Bid Preparation and Hash Submission stage and Earnest Money Deposit has to be submitted

in a separate sealed EMD envelope in form of Bank Draft in favour of the Executive

Engineer, Provincial Division No.2 PWD B&R Br. Rohtak. Desirous Contractors shall have

to pay the Tender Document Fees mentioned against the work at the time of Bid Preparation

and Hash Submission stage. The EMD envelop has to reach in the office of Executive

Preparation and Hash Submission stage, the Bidders are required to keep the EMD ready

appropriately.

5 The tender shall be submitted by the tenderer in the following three separate envelops

online:

1. Earnest Money - Envelope ‘ED’

2. N.I.T. and Technical Bid - Envelope ‘T I’

3. Tender in Form – A (Price Bid) - Envelope ‘C I’

Note: Online Bidders are required to submit the physical EMD in a physical EMD

Envelop – ‘ED’ and any other document related to Technical Bid which cannot be

submitted online in a physical Technical Envelop – ‘TI’. Price Bids are to be

submitted mandatory online and shall not be accepted in any physical from.

Reference of the EMD is to be mentioned Online. Also, in case of Technical Bids,

the list of documents being submitted physically is to be uploaded online.

Above envelop, as applicable, shall be kept in a big outer envelop, which shall also be

sealed, In the first instance, the Envelop – ‘ED’ of all the Bidders containing the Earnest Money shall

be opened online and physically. If the Earnest Money is found proper, the Envelop ‘TI’ containing

Technical Bid shall be opened in the presence of such contractors who choose to be present. The

Financial Offer in Envelop in ‘CI’ shall be opened only if the tenderers meet the qualification criteria

and availability of bid capacity as per qualification, criteria of the Technical Bid document by the

Chief Engineer. The date of opening of Financial Bid shall be fixed at the time of opening of

Technical Bid.

The Contractual Agencies will submit the necessary documents as under.Envelope ‘A’ – Earnest Money

Deposit Envelop

Physical EMD Envelop – Earnest Money in shape of deposit at call/Treasury Challan,

Bank guarantee from Nationalized bank or ICICI /HDFC/IDBI, proof of enlistment and other proofs of

machinery, if any as per requirements of DNIT etc.

Online EMD Envelope—Reference details of the Earnest Money Deposit instrument and scanned copy

of the Earnest Money Deposit.

Envelope ‘B’ – Technical Bid Envelope

Online Technical Envelope – All the information and scanned copies of the

Documents / Certificates as require to be submitted as per the Tender. Also, the list of such documents

that can not be submitted online, if any Physical Technical Envelope – All the Information and

Documents / Certificates as required to be submitted as per the Tender that cannot be submitted online,

if any,

Envelope ‘C’ – Price Bid Envelope

To be submitted mandatory online- Information related to Price Bid of the Tender

Both these Envelopes “A” and “B” shall be placed in another envelops of bigger size clearly marking

the name of agency & name of work. In case, the Bidders have submitted all the information and

documents/ certificates required as a part of Technical Bid online, physical Envelope “B” shall not be

required. Envelope “B” will be only opened if the Contractual Agency fulfills condition in Envelope

“A”.

CONDITONS:-1) DNIT & Prequalification can be seen on any working day during office hours in office of the

undersigned as well as in the office of the Superintending Engineer, RohtakCircle, Hr.P.W

( B&R) Deptt. Rohtak

2) Conditional tenders will not be entertained & are liable to be rejected.

3) In case the day of opening of tenders happens to be holiday, the tenders will be opened on the

next working day. The time and place of receipt of tenders and other conditions will remain

unchanged.

4) The undersigned reserve the right to reject any tender or all the tenders without assigning any

reason.

5) The societies shall produce an attested copy of the resolution of the Co-Operative department

for the issuance of tenders.

6) The tender without earnest money will not be opened.

7) The jurisdiction of court will be at Rohtak

8) The tender of the bidder who does not satisfy the qualification criteria in the bid documents are

liable to be rejected. Summarily without arising any reason and no claim whatsoever on this

account will be considered.

9) The bid for the work shall remain open for acceptance during the bid validity period to be

reckoned from the date of ‘Submit Bid Hash Online’. If any bidder/ tenderer withdraws his bid/

tender before the said period of makes any modifications in the terms and conditions of the bid,

the said earnest money shall stand forfeited. Bids would require to be valid for 3 months from

the date of bid closing.

10) A bidder shall not be permitted to bid for works in the Circle responsible for award and

execution of contracts in which his or his spouse’s near relative (defined as first blood relations,

and their spouses) is posted as Divisional Accountant or as an officer in any capacity between

the grades of Superintending Engineer and Assistant Engineer (both inclusive).

11) No engineer of Gazetted rank or other Gazetted officer employed in Engineering or

Administrative duties in an Engineering Department of the State Government is allowed to

work as a contractor for a period of two years after his retirement from Government service,

without Government permission. This contract is liable to be cancelled if either the Contractor

or any of his employees is found any time to be such a person who had not obtained the

permission of the Government as aforesaid before submission of the tender or engagement in

the contractor’s service.

CHAPTER-1 (iii)

Instruction to Contractor on Electronic Tendering

1. These conditions will over-rule the conditions stated in the tender documents, wherever

relevant and applicable.

2. Registration of the Contractors on the Haryana PW(B&R) Deptt.’s website

http://haryanapmgsy.etenders.in

2.1 All the Contractors registered / intending to register with Haryana PW(B&R) Deptt. and

intending to participate in the tenders processed online, are required to get registered on the

Electronic Tendering System on the Portal http://haryanapmgsy.etenders.in

The Contractors registered with other departments who are also eligible to

participate in the tenders are also required to be register on the Electronic Tendering

System in OPEN category.

3. Obtaining a Digital Certificate:

3.1 The Bids submitted online should be encrypted and signed electronically with a Digital

Certificate to establish the identity of the bidder bidding online. These Digital Certificates are

issued by an approved certifying authority, by the controller of Certifying Authorities,

Government of India.

3.2 A Digital Certificate is issued upon receipt of mandatory identity proofs and verification letters

attested by the bankers with whom the contractor maintains the accounts with. Only upon the

receipt of the required documents, a digital certificate can be issued.

3.3 The registered contractors may obtain Class II B digital certificated from any Certifying

Authority or Sub- certifying Authority authorized by the Controller of Certifying Authorities or

may obtain information and application format and documents required to issue of digital

certificate from:

3.4 Bid for a particular tender may be submitted only using the digital certificate, which is used to

encrypt the data and sign the hash during the stage of bid preparation and hash submission. In

case, during the process of a particular tender, the user looses his digital certificate (i.e. due to

virus attack, hardware problem, operating system problem); he may not be able t submit the bid

online. Hence, the users are advised to back up to certificate and keep the copies at safe place

under proper security to be used in case of emergencies.

3.5 In case of online tendering, if the digital certificate issue to the authorized user of a firm is used

for signing and submitting a bid it will be considered equivalent to a no-objection

certificate/power of attorney to that User. The firm has to authorize a specific individual via an

authorization certificate signed by all partners to use the digital certificate as per Indian

Information Technology Act 2000. Unless the certificates are revoked, it will be assumed to

represent adequate authority of the user to bid on behalf of the firm for Haryana PWD B&R

tenders as per Information Technology Act 2000. The digital signature of this authorized user

will be binding on the firm. It shall be the responsibility of management / partners of the

registered firms to inform the certifying authority of Sub / Certifying Authority, if the

authorized user changes, and apply for a fresh digital certificate and issue a ‘authorization

certificates’ for the new user. The procedure for application of a digital certificate will remain

the same for the new user.

3.6 The same procedure holds true for the authorized users in a private/Public limited company. In

this case, the authorization certificate will have to be signed by the directors of the company.

4. Opening of an Electronic Payment Account:

4.1 For purchasing the tender documents online, contractors are required to pay the tender

documents fees online using the electronic payments gateway service as mentioned in the

D.N.I.T.

4.2 For the list of payments using which the online payments can be made, please refer to

the Home page of the Portal http://haryanapmgsy.etenders.in.

5. Set up of machine

5.1 In order to operate on the electronic tender management system, a user’s machine is

required to be set up. A help file on setting up of the system can be obtained from next

Tenders (India) Pvt. Ltd. or downloaded from the home page of the website -

http://haryanapmgsy.etenders.in.

6. Online Viewing of Detailed Notice Inviting Tenders:

6.1 The contractors can view the detailed N.I.T and the time schedule (Key Dates) for all the

packages floated using the electronic tendering system on the Haryana PWD B&R

website http://haryanapmgsy.etenders.in

7. Purchase of Tender Documents:

a) Download of Tender Documents: The tender documents can only be downloaded

from the Electronic Tendering System on the Portal http://haryanapmgsy.etenders.in

8. Submission of Bid Seal (Hash) of online Bids:

8.1 Submission of bids will be preceded by submission of the digitally signed bid

seal (Hash) as stated in the tender time schedule (Key Dates) of the

Tender.

9. Generation of Super Hash:

9.1 After the time of submission of Bid Seal (Hash) by the Contractors has lapsed, the

bid round will be closed and a digitally signed tender Super Hash will be generated

by authorized Haryana PWD B&R official. This is equivalent to sealing the tender

box.

10. Submission of actual online bids:

10.1 Contactors have to submit their encrypted bids online and upload the relevant

documents for which they generated the hash at the stage of hash generation and

submission after the generation of Super Hash within the date and time as stated in

the Notice Inviting Tenders (Key Dates). The electronic bids of only the contactors

who have submitted their bid seals (Hashes) within the stipulated time, as per the

tender time schedule (Key Dates), will be accepted by the System. A contractor

who does not submit his bid seal (Hash) within the stipulated time will not be

allowed to submit his bid.

11. Submission of Tender Document Fees:

11.1 The Payment can be made by eligible / approved contractors online directly or

thought Approved Traditional Financial Instruments. Arrangements have been made

for contractors to make payments online via Credit Cars / Internet Banking Accounts

/ Cash Cards. The contractors have to pay for the tender documents online by

making online payment of tender document fees using the service of the Secure

electronic payment gateway. The secure electronic payments gateway is an online

interface between contractors and credit card / online payment authorization

networks.

11.2 Contractors submitting the Tender Document Fees physically have to submit it in a

sealed physical envelope and the same should reach the office of concerned

Executive Engineer as stated in the Tender Notice.

12. Submission of Earnest Money Deposit:

12.1 The EMD Payment can be made by eligible / approved contractors through

Approved Traditional Financial Instruments.

12.2 Contractors have to submit the EMD physically in a sealed physical envelope and the

same should reach the office of concerned Executive Engineer as mentioned in the

Tender Notice.

13. Key Dates:

13.1 The contractors are strictly advised to follow dates and times a indicated in the

Notice Inviting Tenders. The date and time will be binding on all contractors. All

online activities are time tracked and the system enforces time locks that ensure that

no activity or transaction can take place outside the start and end dates and time of

the stage as defined in the Notice Inviting Tenders.

Other Information:

1. The intending Contractors shall fill in the item rate/percentage rate in the online

templates in of the online tender. The Price Bid has to be submitted mandatory online.

2. The Earnest Money Deposit and Technical Bid Documents that cannot be submitted

online, if any should be put in separate sealed envelopes and these sealed envelopes together

with the documents listed below should be sealed in another cover and delivered to this office

before the date and time mentioned in the Tender Notice.

i. A list of all documents accompanying the sealed envelopes containing the tender

documents.

ii. Duly accepted power of Attorney in original along with its two certified copies in the name

of tenderer or authorized representative to act on behalf of the agency.

iii. Documents in respect of payment of earnest money.

3. a) Tender must strictly abide by the stipulations set forth in detailed notice inviting

tenders while tendering for the work, the tenderer shall adopt only the three

envelope system.

b) The tender conditions shall be placed alongwith the pricing separately for each

condition in lieu of its assumed withdrawal by the tenderer in the second

envelope marked as “Condition and the pricing for withdrawal of each

condition” in case of manual submission. The envelope must contain pricing of

each condition of the tenderer, whatsoever. In case of non-compliance of partial

compliance by the any tenderer in this respect, his price bid and the tender shall

not at all be considered.

4. The second envelop – Price Bid envelope has to be submitted mandatory online and

shall not be accepted physically under any circumstances. In case any tenders does not

comply with procedure given above, will be presumed that he is not interest in the work

and the work shall not be let out to him, further he may be de-listed without further

notice to him for failing to abide by the strictly approved terms of detailed notice

inviting tenders for this work.

5. The tenders which are not accompanied by the earnest money or proof or earnest money

or do not strictly follow the technical requirement, are liable to be rejected summarily.

6. Tenders quotations which are dependent upon the quotations of another tender shall be

summarily rejected.

7. The tender of the bidders who does not satisfy the qualification in the bid documents are

liability to be rejected summarily without arising any reason and no claim what so ever

on their account will be considered.

1. In case the day of opening of tenders to be a holiday, the tender will be opened of the next

working day at the same venue at the same time. However, the time, date & place of

3. Canvassing of any kind is prohibited.

4. Bidding is open to all eligible bidders meeting the eligibility criteria. One bidder can

submit only one bid. All cost of preparing tender including visits to site and carrying out

investigations and research are to bidder’s account.

5. PWD may modify the bidding documents by using addenda before the deadline for

submission of bids. Any addendum thus issued shall become a part of bidding documents.

6. Bidders shall not be under a declaration of intelligibility for corrupt and fraudulent

practices by the Central Government, the State Government or any public undertaking,

autonomous body, authority by whatever name called under the Central or the State

Government.

7. The Bidder, at his own cost, responsibility and risk, is encouraged to visit, examine and

familiarize himself with the site of works and its surroundings including source of earth,

water, road, aggregates etc. and obtain all information that may be necessary for preparing

be given regarding availability of water. Water which is not suitable for construction as

per relevant IS standards will not be allowed to be used under any circumstances.

8. The Bidder in his own interest is advised to familiarize himself regarding rate of taxes,

7. Tenderers are advised to visit the site sufficiently in advance of the date fixed for submission of thetender. A tenderer shall be deemed to have full knowledge of all the relevant document samples, siteetc. whether he inspects them or not.

8. Submission of a tender by a tenderer implies that he has read this notice and all other contract documentsand has made himself aware of the scope and specifications of the work to be done and of conditions andrates at which stores, will be issued to him by Government and local conditions and other factors bearingon the execution of the works.

9. Each tenderer shall give proof to the entire satisfaction of the Executive Engineer concerned that he hasin his possession the Haryana P.W.D. specification Book 1963 Edition as applicable to Haryana Statefailing which his tender shall be liable to be rejected.

10. The Divisional Officer reserves to himself the right of issuing the materials to the contractors as per listenclosed for use on the work at the places and rates noted against each. When the material is to beissued from stock, the contractor shall be held responsible for obtaining from Govt. all such materialrequired for the work and for making payment therefore by deduction, from is bills at the rates specifiedread less of fluctuations in the market rates or in the stock rate of the Division No carriage or incidentalcharge will be borne by the Govt. for moving the materials beyond the place where the contractor hasagreed to take delivery thereof, except in case of material of which a specified provisions for thepayment of carriage and incidental charges is made in the contract schedule of rates.

11. The Tenderer shall initial all corrections in his tender. Non compliance of this condition will render thetender liable for rejection.

12. The contractor, whose tender is accepted will be required to execute a contract deed on the prescribedform mentioned in paragraph above and will be required to furnish security for the due fulfillment of hiscontract. The security will consist of deduction of ten percent from the monthly payment to be made onaccount of work done. The earnest money (mentioned in paragraph 3 above) will be treated as part ofthe security.

GENERAL RULES AND DIRECTIONS FOR THE GUIDANCE OF CONTRACTORS1. All work proposed for execution by contract will be notified in a Form of invitation to tender pasted on aboard hung up in the office of and signed by the Executive Engineer.

This Form will state the work to be carried out as well as the date for submitting and opening tendersand the time allowed for carrying out the work, also the amount of earnest money to be deposited with tenderand the amount of the security deposit to be deposited by the successful tenderer and the percentage if any tobe deducted from bills. Copies of the specifications, designs and drawings, estimated rates/Haryana P.W.D.Schedule of rates 1988 and any other document required in connection with the work, signed for the purposeof identification by the Executive Engineer during office hours.2. In the event of the tender being submitted by a firm, must be signed separately by each member thereof,or in the event of the absence of any partner, it must be signed on his behalf by a person holding a power ofattorney authorising him to do so.3. Any person who submits a tender shall fill up the usual printed form stating at how much percentabove or below the rates specified in rule 1, he is willing to undertake the work. Only one rate of percentagemore or less on Haryana P.W.D. Schedule of rates 1988 shall be named. Clause 1 - The person/persons whose tender may be accepted (hereinafter called the contractor) shallpermit Government at the time of making any payment to him for work done under the contract todeduct such sum as will (with the earnest money deposited by him) amount to 10% of all moneyssubject to maximum 5 % of contract value so payable. Such deductions to be held by Govt. by way ofsecurity deposit. All compensation or other sums of money payable by the contractor to Governmentunder the terms of his contract may be deducted from the security deposit account or from any sumswhich may be due or may become due to the contractor by Government on any account whatsoever andin the event of his security deposit being reduced by reason of any such deduction the contractor shallwithin ten days thereafter make good in cash or Government securities endorsed as aforesaid any sumor sums which may have been deducted from or raised by sale of his security deposit.Clause 2 – The time allowed for carrying out the work as entered in the tender shall be strictly observedby the contractor and shall be reckoned from the date next after fifteen days on which offer tocommence the work is given to the contractor. The work shall throughout the stipulated period of thecontract be proceed with all due diligence (time being deemed to be the essence of the contract on thepart of the contractor) and the contractor shall pay as compensation an amount equal to 1%(onepercent) which the Executive Engineer-in-Charge may levy on the amount of the estimated cost to thewhole work as shown in the tender for every day the work remains uncommenced or unfinished afterthe proper dates. And further to ensure good progress during the execution of the work the contractorshall be bound in all cases in which the time allowed for any work exceeds one month to complete onefourth of the whole of the work before one fourth of the whole time allowed under the contract haselapsed and one half of the work before one half of such time has elapsed and three-fourth of the workbefore three-fourth of such time has elapsed. In the event of the contractor failing to comply with thiscondition he shall be liable to pay as compensation an amount equal to one percent which the ExecutiveEngineer-in-Charge may levy on the said estimated cost of the whole work for everyday that the duequantity of work remains incomplete provided always that the entire amount of compensation to bepaid under the provisions of this clause shall not exceed 10% (Ten percent) of the estimated cost ofwork as shown in the tender. The Superintending Engineer may on representation from the contractorreduce the amount of compensation and his decision in writing shall be final.

Actionwhenwhole ofSecuritydeposit isforfeited

Clause 3- In any case in which under any clause or clauses of this contract the contractor has renderedhimself liable to pay compensation amounting to the whole of his security deposit (whether paid in onesum or deducted by installments. The Executive Engineer on behalf of the Government shall have powerto adopt any of following course as he may deem best suited to the interest of Government.

(a) To rescind the contract of which rescission notice in writing to the contractor under thehand of the Executive Engineer shall be conclusive evidence and in which case the security deposit of thecontractor shall stand forfeited and be absolutely at the disposal of Government.

(b) To employ labour paid by the Public Works Department and to supply materials to carryout the work, or any part of the work debiting the contractor with the cost of the labour and the price ofthe materials (of the amount of such cost and price, a certificate of Executive Engineer shall be final andconclusive against the contractor) and crediting him with the value of the work done. In all respects inthe same manner and at the same rates as if it had been carried out by the contractor under the terms of hiscontract the certificate of the Executive Engineer as to the value of the work done shall be final andconclusive against the contractor.(c) To measure the work of the contractor and to take such part thereof as shall be unexecuted out of hishands and to give it to another contractor to complete in which case any expenses which may be incurredin excess of the sum which would have been paid to the original contractor of the whole work had beenexecuted by him (of the amount of such excess, the certificate in writing of the Executive Engineer shallbe final and conclusive shall be borne and paid by the original contractor and may be deducted from anymoney due to him by Government under the contract or otherwise or from his security deposit.In the event of any of the above courses being adopted by the Executive Engineer, the contractor shallhave no claim to compensation for any loss sustained by him by reason of his having purchased orprocured any material or entered into any engagement or made any advances on account of or with a viewto the execution of the work for the performance of the contract. And in case the contractor shall berescinded under the provision aforesaid the contractor shall not be entitled to recover or be paid any sumfor any work thereto for actually performed under the contract, unless and until the Executive Engineerwill have certified in writing the performance of such work and the value payable in respect thereof and heshall only be entitled to be paid the value so certified.

Clause 4 – In any case in which any of the powers conferred upon the Executive Engineer byclause 3 hereof shall have become exercisable and the same have not been exercised, the non-exercise thereof shall not constitute a waiver of any of the conditions thereof and such power shallnot withstanding be exercisable in the event of any future case of default by the contractor forwhich by any clause or clauses hereof he is declared liable to pay compensation amounting to thewhole of his security deposit and the liability of the contractor for past and future compensationshall remain unaffected. In the event of the Executive Engineer exercising either of the powers (a)or (c) vested in him under the proceeding clause he may. If he so desires, take possession of all orany tools plants materials and stores in or upon the works, or the site thereof belonging to thecontractor or procured by him and intended to be used for the execution of the work or any partthereof paying or allowing for the same in account at the contract rates or in case of these not beingapplicable at current market rates to be certified by the Executive Engineer whose certificatethereof shall be final otherwise the Executive Engineer may by notice in writing to contractor or hisclerk of the works, foreman or other authorized agent require him to remove such tools and plantmaterial or stores from the premises within a time to be specified in such notice and in the event ofthe contractor failing to comply with any such requisition, the Executive Engineer may removethem at the contractor’s expense or sell them by auction or private sale on account of the contractorand at his risk in all respects and the certificate of the Executive Engineer as to the expense of anysuch removal and the amount of the proceeds and expenses of any such sale shall be final andconclusive against the contractor.Clause 5 – If the contractor shall desire an extension of time for the completion of the work on thegrounds of his having unavoidable hindrance in its execution or on any other ground, he shallapply in writing to Executive Engineer within 30 days of the date of the hindrance on account ofwhich he desires such extension as aforesaid and the Executive Engineer shall if in his opinion(which shall be final reasonable grounds be shown therefore authorize such extension of time, ifany as may in his opinion be necessary or proper.Clause 5 A - The contractor shall deliver in the office of the Executive Engineer on or before the10th day of every month during the continuance of work covered by this contract a return showingdetails of any work claimed for as extra and such return shall also contain the value of such workas claimed by the contractor, which value shall be based upon the rates and prices mentioned inthe contract or in the Schedule of Rates in force in the District for the time being. The contractorshall include in such monthly return particulars of all claims of whatever kind and however arisingwhich at the date thereof he has or may claim to have against the Executive Engineer under Or inrespect of or in any manner arising out of the execution of work and the contractor shall bedeemed to have waived all claims not included in such return and will have no right to enforce anyclaims not so included whatsoever be the circumstances.

Clause 6 - Without prejudice to the right of Government under any clause thereinafter contained oncompletion of the work, the contractor shall be furnished with a certificate by the Executive Engineer(hereinafter called the Engineer-in-Charge) of such completion but no such certificate shall be given norshall the work be considered to be completed until the contractor shall have removed from the premiseson which the work shall be executed all scaffolding, surplus materials and rubbish and cleaned off thedirt from all wood work, walls or floors or other parts of any building in upon or about which the workis to be executed or of which he may have had Possession for the purpose of the execution thereof andthe measurements in the said certificate shall be binding and conclusive against the contractor shall failto comply requirements of this clause as to removal of scaffolding, surplus materials and rubbish andcleaning of dirt of on or before the date fixed for the completion of the work the Engineer-in-charge mayat the expense of the contractor remove such scaffolding surplus materials and rubbish and dispose ofthe same as he thinks fit and clean off such darts aforesaid and the contractor shall forth pay the amountof all expense so incurred and shall have no claim in respect of any such scaffolding or surplus materialsaforesaid except for any sum actually realized by the sale thereof.

Clause 7 – No payment shall be made for works estimated to cost less than rupees one thousand till afterthe whole of the works shall have been completed and a certificate of completion given. But in the caseof works estimated to cost more than rupees one thousand the contractor shall on submitting bill thereofbe entitled to receive a monthly payment proportionate to the part thereof than approved and pasted bythe Engineer-in-charge whose certificate of such approval and passing of the sum of payable shall befinal and conclusive against the Contractor. But all such intermediate payments shall be regarded aspayments by way of advance against the final payments only and not as payments for work actually doneand completed and shall not preclude the requiring of bad, unsound and imperfect or unskillful to beremoved and taken away and reconstructed or re-erected, or be considered as an admission of the dueperformance of the contractor, any part thereof in any respect of the acquiring of any claim not shall itconclude, determine or affect in any way the powers of the Engineer-in-charge under the conditions, orany of them as to the final settlement and adjustment of the accounts or otherwise, or in any other wayvary or affect the contract. The final bill shall be submitted by the contractor within one month of thedate fixed for completion of the work otherwise the Engineer-in-charge’s certificate of the measurementand of the total amount payable for the work accordingly shall be final and binding on all parties.

Clause 8- A bill shall be submitted by the contractor each month on or before the date fixed by theEngineer-in-charge for the work executed in the previous month and Engineer-in-charge shall take orcause to be taken the requisite measurements for the purpose of having the same verified and the claimas far as admissible, if possible before the expiry of ten days from the presentation of the bill. If thecontractor does not submit the bill within the time fixed as aforesaid, the Engineer-in-charge may deputea subordinate to measure up the said work in the presence of the contractor, whose counter-signature tothe measurement list will be sufficient warrant, and the Engineer-in-Charge may prepare a bill from suchlist which shall be binding on the contractor in all respects.

Clause 9 – The contractor shall submit all bills on the printed forms to be had on application at the officeof the Engineer-in-Charge, and the charges in the bill shall always be entered at the rates specified in thetender or in the case of any extra work ordered in pursuance of these conditions and not mentioned orprovided for in the tender at the rates hereinafter provided for such work.Clause 10 – If the specification of estimate of the work provides for the use of any special description ofmaterials to be supplied from the Engineer-in-charge’s store or if it is required that the contractor shall usecertain store to be provided by Engineer-in-charge (such materials and stores, and the prices to be chargedthereof as hereinafter mentioned being so for as practicable for the convenience of the contractor but not somentioned being so for as practicable for the convenience of the contractor, but not so in any way tocontrol the meaning or effect of this control, specified in the schedule or memorandum hereto annexed) thecontractor shall be supplied with such materials and stores required from time to time tobe used by him forthe purpose of the contract only and the value of the full quantity of materials and stores so supplied at therates specified is the said schedule or memorandum may be set off or deducted from any sums then due orthereafter to become due to the contractor under the contract or otherwise against or from the securitydeposit. All materials supplied to the contractor shall remain the property of the contractor, but shall noton any account be removed from the site of the work without the written permission of the Engineer-in-charge and shall at all times be open to inspection by him. Any such materials unused and in perfectlygood condition at the time of the completion of the contract, shall be returned to the Engineer-in-charge’sstore. If by a notice in writing under his hand he shall so require but the contractor shall not be entitled toreturn any such materials Unless with consent, and shall have no claims for compensation on account ofany such materials so supplied to him as aforesaid being unused by him, or for any wastage or damage toany such materials. Clause 11 – The contractor shall execute the whole and every part of the work in most substantial andworkman like manner and both as regards materials and otherwise in every respect in-strict accordancewith the specification. The contractor shall also conform exactly fully and faithfully to the designs,drawings and instructions in writing relating to the work signed by the Engineer-in-Charge and lodged inthe office and to which the contractor shall be entitled to have access at such office, or at the site of workfor the purpose of the inspection during office hours, and contractor shall if he so requires, be entitled athis own expense to make or cause to be made copies of the specifications, and of all such designs, drawingand instructions as aforesaid. Clausen 11 A – The Engineer-in-charge shall have full powers, at all times to object to the employment ofany workman, foreman, or other employee on the works by the contractor and if the contractor shallreceive notice in writing from the Engineer-in-charge requesting the removal of any such man or men fromthe work the contractor shall comply with the request forthwith.

No such workman, foreman or other employee after his removal from the works byrequest of the Engineer-in-charge shall be re-employed or reinstated on works by the contractor at anytime except with the previous approval in writing of the Engineer-in-charge. The contractor shall not be entitled to demand the reason from the Engineer-in-charge, forrequiring the removal of any such workman, foreman or other employees.

Clause 12 – The Engineer-in-Charge shall have power to make any alteration in omission from additionto or substitutions for the original specifications, drawing, designs and instructions that may appear tohim to be necessary or advisable during the progress of the work and the contractor shall be bound tocarry out the work in accordance with any instructions which may be given to him in writing signed bythe Engineer-in-charge and such alterations, omissions, additions or substitutions shall not invalidate thecontract, and any altered, additional or substituted work which the contractor may be the directed to doin the manner above specified as part of the work shall be carried out by the contractor on sameconditions in all respects on which he agreed to do the main work, and at the same rates as are specifiedin the tender for the main work. The time for the completion of the work shall be extended in theproportion the altered additional or substituted work bears to the original contract work and thecertificate of the Engineer-in-Charge shall be conclusive as to such proportion. And if the alteredadditional or substituted work includes any class of work, for which no rate is specified in the contract,than such class of work shall be carried out at the rates entered in the schedule of rates of the districtsubject to the same percentage above or below as included in the contract and if such class of work is notentered in the schedule of rates of the district then the contractor shall within seven days of the date ofthe receipt of the order to carry out the work inform the Engineer-in-charge of the rate which it is hisintention to charge for such class of work and if the Engineer-in-charge does not agree this rate he shallby notice in writing be at liberty to cancel his order to carry out such class of work And arrange to carryit out in such manner as he may consider advisable provided always that if the contractor’s shallcommence work or incur any expenditure in regard there to before the rates shall have been determinedlastly herein before mentioned, than and in such case he shall be entitled to be paid in respect of thework carried out or expenditure incurred by him prior to the date of determination of the rates asaforesaid according to such rate or rates as shall be fixed by the Engineer-in-charge in the event of adispute the decision of Superintending Engineer of the circle shall be final. Clause 13 – If at any time after the commencement of the work the Government shall for any reasonwhatsoever not require the whole work there of as specified in the tender to be carried out, the Engineer-in-Charge shall give notice in writing of the fact to the contractor who hall have no claim to have anypayment or compensation whatsoever on account of any profit or advantage, which he might havederived from the execution of the work in full, that which he did not derive in consequence of the fullamount of the work not having been carried out neither shall he have any claim for compensation byreason or any alterations having been made in the original specification drawings, designs andinstructions which shall involve any curtailment of the work as originally contemplated.Clause 14 – If it shall appear to the Engineer-in-charge or his subordinate in-charge of the work that anywork has been executed with unsounded, imperfect or unskillful workmanship or with materials of anyinterior description or that any materials or articles provided by him for the execution of the work areunsound or of a quality interior to that contracted for or otherwise not in accordance with the contract thecontractor shall on demand in writing from the Engineer-in-charge specifying the work materials ofarticles complained of not with standing that the same may have been inadvertently passed certified andpaid for forth with rectify, or remove and reconstruct the work so specified in whole or in part as thecase may require or as the case may be remove the materials or articles so specified and provide otherproper and suitable materials or articles at his own proper charge and cost and in the event of his failingto do so within a period to be specified by the Engineer-in-Charge in his demand aforesaid theContractor shall be liable to pay compensation at the rate of one percent on the amount of the estimatedcost of the work covered by this contract for everyday not exceeding ten days while his failure to do soshall continue and in the case of any such failure the Engineer-in-charge may certify or remove and re-execute the work or remove and replace with other the materials or articles complained of as the casemay be at the risk and expense in all respects of the contractor.

Clause 15 - All work under or in course of execution or executed in pursuance of the contract shall at alltimes be open to the inspection and supervision of the Engineer-in-Charge and his subordinates and thecontractor shall at all times, during the usual working hours and at all others times at which reasonablenotice of the intention of the Engineer-in- Charge or his subordinate to visit the work shall have beengiven to the contractor either himself be present to receive orders and instructions or have a responsibleagent duly accredited in writing present for that purpose. Orders given to the contractor’s agent shall beconsidered to have the same force as if they had been given to the contractor himself.Clause 16 - The contractor shall give not less then five days notice in writing to the Engineer-in-chargeor his subordinate in-charge of the work before covering up or otherwise placing beyond the reach of themeasurement any work order that the same may be measured and correct dimensions thereof be takenbefore the same is so covered up placed beyond the reach of measurement and shall not cover up or placebeyond the reach of measurement and work without the consent in writing of the Engineer-in-Charge orhis subordinate-in-charge of the work if any work shall be covered up or placed beyond the reach ofmeasurement without such notice having been given or consent obtained the same shall be uncovered atthe contractor’s expenses or in default there of no payment or allowances shall be made for such work thematerials with which the same was executed.Clause 17 - If the contractor or work people or his servants shall break, deface injure or destroy any partof building in which they may be working to any building, road, fence, enclosure of grass and arecultivated ground continuers to premises on which the work, or any part or it is being executed or if anydamage shall happen to the work while in progress from any cause what ever any imperfections becomeapparent in it within three months after a certificate final or other of its completion shall have been givenby the Engineer-in-Charge as aforesaid, the contractor shall make the same good at his own expense, orin default, the Engineer-in-Charge may cause the same to be made good by other workman and deductthe expense of which the certificate of the Engineer-in-charge shall be final from any sums that may bethan or at any time thereafter may become due to the contractor or from his security deposit or theproceeds of sale thereof or of a sufficient portion thereof.

Clause 18 - The contractor shall supply at his own cost all material (except such special materials, if any asmay in accordance with the contract be supplied from the Engineer-in- Charge’s stores) plant, tools,appliances implements, ladders, cordage, tackle, scaffolding and temporary works requisite or Proper for theproper execution of the work, whether original altered or substituted and whether included in theSpecification or other documents forming part of the contract referred to in these conditions or not or whichmay be necessary for the purpose of satisfying or complying with requirements of the Engineer-in-charge asto any matter as to which under these conditions he is entitled to be satisfied or which he is entitled to requiretogether with carriage therefore to and from the work. The contractor shall also supply without charge therequisite number of persons with the means and materials is necessary for the purpose of setting out work andcounting, weighing and assigning in the measurement of examination at any time and from time to time of thework of materials. Failing his so doing the same may be provided by the Engineer-in-charge at expenses ofthe contractor and the expenses may be deducted from any money due to the contractor under the or from hissecurity deposit or the proceeds of sale thereof or of sufficient contract portion thereof.

The contractor shall also provide all necessary fencing and lights, required to protect thepublic from accident and shall be bound to bear the expenses of defense of every Suit, action or other proceedings at law that may be brought by any person for injury, sustained owing toneglect of the above precaution and to pay any damage and costs which may be awarded in any such suit,action or proceedings to any such persons or which may with the consent of the contractor be paid tocompromise any claim by any such person.

ARBITRATION CLAUSE

CONTRACTOR WITNESS EXECUTIVE ENGINEER

Clause 18(a) – The final bill of the contractor shall not be paid unless or until he furnishes to the satisfaction of theEngineer-in-Charge a proof of the price of the earth used for the works having been fully paid to the owners of theland from which the earth was removed or of the matter having been amicably settled with them. The contractorshall also be liable to indemnity the Government against all claims made proceedings and actions taken by anyperson in respect of the price of the earth removed by the contractor from his land for the work against all lossesdamages cost and expenses which the Government may suffer or incur as a result of such claims.Clause 19(a) – No labour below the age of 12 years shall be employed on the work. Clause 19(b) - The contractorshall pay his labourers not less then the wages paid for similar work in the neighborhood.Clause 19 (c) - Only refugee labour will be employed by the contractor. All the labourers who are employed by thecontractor must be registered with the Employment Exchange.Clause 20 - No work shall be done on Sunday without the sanction in writing of the Engineer-in-charge.

Clause 20(a) – In every case in which by virtue of the provisions of Section 12 sub-section (1) of theworkman’s Compensation Act, 1923 Government is obliged to pay compensation to a Workmanemployed by the contractor, in execution of the works, Government will recover from the contractorthe amount of the compensation to paid and without the prejudice to the rights of Government underSection 12 sub-section(2) of the Act, Government shall be at liberty to recover such amount or anypart there of by deducting it from the security deposit or from any sum due by Government to thecontractor whether under this contract or otherwise. Government shall not be bound to contest anyclaim made against it under section 12 sub-section(1) of the said Act, except on the written request ofthe contractor and upon his giving to Government full security for all costs for which Governmentmight become liable in consequence of contesting such claim.

Clause 21 - The contract shall not be assigned or sublet without the written approval of theEngineer-in-charge. And if the contractor shall assign or sublet his contract or attempt to do orbecome insolvent or commence any in solvency proceedings or make any composition with hiscreditors or attempt to do or if any bribe, gratuity, gift loan, requisite reward of advantage,pecuniary or otherwise shall either directly or indirectly be given promised or offered by thecontractor or any part of his servants or agents to any public officer or person in the employ ofgovernment in any way relating to his office or employment or if any such officer or person shallbecome in any way directly or indirectly interested in the contract the Engineer-in-Charge maythereupon by notice in writing rescined the contract and the security deposit of the contractor shallthereupon stand forfeited and be absolutely at the disposal of Govt. and the same consequencesshall ensure as if the contract had been rescinded under clause 3 here of and in addition thecontractor shall not be entitled to recover or be paid for any work therefore actually performedunder the contract.

Disputes Clause 25 A – (1) If any dispute or difference of any kind whatsoever shall arise between the Governor of Haryana/his

authorised agents and the contractor in connection with or arising out of the contract of theexecution of the work that is (I) Whether before its commencement or during the progress of thework or after its completion (ii) and whether before or after the termination/abandonment/breachof the contract, it shall in the first instance be referred to for being settled by the ExecutiveEngineer-in-charge of the work at the time.

Clause 25 A (2) The Executive Engineer shall within a period of sixty days after being requested in writing by thecontractor to do so convey his decision to the contractor and subject to arbitration as hereinafterprovided such decision in respect of every matter so referred shall be final and binding upon thecontractor in case the work is already in progress, the contractor will proceed with the executionof the work on receipt of the decisionby the Executive Engineer-in-charge as aforesaid with alldue diligence whether he or the Governor of Haryana/his authorised agent requires arbitration ashereinafter provided or not.

Clause 25 A (3) If the Executive Engineer-in-charge of the work has conveyed his decision to the contractor and noclaim to arbitration has been filled with him by the contractor within a period of sixty days fromthe receipt of letter communicating the decision the said decision shall be final and binding uponthe contractor and will not be a subject matter of arbitration at all.

Clause 25 A (4) If the Executive Engineer-in-charge of the work fails to convey his decision within a period of sixtydays after being requested as aforesaid the contractor may within further sixty days, of the expiryof first sixty days from the date on which request has been made to the Executive Engineer-in-charge request the Engineer-in-chief, that the matter in dispute be referred to arbitration ashereinafter provided.

Clause 25 A (5) the Appointment of the arbitrating the disputes/differences so referred to arbitration shall be madeonly by the Engineer-in-Chief, Haryana PWD (B&R) after the Contractor furnishes to thesatisfaction of the Executive Engineer in-charge of the work, a security of a sum determinedaccording to detail given below: -

Clause 25 (6) This security shall on the termination of the proceedings be adjusted against the cost if any, awarded bythe arbitrator against the claimant party and the balance remaining after such adjustment in the absence of any suchcost being awarded the whole the whole of the sum will be refunded to him within one month from the date of theaward.Clause 25 (7) Only graduate engineers shall be eligible for appointment as arbitrator.Clause 25 (8) There shall be no objection to appointment of any serving officer of the Government as arbitrator on the

plea that he had expressed his views on all or any of the matters in dispute. In case, arbitrator isappointed by designation, the arbitrator to whom the matter is originally referred being transferredor vacating his office his successor in office as such shall be entitled to proceed with the stage atwhich it was left by his predecessor.

Clause 25 (9) In case the arbitrator nominated by the Engineer-in-Chief is unable or unwilling to act as such for anyreason what so ever the Engineer-in-Chief shall be competent to appoint and nominate any otherarbitrator in his place and the Arbitrator so appointed shall be entitled to proceed with thereference.

Clause 25 (10) In all cases, the arbitrator shall give reasons for his award in respect of each claim and counter claimand counter claim separately and that any lump sum award shall not be enforceable.

Clause 25 (11) The following matters shall not be within the purview of arbitration: -a) Any dispute relating to the levy of compensation as liquidated damages which has already been referred

to the Superintending Engineer and is being heard or/and has been finally decided by the SuperintendingEngineer in-charge of the work

Clause 22 - All sums payable by way of compensation under any of these conditions shall beconsidered as reasonable compensation to be applied to the use of Government without reference to theactual loss or damage sustained, and whether or not any damages shall have been sustained.

c) Any dispute regarding the scope of the work or its execution or suspension or abandonment that has beenreferred by the contractor for the decision of the Government of Haryana and has been so decided finallyby the Haryana Government.

Clause 25 (12) The contractor shall not be entitled to bring a dispute/difference for decision of the Executive Engineerin-charge under clause 25 (2): -

a) After 6 months of the date of completion of work, orb) After 6 months of the date of abandonment of the work, orc) After 6 months of dispatch through a registered letter of an intimation from the Executive Engineer in-charge

of the work that final payment due to or recovery from the contractor had been determined which he mayacknowledge and/or receive.

Clause 25 (13) If the matter is not referred to arbitration within the period prescribed above all the rights and claims ofthe contractor under the contract shall be deemed to have been walved.

Clause 25 (14) It is also a term of this arbitration agreement that no question relating to this contract shall be broughtbefore any civil court without first involving and completing the procedure above.

Clause 25 (15) The pendency of arbitration proceedings shall not disentitle the Government to make alternativearrangements for completion of the work.

Clause 26 - The contractor shall obtain from the stores of the Engineer-in-charge all storesand articles of European or American manufacture which may be required thereof or inconnection there with unless he has obtained permission in writing from the Engineer-in-charge to obtain such stores and articles else where. The value of such stores and articles asmay be supplied to the contractor by the Engineer-in-charge will be debited to thecontractor in his account at the rates shown in the schedule attached to the contract and ifthey are not entered in the schedule they will be debated at cost price which for the purposeof this contract shall include the cost of carriage and all other expenses whatsoever whichshall have been incurred in obtaining delivery of the same at the stores aforesaid.Clause 26 - (a) Any fluctuations in Railway rates which may occur during subsistance ofand affecting freights of any material to be supplied under this contract shall be brought tothe notice of the Engineer-in-charge by the contractor within fifteen days from such datewithout prejudice to the rights of Government should the contractor fail to comply with theabove requirement any excess or short charge on account of such increase or decrease shallcredited to or recovered from the contractor. No alteration in contract rates shall beadmissible in consequence of fluctuation in railway freight when such railway freight is onaccount of material which is required by a contractor in the manufacture of an article to besupplied under this contract e.g. fluctuation of railway freight on coal enquired for burningbricks will not be taken into consideration or for an articles which from part of a finishedwork or purpose of this clause. Similarly no alteration in rates will be allowed when amanufactured article is transported by rail from place A to place B to from part of a finishedwork.Clause 27 - When the estimate on which a tender is made includes lump sum in respect ofparts of the work the contractor shall be entitled to payment in respect of the items of workinvolved or the part of the work in question at the same rates as are payable under thiscontract for such items or if the part of the work in question is not in the opinion of theEngineer-in-Charge capable of measurement the Engineer-in-Charge may at his discretionpay the lump sum amount entered in the estimate and the certificate in writing of theEngineer-in-Charge shall be final and conclusive against the contractor with regard to anysum or sums payable to him under the provisions of this clause.Clause 28 - In the case of any clause of work for which there is no such specification as ismentioned in rule 1 such work shall be carried out in accordance with the districtspecifications and in the event of three being no district specification than in such case thework shall be carried out in all respects in accordance with the instructions andrequirements of the Engineer-in-Charge.Clause 29 - The expression ‘works’ or where used in these conditions shall unless there besomething either in the subject or context repugnent to such constructions be constructedand taken to mean the work by or by virtue of the contract contracted to be executedwhether temporary or permanent and whether original altered substituted or additional………………………….

BROAD SPECIFICATION OF VARIOUS MATERIAL ISSUED BY THE DEPARTMENTAND TO BE USED BY THE CONTRACTOR/BIDDER

1. C.T.D. (RIBBED/TOR STEEL) BARS:

The steel to be used for the work shall be T.M.T. steel as per I.S.1786, Fe.415/500 instead

of cold twisted Deformed (Ribbed/Tor steel) as stated in the DNIT and the same will be issued by the

Department from PWD Main Store at Rohtak at the rate mentioned in Chapter No.6 and Page 15.

2. Cement: -. I.S.I. marked 43 grade ordinary Portland cements as per I.S. 8112(latest) packed in

conventional Jute/HDPE bags of 50 kg. each from the reputed firm from Birla, Ambuja and J.K. and the

same will be issued by the Department from PWD Main Store at Rohtak at the rate mentioned in Chapter

No.6 and Page 27.

3. DOORS AND WINDOWS FITTING SUCH AS TOWER BOLTS, HANDELS, SLIDING BOLT,

HASP STAPLE ETC.

All doors and window fittings are to be of classic or equivalant make confirming to I.S.

specifications. These shall be of iron or aluminum as required will be issued by the Department.

4. DISTEMPER:

The Distemper shall confirm to I.S.427-1965 and subject to approval of Engineer-in-

Charge.

5. Fine and course aggregates shall consist of normally accruing crust encrust material whichapart grading requirement simply with IS 383. The aggregate should be of Tosham/Khanak Quarryonly. The silt content in all type of fine aggregate should not more than 4%.

6. In case factory manufactured items, the contractor will get the name of approved manufacturers and a

warranty certificate (5 years) in the name of department shall also be given by the manufacturer. The flush

door will be from renowned manufacturer such as Ujala/Jawala or equilant as approved by the Engineer in

charge.

7. All material which will be brought to the site either should be got tested at site or a test certificate from

the manufacturing will be produced by the contractor. In case department is not satisfied with certificate

produced by the contractor than the material will be sent to a reputed laboratory for testing as desired by

the Engineer-in-Charge and charges of which will be borne by the department and if the result of the

laboratory viz-a-viz to test certificate. And if it is not viz-a-viz to the certificate produced by the

manufacture/contractor and facilities of testing should be available in his manufacturing unit where testing

can be conducted in presence of represented of Engineer-in-Charge.

If the samples of finished items fail beyond the frequency acceptable as perrepresentatives and will be either tested in their presence or through testing lab of highrepute i.e. SHRIRAM INSTITUTE FOR INDUSTRIAL RESEARCH, IIT DELHI or IITRoorkee etc.

In case sample is not found up to the specification than the testing expenditure will be

borne by the agency and material is to be replaced.

If test certificate is not produced by the contractor/manufacturer the same will be got

tested at the frequency as in I.S. code/laboratory manual and entire expenditure will be borne by the

agency. Necessary testing charges will be recovered from the agency.

CONDITION OF EARTH WORK

1 The measurement of earth will be made on the basis of cross sections. The cross sections of the existing ground level will be recoded at an interval of not exceeding 15 Meter and

to be accepted by the Society/ Contractor before the start of the work. The levels so recorded shall be considered final and building on the Contractor/ Society.

2 Contractor will set-up his own lab. Or got the sample tested as required in MORTH specification. All necessary field testing such as D.B.D. will be checked at site to ensure the

required compaction as per specification.

3 The earth will be executed and proceeded to in such manner that no hindrance/ inconvience of any kind is caused to the traffic. The executed earth work would be maintained by

the contractor/ society till the completion of total work to the satisfaction Engineer-In-Charge. No charges or compensation of any kind will be payable in this account to the

contractor/ society. The damaged if any caused during the running traffic or through any other reason what’s over may be, will be set right by the contractor/ society at his own

cost and nothing extra will be payable on this account to the contractor/ society. The Engineer-In-Charge will be entitled to get the need ful done at risk and cost of contractor/

society without giving any notice in case the contractor/ society fails to observe his obligations stated here.

4 The recovery will be made from the contractor/ society @ Rs. 35/- (Rs. Thirty five only) per hundred cum plus approved ceiling premium of the prevailing market rate at the

time of execution which ever is more in case the contractor/ society does not pay the compensation of earth to the owner of the land from where the earth has been taken by him.

The production and submission of receipt of owner of land in taken of acknowledgement the receipt of the compensation amount dully verified by the Sarpanch , Patwari and

Tehsildar to the satisfaction of Engineer-In-Charge would only dissolve the said deduction of compensation amount from the contractor/ society.

ADDITTIONAL CONDITION (E.I. WORK)

1) The recovery of pipe already laid will be made on measurement rate basis or point rate

basis or on actual expenditure basis which ever is on high side. In case of departmental

work 10% supervision charge shall be added.

2) Conduit pipe where already laid for wiring purposes will be delivered to the contractor in

absolutely clean condition with round inspection boxes duly painted covered and whole

system tested. After the conduit system is handed over to the contractor to whom the

work is allotted, he will be responsible for its up keep.

3) During execution of work, if the contractor does not lay pipe and its accessories in the

slab within time prescribed by the Engineer-in- Charge of the work, the Department can

then lay the said pipe departmentally at contractors risk and cost without operating the

clause 2 & 3 of the contract agreement.

4) The rate of bus bars includes the cost of all materials and Labour required to complete the

job in all respect including thimble etc. of the same materials as that of bars. The support

for bars will be made of best porcelain. No extra payment in this regard will be given.

5) MCBs & enclours etc. will be installed of one make only.

6) The rates mentioned in the NIT are for complete Items including cost of all accessories,

material, Labour, tool’s plants, water electricity bill etc. Un less otherwise specified. No

extra payment for the same shall be made.

7) The contractor shall provide suitable measuring arrangement at site for checking and

measuring of various items.

8) The Tender’er must either he himself be holder of license “A” Class Electrical contractor

granted under rule 45 of the Indian Electricity rules 1956 by Chief Electrical Inspector

Haryana, is enlisted with electrical wing of the Department in appropriate category and is

specialist for doing these type of works, or he must subject the electrical work to a sub

contractor possessing the above qualifications. The sub contractor will be done with the

written approval of the Executive Engineer, Electrical Division PWD B&R branch

Rohtak.

9) The contractor will install the material from the list of material appended in the N.I.T.

10)The contractor must employ the following staff while carrying out works: -

11) The electrical parts of the bill of quantity of the agreement will be got executed under the

supervision of Executive Engineer, Electrical Division PWD B&R branch Rohtak and all

the running payments of Electrical works will be recorded and paid by him. However

copy of final bill, will be sent Executive Engineer(Civil) to include in their final bill. The

over all technical supervisions of Electrical work shall be of Superintending Engineer,

Electrical Circle PWD B&R Branch Karnal and any technical instruction given by him

will have to be adhered to strictly by the contractor.

12) Separate conduit pipe for power plug with independent circuit wires for and each power

plug should be laid for which no additional payment will be made. The deference of cost

of wires of higher size than 4 Square mm will be paid extra on measurement basis,

wherever required.

13) Multi plug should be provided in all residential buildings and in case of non residential

building multi plugs should be provided in computer room, Doctor’s room and

Laboratory etc. for which no extra payment will be made.

14) C. Series MCBs will be provided for motor and air conditioner wiring and no extra

payment will be made.

15) Vertical type of MCB distribution boards will be provided where ever required as per

design. Thickness of sheet shall be 1.2 mm and 1.6 mm for SP+L1+7PN enclosures

respectively.

16) The thickness of M.S. sheet of switch boxes should be of 16 gauge for which no extrapayment will be made.

17) The fan boxes should be of 16 gauge and for which no extra payment will be made.

18) The contractor must ensure preparation and submission of pipe diagram, the wiring

diagram; key diagram and cable diagram etc. as required vide PWD specification Chapter

No. 31.6.

19) Only stranded PVC Cable shall be used at site.

20) The rates should be quoted by the tenderer both in the figure and words. In case of any

difference between the two, the lowest of the two shall be considered as final.

21) The minimum size of M.S. control switch board for one fan point and light point shall

not be less then 20cm x 25cm x 10cm.

22) The M.S. box for telephone inter com. bell bush shall be installed of size 100mm x

100mm x 60mm in place of 75mm x 75mm x 60mm.

23) Tender having ambiguous/confusing rates and condition shall be summarily rejected.

24) The quantity/amount of N.I.T. can be increased /decreased.

25) The contractor is allowed to use MCB of 10 K.A. repturing capacity dully I.S.I. marked

for which no extra payment will be made.

26) Where so ever specific makes have been mentioned in the schedule of work, these will

be supersede as mentioned else where.

27) PVC copper conductor cables/ wires and copper lugs ISI marked in place of PVC

aluminium conductor cable and aluminium lugs will be used. The contractor should quote

the rates accordingly and no extra payment on this account will be made.

28)Double door NCB enclosures with hinged cover and loose wire box shall be installed in

place of single door enclosure for which no extra payment will be made.

29) The contractor shall install two Nos. check nuts and one No. PVC threaded bush for each

pipe in M.S. inspection boxes. The contractor shall also install PVC flange bush in the

junction boxes for each pipe. No extra payment on this account will be made. The

Contractor shall quoted the rates accordingly.

30) Only white bakelite sheet will be installed and no extra payment in account will be made.

31)All the street light fittings, bulbs and cables will be got inspected by the contractor at the

works / Go down of the manufacturer before installation at site. A certificate will also be

EXPLANATORY NOTES

1. The above rates are for complete work including cost of all materials, labour, tools and

plants and water etc. unless or otherwise specified.

2. All other items covered by the Haryana P.W.D. Schedule of rates 1988 2nd edition

corrected upto date and got carried out, if any, will be paid for as per Haryana P.W.D.

Schedule of rates 1988 2nd edition, corrected upto date subject to the accepted tendered

Premium/abatement given by the contractor for similar items of relevant chapters.

3. All clauses and notes given in the Haryana P.W.D. Schedule of rates 1988, 2nd edition, with

upto date correction slips shall be applicable to all above items wherever necessary.

4. The description, rates, units etc. of above schedule shall be corrected as per Haryana

P.W.D. Schedule of rate 1988 2nd edition, in case of any error or omission.

5. Chapter numbers with items referred to above are of Haryana P.W.D. Schedule of rates

1988 2nd edition, corrected upto date.

5.(a) Glazed Tiles:- The glazed tiles shall be of reputed firm for example :- Kajaria,

Somany/ Orient and Johnson ect.

5.(b) Granite Polish will be done by the agency wherever required

and nothing extra shall be paid for the same.

6. The whole work shall be carried out strictly in accordance with the Haryana P.W.D.

specifications book 1990, Ist eddition, as applicable to Haryana State with upto date

correction slips.

7. No premium shall be payable on the items which are not provided in the Haryana P.W.D.

Schedule of rates 1988 2nd edition corrected upto date.

8. Samples of all building materials, doors and windows, fittings and other articles required

for use on the work shall be got approved from the Engineer-in-Charge, Articles

manufactured by firms of repute, approved by the Engineer-in-Charge shall only be used.

Only articles classified as First quality by the manufactures shall be used. Articles which

are not First quality’ shall be rejected by the Engineer-in-charge. Preference shall be given

to those articles which bear I.S.I. certification mark. In case articles bearing I.S.I.

certification mark are not available, the quality of samples brought by the contractor shall

be judged by the standards laid down in the relevant I.S.I. specifications. All materials and

articles brought by the contractor to the site of work for use shall confirm to the samples

approved, which shall be preserved till the completion of work. Final decision to reject

any material shall rest with the Engineer-in-charge. The contractor shall provide suitable

measuring arrangements at site for checking of various articles brought by him to ensure

mixing in specified proportions.

If the samples of finished items fail beyond the frequency acceptable as per representatives

and will be either tested in their presence or through testing lab of high repute i.e

SHRIRAM INSTITUTE FOR INDUSTRIAL RRESEARCH, IIT DELHI OR IIT Roorkee

etc. testing expenditure will be born by the agency.

9. The contractor shall provide such recesses, holes, openings etc. as directed by Engineer-

in-charge as required for the Electrical/Sanitary work and nothing shall be payable on this

account.

10 Thickness of R.C.C. shall be measured and paid for as per structural sizes designed.

11. Steel used in supports, spacers and for hooks and overlaps which are not approved i.e. which

are not provided according to the drawing or the instructions of Engineer-in-Charge shall not be

measured for payment.

12 Wherever there is a provision for flush doors, only doors as bear the I.S.I. certification marks and

arranged from manufactures of good repute shall be accepted. In case flush doors bearing I.S.I.

certification marks are not available in the market, flush doors confirming to I.S.I. specifications

and arranged from manufactures of good repute shall only be accepted and name of manufacturer

to be got approved from the department along with 5 years warranty to be given by manufacturer

in favour of department. In case agency fails to do so, than 50% rate of HSR-1988 for the same

shall be paid to the agency.

14 Steel butt hinges shall strictly confirm to Indian Standard specification, IS-1341-1970 (Latest

edition) and dimensions given in table 2 for medium weight cold rolled mild steel butt hinges of

the above specifications Hinges shall be of good workmanship and manufactured by the firm of

good repute.

15 Analysis of rates for non-schedule/non agreement items i.e. items which are not provided in the

Notice Inviting Tender/Haryana P.W.D. Schedule of Rates, 1988 2nd edition corrected upto date

shall be payable as per actual lowest market rates from the recognised public market suitable to

the executing division and wages of labour as applicable at the time of execution of work, plus

admissible contractor’s profit and over head charges. For such items of materials, the contractor

shall be required to produce original vouchers which shall be subjected to verification by the

Engineer-in-charge, if deemed necessary. The rates for non-Schedule items shall be approved by

the competent authority as recognised in the departmental financial rules in existence at the time

of approval.

16 Tender with the condition regarding steel work to be done at labour rates shall be considered

invalid and rejected straightway.

17 First Quality glazed tile of reputed manufactures Kazaria, Zonsan, Samani Orient will only be

used after pvior approval from the Engineer-in-Charge.

18 The quantities of all items given in the Schedule are tentative. These can be increased or

decreased as per working Architectural drawings/structurals drawings.

19 For quality control, the contractor shall be required to use cement concrete mix giving a minimum

cube strength as may be prescribed in the relevant structural drawings of work. For cement

concrete and cement mortar work and other items the test should be regularly carried out as per

procedure laid down in relevant I.S.I. & other codes at the expense of the contractor. The rates

provided in the H.S.R. 1988 2nd edition included the cost of such testing.If the contractual agency

fails to bring any of the quality control Lab. equipment at the site of work, the item will be

arranged by the Department and recovery shall be made from the contractor’s bill @ double the

cost of that item.

20 Irrespective of what is stated in para 6 of General Rules of Haryana P.W.D. schedule of rates,

1988 2nd edition no carriage of cement, steel and bricks or any other type or material shall be

admissible irrespective of any lead involved as per entire carriage included in the rates.

21. All the flooring like terrazzo, Kotah stone or marble flooring should be granite finished. No extra

rate shall be paid on this account to the contractor

22. In case the glazed tiles of size other then exhibited in the DNIT are got fixed, the rate for the same

shall be paid as per HSR 1988 2nd edition 14.48 (a) (i) and no extra rate shall be paid for the same.

22(a) Marble will be arranged by the Department & supplied to the agency for use.

23. 4% Sales Tax, 2% Income Tax, 10% surcharge and Labour Cess/ Service Tax as applicable will be

deducted from the Bills of the Agency on the gross Amount of the bill payable to the contractor.

24. Where-ever brick work or earth filling/embankment work is to be executed, the same has to be

executed in accordance with the provision in the Fly Ash Notification dated 4.9.99 & 27.8.2003

i.e. by using Fly Ash brick and filling/embankment constn. by Pond Ash/Fly Ash as specified in

the aforesaid notification after getting the design approved from Engineer-in-Charge.

25. Only I.S.I. marked factory manufactured flush door shutter ply and block board should be used,

where ever required.

26. In case factory manufactured paneled and glazed door and window shutter and wire gauge door

and window shutter, the contractor will get the name of manufacturers approved from department

and a warranty of 5 years certificate in favour of engineer in charge. In case of door shutters the

type of wood used shall also be given by the manufacturer the agency shall produced a certificate

that door and window shutters fixed at site are actually factory manufactured , In case agency

fails to do so, the rate for the same shall be paid for site manufactured shutters as per item

no.17.30and 17.31 of HSR 1988 second edition.

27. Fine and course aggregates shall consist of normally accruing crust encrust material which apart

grading requirement simply with IS 383. The aggregate should be of Tosham/Khanak Quarry only.

The silt content in all type of fine aggregate should not more than 4%.

28. The Contractor will submit the design of temporary structure scofolding to department in advance

without any cost.

29. Contractor will provide a well equipped site laboratory along with trained staff for day to day

testing of material.

30. The Contractor will employ on the work well qualified Engineers such as Degree Holder and

Diploma Holder.In case of non-employment of qualified engineer, deduction will be made from

the bills /due payment of the contractor on account of salary per month at the rate of Rs.60000/-

for Degree Holder & Rs.40000/- for Diploma Holder.

31. Water should be got tested at regular interval i.e. maximum of Three Months from the Laboratory

approved by Engineer no extra cost will be paid.

32. (i) All the taxes, local taxes, fees and cess etc. as applicable from time to time

will be born by the contractor.

(ii) Labour cess and service tax as applicable from time to time shall be deducted from the

each bill of the agency / contractor, as per instructions issued by Head office memo

No.4184-4265/Genl. Dt. 22-05-07

(iii) The contractor will quote rate both in figures and words and will put transparent tape on the

quoted rates

33. If the agency does not fill / quote the rate of any items then it will be considered as nil and same

will be executed by the agency free of cost and it will be contingent to work. The agency will

have to give an undertaking on account of above otherwise earnest money will be forfeited in

addition Engineer-in-Charge may also black list the agency.

34. The material of TATA/SAIL Marka shall be used in the structure.

Chapter No.8

SCHEDULE OF ADDITIONAL CONDITIONS

1. Upon completion and before offering the work for acceptance, the contractor shall remove all false work,excavated and useless materials, rubbish, temporary building constructed by him and shall leave the site andadjacent area in a neat and clean condition to the entire satisfaction of the Engineer-in-charge.

2. The Executive Engineer, reserves the option to take away any item of work or any part there of at any time duringthe currency of the contract and reallot it to any other agency with due notice to the contractor without liability of anykind or payment of any compensation.

3. The contractor has to make his own arrangements for water, bricks, wood and every item required directly orindirectly for completion of work, except those mentioned in the material statement of this NIT Page 18 (see pageopposite).

4. No claim shall be entertained on account of increase in price of labour and material due to any cause whatsoever.5. 10% (Ten percent) security shall be deducted from running bills subject to a maximum of 5% of the agreement

amount and shall be refunded 50% after 3 months from the date of Completion of work to the satisfaction of Engineer-in-charge & further 25% after 6 months from the date of completion & balance after 13 months from the date ofcompletion. However security deposit can be released against unconditional Bank Guarantee in favour of departmentvalid for 60 days more stipulated period or a desired by Engineer–in-Charge.

6. In case of emergency the contractor shall be required to pay his labour every day and if this is not doneGovernment will make the requisite payment and recover the same from the contractor.

7. Actual quantities of completed and accepted work shall only be paid.8. No pits shall be dug by the contractor near the site of work or within road land/Govt. land for taking out earth for

use on the works. In case of default the pits so dug will be filled in by the department at the cost of the contractor plusfourteen percent departmental charges.

9. The rates to be quoted by the contractor shall be inclusive of octroi terminal tax, royalty and all other taxes andcharges. These are for complete work in all respects.

10. The contractor shall not be entitled for any payment on account of work done till he signs his agreement.11. Nothing extra shall be paid for any lead and if unless otherwise specified for any material required directly or

indirectly and the rates to be given in the tender should include all leads in the contract schedule.12. The contractor shall be responsible for any and all losses of material, damage done to unfinished work as a result of

floods and other acts of God. The Govt. will not be responsible for any compensation as a result or such damage orloss to the contractor and the contractor shall be liable to set right such damage at his own cost to the satisfaction ofthe Engineer-in-charge.

13. The royalty, sales tax and other taxes, if any shall be paid by the contractor direct to the respective department inaccordance with their rules and regulations in force from time to time without intervention of the public worksdepartment.

14. Amount of work may be increased or decreased and any item committed and substituted in accordance with therequirement of the department and no claim on this amount shall be entertained.

15. Contractor shall be responsible to provide to the entire satisfaction of the Engineer-in-Charge at his own expensesthe following amenities for the labour employed by him.

(i) Suitable temporary hutting accommodation.(ii) Trench latrines bathing enclosures platforms separately for men and women and their regular cleanliness.(iii) Clean drinking water.

In the event of his failure to provide any or al of the amenities the same shall be provided by the Govt. and costthereof shall be recovered from the contractor. Any dispute regarding above points shall be settled by theEngineer-in-charge and his decision shall be final.

16. The contractor shall be responsible for hosing, sanitation and medical treatment of labourers employed by him andshall abide by all the rules and regulations made by Govt. in this behalf from time to time.

17. For contractor’s labour regulations fair wage clause and rules for protection of health and sanitation arrangements forworkers employed by the public works department or its contractor’s reference be made to chapter 7,8 and 9respectively.

18. (1) The contractor shall be responsible for loss or damages to any material issued to him by the department from anycause whatsoever. In case the material such as cement, steel or any other commodity issued to the contractor by theEngineer-in-charge for use directly on the aforesaid work or in manufacture of material required in connection therewith is not utilized for the purpose for which it is issued and is otherwise disposed of by him or spoiled or lost orallowed to get detericrated or used in excess of the quantity actually required to be used as per specification hereinstipulated of those fixed by the Engineer-in-charge, the cost of such quantity of that materials shall without prejudiceto other rights and remedies available to Govt. be recoverable from the contractor at double the rate which it is agreedto be supplied to the contractor.

(2) The recovery from contractor for the material consumed in excess or in short of the originalrequirements as per specification herein stipulated or otherwise fixed by the Engineer-in-charge other than thevariation to be regulated by the preceding clause, shall be dealt with as under: -FOR EXCESS CONSUMPTION OF MATERIALS:(i) Upto 5% (five percent). No action is called for.(ii) Above 5% (Five percent) if actual consumption exceeds the oritical consumption by more than 5%

(five percent) recovery shall be made for the excessive consumption of material beyond initial fivepercent at double the rate at which it is agreed to be supplied to the contractor.

B. FOR SHORT CONSUMPTION OF MATERIALS:(i) Upto 5% the recovery of cost of material thus saved shall be made from the contractor at the issue

rates.(ii) Less consumption by more than 5% (i.e. above 5%) the rates of items of work involved shall be

reduced. If it is not possible to determine the exact items on which less material has been used the costof the material shall be recovered from the contractor at the issue rate. The Executive Engineerreserves the right to take any other detrent action which he deems fit against the contractor. It shall beat the discretion of the department to determine whether the stability of the structure is affectedadversely due to less consumption of materials and in case it is felt that is likely to be so the ExecutiveEngineer-in-charge shall reject the work and the decision of Superintending Engineer in such mattershall be final.

19. 4% Sales Tax & 2% Income tax + Surcharge, Labour Cess and Service tax as applicable will be deducted fromthe Bills of the Agency on the gross Amount of any Bill payable to the contractor.

20. The jurisdiction of the Court will be at Rohtak21. Validity of tender is 90 days.22. Should the tenderer modify or withdraw his tender without the written concurrence of the Executive Engineer

within 90 (Ninety) days from the date of tender, he is liable to be blacklisted besides forfeiture of earnest moneyand other penality envisaged in the tender form.

23. No claim of any kind whatsoever shall be entertained for any and all the losses of damages to the contractor dueto the completion of the work getting delayed due to the failure or delay on the part of the public worksdepartment under the terms and conditions of the contract.

24. Apprentice Act- The contractor shall comply with the provisions of the Apprentice Act, 1961 and the rules andorders issued there-under from time to time. If the contractor fails to do so his failure will be breach of thecontract and the Superintending Engineer may at his discretion cancel the contract. The contractor shall also beliable for any peculiary liability arising on account of any violation by him of the provision of the Act.

25. If for the execution of the work, the contractor will engage imported labour, he shall immediately inform thelocal health authorities entrusted with the work of eradication of malaria for their (Labourers) inclusion in thesurve iliance opration and for getting their blood examined from the aforesaid authorities in order to excludemalaria positive.

26. Imported labour means Labour belonging to a state other than Haryana State.

27. All material left at site by the contractor for a period of one month after the completion of work shall becomethe property of the public works department and contractor shall have no claim whatsoever for such material.

28. The contractor shall supply at his own cost and expenses all labour materials etc. for labour and checking of anyportion of the work during construction. Wheresoever required by the Engineer-in-charge for his representativeand nothing extra shall be paid for services.

29. The contractor shall not remove from the site of work without the written permission of the Engineer-in-chargeany material which has been issued to him for use on the work.

30. The contractor shall maintain at site of work full details of specification of the work fixed by the Engineer-in-charge and approved drawing of the work.

31. Nothing extra shall be paid to the contractor for diversion of water in the channels stream if it becomesnecessary for the execution and completion of the work.

32. In case of delay in supply of cement, steel or any other material agreed to be supplied by the department as perdetails in N.I.T. or failure to supply the required quantity in time for execution of work, the contractor shall notbe paid any compensation from any or resultant effects of losses.

33. The contractor shall employ a duly accredited and experience Resident Engineer at his agent in charge of theexecution of work instructions given by the Engineer-in-charge or his authorised representative to the agentshall have the same force as instructions given to the contractor.

34. The contractor will not have any claim in case of delay by the Department for removal of tree or shifting,raising, removing of telegraph, telephone or electric lines (Over head of under ground) and other structure, ifany, which comes in the way of the work.

35. Relation with Public Authorities: The contractor shall comply with all legal orders and directions given from time to time by any local or publicauthorities and shall pay out of his own money the fees or charges to which he may be liable.

36. Occupation of Additional Lands:In case, when it becomes necessary for due fulfilment of the contract for the contractor to occupy land outsidethe P.W.D. limits the contractor shall make his own arrangement with the land owners and pay such amount, asmay be mutually agreed upon by them.

37. No claim by the contractor for additional payment will be allowed on the ground of any misunderstanding ormisapprehension in respect of any such matter or otherwise on the ground of any allegation or fact that incorrectinformation was given to him by any person whether in the employ of the Govt. or not or of the failure on hispart to obtain correct information nor shall the contractor be relieved from any risk or obligations imposed on orundertaken by him under the contract on any such ground or on the ground that he did not or could not fore-seeany matter which may in fact, effect or have affected the execution of the work.

38. (1) During the absence on work of the Engineer-in-charge he shall be represented by one of the subordinatewhose duties are to watch and supervise the works, to test and examine any materials to be used orworkmanship employed to ensure that the works are performed in conformity with the plans, estimates andspecifications in all respects and to keep Engineer-in-charge informed of the progress of the works and themanner in which they are done. The Engineer-in-charge may from time to time delegate any of the powers andauthorities vested in him to the departmental representative in writing.

38. (2) The Departmental representative shall have no authority to after or waive the provisions of plans andestimates and specifications or to relieve the contractor or any of his duties or obligations under the contract.He shall however, have the authority to inform the contractor in writing to replace any materials considereddefective and to suspend, to do or rectify and work improperly performed or not according to plans andestimates or specifications in his judgment and the contractor shall comply.

38. (3) Failure of the Departmental Representative to dis-approve any work of materials shall not prejudice thepower of the Engineer-in-charge thereafter to disapprove such work or materials and to order the pulling down,removal or breaking up thereof. If the contractor shall be dissatisfied by reason of any decision of thedepartmental representative, he shall be entitled to refer the matter to the Engineer-in-charge. Who shallthereupon confirm or reverse such a decision.

38. (4) The contractor shall give or provide all necessary, content and whole time superintendence during theexecution of the works and as long there after the Engineer-in-charge may consider necessary by either.

(i) Personally superintending of the work himself. Or (ii) Employing a skilled and qualified Resident Engineer thoroughly experienced in the type of work to be

executed and fully authorised to receive & execute on behalf of the contractor orders, instructions ordirections of the Engineer-in-charge without delay and to, promptly supply such materials, labour,equipments tools and incidentals as may be required.

39. (1) The contractor will be held strictly responsible to the true intent of the specification in regard to quality ofmaterials workmanship and the diligent execution of the contract.

39. (2) All materials and each part of detail of the work shall be subject at all times to inspection by the Engineer-in-charge. Departmental Representative or other authorized subordinate who shall be furnished with reasonablefacilities and assistance by the contractor for ascertaining whether or not the work as performed or the materialsused are in accordance with the requirements and intent of the plans and specifications.

39. (3) The contractor shall furnish written information to the Engineer-in-charge stating the original source ofsupply and dates of manufactures of all materials manufactured away from the actual site of work. Theinformation shall be furnished at least two weeks (or such other period as may be directed by Engineer-in-charge) in advance of the incorporation of any such materials in the works.

39. (4) The contractor shall also inform the Engineer-in-charge in writing when any portion is ready for inspectiongiving him sufficient notice to enable him to inspect the same without retarding the further progress of thework.

39. (5) Any work done or materials used without supervision or inspection by the Engineer-in-charge of theDepartmental Representative is liable to be ordered to be removed and replaced at the contractor’s expenses.

39. (6) If so directed the contractor shall at any time before the acceptance of the work, remove or uncover such portion of the finished work as may be directed. After examination, thecontractor shall restore the said portion of the work to the standards required by the specifications. The work shallnot be considered to have been completed in accordance with the terms of the contract until the Engineer-in-charge shall have certified in writing that it has been completed to his satisfaction. No approval of materials orworkmanship or approval of part of the work during the progress of execution shall bind the Engineer in any wayor effect his power to reject the work when alleged to be completed or to suspend the issue of his certificate ofcompletion until such alterations or modifications or reconstructions have been affected as shall enable him tocertify that the work has been completed to his satisfaction.

39. (7) The inspection of the work or materials shall not relieve the contractor any of his obligation to fulfill theterms of the contract as herein prescribed by the plans and specifications.

39. (8) Failure to reject any defective work or material will not in any way prevent later rejection when such defectis discovered or obligate the department to make final acceptance.

40. (1) Unless otherwise provided in the contract document materials such as rubble, gravel sand, murrum kankarearth, soil, etc. obtained from excavation and materials obtained by dismantling any existing structures shallremain the property of the Government. When deemed fit, the Executive Engineer-in-charge may with the approval of competent authority permit theuse of such materials on the work in substitution of materials which the contractor would have otherwiseprovided, subject to the condition that a suitable deduction shall be made in the rate of the items in which suchmaterials are used.

40. (2) Any trees branches, bushes, crops etc. which may be required to be cut during the execution of the workshall be handed over to the Public Works Department or disposed of as directed.

41. The Bidder shall have following number of Technical and Administrative Employees for the proper executionof the contract.

1. Degree Holder in Civil Engineer or Diploma Holder in Civil Engineering with 10 yearsexperience = 1 No.

2. Lab Assistant = 1 No.

42. The Bidder will produce requisite documents to the satisfaction of Engineer-in-charge that they have alreadyinstalled the requisite machinery required in construction of building work or the bidder will produce therequisite documentary proof along with affidavit to the satisfaction of the Engineer-in-charge for obtaining therequired machinery on leases as required from authorized and established leasing company/agency alreadyengaged in this business.

43. Department shall not be responsible for any depreciation in the value of securities, not for any loss of interestthereon.

44. Convassing in connection with a tender in any form renders the tender liable to rejection.45. In case of any discrepancy between description in a works and figures quoted by a tenderer the description in

works shall prevail.46. If there are varying or conflicting provisions made in any document forming part of the contract the accepting

authority shall be the decision authority with regarded to the intention of the document.47. No reference for arbitration shall be maintainable unless the contractor furnishes a security deposit of a sum

determined according to the table given below and the sum so deposited shall on the termination of the

arbitration proceedings, be adjusted against the cost if any, awarded by the arbitrator against the party and thebalance remaining after such adjustment or in the absence of any such cost being awarded, the whole of the sumshall be refunded to him within one month from the date of the award.

48. Condition of “As Built” Drawings.

“As Built” Drawings would be supplied by the contractor in two sets with in 28 (Twenty Eight) days of issue of

certificate of completion of whole or section of the work as the case may be.

If the contractor does not supply the above drawings by due date the Department/Engineer shall withhold the amount

of Rs.2.00 Lacs from payments due to the contractor and the same shall be got prepared through an independent

agency at the contractors risk and cost.

HARYANA PUBLIC WORKS DEPARTMENT

Contractor’s Labour Regulation

1. Short TitleThese regulations may be called Haryana Public Works Department Contractor’s Labour Regulation.

2. DefinationIn these regulations, unless otherwise expressed or indicated the following words and expression shall have the

meaning hereby assigned to them respectively that is to say:(1) Labour means workers employed by a Public Works Department contractors directly or indirectly through a

sub-contractor or other persons of by an agent on his behalf.(2) Fair wages means, whether for item or place work, notified at the time of inviting tenders for the work and

where such wages have not been so notified the wages prescribed by the Public Works Department for the district inwhich the work is done.

(3) “Wages” shall have the same meaning as defined in the payment of Wages Act 1936 and includes time andplace rate wages.3. Display of notice regarded wages etc.

The contractor shall before he commences his work on contract display and correctly maintain & continue todisplay and correctly in a clean and legible condition in conspicuous places on the work notice in English and in theLocal Language spoken by the majority of the Workers giving the fair wages notified or prescribed by the HaryanaPublic Works Department and the hours of work for which such wages are earned.

4. Payment of Wages(i) Wages due to every worker be paid to him direct.(ii) All wages shall be paid in current coin or currency or in both.

5. Fixation of Wages Periods(i) The contractor shall fix the wage periods in respect of which the wages shall be payable. (ii) No wage period shall exceed one month.(iii) Wages of every workman employed on the contract shall be paid before the expiry of ten days

after the last day of the wage period in respect of which the wages are payable.(iv) When the employment of any worker is terminated by or on behalf of the contractor, the

wages, earned by him shall be paid before the expiry of succeeding the one on which hisemployment is terminated.

(v) All payment of wages shall be made on a working day.6. Wages Book and Wages Slip etc.

(i) The contractor shall maintain a wage book of each worker in such form as may be convenientbut the same shall include the following particulars –

(a) Rate of daily or monthly wages.(b) Name of work on which employed(c) Total Numbers of days worked during each wage period.(d) Total amount payable for the work during each wage period(e) All deductions made from the wages with an indication in each case of the ground for which

the deduction is made.(f) Wages actually paid for each wage period.(ii) The contractor shall also maintain a wage slip for each worker employed on the work.(iii) The authority competent to accept the contract may grant an exemption from the maintenance

of Wages book and Wage slips to a contractor who in his opinion may not directly orindirectly employ more than 100 persons in the work.

7. Fines and deductions which may be made from wages1. The wages of a worker shall be paid to him without any deduction of any kind except the

following :(a) Fines(b) Deductions for absence from duty i.e. from the place or places where by the terms of his

employment he is required to work. The amount of deduction shall be in proportionate to theperson for which he was absent.

(c) Deductions for damage to or loss of goods expressly entrusted to the employed person forcustody or for loss of money for which he is required to account where such damage or loss isdirectly attributable to his neglect or default.

(d) Any other deductions which the PWD may from time to time allow.2. No fine shall be imposed on a worker and no deduction for damage or loss be madefrom his wages until the worker has been given an opportunity of showing cause against such fines ordeductions.3. The total amount of fine which may be imposed in any onewage period on a worker shall not exceed an amount equal to half anna in a rupee of the wage payable tohim in respect of that wage period4. No fine imposed on any worker shall be recoverable from him by installments or after theexpiry of 60 days from the date on which it was imposed.

8. Register of Fine etc.1. The contractor shall maintain a register of fine and of all deductions for damage or losssuch Register shall maintain the reason for which fine was imposed or deduction for damage or losswas made.

2. The contractor shall maintain, a list in English and Local Indian Language clearly definingacts and commissions for which penalty of fine can be imposed. He shall display such list and maintainit in a clean and legible condition in conspicuous places on the work.

9. Preservation of BooksThe wage book, the wage slips and the Register of fines, deductions required to be maintained under these

regulations shall be preserved for 12 months after the date of last entry made in them.10. Power of Labour Welfare Officer to make investigation of Enquiry

The Labour Welfare Officer or any person authorised by the Government on their behalf shall have power tomake enquiries with a view to ascertaining and enforcing due and proper observance of the wage clause and provisionsof three regulations. He shall investigate in to any complaint regarding the default make by the contractor or subcontractor in regard to such provisions.11. Report of Labour Welfare Officer

The Labour Welfare officer or any other person authorised aforesaid shall submit a report of the result of hisinvestigations enquiry to the Executive Engineer concerned indicating the extent, if any, to which the default has beencommitted and the amount of fine recoverable in respect of the acts or commission and omission of the labourer with anote that necessary deduction from contractor’s will be made and the wages and other dues be paid to the labourersconcerned.12. Appeal against the decision of Labour Welfare Officers

Any person aggrieved by the decision and recommendation of the Labour Welfare Officer or other person soauthorised may appeal against decision to the Labour Commissioner but subject to such appeal the decision of theofficer shall be final and binding upon the contractor.12A. No party shall be allowed to be represented by a lawyer during any investigation, enquiry appeal or any otherproceedings under these regulations.13. Inspection of Register

The contractor shall allow inspection of the Wage Book. Wage Slips to any of his workers or to his agent at aconvenient time and place after due notice is received, or to the Labour Welfare Officer or any other person authorisedby the Haryana Government in his behalf.14. Submission of Returns

The contractor shall submit periodical as may be specified from time to time15. Amendment

The Haryana Government may, from time to time and to amend these regulations, the decision of the LabourCommissioner, Haryana Government or any other person authorised by the Haryana Government in that behalf shallbe final.

FAIR WAGE CLAUSES

(a) The contractor shall pay not less than the fair wage to labourers engaged by him on the work.

EXAMINATION: - Fair Wage means wage whether for time of piece work notified from time to time for the

area and where such wages have not been so notified the wages specified by the Public Works Department B&R

Branch Haryana for the district in which the work is done.

(b) The contractor shall not withstanding the provisions of any agreement to the contrary, caused to be

paid fair wages to labours, indirectly engaged on the work including any labour engaged by his sub-contractors in

connection with the said work, as if the labourers had been directly employed by him.

(c) In respect of labour directly or indirectly employed on the works for the performances of the

contractor’s part on this agreement the contractor shall comply with or cause to be complied with the Haryana

PWD Contractor’s Labour’s Regulations made by the Government from time to time in regard to payment of

wages wage period deductions from wages recovery of wages not paid and deductions unauthorisedly made

maintenance of wage register wage book, wage slip, publication of wages and other terms of employment

inspection and submission of periodical returns and all other matters of a like nature.

(d) The Executive Engineer or Sub Divisional Engineer concerned shall have the rights to deduct, from

the moneys due to the contractor, any sum required or estimated to be required for making good the loss suffered

by a worker or workers by reason of non-fulfillment of the conditions of the contract for benefit of the workers,

non payment of wages or deductions made from his or their wages, which are not justified by terms of the contract

for non observance of the regulations referred to in clause (c) above.

(e) Vis-à-vis the Haryana Government, the contractor shall be primarily liable for all payments to be

made under and the observance of the regulations aforesaid without prejudice to his right to claim indemnity from

his sub contractors.

(f) The regulations shall be deemed to be a part of this contract and any branch there shall be deemed to

be a branch of this contract.

CHAPTER – 11

Rules for the Protection of Health and Sanitary Arrangements for Workers Employedby the Haryana Public Works Department or its Contractors

The Contractor shall at his own expense provide or arrange for the provision of foot wear for anylabour doing cement mixing work (the contractor has undertaken to execute under the contract) to the satisfaction ofthe Engineer-in-Charge and on his failure to do so Government shall be entitled to provide the same and recover thecost thereof from contractor.

The contractor shall submit by the 4th and 19th of every month to the Executive Engineer a truestatement showing in respect of the second half of the proceding month and the first half of the current monthrespectively (I) the number of labourers employed by him on the work (ii) their working hours (iii) the wages paid tothem (iv) the accident that occurred during the said forthright showing the circumstances under which they happenedand the extent of damage and injury caused by them and (v) the number of female workers who have been allowedMaternity benefit according to clause 19-F and the amount paid to them failing which the contractor shall be liableto pay to Government a sum not exceeding Rs. 50/- for each default of materially incorrect statement. The decisionof the Executive Engineer shall be final in deducting from any bill due to the contractor the amount levied as fine.

Maternity benefit for female workers employed by the contractor leave and pay during leave shall beregulated as follow –1. LEAVE (I) in case of delivery/maternity leave not exceeding 8 weeks (4 weeks upto and including the day of

delivery and 4 weeks following that day) (ii) in case of miscarriage upto 3 weeks from the date of miscarriage.2. PAY (I) In case of delivery leave pay during maternity leave will be at the rate of the woman’s average daily

earning calculated on the total wages earned on the day when full time work was done during a period of 3months immediately preceding the date of which she gives notice that she excepts to be confined or at the rate ofRs. 12/- per day which ever is greater. (ii) In case of miscarriage, Leave pay at the rate of average daily earning calculated on the total wages earnedon the days when full time work was done during a period of 3 months immediately proceeding the date of suchmiscarriage.(iii) Conditions for the grant of Maternity Leave - No Maternity leave benefit shall be admissible to a womanunless she produces a certificate of confinement and excepted delivery within 4 weeks proceeding the date onshe proceeds on leave.FIRST AID:

(a) At every work place, there shall be maintained in readily accessible place first and appliancesincluding an adequate supply of storlisied dressing and cotton wools. The appliances shall be kept in good orderand in large work places it shall be placed under the charge of a responsible person who shall be readilyavailable during the working hours.

(b) All large work places where hospital facilities are not available within easy distance of the work,first and post shall be established and be run by a trained compounder.

(c) Where large work places are remote from regular hospital an indoor ward shall be provided withone bed for every 250 employees.

(d) Where large work places are situated in cities, towns in their suburbs and no beds are considerednecessary owing to the proximity of city or town hospitals a suitable transport shall be provided to facilitateremoval of urgent cases to these hospitals.

At other work place some conveyance facilities such as car shall be kept readily available to takeinjured or persons suddenly taken seriously ill, to the nearest hospital. Scales of accommodation in LatrinesUrinals: There shall be provided within the precinet of every work places, Latrines and Urinals in an accessibleplace and the accommodation separately for each of them shall not be less than the following scales :-No. of Shades(a) Where the numbers of persons does not exceed 50 2(b)Where the number of persons exceeding 50 but does not exceeds 100 3(c) For every additional 100 3 per 100In particulars cases the Executive Engineer shall have the powers to very the scale where necessary.

Laterines and Urinals for women: If women are employed separate latrines and urinals screened from thesefor men and marked in vernacular in conspicuous letters ‘FOR WOMEN ONLY’ shall be provided on the scale laidin rules. Similarly those for men shall be marked ‘FOR MEN ONLY’ A poster showing the figures of a man andwomen shall also be exhibited at the entrance of latrine for each sex. There shall be adequate supply of water closeto latrines.Latrines and Urinal Except in work places provided with flush latrines concerned with a water borne seweragessystems all latrines shall be provided with receptacles order earth system which shall be in working order and kept instrictly sanitary conditions. The receptacles shall be tarried inside and outside at least once a year.

The inside walls shall be constructed of masonry or some suitable heat resisting non absorbent materialand shall be cement washed inside and outside at least once a year. The dates of cement shall be noted in registermaintained for this purpose and kept available for inspection.Disposal of Excrete: - Unless otherwise arranged for by the local sanitary authority arrangements for properdisposal and a sanitary of excreta by incineration at the work place shall be made by means of a suitable incinerationapproved by the Asstt. Director of Public Health or Municipal Medical Officer of Health, as the case may be, inwhose jurisdiction the work place is situated, alternately excreta may be disposed of by putting a layer of night soilat the bottom of pucca tank prepared for the purpose and covering it with 9 inches layers of earth for a fortnightwhen it will turn into a manure.Creche : At every work place there shall be provided free of cost two suitable sheds one main and the other for theuse of labour. The height of the shelter shall not be less than eleven feet from the floor level to the lowest part of theroof.PROVISION OR SHELTRE DURING REST: At every work place at which 50 or more womenworkers are ordinary employed there shall be provided two huts for use of children under the age of six yearsbelonging to such women. One hut shall be used for infants “Games and to play’ and the other as their bed room.The hut shall not be constructed on a lower standard then the following.

(i) Thatched roofs(ii) Mud floors and walls.

(iii) Plants spread over mud floor and covered with matingThe huts be provided with suitable and sufficient opening for light and ventilations. There shall be adequate

provision of sweepers to keep the place clean. There shall be two day in attendance. Sanitary, utensils shall beprovided to the satisfaction of Health Office of the area concerned. The use of the hut shall be restricted to children,their attendants and mothers of the children.CANTEEN A cooked food canteen on a moderate scale shall be provided for the benefit of workers whereover it is considered expedient.GENERAL RULES AS TO SCAFFOLDS:

(i) Suitable scaffolds shall be provided for all workmen for all works that cannot be safely done from a ladder orby other means.

(ii) A scaffolds shall not be constructed taken down or substantially altered except.(a) Under the supervision of a competent and responsible person, and

(b) As far as possible by competent workers possessing adequate experience in this kind of work.

(c) All scaffolds and appliances connected there with and ladder shall.(1) Be of sound material.

(2) Be of adequate strength having regard to the load and strains to which they will be subjected and

(3) Be maintained in proper condition.

(4) Scaffolds shall not be overloaded and so far as practicable, the load shall be evently distributed.

(5) Scaffolds shall be so constructed that no part there of can be displaced in on normal use.

(6) Before installing, lifting gear on scaffolds special precautions shall be taken to ensure the strength andstability of the scaffolds.

(7) Scaffolds shall be periodically inspected by the competent person.8. Before allowing a scaffold to be used by the workman every care shall be taken to see whether thescaffolds have been erected by his workmen or not and steps taken to ensure that it complies fully with therequirement of the articles.(8) Working platforms gangways and stairways shall(a) be so constructed that no part of the road is covered.(b) be so constructed and maintained, having regard to the prevailing condition as to reduce as far as

practicable.(c) be kept free from any unnecessary obstructions.(d) In case of working platforms gangways place and stairways at a height exceeding that to be prescribed

by a national laws and regulations:-(i) every working platform and every gangway shall be closely boarded unless other adequate

measures are taken to ensure safety.(ii) Every working platform and every gangway shall have adequate width, and.(iii) every working platform gangway working place and stare way shall be fenced.

Every opening in the floor of a building or in working platforms shall except for the time and to the extentrequired to allow the access of persons or the transport or shifting of material be provided with suitable means toprevent the fall of persons or materials.

When persons are employed on a roof where there is a danger of failing from a height exceeding that to beprescribed by national laws of regulations suitable precautions shall be a taken to prevent the fall of persons ormaterials.

Suitable precautions shall be taken to prevent persons being struck by articles which might fall fromscaffolds or other working places.

(1) Soft means of access shall be provided to all working platforms an other working places.(2) Every place where work is carried on the means approach there to shall be adequately lighted.(3) Every ladder shall be security fixed of such length as to provide secure hand held and foot at every

position at which it is used.(4) Adequate precautions shall be taken to prevent danger from electrical equipment.(5) No material on the site shall be so stacked or placed as to cause danger to any person.

GENERAL RULES AS TO SAFETY EQUIPMENT AND FIRST AID(1) All necessary personal safety equipment shall be kept and available for use of the persons employed on

the site be maintained in condition suitable for immediate use.(2) The worker shall be required to use the equipment thus provided and the employed shall

take adequate steps to ensure proper use of the equipment by these concerned. Adequate provisionshall be made for prompt first aid treatment of all injuries likely to be sustained during the course ofthe work.

2) If the Bidder have been notified of the acceptance of his bid by the Employer duringthe period of Bid validity,

a) fails or refuses to execute the Form of Agreement in accordance with theInstructions to Bidders, if required; or

b) fails or refuses to furnish the Performance Security, in accordance with theInstruction to Bidders; or

c) does not accept the correction of the Bid Price pursuant to Clause 27,

We undertake to pay to the Employer up to the above amount upon receipt of his first writtendemand, without the Employer having to substantiate his demand, provided that in his demand theEmployer will note that the amount claimed by him is due to him owing to the occurrence of oneor any of the three conditions, specifying the occurred condition or conditions.

This Guarantee will remain in force up to and including the date ________, i.e. 135 days after thedead line for submission of Bids as such deadline is stated in the Instructions to Bidders or as itmay be extended by the Employer, notice of which extension(s) to the Bank is hereby waived. Anydemand in respect of this guarantee should reach the Bank not later than the above date.
