costs to the City within the worksheet, inconsistencies within elements of the work plan relating to internal and external character defining features and elements of the building that are listed as original, compatible and non-compatible. It was recommended that the consultant review and update the work plan to correct the inconsistencies and Staff create a template of a preferred workplan for future use. NELS YOUNGBORG AND MEMBERS OF THE COMMISISON further discussed the character defining features within the work plan particularly concerns by Commissioner Dubin about potential internal character defining features. They addressed elements of the property that are not character features but require repair/rehabilitation and the importance of identifying the character defining features to ensure they’re preserved and protected. COMMISSIONER OSTERGREN asked if there would be language added in the work plan to prioritize urgent items. Nels Youngborg said requirements to prioritize certain elements of the contract which implore the applicant to complete and prioritize urgent projects are noted in the Mills Act Contract, see page 3 and section 4-B:

B. Owner shall, where necessary, restore and rehabilitate the Historic Property according to the rules and regulations of the Office of Historic Preservation of the State Department of Parks and Recreation and the City of West Hollywood. Attached as Exhibit 4 is a rehabilitation and maintenance plan for the property. The restoration, rehabilitation and maintenance plan may be modified as necessary to maintain the structural integrity of the building. Owner shall submit an annual review of the work completed and work scheduled for the following year.

Continued from October 28, 2019 HPC Meeting. Request to partially redevelop a commercial site with a 69,293 square foot, three-story (49.5 feet) multi-use commercial building with office, restaurant, retail, bar, and design showroom uses located at 7965-7985 Santa Monica Boulevard (French Market Project). STAFF JENNIFER ALKIRE, CHPP MANAGER provided a presentation regarding information listed in the November 25, 2019 staff report that addressed revisions to the previously approved resolution from August 2019 for a multi-use commercial development which included the rehabilitation of the historic resource, the French Market building. She discussed details of the proposed project and its recent changes, said the building qualifies as a historic resource under CEQA, she briefly discussed the previously circulated EIR, provided a timeline of reviews and recommendations by Staff and the HPC. She said the Commission is asked to adopt a new resolution acknowledging: 1) the change in reviewing authority, 2) the addition of Chapter 5 to the EIR which affirms there are no significant impacts to the environment. and 3) the project design changes. She noted the following changes to page 7 of 9 of Draft Resolution No. 19-173, Section 10: Hypothetically, should the new construction be removed in the future, the non-character-defining roof and ceiling structures and non-original rear components of the building could be restored ^reconstructed. Similarly, the aspects of the setting that are essential to conveying its historic character, namely, the prominent corner location and street-facing open-air outdoor dining patio would remain intact following completion of the new construction. Therefore, the essential integrity of the environment ^and the historic resource property would remain even following the development of the surface parking lot area just east of the historic building. He provided a presentation that addressed proposed revisions to the design element of the project.

He said the proposal no longer includes demolition, the fourth story addition has been removed, and said the revisions enhance the resource and street level access for pedestrians. He said the French Market building now has the potential to be eligible for its cultural and social value concerning LGBTQ and may also be eligible for state and national designation. He further explained the recommended revisions, the reduced project size and discussed measures to protect and maintain the existing character defining features. The project proposes to include project design features of documentation in tribute of the French Market and an onsite Historic plaque. Item 8.A. Commissioner Questions to Applicant: COMMISSIONER LEVIN, APPLICANT STEVENS AND STAFF JENNIFER ALKIRE discussed current designation status of the site and determined that the site has not been designated but qualifies as a resource under CEQA. KEITH KAPLAN WEST HOLLYWOOD RESIDENT/BUSINESS OWNER spoke in favor of Staff’s recommendation. He commended Faring Capital on the design element of the project, maintaining the physical structure of the building and adhering to the requests of the community. ROY OLDENKAMP WEST HOLLYWOOD PRESERVATION ALLIANCE spoke in favor of Staff’s recommendation. He said the Alliance supports the Resolution and said the Final Environmental Impact Report (FEIR) is adequate. He acknowledged the site as a contributing factor to the history of the LGBTQ. SCOTT SCHMIDT WEST HOLLYWOOD spoke in favor of Staff’s recommendation. He said Faring Capital listened to the community and adhered to their request to lower the building.

She commended Faring Capital for the changes to the proposal and positive elements of the street level pedestrian access to the site. She commended the applicant for maintaining the look and design of the French Market and also spoke in favor the additional parking. GEORGE CREDLE WEST HOLLYWOOD spoke in favor of Staff’s recommendation. He commented on his support of the proposal during previous meetings and commended Faring Capital on the reduction of the height and scale of the building. CAROL KRAVETZ WEST HOLLYWOOD spoke in favor of Staff’s recommendation. She commented in favor of the reduction to the height and scale of the building and commended the applicant for the solar/green footprint of the proposal. B. 9165 SUNSET BOULEVARD: Request to enter into a Mills Act Contract

for the Rehabilitation of local cultural resource, 9165-9169 Sunset Boulevard (Berman/Kohner Building). STAFF ANTONIO CASTILLO provided a presentation of information listed in the November 25, 2019 staff report for a Mills Act Contract initiated by the Property Owner. He explained the purpose of the Item before the Commission and addressed background/analysis information concerning rehabilitation incentives for resources in West Hollywood. He said the (Berman/Kohner) building is a regency revival style building designed by architect Paul R. Williams, constructed in 1936 and said it was designated a local cultural resource May 18, 2018. He talked about the location of the building, existing features of the buildings symmetrical façade and its current use(s). He talked about qualifying elements and character defining features of the designation and said the Applicant’s request for the Mills Act Contract is to help offset expenditures associated with the rehabilitation, restoration, and maintenance work at the subject property. He stated the details of the proposed work plan and said the property meets the baseline criteria for a Mills Act Contract. He said the applicant presents a well-considered 10-year work plan and said the building is a landmark example of a Regency Revival style mixed-use. He said the savings to the property owner will provide resources necessary for the rehabilitation and maintenance of the property and the proposed work would preserve the structure’s significant architectural features, while conforming to The Secretary of the Interior’s Standards, and will not adversely impact the property’s historic character.

He said Staff received an email from one resident, Elyse Eisenberg, expressing her support for the application and said due to year end time constraints, the Mills Act Contract has been scheduled to be considered by the City Council at its December 16th meeting. He concluded his presentation and said the agenda lists incorrect applicant information for Item 8.B.; applicant is RWS Sunset, LLC. Item 8.B. Public Comment: MARK LEHMAN APPLICANT REPRESENTATIVE, WEST HOLLYWOOD spoke in favor of Staff’s recommendation. He talked about the owners plans to restore, rehabilitate and occupy the building and spoke about the team of associates and professionals contracted to execute the proposal. He briefly addressed costs associated with rehabilitating buildings of this age, benefits of the Mills Act Contract to the owner, previous work executed under existing certificates of appropriateness and requests that the Commission consider all information presented and approve the request. Item 8.B. Commission Questions to the Applicant: THE COMMISISON, STAFF AND APPLICANT discussed information listed in the Historic Structure Report (HSR) and the revised Rehabilitation/Restoration/Maintenance Plan. They commented about, and/or requested edits to the report regarding structural requirements for the rooftop signage, repairs to the onsite portion of the walkway, status of 2018/2019 completed and temporary work schedules-with costs, reconcile information within the HSR and information within the proposed work plan, particularly details and estimated costs for the fenestration of the windows. They discussed timeframes of work to be completed in the 10-year plan and the total costs to complete the proposed work. Item 8.B. Public Comment Continued: VICTOR OMELCZENKO, WEST HOLLYWOOD/WHPA spoke on behalf of the Alliance in favor of Staff’s recommendation. He talked about investments by the owner to preserve the property and its contributing aspects as a structure on Sunset Boulevard. COMMISSIONER LEVIN spoke about a recommendation to designate the Kelly Music Building/Tanino Ristorante structure designed by Paul Williams at the November 26, 2019 City Council meeting of the City of Los Angeles. COMMISSIONER OSTERGREN spoke about previous public comments by Lynn Russell concerning Commission training. She recommended that there be trainings for both existing and new members regarding the purview and processes of the Commission. She also talked about the recent approval of the five-year, State Historic Tax Credit effective 2021. VICE-CHAIR CHARLIE thanked the members of the HPC and the public for their condolences concerning a member of his family. He spoke about attending the Studio-One party at The Factory and the positive feedback from members of the community concerning the inclusion of the property within the Robertson Lane Project. COMMISISONER DUBIN thanked the members of the public for their attendance and Staff for the project presentations and extended holiday well wishes to all. He said the request is for removal of the building located at 8001-8003 Santa Monica Boulevard from the 2016 Commercial Historic Resource Survey’s list of potential cultural resources, and a determination that the building located at 1105 North Laurel Avenue is not a cultural resource. He addressed the details, location and history of both buildings and said the building located on Santa Monica Blvd was constructed in 1922 as a commercial building, is Spanish Colonial Revival design and converted to a medical building by the 1930’s. He said the Laurel Avenue building lacks features of any architectural style, was constructed in 1934 but substantially altered in 1951-52 and was converted to a school between 1975 and 1976. He discussed substantial alterations to the 8001-8003 structure prior to the 2016 survey which somewhat compromised the historic integrity of the building which included removal of character defining features and additions; including new signage. He said other character defining features were removed in error under a building permit in November 2017 to re-roof the structure. He said 8001-8003 Santa Monica Blvd building was determined eligible under criterion A3 of WHMC Section 19.58.050 for its association with the history of commercial development in West Hollywood as one of a small number of commercial buildings from the 1920s remaining on Santa Monica Blvd that were constructed as a direct result of the streetcar line (Sherman and Adjacent County Lands 1895-1925 theme). He explained measure taken to ensure an error of this magnitude does not occur again and training concerning proper review of historic properties have been provided to divisions within the City. He discussed the following timeline of events in greater detail:

Pre-2016: Undocumented alterations to 8001-8003 Santa Monica Blvd. including replacement of all doors & windows and new canopies & awnings

July 24, 2016: 8001-8003 Santa Monica Blvd building surveyed Dec. 2016 – Jun. 2017: City Council review of Commercial Survey Nov. 03, 2017: Building permit B17-0951 issued for re-roofing that

resulted in removal of clay tile roofing, circular towers, coping and decorative wood beam

Nov. 15, 2017: Designation opportunity letter sent to property owners

Oct. 17, 2019: Designation application submitted He said, due to the significant amount of alterations that have been made to the building at 8001-8003 Santa Monica Blvd over the years, it does not retain enough of its characteristics to adequately convey a sense of time

and place, does not meet the integrity thresholds for Design, Materials, Workmanship and Feeling and Association. Additionally, the building at 1105 North Laurel Avenue does not meet any of the criteria for designation as a local cultural resource. Therefore, staff recommends denial of the designation to the City Council. Item 8.A. Questions to Staff: MEMBERS OF THE COMMISISON expressed concerns with information relating to designation eligibility information noted within the staff report and the windshield survey, concerns if the scope of work allowed removal of character defining features within the re-roof permit executed in 2017, measures taken to ensure permit information is current and accurate. They also addressed information listed in the “Timeline” portion of Staffs presentation regarding designation opportunity letters mailed to property owners, City Council review of the Commercial Survey and the process of notifying property owners of potential designation eligibility and/or included within surveys. Vice-Chair Charlie said there was an adequate comment period and notification to members of the public. Item 8.A. Public Comment: APPLICANT PRESENTATION: APPLICANT ANDREW GOODRICH ARCHITECTURAL RESOURCES GROUP (ARG) reiterated information addressed in Staff’s Timeline Activity portion of his presentation and his conclusions. He discussed ARG’s assessment of the property, their methodology and conclusions prepared in 2019 which was based on the present state of the building. He said their findings determined that the building did not retain sufficient integrity for listing as a potential local cultural resource within the survey and also said ARG determined that 1105 Laurel does not merit designation as a local cultural resource. Item 8.A. Commissioner Questions to Applicant: VICE-CHAIR CHARLIE asked if the present owner was the owner during the re-roof project and during the execution of the 2016 survey. COMMISSIONER LEVIN asked about ARG’s conclusion concerning Criterion A3 eligibility and if 8001-8003 Santa Monica Blvd met the requirement of being a contributing factor to the growth or development of the City.

Item 8.A. Public Comments: CATHY BLAIVAS WEST HOLLYWOOD expressed concerns about the error of approving the re-roof project which compromised the integrity of the building and hopes a system is now in place that will protect other potential cultural resources. STEPHANIE HARKER WEST HOLLYWOOD expressed concerns about the process of protecting potential and existing cultural resources from changes to their historic character by City Staff; or the lack thereof. She suggested that an annual inspection of resources be performed and the HPC possibly have more input and/or direct recommendation authority to Staff. LYNN RUSSELL WEST HOLLYWOOD expressed concerns with the changes to the 8001-8003 Santa Monica Blvd building and the lack of due diligence on the part of City Staff to protect the structure from the changes. She commented about her public records request to the City to further review permits and documents concerning the re-roof. VICTOR OMELCZENKO WEST HOLLYWOOD/WHPA expressed concerns regarding Staff’s recommendation. He commented on the process and selection of properties included in the survey and said the WHPA does not support the removal of 8001-8003 Santa Monica Blvd from the list of potential resources. He requests that a system be put in place to ensure that another travesty of this nature does not occur again. APPLICANT REPRESENTATIVE TODD ELLIOTT RESPONSE TO PUBLIC COMMENTS: None. Item 8.A. Public Comments Closed. Item 8.A. Commissioner Comments: VICE-CHAIR CHARLIE stated for the record that he agrees that the changes to the subject property were inappropriate. He requested that additional research be done to determine if other permitted or unpermitted work was completed. He stated for the record that the City’s application process is outdated and should be modified to prevent things of this sort from happening again. COMMISSIONER DUBIN supported Commissioner Charlies comments and said his greatest concern was the late survey notification process to property owners which in turn was counterintuitive to the purpose of the survey. He recommended that the process of review by the HPC and notification to property owners be reviewed and/or revised. COMMISSIONER LEVIN expressed concerns about agendizing a discussion item concerning notification and follow-up of surveys to members of the public and to potentially review the existing

permit/application process to ensure that permitting mishaps of this sort do not occur again. He suggested that Planning and Building & Safety interface in a manner that flags each other when permits are pulled for potential and/or existing cultural resources. He said 8001-8003 Santa Monica Blvd does not meet Criterion A3 requirements for designation, it was substantially altered prior to the survey and therefore supports Staff’s recommendation. COMMISISONER OSTERGREN said she supports Commissioner Levin’s comments. She said the status of the structure was a series of unfortunate events and does not meet the criterion for designation. CHAIR LAJOIE said he supports previous Commissioner comments and supports Commissioner Levin’s recommendation to agendize a discussion item to revise the existing permit/application process with the intent to prevent this from occurring again. 9. NEW BUSINESS: A. CERTIFICATES OF APPROPRIATENESS (COA):

The Historic Preservation Commission discussed the process for review and approval of Certificates of Appropriateness pursuant to WHMC Section 19.58.100 and the previous request by the Commission to review all COA’s prior to approval. They discussed the purpose and items that fall under the umbrella of Certificates of Appropriateness as noted in the City’s Municipal Code, what factors determine the threshold of staff level vs. HPC review/approval and the HPC’s purview as governing authority.

The Commission stated that minor COA’s should remain at Staff Level.

Staff Level approval currently requires a discussion between CHPP

Planner, CHPP Planning Manager and the Director of PDS to determine minor vs. major COA’s.

The Commission requests a document be created by the Director

of PDS to explain the general guidelines of determining the thresholds for staff level vs. HPC review and/or major vs. minor COA’s.

B. THE SECRETARY OF THE INTERIOR’S STANDARD TRAINING: Nels

Youngborg, LEED AP, Senior Associate with Chattel Inc. provided training on the Secretary of the Interior’s Guidelines for Developing Historic Contexts.

NELS YOUNGBORG, CHATTEL, INC. provided training specific to Historic Context Statements. He addressed information relating to the importance of historic context in relationship to a potential historic resource setting, architectural style and social significance. He said a Historic Context Statement is a body of information about historic properties organized by theme, place and time and is a tangible link to historic resources through a property type.

He said it provides a framework to determine the relative significance of properties and evaluating eligibility for designation at local, state or national levels. They are specific to what governing body creates them. He explained the purview of the HPC as a certified local government concerning items that fall under the review of the commission and said the statements are required for individual landmark nominations and historic resource evaluation reports. He said the statements provide qualitative and quantitative standards for defining what is historic and also allow the opportunity for histories that are uncommon to become more significant within communities at local, state, and national level. He explained their use, purpose and eligibility requirements. He provided links to websites that explain local and state requirements. NELS YOUNGBORG, STAFF AND THE COMMISISON discussed existing statements and surveys within West Hollywood, availability of existing and future statements online and the importance of each statement maintaining a compendium specific to its subject matter. LYNN RUSSELL, WEST HOLLYWOOD commended Nels Youngborg on the Historic Context Statement training and the importance of Historic Context Statements to the City.

HISTORIC PRESERVATION COMMISSIONER COMMENTS: COMMISSIONER LEVIN asked for a consensus from the HPC to agendize a discussion item concerning notification and follow-up of surveys to members of the public and reiterated his conflict of interest concerns expressed during the previous HPC meeting about 1251 Detroit that may be a basis for appeal as well. COMMISSIONER OSTERGREN commented about upcoming revisions to the ordinance and asked that Staff provide an update to the HPC at a future meeting. She also mentioned that the L.A. Conservancy has scheduled a yearlong initiative titled “The '70s Turn 50”. VICE-CHAIR CHARLIE thanked the members of the HPC and the public for their attendance and requested an update regarding outreach to homeowners concerning the Mills Act Contract and Architects Who Built Southern California also future contracts to be brought before the HPC. COMMISSIONER ED LEVIN asked that Staff bring back an update regarding permits/COA’s for the Villa Italia and requested to agendize a discussion item regarding the Annual 2020 HPC Event. He stated for the record that he had concerns about his vote in favor of Staff’s recommendation for 1251 N. Detroit although there was information that presented a potential conflict of interest by employee/employer that prepared the HRA and peer reports. He recommended that an HPC representative attend City Council meetings that include items discussed by the HPC. HPC LIASON DOUG VU noted that Staff has three potential venues for the for the HPC Event.
