KTM RENTAL INFOKTM NEW ZEALAND ADVENTURE RALLYE

PICK UP / DROP OFF.All Rentals will be available for pickup at Paradise Motorcycle Tours Office in CHRISTCHURCH at 10.00am on Saturday, December 2nd 2017. Riders will need to arrange transport to this location, with their belongings.

You will be required to carry your own luggage to the start of the Rallye at Mount Cook, for registration and sign on, which takes place after 2.00pm on Sunday, December 3rd 2017.

Rental bikes are required to be returned at Paradise Motorcycle Tours Office in QUEENSTOWN at 10.00am Sunday, December 9th 2017, unless otherwise arrange (i.e. additional rental days pre-arranged). Personal effects (large suitcases or gear bags) that you have used to transport your gear can be left with Paradise Motorcycle Tours in Christchurch and will be transported for you to Queenstown. Limit of 1 bag per person, with any additional bags charged at $30 per bag. These will be stored with Paradise Motorcycle Tours for the duration of your rental, however this is at your own risk.

TYRES.The KTM Rental Bikes will be fitted with a new set of knobby tyres and this is included in the rental fee. If you think that you will require additional tyres, then these can be organized through the Tyre Support service offered at Cromwell on Day 3, at additional cost to you. Once you registered for the Rallye, this information will be sent to you in the Registered Rider Dossier.

INSURANCE EXCESS.Total excess applicable to the rental bike is $5000. Please note the insurance excess is not reducible for this event. Please see our terms and conditions of rental for any additional information.

RIDING GEAR.You will be required to bring all your own riding gear. Suitable adventure gear is required for this event.

GPS.GPS units are not available as part of the rental package. GPS brackets can be rented for an additional cost if required. This does not include the cradle bracket, so you will need to bring that with your GPS unit if you wish to mount it on your rental bike.

LUGGAGE.We recommend taking your belongings in something like the KTM 38L Roll Bag. These bags are waterproof, flexible in size and can be easily carried on the standard carrier plate on the back of the 1090 Adventure R. While riding in the Rallye, a luggage truck will carry your gear during the day.

For odds and ends, spare parts, spare tubes and tools that you wish to carry with you during the day, we suggest a KTM Tank Bag (18L) and the KTM Universal 5L Rear Bag. These can be purchased from KTM NZ and be fitted to your Rental, ready for when you arrive. You can then take them home with you. These items are available at the time of booking under Optional Extras.

If you are travelling Internationally, as outlined earlier, excess luggage will be transferred from the pick-up depot in Christchurch to Queenstown for you to collect on return of the rental. Limit of 1 bag per person, additional bags incur a charge of $30 per bag.

A 20% deposit is required at time of rental booking. This deposit is 20% of your combined Rental Fee and Rallye Fee. Full payment (for both Rental and Rallye) is required 30 days after booking, or 90 days prior to the event, whichever comes first. Cancellation fees are applicable.

PARADISE MOTORCYCLE TOURSRENTAL TERMS & CONDITIONS »NB – The following terms & conditions are supplied as part of this dossier for information only – this document doesn’t constitute ‘the agreement’ which will be completed with the hirer at time of rental pick-up.

This document is an agreement made between the rental service operator (the operator) and the hirer whose particulars are recorded in this agreement (the hirer). It is hereby agreed as follows:

Motorcycle description and term of hire1. The operator will let and the hirer will take the motorcycle details of which are set on page 1 of this agreement (the motorcycle), for the term of hire as described in this agreement

Persons who may ride the motorcycle2. The motorcycle may be ridden during the term of hire only by the person named or described in this agreement and only if each person holds a current full drivers licence appropriate for the class of motorcycle in this agreement. Persons under 25 years of age may only ride by previous agreement with the operator. The rider’s licence details are recorded in the agreement alongside their name and address. Any additional riders must enter into a separate rental agreement with the operator.

Payments by hirer3. The hirer shall pay the operator for the hire of the motorcycle the sum or sums specified in this agreement. The hirer shall pay the operator’s agent ‘KTM New Zealand’ for the hire of the motorcycle the sum or sums specified in this agreement.

4. In addition to the payment specified in clause 3 above, the hirer acknowledges that s/he shall be liable at the end of the hire period to pay the operator any applicable charges payable at the end of the term. These include charges for fuel, late return, damage to or repair of the vehicle (subject to the other terms of this agreement), any enforcement charges relating to such damage or repairs (including legal costs), traffic fines or infringement fees (see clauses 21 and 22) and the administration costs relating to these fines and fees, and toll charges. The operator will deduct such charges from the hirer’s credit card during or after the term of hire is competed, or the hirer may pay such charges as agreed with the operator, such choice to be at the operator’s sole discretion. Use of the motorcycle5. The hirer shall not:

a. use or allow the motorcycle to be used for the transport of passengers for hire or reward unless the motorcycle is hired with the operator’s knowledge for use in a passenger service licensed under Part 4A of the Land Transport Act 1998 the Act);

b. sublet or hire the vehicle to any other person;

c. allow the motorcycle to be used outside his/her authority;d. operate the motorcycle or allow it to be operated in circumstances that constitute an offence against any of Sections 56, 57 and 58 of the Act;

e. operate the motorcycle or allow it to be operated in any race, speed test or contest;

f. operate the motorcycle or allow it to be operated in breach of the Act, the Transport Act 1962, the Land Transport (Road User) Rule 2004, or any other Act, regulations, rules or bylaws relating to road traffic;

g. operate the motorcycle or allow it to be operated for the transport of more passengers goods than the maximum specified in the certificate of loading and/or

RUC certificate, whichever is the lesser for the motorcycle;

h. ride or allow the motorcycle to be driven by any other person if at the time of driving the vehicle the driver does not hold a current driver license appropriate for the motorcycle;

i. ride or allow the motorcycle to be ridden on any roads excluded in clause 17(h) of this agreement, or on any beach, driveway, or surface likely damage the vehicle;

j. allow the motorcyclee to be driven by any person who is not named or described in this agreement as a person permitted to ride the motorcycle.

Hirer’s obligations6. The hirer shall ensure that:

a. all reasonable care is taken when riding and parking the vehicle;b. the water in the motorcycle’s radiator and battery are maintained at the proper level;c. the oil in the motorcycle is maintained at the proper level;d. the tyres are maintained at their proper pressure;e. the motorcycle is locked and secure at all times when it is not in use;f. the distance recorder or speedometer are not interfered with;g. no part of the engine, transmission, braking or suspension systems are interfered with;h. should a warning light be illuminated or the hirer believe the motorcycle requires mechanical attention, s/he stops riding and advises the operator immediately;i. any punctures or other tyre damage is repaired or the tyre is replaced if necessary.

Operator’s obligations7. The operator shall supply the motorcycle in a safe and road worthy condition, up to current Certificate of Fitness standards.

Mechanical repairs and accidents8. If the motorcycle is involved in an accident, is damaged, breaks down or requires repair or salvage, regardless of cause, the hirer shall notify the operator of the full circumstances immediately.

9. the repair or replacement of tyres that are punctured or otherwise damaged is the responsibility of the hirer and must be undertaken at the hirers own cost.

10. The hirer shall not arrange or undertake any repairs or salvage without the operator’s authority except to the extent that repairs or salvage are necessary to prevent further damage to the vehicle or to other property.

11. If through no fault of the hirer the motorcycle requires repairs that make it unrideable the operator shall endeavour to supply a replacement motorcycle. This shall be at the operators expense.

Return of motorcycle12. The hirer shall, at or before the expiry of the term of hire, deliver the motorcycle to the operator or to the operator’s agent’s place of business as shown on the front of this agreement, or obtain the operator’s consent to the continuation of the hire (in which case the hirer shall pay additional hire charges for the extended term of hire). If the hirer does not comply with this clause 12, the hirer shall be liable for a late charge of $1000 per day.

Liability13. The hirer is liable for:

a. any loss of, or damage to, the motorcycle and its accessories;b. any consequential damage, loss or costs incurred by the operator, including salvage costs, loss of ability to re-hire and loss of revenue; andc. any loss of, or damage to, motorcycle and property of third parties, arising during the term of hire.The hirer’s liability is covered by the operator’s insurance in clause 15 up to the market value of the motorcycle in respect of clause 13(a) and $2,000,000 in respect of clause 13(c). The operator’s insurance does not cover the hirer’s liability in respect of the consequential loss described in clause 13(b).

Insurance14. The hirer is advised that motor vehicle insurance must be offered by the operator, but the hirer can make his/her own insurance arrangements, provided they are approved by the operator. If the operator is not satisfied that the hirer’s insurance is comparable to the operator’s, the operator may decline to hire the motorcycle.

15. If the hirer elects to use the operator’s insurance, any driver named in this agreement as a person permitted to drive the motorcycle is, subject to clause 18 and the excess payable by the hirer as set out in clause 17, covered against the losses set out in clause 13. This clause does not apply if the hirer rejects the operator’s insurance.

16. For riders over 25 years of age the insurance premium of $50 per day is included in the hire charge.

17. The excess payable by the hirer is $5,000 in the case of damage to, or accidents involving, the motorcycle only (single vehicle accidents) and $5,000 in the case of accidents involving the motorcycle and one or more other vehicles (multiple vehicle accidents).

Insurance exclusions18. The hirer acknowledges that the cover referred to in clause 15 will not apply at any time when:

a. the driver of the motorcycle is under the influence of alcohol or any drug;b. the motorcycle is in an unsafe or un-roadworthy condition, such condition arising during the course of the hire, that caused or contributed to the damage or loss, and the hirer or driver was aware or should have been aware of the unsafe or un-roadworthy condition of the motorcycle;c. the motorcycle is ridden in any race, speed test, or contest;d. the motorcycle is ridden by anyone not named or described in this agreement as a person permitted to ride the motorcycle;</p>e. the motorcycle is ridden by an unlicensed person;f. the motorcycle is wilfully or recklessly damaged or lost by the hirer, a nominated rider, or a person under the hirer’s authority or control;g. the rider commits a traffic offence while driving the motorcycle;h. the motorcycle was being ridden off road on an unformed road.i. the motorcycle was being ridden on private property without permission of the landowner.j. the vehicle was operated beyond the term of this agreement or any agreed extension if the term.

19. It is agreed between the hirer and the operator that section 11 of the insurance law return act 1977 shall apply with respect to the above exclusions as if clauses 14 to 18 constitute a contract of insurance

Hirer uses his/her own insurance 20. If the hirer elects to use his/her own insurance s/he accept all liability for all losses, costs and damages set out in clause 13(a) to (c), and agrees that clause 15 does not apply to such losses, costs and damages.

Traffic offences 21. The hirer is advised that Section 9.5(1) of the Land Transport Rule: Operator Licensing 2007 permits the operator to debit the hirer’s credit card for any

infringement fee for an offence where the offence was committed during the period of hire and;a. was a speeding offence, a toll offence or an offence in respect of failure to comply with the directions given by a traffic signal where that offence was detected by approved vehicle surveillance equipment;b. an offence for parking in any portion of a road in breach of any bylaw or a road controlling authority or an offence against Part 6 of the Land Transport (Road User) Rule 2004.The operator may also charge an administration fee of $50 in addition to the infringement fee.

22. The operator will send the hirer a copy of the infringement notice and any reminder notice as soon as practicable after it is received by the operator. The hirer has the right to challenge, complain about, query or object to the alleged offence to the issuing enforcement authority, and seek a court hearing (within 56 days from the date of issue of the infringement notice or 28 days from the date of issue of the reminder notice).

Cancellation of Hire Agreement23. The operator may cancel this agreement and/or repossess the motorcycle (and for that purpose enter any premises and remove the motorcycle) without notification to the hirer if: a. the motorcycle is abandoned or appears to be abandoned;b. the motorcycle is not returned on the agreed date or the operator has reasonable grounds to suspect that the motorcycle will not be returned on the agreed date;c. the hirer has obtained the motorcycle through faud or misrepresentationd. the operator has reasonable grounds to believe that the hirer is likely to endanger themselves or others:e. the motorcycle is involved in an accident or otherwise damaged

24. The operator may cancel this agreement by giving notice (written or verbally) to the hirer if the hirer breaches any material term(s) of the agreement particularly clauses 3 to 6.

25. The hirer understands that in the event of cancellation/repossession under either clause 23 or 24 the hirer has no right to a refund of any part of the rental charges.

26. If the agreement is cancelled by either party the hirer must immediately return the motorcycle and keys to the agreed return location. If the operator cancels the hire agreement in accordance with clause 23, the operator shall have the right to take immediate possession of the motorcycle.

NOTE: THE OPERATOR MUST GIVE THE HIRER AT LEAST ONE COPY OF THIS AGREEMENT WHICH MUST BE KEPT WITH THE MOTORCYCLE THROUGHOUT THE TERM OF THE HIRE AND PRODUCED ON DEMAND TO AN ENFORCEMENT OFFICER.
