The California Regional Water QUality Control Board, San DiegoRegion (hereinafter Regional Board), finds that:

1, The Department of the Navy (hereinafter discharger),Southwest Division, Naval racilities Engineering Command(Navy), sUbmitted an incomplete report 6f waste discharge(RWD) btl August 6, 1997 for Project P-338sj the dredging and.disposai of approximately 160;000 cubic yards (cy) ofdredged spoiis from Pier 3 located at Navai Station in SanDiego Bay to a depth of -31 feet below mean lower low water(MLLW), with a 2-foot overdredge allowance. The NavyreviSed the RWD on November 18, 1997 completing theapplication for waste discharge requirements.

2. The discharger reports that Project P-338s will be dividedinto two phases. The first phase consists of dredging thetop layer of sediment which i~ approximateiy 110,000 cyanddisposing the material upland. During the first phase,. siltcurtaihs comprised of a geotextile fabric Buppottedby afloatation boom will be placed around the dredging area tominimize turhidity. 4. The discharger proposes that dredged materials for uplanddisposal will be transported to a confined disposal facility(CDF) located at the Mole Pier in NAVSTA for furthermoistUre removal prior to disposal. . .1. ,i~St!

5. ·The discharger indicates that the CDF has a capacity of30,000 cubic yards and cohsists of an approximately 8,600square meter drying area surrounded by an approximatelythree meter high dike and underlain by a liner of lowpermeapility (not less than 20 mils). The dischargerreports that the dike is constrUcted with imported cleanearth fill and held in place by smaller earthen dikes.

6. The Water Quality Control Plan; San Diego Basin (9)(hereinafter Basin Plan) was.adopted by this Regional Boardon September 8, 1994 and subsequently approved by the Statewater Resources Control Board (State Board) on December 13,1994. SUbsequent revisions to the easin Plan have also beenadopted by the Regional a6ard ahd apprOved by the StateBoard. The Basin Plan deSignates beneficial uses andnarrative and numerical water quality objective, andprohibitions which are applicable to the dischargesregulated under this ,Order.

-The test results demonstrate that the material specified forupland disposal comply withcortcerttration limits establishedby this Regional Board in "Waste Discharge RequirementWaiver Policy' for Disposal/~euse of Dredge Spoils inIndustrial or Commercial Applications". the basis of thiswaiver is that the disposal/reuse would hot cause aviolation of the water qUality standards established in theBasin Plan for surface and ground water hydrologic units,areas arid subareas that comply with all other general andspecific conditions of the waiver pol~cy for disposal/reuseof dredge spoils. These conditions include: separation fromsurface and groundwater resourceS; ad' thematerial after dis osal-;

8. The NaVy Project P-338SI\olill result in short-term increases

in turbidity of San Diego Bay waters in the vicinity of thedredging area. These short term water quality impacts willnot unreasonably affect present and anticipated beneficialUses of bay waters and wiil not result in water quality lessthan that prescribed in applicable plans and policies asdescribed in this Order. The short term change in waterquality is consistent with maximum benefit to the people ofthe state. The project as described in this Order isconsistent with State Water Resources Control BoardResolution No. 68-16, Statement of Policy with Respect toMa1ntaihirlg High Quality of Waters in California.

Re§ource~ Code (PRe) §21060, et ~~q,], gave public notice onSeptember 9, 1997 that the Finding of No Significant Impactfrom an Environmental Assessment prepared in compliance withNEPA meets CEQA requirements and will use the Finding of NoSignificant Impact in pia.ce of a Negative Declaration, asprovided for in PRe §15225. Public notice was accomplishedby publishing a notice in the San Diego Union Tribune. ThisRegional Board hereby approves the Finding of No SignificantImpact and will use it ih place of a Negative Declaration incompliance with CEQA requirements.

3 . PROPER OPERAtION AND· MAINTENANCE

The discharger shall, at all times, properly operate andmaintain all facilities and systems of treatment andcontrol (and related appurtenances) which are installedor used by the discharger to achieve compliance with theconditions of this Order. Proper operation andmaintenance includes effective performance, adequatefunding, adequate operator staffing and training, andadeqUate laboratory and process controls includingappropriate quality assurance procedures. This provisionrequires the operation of backup or auxiliary facilitiesor similar systems only when necessary to achievecompliance with the conditions of this Order.

5 . PENALTIES FOR INVESTIGATION. MONITORING OR INSPECTIONVIOLATIONS -

The California Water Code provides that any personfailing or refusing to furnish technical or monitoringprogram reports, as required under this Order, orfalsifying any information provided in the monitoringreports is guilty of a misdemeanor and is subject to acivil liability of up to 5,000 d9llars for each day inwhich the violation occurs.

"6. ENDANGERMENT "OF HEALTH AND ENVIRONMENT

The discharger shall report any noncompliance which mayendanger health or the environment. Any such informationshall be provided oraily to the Executive Officer within24 hours from the time the discharger becomes aware ofthe circumstances. A written submission shall also beprovided within five days of the time the discharger-becomes aware of the circumstances. The writtensubmission shall cohtain a description of thenoncompliance and its cause; the period of noncompliance,including exact dates and times, and if the noncompliancehas not been corrected; the anticipated time it iseXpected to continue; and steps taken or planned toreduce, eliminate, and prevent recurrence of thenoncompliance. The Executive Officer, or an authorizedrepresentative, may waive the written report on a case­by-case basis if the oral report has beert received within24 hours.

7 . CORRECTIVE ACTION

In an enforcement action, it shall not be a defense forthe discharger that it would have been necessary to haltor reduce the permitted activity in order to maintaincompliance with this Order. Upon reduction, loss, orfailure of the treatment facility, the discharger shall,to the extent necessary to maintain compliance with thisOrder, control production or all discharges, or both,until the facility is restored or an alternative methodof treatment is provided. This provision applies forexample, when the primary source of power of thetreatment facility is failed, reduced, or lost.

J. 0 • HAZARDOUS RELEASES

Except for a discharge which is compliance with thesewaste discharge requirements, any person who, withoutregard to intent or negligence, causes or permits anyhazardous substance or sewage to be discharged in or onany waters of the State, shali as soon as (a) that personhas knowledge of the discharge, (b) notification ispossible, and (d) notification can be provided withoutsubstantially impeding cleanup or other emergencymeasures, immediately notify the Office of EmergencyServices of the discharge in accordance with the spillreporting provision of the State toxic disastercontingency plan adopted pursuant to Article 3.7(commencirig with S~ctiOh 8S74.7) of Chapter 7 of Divisioni of ~itle 1.of the Governmerlt Code, ahd immediatelynotify the State Board, or the appropriate Regional Board6f the discharge. regard to intent or negligence, c~uses or permits any oilor petroleum product to be discharged in or on any watersof the State, or discharged or deposited where it is, orprobably will be, discharged in or on any waters of theState, shall, as soon as (a) such person has knowledge ofthe discharge. (b) notification is possible. and (c)notification can be provided without substantiallyimpeding cleanup or other emergency measures. immediatelynotify the Office of Emergency S~rvices of the dischargein accordance with the spill reporting provision of theState oil spill contingency plan adopted pursuant toArticle 3.5 (commencing with Section 8574:1) of Chapter 7of Division 1 of Title 2 6f the Government Code. Thisrequirement does not require reporting of any dischargeof less than 42 gallohs unless the discharge is alsorequired to be reported pursuant to Section 311 of theClean Water Act or the discharge is in violation of aprohibition in the applicable Water Quality Control Plan.

This Order may be modified, revoked and reissued, orterminated for cause including, but not limited to, thefollowing:

(a) Violation of any terms or conditions of this Order;

(b) Obtaining this Order by misrepresentation or failureto disclose fully all relevant facts; or

(c) A change in any condition that requires either atemporary or permanent reduction or elimination ofthe authorized discharge.

The filing of a request by the discharger for themodification, revocation and reissuance, or terminationof this Order, or notification of planned changes oranticipated noncompliance does not stay any condition ofthis Order.

This Order is not transferable to any person except afternotice to the Exe~utive Officer. The discharger shallsubmit this notice in writing at least 30 days in advanceof any proposed transfer. The notice must include awritten agreement between the existing and new dischargercontaining a specific date for the transfer of thisOrder's responsibility and coverage between the currentdischarger and the new discharger. This agreement shallinclude an acknowledgment that the existing discharger isliable for violations up to the transfer date and thatthe new discharger is liable from the transfer dat'e on.The Regional Board may require modification or revocationarid reissuance of this Order to change the name of thedischarger arid incorporate such other requirements as maybe necessary under the California Water Code.

1. Samples and measurements taken as required herein shallbe representative of the volume and nature of themonitored discharge. All samples shail be taken at themonitoring points specified in this Order and, unlessotherwise specified, before the effluent joins or isdiluted by any other waste stream, body of water, orsubstance. Monitoring points shall not be changedwithout notification to and the approval of theExecUtive Officer.

2. Monitoring must be conducted according to United StatesEnvironmental Protection Agency or CaliforniaDepartment of Health Services approved test proceduresas described in the current Title 40, Code of FederalRegulations (CFR) , Part 13Gand 261, or the currentCalifornia Code of Regulations, Title 22, Article II,as appropriate, unless other test procedures have beenspecified in this Mohitoring and Reporting Program.

B. INITIAL REPORT

The discharger shall notify the Regional Board by letterprior to starting their project. The notification shall bereceived by the Regional Board at least three days beforeany dredging work begins.

C. OPERATIONS MONITORING

The discharger shall submit as part of their monitoringreport the following information:

1. Estimates of the daily volume (in cubic yards) ofdredge material and the location from which thematerial was removed.

2. The total volume (in cubic yards) of dredged materialremoved during the project and the total volume (incubic yards) of material deposited at each finaldisposal location.

3.' A daily log of the volume (in cubic yards) of dredgedmaterial in CDF shall be maintainedabd submitted aspart of the monthly monitoring report.

D. VISUAL OBSERVATIONS

During any monitoring condUcted pursuant to this monitoringand reporting program, visual observations shall also bemade and recorded and submitted as part of the requiredreports. The following observations shall be made,recorded, and submitted monthly:

E. RECEIVING WATER MONITORING

1. TURBIDITY

Sampling shall occur at three sampling stations. Station Ais at 500 feet updrift of the dredging activities. StationB is inside any visual plume at the dredging sites and/orwithin the silt curtain if possible. Station C is between aand 250 'feet downdrift outside the silt curtain of thedredging activities and inside any visual plume if possible.At these stations, a Secehi Disc or turbidity meter shall beused each day during dredging activities to sampleturbidity. If turbidity at Station C increases more than20% over the turbidity at Station A, the dredging operationsshall be suspended and appropriate measures taken, theRegional Board Executive Officer notified and remedial~easures shall be implemented.

2. CHEMICAL ANALYSIS

A minimum of two grab samples of the receiving water at mid­depth within the visible turbidity plume at the dredgingsite, and a grab sample of return water from COP shall becollected and analyzed for the listed constituents. Atleast oft~sample shall be at each station identified in theabove Item E.l:
