Form 18 NOTICE OF REQUIREMENT BY A REQUIRING AUTHORITY
FOR A DESIGNATION Section 168 (1) of the Resource Management Act 1991
TO: The Hamilton City Council 1. WEL Networks Limited (“WEL Networks”) gives notice of a requirement for a designation for an “Electricity Substation”. WEL Networks is a Requiring Authority approved under section 167 RMA. WEL Networks Requiring Authority approval was advertised in the Gazette as a Notice on the 18th of March, 2004; Gazette reference 30/689. Evidence of WEL Networks Limited requiring authority status is enclosed in Annexure 1. 2. Alternative sites, routes, and methods have been considered to the following extent: Under section 171(1)(b)(i) of the Resource Management Act, 1991 a territorial authority must have particular regard to the adequacy of consideration given to alternative sites, routes, or methods of undertaking the work if the requiring authority does not have an interest in the land sufficient for undertaking the work. WEL Networks does not have an interest in the land. WEL Networks has undertaken an evaluation of four sites. The evaluation is enclosed in Annexure 2. 3. The site to which the requirement applies is as follows: The proposed site is located west of Resolution Drive, in Rototuna, adjacent to the Borman Road extension. The legal description of the land on which the site will sit is Allot 518 Kirikiriroa Parish (SO 48706). The certificate of title is 49C/407. The land is owned by The Roman Catholic Bishop of the Diocese of Hamilton. The table and figures in Annexure 3 show the property and planning details of the proposed Horsham Downs Substation site. The proposed substation site boundary will be an irregular shaped lot (1,536 m2). It will contain a 37 m x 9 m (maximum) control building surrounded by a metalled yard and a strip for landscaping which will vary between 2 and 3 m in width. A section of the lot at the eastern end will be planted and landscaped. There will also be two entrance and access-ways leading onto the site. Drawings showing the property boundaries, site layout and profile, and entranceways are provided in Appendix 1.

4. The nature of the proposed public work (or project or work) is: The establishment, construction, operation, maintenance, replacement, repair, and minor upgrading of a substation, and parts of, and works for, or relating to, electricity transformation and distribution. Further details on the nature of the proposed works and operation, including the programme for the project are provided in the table in Annexure 4. The drawings in Appendix 1 depict the proposed project. 5. The public work (or project or work) and designation (or alteration) are reasonably necessary for achieving the objectives of the requiring authority because: The objectives of the requiring authority for which the designation is sought are: (a) The distribution of safe and reliable electricity to people, local
communities and industry in and around the Rototuna and Horsham Downs areas.
(b) The control of electricity flows over the distribution network. (c) The transformation of electricity from higher to lower voltages. The work is reasonably necessary for achieving the objectives of the requiring authority because: (a) The location of the Horsham Downs Substation has in part been
dictated by the electricity load (current and expected future demand) in the area. The site must be located as close as possible to the existing and anticipated electricity load.
(b) The electricity voltage must be lowered (i.e. transformed) so that it can be distributed, received and used by local households, communities and industry.
The designation is reasonably necessary, as a planning technique, for achieving the objectives of the requiring authority because: (a) The substation performs an extremely important function for people,
local communities and industry. Therefore, it must be protected from other land uses. A designation prevents a person from doing anything on a site that would prevent or hinder a project or operation to which the designation relates, without written consent of the requiring authority.
(b) Designated sites are shown on the district planning maps. This allows future land users to identify protected, sensitive and significant areas, in this case the Horsham Downs Substation, and to plan their land uses more effectively around such sites. It also allows future land users to avoid, remediate and mitigate any effects their activities might have on the substation. The Horsham Downs Substation is considered to be significant and sensitive part of the “environment” in terms of Section 2 of the Resource Management Act, 1991.

(c) Some developments by their very nature cannot comply with typical provisions in district plans and therefore risk cessation under any one of a number of procedures in the Resource Management Act, 1991. This may be because the development is limited to a certain site or that it has more than minor effects. Nonetheless, some of these activities are essential for the promotion of sustainable management, particularly with respect to enabling people and communities to provide for their social, economic and cultural wellbeing and their health and safety. These types of activities typically require high levels of investment and commitment in terms of people-time and resources. A notice of requirement (and the ensuing designation) is designed to provide a requiring authority with the certainty and means to plan for these types of projects and works. In light of this, it is considered that the Horsham Downs Substation construction requires the certainty offered by a notice of requirement and the ensuing designation.
(d) In dealing with a complex project such as the installation of a substation, it is only possible to provide a general and conceptual design, and not a full and detailed design, during the early stages of a project. The designation facility under the Resource Management Act, 1991 addresses this problem in a two step fashion: a notice of requirement provides the opportunity to lodge conceptual designs at an early stage; outline plans provide the opportunity to lodge detailed designs at a later stage. In light of this, it is considered that the development of the Horsham Down Substation design can be best communicated and consented using the two-step process provided under sections 168 and 176A of the Resource Management Act, 1991.
(e) The substation will require ongoing maintenance and possibly minor upgrading1 in the future. Maintenance and minor upgrades are an essential substation function and can occur on both a regular or irregular basis. The outline plan procedure under section 176A of the Resource Management Act, 1991 provides the requiring authority with a degree of certainty that it can conduct essential maintenance and where necessary minor upgrades, when needed, into the future. It also provides the requiring authority and territorial authority with an effective and efficient means for communicating and regulating activities within the substation, and for ensuring compliance with the Resource Management Act, 1991.
6. The effects that the public work (or project or work) will have on the environment, and the ways in which any adverse effects will be mitigated, are: An assessment of the effects that the project will have on the environment, including the proposed mitigation measures, is contained in Annexure 5.

7. The nature of the proposed restrictions that would apply is: WEL Networks Limited proposes that the designation be subject to the following conditions (or the like): (a) Construction noise emanating from the site shall not exceed the limits
in, and shall be measured and assessed in accordance with, New Zealand Standard NZS 6803:1999 Acoustics – Construction Noise.
(b) The substation shall be designed and operated to not exceed a noise level of 40 dBA (L10) at or as near as practicable to the boundary of any other site within the Residential Zone. Noise levels shall be measured in accordance with NZS 6801:1999 Acoustics – Measurement of Environmental Sound and assessed in accordance with NZS 6802:1991 Assessment of Environmental Sound.
(c) Electric and magnetic field levels at the substation property boundary shall not exceed the limits in the International Commission on Non-Ionising Radiation Protection (ICNIRP) guidelines endorsed by the National Radiation Laboratory, New Zealand Ministry of Health.
(d) Radio frequency radiation levels at the substation property boundary shall not exceed the levels specified in the New Zealand Standard NZS 6609: 1990 Radio Frequency Radiation.
(e) Landscaping shall be undertaken in general accordance with the landscaping plan submitted with the Notice of Requirement. The landscaping shall be maintained for the life of the substation.
(f) The management of hazardous substances shall be in general accordance with the information submitted in the Notice of Requirement.
(g) Dust and fine particulate discharged into the air from any earthworks shall not result in rates of deposition in excess of 4 grams per square metre per 30 day period. Any stockpiles of loose material shall be contained or maintained to prevent dispersal of material into the air.
(h) No new structures other than those specified in this notice, shall be erected on site after this notice of requirement is given, without the submission of an outline plan pursuant to section 176A of the Resource Management Act, 1991, unless the structures are a permitted activity in the Hamilton City Proposed District Plan.
(i) If Maori artefacts or European antiquity are uncovered during the earthworks the relevant iwi group and/ or appropriate museum institution shall be contacted to decide on what appropriate action to take. If artefacts made of organic material are uncovered from waterlogged or impervious mud or clays these shall be kept wet to prevent aerobic degradation until appropriate action, such as conservation treatment, is determined.
(j) If bodily remains are uncovered during the earthworks, the earthworks shall cease and the police, the Councils and any relevant iwi group shall be contacted to decide on what action to take. The earthworks shall not start until after the bodily remains have been removed and the necessary procedures or ceremonies have been conducted.

8. The following resource consents are (or are not) needed for the proposed activity and have (or have not) been applied for: It is considered that no resource consents from the Regional Council are needed for the proposed activity. In support of this claim an assessment of the relevant planning restrictions and provisions is provided in Annexure 6. A subdivision consent or a Certificate of Compliance for the subdivision of the site will be required. 9. The following consultation has been undertaken with parties that may be affected: Consultation is currently being undertaken with the potentially affected parties set out in Table 1.

project. (c) Meet with those people that have serious complaints or concerns. (d) Address any ideas, issues or concerns that are raised by the potentially
affected parties. (e) Send the details of responses from potentially affected parties, and any
actions taken to address any complaints or concerns, to the Hamilton City Council.
(f) Respond to the potentially affected parties as required. 10. Other matters: Designation to be provided for in the proposed district plan: Pursuant to section 175 of the Resource Management Act, 1991 the territorial authority must include the designation in its district plan and any proposed district plan (subject to certain conditions), and state the name of the requiring authority which has the benefit of the designation. Alternative Sites 2.1 Alternative sites have been considered for the substation. Alternative
methods for distributing, controlling and transforming electricity have also been considered. An outdoor substation was evaluated against an indoor substation scenario.
2.2 A number of sites around Rototuna have been evaluated against the
requirements of the RMA (section 168, RMA; Resource Management [Forms, Fees, And Procedure] Regulations 2003 Form 18; section 171, RMA). The sites are shown in Figure 1.

2.3 Three sites underwent a preliminary evaluation. One site was
eliminated due to obvious practical limitations. Site 1 was sited too far to the north of existing electricity infrastructure and load demand.
2.4 The three remaining sites (Sites 2, 3 and 4) were evaluated in detail in
terms of the Hamilton City Proposed District Plan (HCPDP). 2.5 Two access route configurations for Site 3 were evaluated. The access
route evaluation also informed the site evaluation.

Evaluation Criteria 2.6 The evaluation involved an assessment of the:
• planning restrictions applicable to each site in order to determine the activity status of the work forming the projects; and
• planning duties applicable to each site in order to determine the scope of the matters to be considered by council, likely consultation requirements and likely monitoring conditions, and
• the ease of creation, and subsequent effects of access and entranceway locations, and
• the strategic planning of the Rototuna area as detailed in the Rototuna Structure Plan.
Preferred Alternative 2.7 The results of the evaluation are summarised in the following table.
The table evaluates the three remaining sites against key criteria drawn from the full assessment and evaluation.
2.8 Both sites 2 and 3 have the same activity status, and percentage of
activities that are permitted. However, the safety of the access and entrance way onto Resolution Drive is considered to be greater than that suggested for site 2 onto Cate Road.
2.9 Site 2 is also situated adjacent to an area suggested for education
(school) land use as per the Rototuna Structure Plan. 2.10 Negotiations for the purchase of site 3 were conducted. However after
detailed analysis of the Rototuna Structure Plan and consultation with the landowner it was determined that there were a number of practical limitations with the site.
2.11 Site 4 has potential for suitable access and is the nearest of the sites to
WEL’s existing network. 2.12 Site 4 is also considered suitable because there are no conflicts with
the Structure Plan for the development of the Rototuna Area. 2.13 An indoor substation was considered to be the best design considering
that the surrounding area is residential. 2.14 The evaluation summary (in the table below) indicates that Site 4 is the
alternative that is more likely to satisfy the requirements of sections 168 and 171 of the RMA.

Site Layout 4.4 The proposed site boundary will be close to a rectangular shape. The
approximate boundary lengths will be 28.88 m x 75.72 m x 33.70 m x 51.53 m (14.65 m + 14.65 m + 14.65 m + 7.58 m). The site will contain an approximately 5 metre wide strip for planting/ landscaping. There will also be an area of landscaping beside Resolution Drive.
4.5 Two access ways will lead onto the site from the Borman Road
extension. The entrance and access ways will also be designated up to the road boundary, which is also designated.
4.6 The drawings provided in Appendix 1 show the site layout and
demarcation of the proposed boundaries and entranceway. All areas within the boundaries, including the entrance and access way boundaries, form the designation area.

Substation Yard Equipment Oil Containment 4.8 Bunded concrete pads will be located below each transformer, located
inside the building, and will drain into the oil containment facility which is designed to contain 30,000 L of oil.
Switchyard earthing 4.9 Switchyard earthing will be designed in accordance with IEEE STD 80-
2000 and WEL design and construction standards in mesh layout. Ground conditions are expected to present satisfactory conditions for earth current distribution within safe limits. The switchyard earthing will be located inside the perimeter of the security fence with the exception of a required earth perimeter wire installed 1 m outside of the fence for safety purposes.
33 kV Cabling 4.10 33 kV cabling from WEL’s 33 kV distribution network to the
transformers will be required. This cable will be buried.
11 kV Cabling 4.11 11kV cabling from the transformers to indoor switchgear will be
required. 4.12 In addition, 11 kV cabling from the indoor switchgear will be buried and
ducted to 11 kV lines. Outdoor Lighting 4.13 Outdoor flood lighting is required, which will be attached to the control
room. It will be required only for emergencies, or irregular maintenance and switching during the hours of darkness.
Security 4.14 Double entry gates, or a chained off driveway will be needed for
vehicular and person entry. Industry standard codes of practice and regulatory security arrangements will apply. The transformers are housed within a locked building, as shown in Appendix 1.
Parking 4.15 Parking for WEL staff/ contractors will also be provided on site. Communication SYSCON 4.16 The antennae will be located either on a 10 m high pole beside the
control room building or on the substation roof.

Building Systems Building 4.17 The substation building will be approximately 37 m x 9 m x 9 m high.
The building has been architecturally designed so that it is not obtrusive. It is similar in appearance as that of a residential dwelling. Conceptual drawings of this building are provided below and in Appendix 1.

4.18 Transformers, internal switchgear, load control plant and ancillary
equipment will be located in this building. It is proposed that low maintenance, fire rated construction materials be used to construct the building with concrete floor and cable channel ducting. Rainwater collection from the roof is proposed for washing facility.
Two 33/11 kV Transformers 4.19 Two 33/11kV 11.5/23 MVA transformers are proposed for the site.
Transport and crane will be required for movement. Each transformer will be connected to an indoor circuit breaker by buried 33 kV power cables.

33 kV &11 kV Switchgear 4.20 It is proposed that switchgear be installed. This should consist of
feeder panels with voltage transformers (VTs), circuit panels and associated current transformers (CTs), protection relays and local controls. Two 33 kV circuit breakers will be installed in the building.
Local Service Transformer 4.21 AC supplies are required within the control room for general services,
load control plant and battery charging. Lighting & Smoke Detection 4.22 Emergency lights may be needed inside the building depending on the
building type. 4.23 The building will have smoke detectors in each room which will be
linked to SCADA. Water & Sanitation 4.24 Connection to city services will be required for water supply and
wastewater disposal. Protection 4.25 All protection relays on switchgear and cabling will communicate to the
SCADA through the fibre optic cables. Site Access 4.26 The two access ways will extend to the boundary of Borman Road. See
Appendix 1 for drawings of the entrance and access-way design. 4.27 Appendix 7 contains a discussion document on the option of a single
entrance and access-way location. However, it has now been determined that it will be safer if large vehicles can drive through without having to carry out a three point turn within the site.
4.28 HCC has been informed of the proposed modification, but as yet no
response has been obtained.

Bio-physical Environment 5.1 The proposed site is located approximately 50 m west of the
intersection between the proposed Borman Road extension, and Resolution Drive.
5.2 The surrounding land to the west and north of the site is flat, and is
vegetated mostly with pastureland (see photographs below).

Socio-economic Environment 5.4 Much of the surrounding land to the west and north of the proposed
site is used for pastoral farming. Traditional farming practices and objects dominate the landscape.
5.5 There is an increasing amount of residential and commercial
development in the Rototuna area, and in particular to the south of the proposed site (see photograph below).

5.6 The substation will be located adjacent to the extension of Borman Road. This road is currently being constructed, and is not yet used by traffic.
5.7 A number of construction activities and roading works are taking place
nearby. These activities form part of the receiving environment, however they are temporary activities.
5.8 The Rototuna Structure Plan (see Appendix 8) shows the possible
future developments in the area. The area surrounding the proposed substation is shown on the Rototuna Town Centre Concept Map below.

5.9 The substation will be located opposite the proposed local commercial/
community node.
Cultural Environment 5.10 There are no pa zones, urupa, items of cultural heritage value or
archaeological features marked on the district plan maps in the area surrounding the site.
5.11 There are no records of any historic places, historic areas, wahi tapu
and wahi tapu areas according to the New Zealand Historic Places Trust.
5.12 There is a long history of pre-European Maori occupation of this area,
by various hapu, It is anticipated that the consultation process will confirm whether or not there are areas or objects with Maori or European cultural or heritage value located in the area.

Matters for Consideration 5.13 The matters for consideration determine the scope of the Assessment
of Environmental Effects (“AEE”) and the consent authority’s consideration of an application.
5.14 When making a decision on a requirement, a territorial authority must
consider the effects of the activity on the environment (RMA 171(1)). The adequacy of consideration to alternatives must also be given regard if is it likely that the work will have significant adverse effects on the environment (RMA s171(b)(ii)).
5.15 In accordance with RMA s171(1)(a), the potential adverse effects on
the environment have been considered by having regard to the relevant provisions of, amongst other things (subject to Part 2): • Plans or proposed plans • Permitted baseline (RMA s104(2))
5.16 The table below sets out the matters that are relevant to the
consideration for the proposed work activity. 5.17 The AEE aims to show that the work will have no significant adverse
effects on the environment.

Magnitude and Significance of Environmental Effects 5.18 The table below identifies and predicts the magnitude, and evaluates

5.19 The magnitude of the effects is predicted having taken the proposed

Substation buildings facilities and equipment • All substation equipment will be located within a building so it will not be seen. • The substation building will be designed to have a “residential” appearance. • Planting will take place around the entire perimeter of the site within the landscape strip. • The plants will grow to an approximate height of 8 m. These are likely to be evergreen, slow growing types suited to the open wet conditions of the locality. • The plants will be closely spaced in order to provide a dense coverage. • Transformer oil is a mineral oil prepared from the distillation and refining of petroleum. It comprises a complex mixture of three main groups of hydrocarbons: aromatic (10%), naphthenic (40-50%) and paraffinic. The exact composition is unknown, but the aromatic fraction is likely to contain polycyclic hydrocarbons, some of which are carcinogenic and mutagenic. Of the chemicals present in the transformer oil, these are likely to be the most hazardous in terms of water quality. The “NFPA Hazard Rating” sheets provided in Appendix 4 detail some of the physical and chemical properties. • The transformer oil is a non-PCB liquid6. • A major spill or explosion is unlikely outside of a natural disaster or deliberate human sabotage.

Resource Management Act, 1991
Designated Sites (Sections 166 to 186) 6.1 WEL Networks became a requiring authority under section 167 of the
RMA on 18 March, 2004. Under section 168(2), a requiring authority can at any time give notice to a territorial authority of its requirement to designate a site or route.
6.2 A designation is a provision made in a district plan which relates to an
area. A designation authorises a requiring authority to carry out its work on a site without the need for a land use consent under section 9(1) from the relevant territorial authority7.
6.3 Once the designation is made, the requiring authority can do anything
on a designated area that is in accordance with the purpose of the designation without restriction from the district plan. However, in some instances a requiring authority must submit an outline plan to the territorial authority before it begins work on a designated site. An outline plan is a plan or a description of the work.
6.4 Activities of a requiring authority on a designated site are not exempt
from resource consents required by correct authorities under sections 9(3), 12, 13, 14 and 15. Furthermore, they must comply with the general requirements of section 16, that is, the duty to avoid unreasonable noise.
Restrictions on Use of Land (Section 9) 6.5 In the absence of a designation, the proposed work and operation is
subject to section 9 of the Resource Management Act, 1991. 6.6 In accordance with section 9(1), no person may use 8 any land in a
manner that contravenes a rule in an operative or proposed district plan, unless the activity is expressly allowed by a resource consent granted by the territorial authority responsible for the plan, or an existing use allowed by section 10. Note that section 9(1) does not apply to activities on a designated site that are consistent with the designation.
6.7 In accordance with section 9(3), no person may use any land in a
manner that contravenes a rule in an operative or proposed regional plan, unless that activity is expressly allowed by a resource consent granted by the regional council responsible for the plan, or an existing use allowed by section 20A.

Regional and District Plans District Plans 6.8 Parts of the proposed work and operation fall under the jurisdiction of
the Hamilton City Proposed District Plan. 6.9 The plan regulates activities ‘captured’ by sections 9 and 16 of the
RMA. Regional Plan 6.10 Parts of the proposed work and operation fall under the jurisdiction of
the Proposed Waikato Regional Plan. The proposed plan has been updated to December 2006. The regional plan is administered by Environment Waikato.
6.11 The Proposed Waikato Regional Plan regulates activities caught by
sections 9 (3) and 15 of the Resource Management Act, 1991 (e.g. earthworks, and contaminant and water discharges).
Rules, Conditions, Standards and Activity Status 6.12 A preliminary assessment of the rules, conditions, standards and
activity status applying to the various activities is outlined in Table 7 with respect to sections 9, 15 and 16 of the Resource Management Act, 1991.
6.13 Table 7 does not include the requirements of section 11, or the relief
provided by sections 168, 176 and 176A of the Resource Management Act, 1991.
6.14 In the absence of a designation the activity status of the proposed
substation would be discretionary under Rule 3.3.1 and 3.3.2 of the Proposed Hamilton City District Plan.

Cliff, Thanks for the response. The width of the access will be 5.5 m which is the upper limit of what is permitted in the residential zone in the District Plan (Table 5.2-3). As per our conversation this morning, WEL Networks have asked me to get a written statement from Hamilton City Council (“HCC”), or an agreement in principle, to allow the creation of an entranceway for access onto their proposed substation at Rototuna. The attached PDF diagram shows the basic location of a single accessway, which would meet WEL’s minimum access requirements.
A written statement regarding the suitability of the location of access/ entrance from HCC is needed to allow WEL to continue with the purchase of this land with surety. It is therefore requested that HCC respond as soon as is convenient.
Please note that WEL does not require sign off on the design, and that the written statement does not remove the need for any consents or permits that may be required through legislation or regulation.
