CPWD-6 FOR e-Tendering

Item rate tenders are invited on behalf of the President of India from the approved and eligible contractors

registered in Horticulture Category of C.P.W.D, for the following Work:– M/o Garden area attached to sec-7, R K Puram New Delhi dg. 2015-16 (SH: M/o Garden features)

The enlistment of the contractors should be valid on the last date of online submission of tenders.

In case the last date of submission of tender is extended, the enlistment of contractor should be valid on

the original date of submission of tenders.

In case both the last date of receipt of application and sale of tenders are extended, the enlistment of

contractor should be valid on either of the two dates, i.e., original date of sale of tender or on the

extended date of sale of tenders.

1. The work is estimated to cost Rs. 6,07,472/-. This estimate, however, is given merely as a rough

guide.

2. Agreement shall be drawn with the successful tenderders on prescribed Form No. CPWD 7/8 (or other

Standard Form as mentioned). Tenderders shall quote his rates as per various terms and conditions of

the said form which will form part of the agreement.

3. The time allowed for carrying out the work will be 12 Months from the date of start as defined in

schedule ‘F’ or from the first date of handing over of the site, whichever is later, in accordance with

the phasing, if any, indicated in the tender documents.

4. (i) The site for the work is available.

The site for the work shall be made available in parts as specified below:-

(ii) The architectural and structural drawing for the work is available.

5. The tender document consisting of plans, specifications, the schedule of quantities of various types of

items to be executed and the set of terms and conditions of the contract to be complied with and other

necessary documents except Standard General Conditions of Contract Form can be seen on website

www.tenderwizard.com/CPWD or www.cpwd.gov.in free of cost.

6. After submission of the tender the contractor can re-submit revised tender any number of times but

before last time and date of submission of tender as notified.

7. Earnest Money can be paid in the form of Treasury Challan or Demand Draft or Pay order or

Banker`s Cheque or Deposit at Call Receipt or Fixed Deposit Receipt (drawn in favour of Dy. Director (Hort.) Hort. Division No.-5 , CPWD, New Delhi ) shall be scanned and uploaded to the

e-tendering website within the period of tender submission and original should be deposited in the office of Dy. Director (Hort.) Hort. Division No.-5, CPWD, New Delhi within the period of tender submission in single sealed envelop superscripted as “Earnest Money” with name of work

and due date of opening of the bid also mentioned their own.

A part of earnest money is acceptable in the form of bank guarantee also. In such case, 50% of

earnest money or Rs. 20 lac, whichever is less, will have to be deposited in shape prescribed above,

and balance in shape of Bank Guarantee of any scheduled bank which is to be scanned and

uploaded by the intending tenderders.

Interested contractor who wish to participate in the tender has also to make following payments within

the period of tender submission:

(i) e-Tender Processing Fee – Rs. 572/- shall be payable to M/s ITI Limited through their e-gateway

by credit/debit card, internet banking or RTGS/NEFT facility. The contractor already registered on the e-tendering portal will have option to continue by paying tender processing fee upto one

year from the date of registration, or to switch over to (new) registration without tender processing fee any time. All new registration from 01.04.2015 will be without tender processing

fee.

Copy of Enlistment Order and certificate of work experience and other documents as specified in the press notice shall be scanned and uploaded to the e-Tendering website within the period of tender

submission. However, certified copy of all the scanned and uploaded documents as specified in

press notice shall have to be submitted by the lowest tenderder only within a week physically in the office of bid opening authority.

Online tender documents submitted by intending tenderders shall be opened only of those tenderders,

who has deposited e-Tender Processing fee with M/s ITI Limited and Earnest Money Deposit and other documents scanned and uploaded are found in order.

The tender submitted shall be opened at 03:30 PM on 20.01.2016.

8. The tender submitted shall become invalid and e-Tender processing fee shall not be refunded if:

(i) The tenderer is found ineligible.

(ii) The tenderer have to upload all the documents (including service tax registration/Sales Tax registration)

as stipulated in the tender document including scanned copy of EMD.

(iii) If any discrepancy is noticed between the documents as uploaded at the time of submission of tender

and hard copies as submitted physically by the by bidder in the office of tender opening authority.

9. The contractor whose tender is accepted will be required to furnish performance guarantee of 5% (Five

Percent) of the tendered amount within the period specified in Schedule F. This guarantee shall be in the form of cash (in case guarantee amount is less than Rs. 10000/-) or Deposit at Call receipt of any

scheduled bank/Banker’s cheque of any scheduled bank/Demand Draft of any scheduled bank/Pay

order of any Scheduled Bank (in case guarantee amount is less than Rs. 1,00,000/-) or Government

Securities or Fixed Deposit Receipts or Guarantee Bonds of any Scheduled Bank or the State Bank of

India in accordance with the prescribed form. In case the contractor fails to deposit the said

performance guarantee within the period as indicated in Schedule ‘F’, including the extended period if

any, the Earnest Money deposited by the contractor shall be forfeited automatically without any notice to the contractor. The Earnest Money deposited along with tender shall be returned after receiving

the aforesaid performance guarantee.

10. The description of the work is as follows:

Copies of other drawings and documents pertaining to the works will be open for inspection by the tenderers at the office of above mentioned officer.

Tenderers are advised to inspect and examine the site and its surroundings and satisfy themselves

before submitting their tenders as to the nature of the ground and sub-soil (so far as is practicable), the

form and nature of the site, the means of access to the site, the accommodation they may require

and in general shall themselves obtain all necessary information as to risks, contingencies and other

circumstances which may influence or affect their tender. A tenderer shall be deemed to have full

knowledge of the site whether he inspects it or not and no extra charge consequent on any

misunderstanding or otherwise shall be allowed. The tenderer shall be responsible for arranging and

maintaining at his own cost all materials, tools & plants, water, electricity access, facilities for

workers and all other services required for executing the work unless otherwise specifically

provided for in the contract documents. Submission of a tender by a tenderer implies that he has read

this notice and all other contract documents and has made himself aware of the scope and

specifications of the work to be done and of conditions and rates at which stores, tools and plant, etc.

will be issued to him by the Government and local conditions and other factors having a bearing on the execution of the work.

11. The competent authority on behalf of the President of India does not bind itself to accept the lowest

or any other tender and reserves to itself the authority to reject any or all the tenders received

without the assignment of any reason. All tenders in which any of the prescribed condition is not

fulfilled or any condition including that of conditional rebate is put forth by the tenderer shall be

summarily rejected.

12. Canvassing whether directly or indirectly, in connection with tenderers is strictly prohibited and the

tenders submitted by the contractors who resort to canvassing will be liable to rejection.

13. The competent authority on behalf of President of India reserves to himself the right of accepting the

whole or any part of the tender and the tenderer shall be bound to perform the same at the rate

quoted.

14. The contractor shall not be permitted to tender for works in the CPWD Circle (Division in case of

contractors of Horticulture/Nursery category) responsible for award and execution of contracts, in

which his near relative is posted a Divisional Accountant or as an officer in any capacity between the

grades of Superintending Engineer and Junior Engineer (both inclusive). He shall also intimate the

names of persons who are working with him in any capacity or are subsequently employed by him and

who are near relatives to any Gazetted officer in the Central Public Works Department or in the

Ministry of Urban Development. Any breach of this condition by the contractor would render him

liable to be removed from the approved list of contractors of this Department.

15. No Engineer of Gazetted Rank or other Gazetted Officer employed in Engineering or

Administrative duties in an Engineering Department of the Government of India is allowed to work as a contractor for a period of one year after his retirement from Government service, without the prior

permission of the Government of India in writing. This contract is liable to be cancelled if either the

contractor or any of his employees is found any time to be such a person who had not obtained the

permission of the Government of India as aforesaid before submission of the tender or engagement in

the contractor’s service.

16. The tender for the works shall remain open for acceptance for a period of ninety (45) days from the

date of opening of tenders/Ninety days from the date of opening of technical tenders in case tenders are

invited on two envelop system/one hundred twenty (120) days from the date of opening of technical

tenders in case tenders are invited for specialized works on three envelop system (strike out as the case may be) if any tenderer withdraws his tender before the said period or issue of letter of

acceptance, whichever is earlier, or makes any modifications in the terms and conditions of the tender which are not acceptable to the department, then the Government shall, without prejudice to any other

right or remedy, be at liberty to forfeit 50% of the said earnest money as aforesaid. Further the tenderer

shall not be allowed to participate in the retendering process of the work.

17. This notice inviting tender shall form a part of the contract document. The successful

tenderer/contractor, on acceptance of his tender by the Accepting Authority shall within 15 days from

the stipulated date of start of the work, sign the contract consisting of:-

a) The Notice Inviting tender, all the documents including additional conditions, specifications and

drawings, if any, forming the tender as issued at the time of invitation of tender and acceptance thereof together with any correspondence leading thereto.

GENERAL CONDITIONS

1. The work shall be carried out according to the CPWD Specifications -2009 Vol. I to II with upto date correction

slips, if any items are not available in CPWD specification then relevant I.S.I specification of decision of the

Engineer-in-Charge shall be followed.

2. The rates tendered by the contractor’s should be including all royalty, taxes, carriages all leads and lifts & stacking

etc. complete upto the site work. Nothing extra shall be paid to him on this account.

3. The contractor must quote their rates for each item of work both in figure and in words strictly otherwise tender

will not be accepted.

4. The contractor must get acquainted with the proposed site of the works and study specification and conditions

carefully before tending.

5. The undersigned reserves the right to reject any tender without assigning any reason and no conditional tender

will be accepted.

6. The contractor shall bear all incidental charges for cartage, storage and safe custody of the materials.

7. The quantity shown in the schedule of quantity can be increased or decreased upto 25% on either side.

8. No payment will be made to the contractor for the damage caused by rains or other natural calamities during

the execution of work and no such claim on this account will be entertained.

9. The contractor shall not employ labourer below the age of 18 years on the work.

10. Necessary recoveries as applicable shall be made from the gross amount of each bill.

11. The Security deposit shall not be refunded till the clearance certificate obtained from the Sr. Labour Office,

CPWD & produced to undersigned.

12. If due to any reasons the date of opening the tender has been declared holiday by the Govt. of India then

tender will be opened on next working day.

(MAINTENANCE WORKS)

1. The work shall be carried out as per CPWD specification-2009 Vol. I & II with upto date correction slips and as

per yard stick properly and according to the entire satisfaction of the Officer – in – Charge and client department.

2. The contractor shall take instruction from the Officer – in – Charge regarding supply and stacking of material at

site. He shall bear all charges for storage and safe custody of materials.

3. The contractor shall have to maintain log book for tanker, tempo’s and other vehicles on day to day basis and

should get it countersigned by Officer – in – Charge.

4. The contractor must have sufficient plants & material at site of work to meet out day to day requirements and also

authorized two or more nurseries from where department can take different type of plants materials as and when

required.

5. The location for storing and stacking of material shall be got approved from Officer – in – Charge.

6. The contractor must got approved samples of plants from Officer – in – Charge before supply.

7. The regrassing / alteration of garden should be got approved from Officer – in – Charge.

8. Any work carried out without approval of the Officer – in – Charge at the site of work shall not be accounted /

measured and will not be paid.

9. Income Tax & other Tax shall be recovered as per prevailing rules of various Govt. Department.

10. The site shall be cleared after completion of the work.

11. All malba/rubbish/waste/garbage etc generated due to any operation from Horticulture works and in lawn area

whatsoever shall be disposed off on daily basis by the contractor to the specified common disposal point and

nothing extra shall be paid on this account. After the collection of full truck load of the said malba, the same shall

be disposed off by the contractor to the authorized municipal dhalao/dumping ground, in case of non-

removal/disposal in the specified period, a sum of Rs. Two Thousand per day shall be recovered from the

contractor.

12. Special repair works are to be carried out as per direction of Officer – in – Charge.

13. All T&P required for the completion of the given works/complaints shall be arranged by the contractor himself.

14. The contractor will have to prepare Seasonal flowering beds as & when required and as directed by the Officer –

in – Charge.

15. The contractor or his supervisor will regularly meet with the site Officer – in – Charge for taking the direction.

16. In case of any causality of shrubs, tree or any other plants has been found during maintenance of work, the

contractor has to replace the tree/shrubs/other plants of the same height and specification by another at his risk

and cost and nothing extra shall be paid for the same in this regard or recovery of the Rs. 60/- per shrubs, Rs.

250/- per tree plants, Rs. 140 for other foliage/decorative plants and Rs. 100/- per sqm for lawns shall be made.

The decision of the Dy. Director of Horticulture shall be final and binding in this regard.

17. The rejected and sub-standard material should be removed from the site of work immediately, the department

shall not be responsible for any damage/loss of rejected materials. If the same will not be removed within five

days after issuing notice in writing by Dy. Director of Horticulture then recovery shall be made @ Rs. 200/- per

day.

18. The staff deployed for horticulture work must have good knowledge about horticulture works operations like

hedge cutting, mowing of lawn, plantation of plants/seeding, lawn maintenance, potted plants maintenance etc. the

supervisor/Mali should be well behaved to communicate with the clients, occupants, staff and officers.

19. The contractor shall maintain the attendance of staff/labour deployed at site through bio-metric system/authentic

proof of attendance if demanded by client department or Officer – in – Charge.

Nothing shall be paid to the agency on this account.

20. The contractor shall make deduction on account of E.P.F & E.S.I to labour/staff deployed by him on the work and

will furnish detail of each workers at division office every months.

21. The contractor shall produce valid registration/license ESI/EPF before start of work.

22. The contractor shall bear all charges for cartage, storage and safe custody of the materials.

23. Rs. 500/- per day shall be deducted from the bill of the contractor for each day of absence of the Mali.

24. The contractor shall be fully responsible to provide proper uniforms of the worker with half jacket (fluorescent

material) which bear the name of CPWD (Horticulture) prominently; Design to be got approved from Officer – in

– Charge, ID card and other facilities to his worker as per prevailing labour rules, nothing extra shall be paid to

the agency on this account.

25. The contractor shall be responsible for the requisite to cover any risk for his worker and other welfare measure as

per labour rules.

26. One intermediate payment shall be allowed after completion of work done of amount not less than 50% of

tendered amount and after making payment to workers of such period through ECS/cheque.

27. The payment shall be made in the presence of S.O. who will certify the same in MB while preparing the bill.

28. At least minimum wages must be paid to the worker in accordance with Delhi Govt. rules failing which two times

of balance amount will be recovered from the bill of contractor and action will be initiated against the contractor

as per labour law. In case the minimum wages are increased by GNCTD during the Contract period /extended

period of the contract the contractor has to pay according to the increased wages and nothing extra shall be paid

by the department.

29. The working hours will be of 8 hours duty per person per day as per working period decided by Engineer-in-

Charge according to working hours of particular Office / Service Center.

30. The payment shall be given through cheque /ECS to the workers and shall be made as per the minimum wages act

1948 vides notification issued time to time.

31. Police verification of workers shall also be required if demanded by client department or Officer – in – Charge.

32. The contractor shall maintain record prescribed in ‘CPWD Contractor’s Labour Regulations’ laid down in GCC are

maintained. These include registers for workmen employed by the contractor, Muster Roll, Register of Wages,

Wages Slip, Employment Card, Service Certificate, Register if Fines, Register of Deduction for Damage of Loss,

Register of Overtime and Register of Advance.

33. The Contractor shall make his own arrangement for obtaining Electric/Water connection if required and make

necessary payment directly to the Department concern.

34. The Department shall not be responsible for any injury partial or permanent or death of any worker at site due to

accident during functioning of the equipment or by negligence of the staff.

35. The Department shall be at liberty to discontinue/cancel agreement by serving one-week notice without assigning any

reason thereof. Decision of the Dy. Director of Horticulture shall be final and binding to the Contractor for which no

claim on any account shall be entertained by the department.

36. No compensation shall be payable to the Contractor for any damage caused by natural Calamity (Rains, storms,

earthquakes and other calamity) during the execution of work.

37. In Case, if it is observed that the maintenance is not healthy and to the required standard, no payment shall be made

of the specific area for the period over which the maintenance has been found to be neglected. The decision of the

Dy-Director of Horticulture shall be final and binding in this regard.

38. If any damage caused for public conveniences/services, the same shall have to be repaired instant, failing which

necessary recovery shall be made from the Contractor bill.

39. The required quantity of insecticides/pesticides will be issued free of cost by the department for proper maintenance

(only during the maintenance period) if needed.

40. The undersigned reserved the right to accept/reject any or all the tenders without assigning reason.

41. If any Civil Masonry work Building, Road and Channels will be damaged by the Contractor during execution the

same will have to repair by the Contractor at his risk and cost, otherwise the complete cost will be recovered as

intimated by the Civil Division concerned.

42. The field staffs are to be engaged as per approved yard stick of Govt. of India. The yard stick for reference is given

below:-

a. Garden area @ 1 Mali/ 1.35 acre for lawn area. Prestigious

b. Trees upto 4 years old @ 1 Mali/250 Nos, Trees upto 4-8 years old @ 1 Mali/300 Nos, Trees above 8 years old @

1 Mali/1200 Nos.

c. Shrubs @ 1 Mali /1200 Nos.

d. Hedge @ 1 mali / 3660 Rmtr.

e. Cement pots @ 1 Mali @ 300 Nos

Earthen pots @ 1 Mali @ 3000 Nos.

43. The total Nos. of field staff to be engaged will be 4nos. the staff should have experience. The normal working hours

will be 8 hours a day from 9.00 a.m. to 5.00 p.m. with one hour lunch break from 1.00 p.m. to 2.00 p.m. subject to

staggering of duty hours as per actual requirement. During Sundays and other Holidays contractor must deploy

essential staff to ensure minimum maintenance particularly for watering of pots and maintenance of nursery.

44. The contractor shall maintain an attendance register of workers deployed at site and wages slip duly paid to the

workers and same would be part of the bill and shall be checked by SOH/ADH/DDHH during site inspection.
