• School Board authority and duty to redistrict school boundaries or adopt pupil assignment plans following public hearing. Va. Code § 22.79 (8)

Equal Educational Opportunity Act, 20 U.S.C. § 1701

• (1) All children enrolled in the public schools are entitled to equal educational opportunity without regard to race, color, sex, or national origin; and

• (2) the neighborhood is the appropriate basis for determining public school assignments.

Equal Protection Clause of the 14th Amendment to the U.S. Constitution

• Plan must be facially neutral, i.e., assign students by neighborhood or geographic area, rather than race, national origin, etc.

• May not assign a specified percentage of a particular student group merely because of race or ethnic origin. “Outright racial balancing is ‘patently unconstitutional.’” Parents Involved in Community Schools v. Seattle School Dist. No. 1., U.S. Supreme Court (2007).

• However, school divisions may pursue diversity “by drawing attendance zones with general recognition of the demographics of neighborhoods.”

• “The Constitution imposes no duty on school officials to correct segregative conditions resulting from factors over which they have no control, such as residential patterns.”

• However, “in the administration of public schools . . . it is permissible to consider the racial makeup of schools and to adopt general policies to encourage a diverse student body, one aspect of which is its racial composition.”

Pupil Reassignment Policies and Procedures

• Must consider only those factors which the Division has historically deemed important (as designated in its reassignment policy).

• Must balance those factors, including diversity

• Must focus on neighborhoods and geographical areas

• Must have a public process for adoption, including public meetings and input, and open deliberations by the School Board.

• “School boundaries for each school are established by the School Board based on the need to provide for instructional effectiveness and the health, safety, and general welfare of all students.”

• Factors considered historically when establishing boundaries• Balanced enrollment within 15% of overall capacity utilization of the affected schools over subsequent

three years (why weight given to this factor)

• Demographic balance

• Minimization of times a particular geographic area or neighborhood is reassigned

• Efficiency of transportation and minimizing travel for students

• Avoiding splitting small neighborhoods

• Improving geographic progression of communities (ES to MS to HS)

Regulation 264-2• Office of Facilities Services hold a preliminary “Scoping Meeting”

• Following the “Scoping Meeting” the Office of Facilities Services shall develop one or more boundary proposal(s)

• School Board members shall be apprised of the features of the boundary proposal(s) for their comments and consideration

• Following any necessary adjustments, staff shall share the proposals with the public through established communication channels

• Office of Facilities Services shall hold a Community Meeting to gather input from the public regarding the proposed high school boundaries

• Office of Facilities Services shall hold a second Community Meeting to gather input from the public regarding the proposed high school boundaries

• Office of Facilities Services shall publish documents pertaining to the boundary process and specific boundary proposal(s) to the website

• The School Board shall establish high school boundaries

Recommendations of the Office of Facilities Services for the Boundaries of the 13th High School

• The Office of Facilities Services recommends that the School Board:

• Receives this report and approves one of the presented boundary plan proposals (i.e. Plan 1a or Plan 2)

• Permits rising 12th graders who reside in the affected areas to remain in their presently assigned school for SY 2021-22

• Permits rising 11th graders who reside in the affected areas to (1) make a one-time choice to either attend the newly assigned school or (2) remain at their presently assigned school for the SY 2021-22

• The Office of Facilities Services would like to thank everyone who provided them with feedback on the plans under consideration. The content of each e-mail received, as well as comments and suggestions provided at the community meetings, have been given consideration. Additionally, we would like to express our appreciation for the guidance and assistance provided by the Office of Transportation Services and by the Superintendent’s Staff.
