Reference of the EMD is to be mentioned online. Also, in case of Technical Bids, the list of

documents being submitted physically are to be uploaded online.

In the first instance, the Earnest Money shall be opened online. If the Earnest Money is found proper,

the Envelop ‘TI’ containing Technical Bid documents which can not be submitted online, shall be opened in the

presence of such contractors/firms who choose to be present. The Financial Offer shall be opened only if the

tenderers meet the qualification criteria and availability of bid capacity as per qualification, criteria of the Technical

Bid document. The date of opening of Financial Bid may be fixed and announced at the time of opening of

Technical Bid or later on.

The contractual agencies will submit the necessary documents as under:-

Envelope – Technical Bid Envelope

Online Technical Envelope – All the information and scanned copies of the Documents / Certificates as

required to be submitted as per Tender. Also, the list of such documents that can not be submitted online, if any.

Physical Technical Envelope – All the Information and Documents / Certificates as required to be submitted as per

Tender that cannot be submitted online, if any.

This envelope will be only opened if the Contractual Agency fulfills conditions.

The contractual Agencies can submit their tender documents as per the date mentioned in the key

Dates stated above:-

CONDITONS:- DNIT & Prequalification Criteria can be seen on any working day during office hours in the office

of the undersigned.

1) Conditional tenders will not be entertained & are liable to be rejected.

2) In case the day of opening of tenders happens to be holiday, the tenders will be opened on the next

working day. The time and place of receipt of tenders and other conditions will remain unchanged.

3) The undersigned reserve the right to reject any tender or all the tenders without assigning any reason.

4) The societies shall produce an attested copy of the resolution duly approved by the Co-Operative

department alongwith technical bids.

5) The tender without earnest money will not be opened.

6) The jurisdiction of court will be at Chandigarh/Panchkula.

7) The tender of the bidder who does not satisfy the qualification criteria in the bid documents are liable to

be rejected, summarily without arranging any reason and no claim whatsoever on this account will be

considered.

8) The bid for the work shall remain open for acceptance during the bid validity period to be reckoned from

the date of ‘Submit Bid Hash Online’. Bids would require to be valid for 45 days from the date of bid

closing.

9) A bidder shall not be permitted to bid for works in the Circle responsible for award and execution of

contracts in which his or her spouse’s near relative (defined as first blood relations, and their spouses) is

posted as Divisional Accountant or as an officer in any capacity between the grade of Superintending

Engineer and Assistant Engineer (both inclusive).

10) No Engineer of Gazetted rank or other Gazetted officer employed in Engineering or Administrative

duties in an Engineering Department of the State Government is allowed to work as a contractor for a

period of two years after his retirement from Government service, without Government permission. This

contract is liable to be cancelled if either the Contractor or any of his employees is found any time to be

such a person who had not obtained the permission of the Government as aforesaid before submission of

the tender or engagement in the contractor’s service.

Instruction to Contractor on Electronic Tendering (Applicable only for contract(s) amounting to more than Rs.5.00 lacs)

1. These conditions will over-rule the conditions stated in the tender documents, wherever

relevant and applicable.

2. Registration of the Contractors on the Haryana PW(B&R) Deptt.’s website

http://haryanapmgsy.etenders.in

All the Contractors registered / intending to register with Haryana PW(B&R) Deptt. and intending

to participate in the tenders processed online, are required to get registered on the Electronic

Tendering System on the Portal http://haryanapmgsy.etenders.in

The Contractors registered with other departments who are also eligible to participate in the tenders

are also required to be registered on the Electronic Tendering System in OPEN category.

3. Obtaining a Digital Certificate:

3.1 The Bids submitted online should be encrypted and signed electronically with a Digital

Certificate to establish the identity of the bidder bidding online. These Digital Certificates

are issued by an approved certifying authority, by the controller of Certifying Authorities,

Government of India.

3.2 A Digital Certificate is issued upon receipt of mandatory identity proofs and verification

letters attested by the bankers with whom the contractor maintains the accounts with. Only

upon the receipt of the required documents, a digital certificate can be issued.

3.3 The registered contractors may obtain Class II B digital certificated from any Certifying

Authority or Sub- certifying Authority authorized by the Controller of Certifying

Authorities or may obtain information and application format and documents required to

issue of digital certificate from:

3.4 Bid for a particular tender may be submitted only using the digital certificate, which is

used to encrypt the data and sign the hash during the stage of bid preparation and hash

submission. In case, during the process of a particular tender, the user looses his digital

certificate (i.e. due to virus attack, hardware problem, operating system problem); he may

not be able to submit the bid online. Hence, the users are advised to back up to certificate

and keep the copies at safe place under proper security to be used in case of emergencies.

3.4 In case of online tendering, if the digital certificate issued to the authorized user of a firm is

used for signing and submitting a bid it will be considered equivalent to a no-objection

certificate/power of attorney to that User. The firm has to authorize a specific individual via

an authorization certificate signed by all partners to use the digital certificate as per Indian

Information Technology Act 2000. Unless the certificates are revoked, it will be assumed to

represent adequate authority of the user to bid on behalf of the firm for Haryana PWD B&R

tenders as per Information Technology Act 2000. The digital signature of this authorized

user will be binding on the firm. It shall be the responsibility of management / partners of

the registered firms to inform the certifying authority of Sub / Certifying Authority, if the

authorized user changes, and apply for a fresh digital certificate and issue a ‘authorization

certificates’ for the new user. The procedure for application of a digital certificate will

remain the same for the new user.

3.5 The same procedure holds true for the authorized users in a private/Public limited

company. In this case, the authorization certificate will have to be signed by the directors of

the company.

4. Opening of an Electronic Payment Account:

4.1 For purchasing the tender documents online, contractors are required to pay the tender

documents fees online using the electronic payments gateway service as mentioned in

the D.N.I.T.

4.2 For the list of payments using which the online payments can be made, please refer to the

Home page of the Portal http://haryanapmgsy.etenders.in.

5. Set up of machine

5.1 In order to operate on the electronic tender management system, a user’s machine is

required to be set up. A help file on setting up of the system can be obtained from next

Tenders (India) Pvt. Ltd. or downloaded from the home page of the website -

http://haryanapmgsy.etenders.in.

6. Online Viewing of Detailed Notice Inviting Tenders:

6.1 The contractors can view the detailed N.I.T and the time schedule (Key Dates) for all the

packages floated using the electronic tendering system on the Haryana PW(B&R) website

7. Purchase of Tender Documents:

a) Download of Tender Documents: The tender documents can only be downloaded from the

Electronic Tendering System on the Portal

http://haryanapmgsy.etenders.in

8. Submission of Bid Seal (Hash) of online Bids:

8.1 Submission of bids will be preceded by submission of the digitally signed

bid seal (Hash) as stated in the tender time schedule (Key Dates)

9. Generation of Super Hash:

9.1 After the prescribed time of submission of Bid Seal (Hash) by the Contractors has

lapsed, the bid round will be closed and a digitally signed tender Super Hash will be

generated by authorized Haryana PW(B&R) official. This is equivalent to sealing the

tender box.

10. Submission of actual online bids:

10.1 Contactors have to submit their encrypted bids online and upload the relevant

documents for which they generated the hash at the stage of hash generation and

submission after the generation of Super Hash within the date and time as stated in

the Notice Inviting Tenders (Key Dates). The electronic bids of only those contactors

who have submitted their bid seals (Hashes) within the stipulated time, as per the

tender time schedule (Key Dates), will be accepted by the System. A contractor who

does not submit his bid seal (Hash) within the stipulated time will not be allowed to

submit his bid.

11. Submission of Tender Document Fees:

11.1 The Payment can be made by eligible / approved contractors online directly. Arrangements

have been made for contractors to make payments online via Credit Cards / Internet

Banking Accounts / ITZ Cash Cards/Debit Cards. The contractors have to pay for the

tender documents online by making online payment of tender document fees using the

service of the secure electronic payment gateway. The secure Electronic payments

gateway is an online interface between contractors and credit card / online payment

authorization networks.

12. Submission of Earnest Money Deposit:

12.1 The EMD Payment will be made by eligible / approved contractors online.

13.1 The contractors are strictly advised to follow dates and times a indicated in the Notice

Inviting Tenders. The date and time will be binding on all contractors. All online

activities are time tracked and the system enforces time locks that ensure that no

activity or transaction can take place outside the start and end dates and time of the

stage as defined in the Notice Inviting Tenders.

Other Information:

1. The intending Contractors shall fill in the item rate in the online templates of the online tender.

The Price Bid has to be submitted mandatory online.

2. Technical Bid Documents that cannot be submitted online, if any should be put in separate

sealed envelopes and these sealed envelopes together with the documents listed below and

delivered to this office before the date and time mentioned in the Tender Notice.

i. A list of all documents accompanying the sealed envelopes containing the tender

documents.

ii. Duly accepted power of Attorney in original along with its two certified copies in

the name of tenderer or authorized representative to act on behalf of the agency.

3. a) Bidder must strictly abide by the stipulations set forth in detailed notice inviting

tenders while tendering for the work.

4. Price Bid has to be submitted mandatory online and shall not be accepted physically under any

circumstances. In case any tenders does not comply with procedure given above, will be

presumed that he is not interested in work and the work shall not be let out to him, further

he may be de-barred without further notice to him for failing to abide by the approved

terms of detailed notice inviting tenders for this work.

5. The tenders which are not accompanied by the earnest money or do not strictly follow the

technical requirement, are liable to be rejected summarily.

6. Tenders quotations which are dependent upon the quotations of another tender shall be

summarily rejected.

7. The tender of the bidders who does not satisfy the qualification in the bid documents are

liable to be rejected summarily without arising any reason and no claim what so ever on

their account will be considered.

NOTICE INVITING TENDERS

Haryana PWD B&R Branch PROJECT:

1. Bid Documents consisting of Conditions, specifications, schedule of quantities of the work to be done may be collected from the office of Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh on any working day from __________ to _____________ between 10.00 a.m. to 17.00 p.m.

2. Bidders are advised to inspect and examine the site and its surroundings and satisfy themselves before submitting their Tenders so as to be aware of the nature of the ground, the form and nature of the site, means of access to the site, accommodation they may require and in general shall themselves obtain all necessary information as to risks, contingencies and other circumstances which may influence or effect their Tender. A Tenderer shall be deemed to have full knowledge of the site, whether he inspects it or not and no extra charges consequent on any misunderstanding or otherwise shall be allowed.

3. Bidders should quote in figures as well as in words rates tendered. The amount for each item should be worked out and requisite totals given. Special care shall be taken to write rates in figures as well as in words and the amounts in figures only in such a way that interpolation is not possible. The total amount shall be written both in figures and in words.

a) Where there is a discrepancy between the amounts in figure and in words for any discrepancy, the amount in words shall prevail.

b) Where there is a discrepancy between the total bid amount and the sum of total cost, the sum of total cost shall prevail and total bid amount will be corrected.

4. A tenderer shall submit the tender whom satisfies each and every condition laid down in this notice, failing which, the tender will be liable to be rejected.

5. The Employer does not bind themselves to accept the lowest or any tender or to give any reasons for their decision.

6. The Employer reserve to themselves the right of accepting the whole or any part of the tender and tenderer shall be bound to perform the same at his quoted rates.

7. This notice of tender shall form part of the Contract Documents.

8. Bid opening shall be carried out in two stages. Firstly, “Technical Bid” of all the bids received (except those received late) shall be opened on the date and time mentioned in clause 8 above. Financial bid of those bidders whose technical bid is determined to

be substantially responsible as per technical requirement give below shall be opened on any specified day in the presence of the bidders who may like to be present.

i) Average annual financial turn over in last 3 years ending 31st March, 2011: equal 75 % to the estimated cost of the work. The information must be supported by Audited balance sheet or certificate of Chartered Accountant, otherwise the information will not be considered and bid will be rejected.

ii) The bidder should have minimum of 5 years experience in providing security services and facilitating services in Government Department/ Public Sector Organization / 5 Star Hotels/ Guest House only. Experience of private firms will not be considered at all.

iii) The bidder should have successfully & timely completed in the field of similar nature minimum one work of Rs. 15.00 lacs during last 5 years in Government Organization, Public Sectors Organization, 5-Star hotels/ guest house only. Work Experience of private firms will not be considered at all. Contractor should submit documentary evidence, Award Letter and satisfactory completion of work from the previous Employer (not below the rank of Assistant Engineer / Assistant General Manager or Equivalent). Otherwise the experience will not be considered for evaluation and bid will be rejected. Similar nature of work means” providing the security services and facilitating services in Govt. organization/Public Sector organizations/5 star hotel/Guest house etc. having minimum 10,000 sq. m. of floor area. Timely completion means, the work should have successfully completed and date of completion should fall before 31.03.10.

iv) The tenders shall be accompanied by an “Earnest Money” of Rs.16,800/- from Societies/Rs.33,600/- from Contractors in the form of demand draft or pay order in favour of Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh.

v) Bidder should submit the photocopy of Registration Certificate of ESI, PF, and Service Tax and submit the photocopy of Labour License and PAN No. etc., if not, the bid will be declared non-responsive.

vi) Bidder should submit the photocopy of EPF return of the latest month submitted by the firm to the statutory body and should have minimum 100 employees on the pay role, if not, the bid will be declared non-responsive.

vii) The firm/ organization should submit the CV’s of at least one Supervisor and Receptionist, well experienced in similar type of job for site in-charge and receptionist post, whose particulars such as Name, Age and Experience should be furnished.

9. Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh will return earnest money to all unsuccessful bidders soon after the signing of the contract with the successful bidder. Earnest money of successful bidder will be returned only after submission of Performance security and commencement of services.

CONDITION OF CONTRACT PART I OBLIGATIONS OF SECURITY AGENCY

(a) Security agency will cover its Security agency Staff for personal accident and death while performing the duty.

(b) Adequate supervision will be provided to ensure correct performance of the said services in accordance with the prevailing assignment instructions to be agreed upon between the two parties.

(c) All necessary reports and other information will be supplied on a mutually agreed basis and regular meetings will be held with Executive Engineer, Construction Division, Hr PWD B&R Chandigarh.

(d) Security agency and its staff shall take proper and reasonable precautions to preserve from loss, deduction, waste or misuse of the Haryana PWD B&R building.

(e) The Security agency staff shall not accept any gratuity or reward in any shape or form.

(f) Under the terms of their employment agreement with Security agency, the Security agency staff shall not do any professional or other work for reward or otherwise either directly or indirectly except for and on behalf of Security agency.

(g) Security agency shall do and perform all such security services, acts, matters and things connected with the administration, superintendence, conduct of the security arrangements and proper maintain the reception and entry points of the building as per the directions enumerated herein and in accordance with such directions, which HARYANA PWD (B&R) may from time to time in liaison with officer-in-charge of the building.

(h) Security agency shall be responsible to look after all property, equipment and machinery of HARYANA PWD (B&R) entrusted to it for its own use and under its control (reasonable wear and tear exempted).

(i) Security agency shall indemnify the HARYANA PWD (B&R) for all losses, damages and theft on account of negligence of security personnel provided by Security agency

(j) Security agency shall not sublet /sub-contract or assign or any or full portion of the work without prior written permission from Executive Engineer, Construction Division, Hr PWD B&R Chandigarh.

(k) Security agency shall be responsible for the settlement of dispute if any arising with the security personnel and shall keep the Authority indemnified against all damages/claims arising there from. The authority shall be at liberty to make deductions from the running of such claim if any after mutual consent.

(l) Security agency shall obtain all necessary clearance/permission /licence related to them from concerned authority as per requirement of law at their cost. Security agency shall solely be responsible for any lapse in this regard.

(m) The contract period for providing Security Service is to commence within 7 days from the date of allotment to the agency.

(n) Haryana PWD B&R would however vary if the number of Security Personnel are decreased or increased as required by Haryana PWD B&R.

(o) Regarding fire fighting, all the security guards and Supervisor deployed by the agency shall be properly trained in handling the fire fighting operations and equipments. In any such eventuality, they should have immediately inform the Fire Department and the officer-in-charge of the building and take necessary steps like running and operate the fire equipments till the time of team of Fire Department arrives.

PART II DURATION

1. This contract is valid for one year from the start date and will be automatically renewable for equal period unless either party terminated the same giving one month notice in writing before the end of the contract period.

2. Executive Engineer, Construction Division, Hr PWD B&R Chandigarh reserve the right to terminate the contract at any time by giving one month notice.

3. In case of any misconduct /negligence on the part of personnel deployed by Security agency Executive Engineer, Construction Division, Hr PWD B&R Chandigarh may request their removal /replacement and it shall be complied with by Security agency immediately, within 24 hours.

PART III SETTLEMENT OF DISPUTE

Any dispute and /or difference except those covered under clauses of part-1, arising out of or relating to this contract including interpretation of its terms will be resolved through joint discussion of the Authorized Representative of the concerned parties. However, if the disputes are not resolved by the discussion, then the matter will be referred for adjudication to the arbitration. The decision of the arbitrator shall be final and binding on the parties. In such case the Superintending Engineer, Chandigarh Circle HARYANA PWD (B&R) shall be the sole arbitrator

PART-IV JURISDICTION

It is hereby agreed by parties hereto that only court of Chandigarh shall have jurisdiction to decide or adjudicate upon any dispute(s), which may be arise out of or be on connection with the agreement.

SPECIAL CONDITIONS OF CONTRACT 1. LABOUR:

The Contractor shall, unless otherwise provided in the Contract, make his own arrangements for the engagement of all staff and labour, local or other, and for their payment, housing, feeding and transport. The Contractor shall, if required by the Engineer-in-Charge, deliver to the Engineer-in-Charge a return in detail, in such form and at such intervals as the Engineer-in-Charge may prescribe, showing the staff and the numbers of the several classes of labour from time to time employed by the Contractor on the Site and such other information as the Engineer-in-Charge may require.

2. COMPLIANCE WITH LABOUR REGULATIONS :

During continuance of the contract, the Contractor and his sub-contractors shall abide at all times by all existing labour enactments and rules made thereunder, regulations, notifications and bye laws of the State or Central Government or local authority and any other labour law (including rules), regulations, bye laws that may be passed or notification that may be issued under any labour law in future either by the State or the Central Government or the local authority. Salient features of some of the major labour laws that are applicable to construction industry are given below. The Contractor shall keep the Employer indemnified in case any action is taken against the Employer by the competent authority on account of contravention of any of the provisions of any Act or rules make thereunder, regulations or notifications including amendments. If the Employer is caused to pay or reimburse, such amounts as may be necessary to cause or observe, or for non-observance of the provisions stipulated in the notifications/bye laws/Acts/Rules/regulations including amendments, if any, on the part of the Contractor, the Engineer-in-Charge/Employer shall have the right to deduct any money due to the Contractor including his amount of performance security. The Employer/Engineer-in-Charge shall also have right to recover from the Contractor any sum required or estimated to be required for making good the loss or damage suffered by the Employer. The employees of the Contractor and the Sub-Contractor in no case shall be treated as the employees of the Employer at any point of time. 1. The service provider(contractor) shall sign agreement with department as per DNIT. 2. The contractor shall in respect of labour employed by him comply with the provisions of

Contract Labour (Regulations & Abolition) Act 1970 in regard to all matters provided therein, including obtaining a valid license.

3. The contractor should have registered for depositing the EPF/ESIC and service tax etc. issued by the concerned deptt. The statutory amount payable by deptt. shall be paid only after submission of proof of having deposited same by contractor.

4. The contractor shall execute the work as per DNIT. 5. The period of contract shall be 12 months from the date of allotment if not otherwise

revoked or cancelled as per the terms and conditions of this agreement. The contract can also be increased/decreased if so desired by Engineer-in-charge.

6. The contractor will submit monthy bill by 5th of every month. The Department will make efforts to make payment to the contractor by 10th of every month in case of holiday the payment will be made on the next working day. This is being done so that the employees get their salary well in time. This is subject to condition that contractor complies with all conditions of DNIT failing which contractor will be responsible for delay in payment of his bill. The contractor is however required to make payment to his staff for minimum two months even if his monthly payments are delayed due to any reason.

7. The contractor/agency shall be responsible for complying with all the relevant acts/rules whatsoever are applicable as on date or made applicable in future during the period the contract by Haryana State (Chd. Administration)/Central Govt./Judiciary or any other statutory body.

8. The contractor shall have his office at Chandigarh/Panchkula. The address and telephone number of the office will be informed to the Executive Engineer, Constn.Divn.Hr.PWD B&R,Br.,Chandigarh.

9. The contractor shall pay minimum wages to his staff not less than the rates fixed by the D.C., Chandigarh however contractor will be required to pay minimum applicable wages during period up to contract.

Those tenderers which quote less than minimum prescribed rates as above are likely to be rejected. The contractor shall make the payment to his staff by cheque or any

other mode as fixed by SDE In-charge/E.E.Constn.Divn. Hr.PWD B&R,Br., Chandigarh and payment shall be made in front of SDE In-charge or staff authorized by him. The contractor will be bound to keep proper record of payment made by him to his staff and which will be produced to Engineer-in-charge/SDE- in- charge as and when asked for supply of record and cards of payment of EPF & ESI in respect of staff deployed by him.

10. The contractor is required to deposit the EPF & ESI in respect of staff employed by

him with concerned authorities. The employees share of EPF & ESI are included in the minimum wages as mentioned above. The employer’s share of EPF @ 12% + ESI @ 4.75% + Admn. Charges @ 1.61% and service tax at 10.30% ( or as applicable) will be reimbursed to contractor against proof of depositing the same to the concerned authorities.

11. The contractor is required to deposit the statutory payments namely service tax, EPF,ESI with concerned authorities monthly/quartery as per schedule fixed by concerned authorities and submit a monthly report of complying with statutory requirement shall be submitted by the contractor to Engineer-in-charge failing which his payment may be withheld. The contractor is also required to submit the EPF & ESI of concerned employees to this office and also supply necessary details/documents to concerned employees to enable them to utilize above benefits.

12. The agency/firm shall be responsible for taking/obtaining license for the deployment of clerical staff from the labour department of Chd. Admn.or State authority at their own level.

13. The contractor will have to deposit 5% security in lump sump or deduction of equal amount from his running bills.

The department shall have absolute rights and power from revocation of the said security, in case of break of any clause of this contract, without any prior notice and no claim whatever on this count shall be entertained. The earnest money deposited shall remain with the department as security till final contract. In addition to it the contractor shall also deposit performance guarantee @ 5% at time of start of work which will be returned after completion of work subject to fulfillment of all terms and conditions.

14. The decision of the Executive Engineer with regard to the determining of quality of work/service done by the contractor/service provider shall be final and acceptable to the service provider. The service provider shall, therefore rectify the deficiency in service, he will be responsible in case of absence of his employee and also any loss of documents material after the office hours.

15. For the purpose of proper identification of the employees of the contractor/service provider deployed at various points, the contractor/service provider shall himself issue them the identify cards/identification documents at his own cost under his name, trading style and signature and they shall be duty bound to display the identify cards at the time of duty.

16. The persons so deployed shall be under the control and supervision of the contractor/service provider. The contractor/service provider shall be responsible to prevent any unlawful act or disorderly conduct of his employees so deployed and for the preservation of peace and protection of persons and property of the office.

The Executive Engineer Incharge or his representative shall carry out any surprise check on the working of the persons so deployed by the

contractor/service provider in order to ensure that the required number of persons are deployed and that they are doing their duties properly.

17. In case, any person deployed by the contractor/service provider does not come up to the mark or performs his duties properly or indulges in any unlawful act or disorderly conduct, the contractor/service provider shall take suitable action. In case of any complaint/deficienty in service of the employee so deployed, the contractor/service provider shall immediately replace the particular person so deployed.

18. The controller/service provider will ensure those employees deployed by him are medically fit and free from communicable diseases. The antecedents of the persons to be provided by the contractor/service provider will be got verified from the appropriate authority by the contractor/ service provider at his own level and a certificate to the effect will be given to this office.

19. Income tax shall be deducted from the bill of the contractor/service provider at source at the rates as applicable from time to time in accordance with the instructions/rules applicable in this regard.

20. It is obligatory on part of the contractor/service provider to fulfill his commitments towards his employees also deployed by him under the various labour laws. The contractor/service provider shall comply with or cause to be complied with the contractors labour regulations made by the Govt. from time to time.

21. Any obligations and/ or formalities which are required tobe fulfilled under contract labour ( regulations and abolitions) Act 1970 as amended from time to time or any other act for the purpose of entering into and/or execution of this contract shall be carried out by the contractor at his own cost and the contractor shall report the compliance thereof to the officer in charge. The contractor shall be solely responsible in case of violation of any provision of the said act.

22. The contractor/service provider shall not charge any money from the contractural employees towards security deposits. The contractor shall issue employment cards containing terms and conditions of appointment of its employees to be deployed at site.

23. The contractor/service provider shall keep the site of work indemnified against any loss caused to the Govt. property by way of theft,mishandling or otherwise and the claims whatever in respect of the employees deployed by the contractor. He shall be responsible for payment of any loss caused to the Govt. property.In case any employees of the contractor so deployed enter into dispute of any nature whatsoever, it will be the sole responsibility of the contractor concerned to contest the same. Further, the contractor shall ensure that no financial or other legal liability comes on the Govt. in respect at any time for the act done by the person of the contractor.

24. In case of any deficiency in service the Engineer-in-charge shall be at liberty to impose a penalty as may deemed fit which will be up to 10% of contract amount. The decision of the Executive Engineer,Constn.Divn.Chd. shall be final and binding on the contractor.The department shall have further right to adjust or deduct any of the amount as aforesaid from the payments to be made to the contractor under this contract or out of the security deposits of the contractor.

25. The contractor/service provider has to strictly follow the fair wage clause and ensure that minimum wages as mentioned in DNIT are paid to his staff. 26. The fact that any time during operation of this agreement or thereafter the department

is made liable in any manner by an order of any court authority or tribunal to pay any amounts in respect of or to any of present or ex-staff of contractor or to any third

party in any event including mentioned else where in the DNIT, contractor shall immediately pay to department all such amounts and costs also and in all such cases/event decision of department shall be final and binding upon contract and department shall be entitled to deduct any such amount as aforesaid from his contractor’s security deposit or any other pending payment.

27. The contractor shall give an undertaking each month of contract that he has complied with his statutory obligations before payment is released to him.

28. The period of contract can be decreased or increased by the Engineer-in-charge i.e. XEN Constn.Divn.Hr.PWD B&R,Br.,Chandigarh and no claim from contractor on this account will be entertained. The contract can be terminated by the Engineer-in-charge even before expiry of contract period in case services rendered by contractor are unsatisfactory or for breach any terms and conditions of contract by contractor being declared in solvent by competent court of law or default on part of contractor in making payments of wages to his employees as per terms and conditions of DNIT or any other reason as deemed fit by Engineer-in-charge. In case of termination of contract due to break of any terms and conditions of contract by contractor or due to any reason, the contractor will be liable to department for losses on account of such break and Engineer-in-charge may recover such losses and other liabilities from contractors pending payment/security.

29. Sub Contractors. The contractor shall not enter into any subcontract without the written/prior approval of the employer.

30. Haryana PWD B&R Decision. If dispute of any kind whatsoever arises between the Executive Engineer and the contractor in connection with or arising out of the contract or the execution of the work whether during the execution of the work or after their completion and whether repudiation or other termination of contract including in a dispute as to any opinion, design, specification, instruction, determination, certificate or valuation of Haryana PWD B&R, the matter in dispute shall in first place be referred to the Executive Engineer within 30 days of rising of the dispute who shall with in a period of 60 days thereafter give his decision in writing.

31. Arbitration All disputes or differences in respect of which the decision of the engineer has not become final and binding and the decision of the constellation is not acceptable to either party shall be referred to a sole arbitrator to be appointed as under: - The Executive Engineer, const. Divn. Chandigarh within 60 days of receipt of notice from any party to the contract for appointment of arbitrator shall send to the contractor , the penal of three names of persons amongst whom he intends to appoint the arbitrator. The contractor shall within 15 days of receipt of this penal select and communicate to the Executive Engineer, const. Divn. Chandigarh, the name of the person acceptable to him. If the contractor feels to communicate his options within stipulate period of time, the Executive Engineer, Const. Divn. Chandigarh shall appoint the arbitrator. If the Executive Engineer, Const. Divn. Chandigarh fails to give the panels of name within the specified period, the contractor can proceed for the appointment of arbitrator through court as per arbitration and conciliation Act, 1996.

All notices to be given by the employer or by the engineer to the contractor under the terms of contract shall be served them under sending by Registered Post or delivering the same to the contractor’s place of business or such other address, as the contractor shall nominate for this purpose.

33. Service of notice on Executive Engineer, Const. Divn. Hr PWD B&R Chandigarh All notices to be given to the employer on the terms of the contract shall be served by sending the same under registered post or delivering the same to the employer’s address.

34. Applicable Law

The contractor shall be governed by construed and enforced law in accordance with the Laws of India.

35. Enhancement

a) No enhancement in rates will be allowed during the initial contract period on any account even if the minimum wages any increase by the Government or for any reason whatsoever.

TERMS OF REFERENCE

1. SCOPE OF WORK Security services are to be provided for Nirman Sadan, Sector-33, Chandigarh. The Nirman Sadan building consist of 3 Blocks A, B & C. The Block –A consist basement +6 storied. The block-B Basement+2 storied and the Block-C basement +4 storied with rooftop. The building also includes the stair cases, Back landing (Fire Escape), Parking, Open area (within the compound wall) etc. The total covered area is 10400 Sq. mtr and 15000sq. mtr. is open area. Security services includes the following activities: - • Round-the-clock security to the entire office complex, machinery and equipment

located therein. • Controlling and regulating entry into the building. • Manning the reception centre • Management and maintenance of access control system (CCTV). • Regulating the entry of the entrance in the building and control of sensor door of

the main entrance. • Issue of visitor card to the visitors, contractors and guests at the reception. • Control of parking area of the campus. • Handling and registering of daks at the reception centre.

2. CONTRACT PERIOD The contract period for security services and related services shall be initially for a period of one year from the date of award of the contact which can also be curtailed or renewed for subsequent years on yearly basis limited to total three years contract on the basis of performance. The renewed contract period will be decided after negotiations incorporating any amendments etc.

3. MANPOWER

a) The agency shall be required to deploy, eight Security personnel, one lift boy and two receptionist as per details in forthcoming pages for ensuring proper round the clock security of the building and campus area at the reception counter entry and exit of the main gate etc. within the campus area. Man Power can be decreased or increased any time by the Executive Engineer, Constn.Divn.Hr.PWD B&R,Br.,Chandigarh & Superintending Engineer,Chandigarh Circle,Hr.PWD B&R,Br.,Chandigarh.

b) Police verification of the supervisors/ security personnel, lift boys and

receptionist shall be arranged by agency and shall be submit to Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh along with their photos for record.

4. SHIFTS Security services and related services will be required to be made on daily basis round the clock. The shift for the deployed security personnel will be of 8-Hours rotation and the rotation will be decided by the Executive Engineer,Constn.Divn.Hr.PWD B&R,Br.,Chandigarh.

a) The agency shall ensure and certify the credentials of persons deployed for Security Services and submit the proof duly signed by each worker for record. Any change of manpower if required, during the currency of agreement will be permitted with prior permission of Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh.

b) The above cited schedule of duty is tentative and the timing may be adjusted as per actual requirement in consultation with the Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh.

5. PERFORMANCE SECURITY

The successful bidder shall submit a performance security in form of an unconditional Bank Guarantee, acceptable to Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh, equivalent to 10% of the bid amount and the same shall be remained valid for the initial contract period + 1 month, i.e. 13 months from date of signing of Agreement.

6. ESSENTIALS SECURITY SERVICES TO BE PROVIDED ON DAILY

BASIS ON ALL DAYS FROM MONDAY TO SATURDAY Site Instructions

Based on the deployment of Guarding Services as per Annexure-1 and facility Services as per Annexure-2, the site instructions which shall be followed by the Security agency staff and security personnel at the site of Nirman Sadan Building, Haryana PWD B&R Branch Sector-33, Chandigarh are mentioned below: -

1. The guards at the main gate have to control the inflow and outflow of pedestrians

as well as vehicular traffic. 2. The guards shall allow only the vehicles bearing authorized “vehicle pass” entry

to the building. Vehicle of VIP visitors or transport vehicles shall be allowed entry only on written permission of the Officer-in-Charge of the building.

3. The visitors pass for visitors shall be issued at the reception by the Receptionist after verifying the identification with the coordinator officer appointed by the Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh and entry will be controlled by the Security personnel at the sensor door. The entry of entrants in the building shall be classified and controlled as follows:

a. Employees: Employees shall be allowed entry on verifying their photo

identity (ID) card /thumb impression which is to be displayed by them on their

person. In case the employee is not able to produce the card, Temporary pass needs to be issued by the receptionist as per discussion with officer-in-charge/officer to whom the visitor has to want to meet and to be registered in the Register alongwith timing.

b. Contractors: The contractors shall carry Contractor card-cum-visitor card and

shall be allowed access to the building to carry out that respective task. No contractors shall be allowed entry without the Contractor- cum-visitor card.

c. Guests: The Guest shall be issued with a “Guest /Visitor” pass on prior

intimation or on spot confirmation from the official/officer to whom the guest intents to meet.

d. VIP Visitor : It is recommended that the HARYANA PWD (B&R) employee

shall accompany the VIP visitors. Alternatively, the security control room at the main gate shall have pre-programme “VIP Visitor” Cards which would allow access to the main entrance doors. However, it is recommended that an advance intimation be given to the security control room for effectively handling, VIP visitors.

It is expected that the VIP Visitors would be allowed to park their vehicles inside the premises and necessary arrangement shall be allowed for them. The VIP Visitors card would also be programmed to allow access in the parking for self driven vehicles. For chauffeur driven vehicles, an additional card needs to be issued to the chauffeur who would show the card at the entry barrier to enter and would drop the card in the “visitor card deposit” box at the exit barrier before leaving the parking. In case there is not prior intimation on spot confirmation can be made by officer-in-charge /coordinator officer.

e. General Visitors: The general visitors would be issued with the “Visitor” card

on confirmation with the concerned HARYANA PWD (B&R) employee. The visitors of all employees of the rank of Junior Engineer and above are allowed to visit them at their respective office. However, other visitors are required to stay at the reception and the respective employee shall meet them at the reception.

4. The three receptionists proposed shall handle the reception duty including dak

reception and handing over the same to the H.R. Branch, identification of visitors and issuing of visitor pass at the reception counter.

5. The Receptionist at the dak center shall also be responsible for handling the daks of HARYANA PWD (B&R) and Chief Architect office. A brief guideline has been listed below for the Receptionists to handle daks.

6. The methodology of the entry system as well as entire security system shall be reviewed by the department from time to time and can be changed at any stage in view of convenience of the department in consultation with the agency.

Reception of ‘Dak’

a) The dak is first received at the gate by the Security Guard who in turn would hand it over to the reception/dak centre.

b) The receptionist shall then stump the receiving date and time. c) Enter the details of dak alongwith the serial number in the register. d) Mark it to the concerned HARYANA PWD (B&R) department/ Architect

Department. e) Prepare a list department and branch wise. f) Inform the PA’s of the respective department. g) The PA’s of the respective department shall take charge of the daks from the

reception alongwith the list and shall do verification /cross check of missing documents.

h) In case the dak is not matching with the list it shall be brought to the notice by the concerned department immediately otherwise it is assumed that the dak is incorrect.

7. The Receptionists shall receive the fax from the machine kept at the reception and

process it in the same manner as of the “daks”. 8. The Receptionists shall attend to the visitors in a courteous manner and do the

coordination with the respective HARYANA PWD (B&R) and Chief Architect’s office employees.

9. The Receptionists shall attend to the telephone calls and route it to the respective HARYANA PWD (B&R) employees and Chief Architect’s office as required.

7. SECURITY MATERIALS/EQUIPMENTS:

All the requisite security materials/equipments such as like checking of persons and vehicles will be provided by the department for smooth security services.

8. STATUTORY REQUIREMENTS

i. The agency shall ensure for holding of valid licenses for providing security services from the concerned Govt. Departments.

ii. The agency shall maintain necessary Attendance register for the deployed manpower regularly and submit for inspection on demand by Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh.

iii. The manpower deployed by the agency shall be provided with proper uniform for both summer and winter seasons and each security men will be equipped with torch lights, sticks etc. by the agency at his own cost.

iv. The agency shall be required to submit to Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh consolidated monthly salary statement of all the persons duly signed along with the bills of payment for records.

v. The agency shall ensure for meeting the statutory compliances under the provisions of the Payment of Wages Act, 1936, Minimum Wage Act, 1948, Employees provident Fund & Miscellaneous Provisions Act, 1952, ESI Act, 1948, Employer’s Liability Act, 1938, Workmen’s Compensation Act, 1923, Industrial Dispute Act, 1947, Maternity Benefit Act, 1961 and Contract Labour (Regulations and Abolition Act), 1970 Bonus Act or any modifications thereof or any other laws relating there to and rules made there-under from time to time.

9. COMPENSATION

The agency shall ensure that the property of Haryana PWD B&R does not come to any harm due to carelessness of deployed manpower. In case of any injury of major accident the agency shall be required to compensate to the deployed manpower suitably. Haryana PWD B&R will not be responsible on this account in any way. The agency will also ensure proper compensation to the deployed manpower on account of injury/death during the course of their deployment. The agency shall make necessary insurance arrangements for the manpower deployed and deposit the policy with Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh.

10. FORCE MAJEURE

The obligations of the Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh and the Agency will be suspended when either party is subject to Force Majeure, which can be termed as civil disturbance, riots, strikes, storm, and acts of God.

11. TERMINATION AND PENALTY

i) The contract is liable to be terminated by either side on giving one month’s advance notice.

ii) In case the agency fails to abide by the terms and conditions, the Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh will be at liberty to obtain the security services from any other agency at the cost and risk of the original agency.

iii) In the event of each unsatisfactory performance of security services, a penalty as per following details shall be imposed on the agency by Executive Engineer, Const. Division Haryana PWD B&R Branch, Chandigarh. Further, if there is any absentism of the manpower deployed, Rs. 500/- shall be deducted from the bill for each absentism.

12. The Contractor shall make arrangement to issue Identity Cards to each of the Workmen, supervisor and staff for entry into the premises. These I Cards shall be issued by the contractor at his cost. Security staff shall be at liberty to exercise check on any of the works, supervisors while entering, search them in the premises during the work and while leaving from the premises. The contractor shall also make arrangements to provide 2 sets of summer uniforms(with firms’s logo and name of worker) and 1 set of pullover(with firms’s logo and name of worker) with one pair of shoe to each of the staff member each year at his own cost and will be distributed in presence of representative of Executive Engineer, Const. (FINANCIAL BID) 1.0 Preamble

1.0.1 The bill of quantities shall be read in conjunction with Bid notice, Notice

inviting tender, Conditions of Contract, and other instruments. 1.0.2 The quantities given in the BOQ are estimated and provisional and given to

provide a common basis for bidding. The basis of payment will be actual quantities of work ordered and carried out and valued at the rates and prices tendered in the priced Bill of quantities, where applicable and otherwise at such rates and prices as fixed with in the terms of Contract.

1.0.3 The rates and prices tendered in the priced Bill of Quantities shall, expect in so far as it is otherwise provided under the contract, include all equipment, labour, supervision, materials, application of materials, maintenance, profit, taxes and duties together with all general risks, liabilities and obligations set out and implied in the Contract. The Contractor shall provide all the equipment related to the work.

1.0.4 The rates and prices must be quoted in words and figure (entirely in Indian Currency).

1.0.5 A rate or price shall be entered against each item in the Bill of quantities whether the quantities are stated or not. The cost of the items against which the Contractor has failed to enter rate or price shall be deemed to be covered by other rates and prices entered for the related items of work.

1.0.6 The whole cost of employing with provisions of the Contract shall be included in the items provided the cost shall be deemed to be distributed among rates and prices entered for the related items of work.

1.0.7 The bidder should submit the financial justification of the monthly quoted amount the in the performa given in the financial bid, only for supporting their financial quote, not for Bid amount. The final decision of the bid will be taken by the Competent Authority as per the financial quote and financial justification given by the bidder. Financial bid submitted by any bidder with unreasonable justification, will be rejected.
