From the Desk ofCouncilor Mike Pagtakhan

A Letter of Support from a Kababayan

I am very surprised to receive an e-mail from a kababayan who is a regular reader of Filipino

Journal through its Internet edition. I would like to take this opportunity to reprint his e-mail which dealt with his unsolicited support for my nomination to become the official candidate of the Liberal Party as Member of the Parliament to represent Winnipeg North.

Here is the content of his e-mail:

Dear Konsehal Pagtakhan, I am an avid reader of Filipino

Journal via Internet.

“Hello, Noynoy”

At 9:30 AM on June 10, 2010, after he was proclaimed President-elect by Congress,

Benigno “Noynoy” Aquino III received a telephone call from President Gloria Macapagal Arroyo who had just left Shanghai, China on her way back to Manila. The conversation goes:Gloria: Hello, Noynoy. This is Ate Glo calling.Noynoy: Ate Glo… who?Gloria: This is President Gloria Macapagal Arroyo. But just call me Ate Glo.Noynoy: Oh, hello! Madame President… err.. Ate Glo… umm. What a pleasant surprise that you called.Gloria: Well, I want to be the first to congratulate you on your proclamation as President-elect. You deserve the honor… Noynoy: Thank you for your kind words, Ate Glo. But I just want to let you know that you’re not the first who called. President Barack Obama called 30 minutes ago. He was the first to congratulate me. Gloria: Well, I’m glad then that I’m the second to call…

Noynoy: The second was Chinese President Hu Jintao. He told me that you wanted to see him in Shanghai to talk about improving China-Philippine relations. But he said he refused to meet with you because you’re now a lame pekeng duck. He he he… The third was Japanese Prime Minister Naoto Kan. We had a productive talk. And the fourth was the Portuguese Prime Minister. Gloria: Portuguese? Hmm… Anyway, I’m on a plane heading back to Manila. I would like to invite you to my private island resort for a tête-à-tête to… umm… talk about our common interests. Noynoy: I don’t think we have anything in common… other than smoking.Gloria: I don’t smoke, Noynoy. Noynoy: Well, in that case, there’s nothing to talk about then. Barack and I hit it off when we talked about our smoking habits. He he he… He invited me to a smoking and beer summit at the White House garden next month. Gloria: Very good! Seriously, I must see you about something, Noynoy.Noynoy: What is it, Ate Glo?

Gloria: I’m concerned about all this talk that you’re going to prosecute me for plunder. That’s a very serious allegation. However, I have a proposal to make.Noynoy: Proposal? What is it that you want to propose, Mrs. Arroyo?Gloria: Well, I’m willing to return 75% of all my wealth in exchange for immunity from prosecution.Noynoy: That’s interesting! Actually, that also happened to my mom when she was president. The deposed dictator Ferdinand Marcos made a deathbed proposal through Vice President Doy Laurel that he was willing to return 90% of the Marcos loot in exchange for immunity of his family from prosecution. Now, why is it that you’re only offering 75% of your loot?

Gloria: The percentage doesn’t matter, my friend. You see, the 75% I’m willing to return would be 10 times bigger than the 90% Marcos was willing to return! Noynoy: Oh Lord, it’s true then! You’re the most corrupt president in the history of the Philippines!!! Kurakot!Gloria: Hold it, hold it! Don’t get excited, my friend. I’ll make you an offer you can’t refuse. Noynoy: Oh? And what’s that, godmother?Gloria: I’ll give you half of the other 25%. That’s 12.5% of the total loot! And I’ll sweeten the pot, too. I have copies of the 175 Yamashita treasure maps. I’m talking about gold, silver, and precious stones valued in tens of trillions in US dollars! That’s a lot of moolah, pal. Let’s have a joint venture and split 50/50 what we recover. It’s going to be fun! What says you, partner?Noynoy: My mom refused Marcos’ offer and I’ll do the same. I won’t take your offer. You’ll be prosecuted for plunder! And one of my top priorities would be to recover your loot! As for the Yamashita loot,

the Japanese Prime Minister and I already agreed that our governments will collaborate in searching for the treasures. Our governments will split what’s recovered. Gloria: Ha ha ha… In that case I’m not going back to the Philippines. Hoy, Mike! (talking to her husband) Tell the pilot to change course. We’re going to Portugal, right now! Did you hear that, Noynoy boy? We’re going to Portugal where there is no extradition treaty with the Philippines. Adios, kiddo! Ha ha ha…Noynoy: Not so fast, Ate Glo! Didn’t I tell you that the fourth person who called me was the Portuguese Prime Minister? Well, I lied. Actually, I was the one who called him.Gloria: You called him? Why???Noynoy: Well, I called him about your secret plan to go to Portugal to avoid prosecution here. I requested him to deny you entry into Portugal. He agreed. You are now a persona non grata in Portugal. You have nowhere else to go. Come on home now and face the music. It’s going to be sweet and sassy. Hasta la vista, baby.

Gloria: Walang hiya!

Thank you so much, Ricardo, for your e-mail that showed your support. You inspired me more to continue my mission of serving the public with enthusiasm, passion, vision, and dedication. Let’s keep going.

God bless all Filipinos!

The Wave Splashes Eternal (part 4)(New album from the Winnipeg-born Postpunk band Crash Test Dummies)

Many influential people in the music business have long been

predicting the death of albums in physical formats such as CDs and vinyl records. Time and again, passionate artists and serious music enthusiasts have proven them wrong; because, although many artists have begun releasing singles and a l b u m s in digital formats, m a n y b a n d s c o n t i n u e to issue a l b u m s on CDs. The sales of records in CD formats may have dwindled, but CDs and vinyls are here to stay—at least for another decade—as long as there are collectors and true music lovers out there who, despite downloading music, still purchase records.

Speaking of new music released in CD format, here’s the latest album from the New Wave– / Postpunk-influenced band Crash Test Dummies, who originally hailed from Winnipeg, Manitoba! Bandleader and lead vocalist/multi-instrumentalist Brad Roberts—the remaining mainstay of the band—has moved to New York, where he has been living since; but fortunately, he

never abandoned creating music.Crash Test Dummies

Although many music journalists regard Crash Test Dummies as a Johnny-come-lately in the music New Wave / Postpunk arena, because it was already in the 1990s when they

shot to popularity, the Dummies has become a distinctive band

in the said g e n r e

p r i m a r i l y because of the bass-baritone vocal range of Brad Roberts and the heavy influence of baroque on the band’s music, evidensed by the use of instruments like mandolin, banjo, cello, violin, and accordion.

Crash Test Dummies released its first album, The Ghosts that Haunt Me, in 1991, which gave

by aLfie vera mella [email protected]

them the hit “Superman’s Song.” However, what catapulted the band to international success was the followup album, God Shuffled His Feet (1993), which contained one of their most well-known songs, “Mmm Mmm Mmm Mmm.” Sadly, in the years that followed, the popularity of Crash Test Dummies slowly faded, perhaps because of the surge of another genre of music known as Grunge, which swept the entire Rock music scene.

Seemingly unaffected by this, Roberts and his band went on to release five more albums before going on a hiatus: A Worm’s Life (1996), Give Yourself a Hand (1999), I Don’t Care that You Don’t Mind (2001), Puss ‘n’ Boots (2003), and Songs of the Unforgiven (2004). Despite having turned his focus on other priorities—like a dayjob as a music teacher, Roberts continued to make music on his spare time the initial results of which he originally planned to release only

in digital format. However, in May 2010, with the backing of a record label, Crash Test Dummies released its eighth album, Oooh La La! The album still carried a baroque-influenced sound that features instruments like Optigan, Omnichord, mandolin, banjo, violin, viola, and cello. Among the original members of the band, however, only

Ellen Reid was able to join Brad Roberts in the album.

Crash Test InfluencesOne of the biggest influences

for Brad Roberts was the English Postpunk band XTC, two songs of whose Crash Test Dummies went on to cover, “The Ballad of Peter Pumpkinhead” for the soundtrack to the film Dumb and Dumber

and “All You Pretty Girls” for the XTC tribute album A Testimonial Dinner. Roberts’s University of Winnipeg education and interest in philosophy, literature, and the arts is very much evident in his lyrics and the concepts of his band’s albums.

Final NoteAccording to latest writeups,

Roberts is hoping to reunite the full band (Ellen Reid, Dan

Roberts, and Mitch Dorge) for a show in the band’s original hometown of Winnipeg. If this plan pushes through, I will be one of the first to purchase tickets so I may watch for the first time one of my favorite Canadian Postpunk bands, and take the opportunity to have them autograph my Crash Test Dummies albums.

At wag mo ring kalimutan ang tinuran ng bantog na philosopher na si Friedrich Nietzsche: ‘What does not kill me, makes me stronger.’

ABS-CBN’s Nina Corpuz wins International Media prize for Labor Rights

ABS-CBN Senior Reporter Nina Corpuz has been awarded The Media For Labor Rights Prize, a journalistic prize established by International Labour Organization (ILO), the labour arm of the United Nations.

The prize recognizes efforts to help spread information on international labour standards drawn up and overseen by the ILO and their relevance to local labour and social issues.

Nina’s article, entitled “Filipino Domestic Workers, Between Justice And Survival”

was chosen as the best story on labour rights among 50 entries from journalists and media professionals around the world. Previous winners were from Japan and Zambia.

The award ceremony will take place during the 99th Session of the International Labour Conference from June 2 to 18 in Geneva, Switzerland.

The article will also be posted on the ILO website, and will be published by newspapers in different countries and languages.

In August last year, Nina was granted a scholarship to attend a course on “Communicating Labor Rights” at the International Training Center of the ILO (ITC-ILO) in Turin, Italy. It was here that she started writing the winning article, and continued working on it upon her return to the Philippines.

The article was further inspired by her experience while covering repatriated Overseas Filipino Workers who were sent home from the Middle East in August 2009 after their employers

abused them.According to Mr. Vittorio

Longhi, a Trainor at the ITC-ILO, Nina’s article “is a global story” which he hopes “will also have an impact in the Philippines and help to improve domestic workers’ conditions.”

The article’s topic is also timely, as the 99th International Labor Conference is including in its agenda for the very first time the setting of international standards for the protection of Domestic Workers.

Nina has been a television journalist for ABS-CBN for the past 9 years, filing reports for newscasts TV Patrol World and Bandila, The ABS-CBN News Channel (ANC), Studio 23 and www.abs-cbnnews.com. She also anchors a news program, Balitang Europe, which airs on The Filipino Channel (TFC) and ANC. Nina also hosts the daily evening show “Magandang Gabi Dok” and the Saturday morning program “Para Sa ‘Yo Bayan” with Vice President Noli “Kabayan” De Castro on DZMM Teleradyo.

The bad reputation of sharks has been magnified and became popular because of scary shark movies like Jaws (originally released in 1975), which primarily focused on great white sharks and their attacks on people in specific areas of the United States. Scientists continue to study sharks especially their behavior, which will help dispel the many scary myths surrounding these misunderstood animals.

What Law Applies when Doing Business Overseas?

When doing business overseas, one question often overlooked is,

which country’s law applies. In many contracts, the governing law is buried deep within the last part of the document. Unfortunately, when a dispute arises, the governing law becomes very important.

What is the “governing” law of the contract?

The “governing” law is that of the country’s which applies to the contract. This is important because different legal systems can interpret words in contracts in different ways.

The best way to be clear on the “governing” law is to stat it in the contract. If your contract makes the laws in your province or country the governing law, you may have an advantage because it may be easier for you to find lawyers with expertise who can help you.

Where would any lawsuit be decided?

In addition to knowing the governing law, another important consideration is the place where lawsuits could be decided.

I have seen contracts in which Winnipeg-based companies require any disputes to be dealt within Manitoba courts. This can create great advantages for Manitoba businesses because the travel costs are minimal and the ability to find local lawyers is easier. On the other hand, if you enter into a contract which requires disputes to be dealt in courts outside of Canada, you will be the one paying the travel bills and looking for foreign lawyers to hire.

If I have the right paragraphs in my contract, am I safe?

Not necessarily. Although a contract is governed by Manitoba law and requires lawsuits to be filed in Manitoba, there are sometimes other things that can be done overseas. When doing business overseas, getting legal advice from a lawyer in that country is a good idea; for this allows you to see what possible exposure you have.

Is there anything else I can do to protect my business dealings overseas?

Yes. There are a number of different things you can do to protect your business dealings. Some businesses

purchase specific insurance for their overseas dealings, some businesses purchase contracts that can protect them from exchange rate changes, some businesses set up business structures that limit liability, and some businesses deal with letters of credit that regulate the schedule when payment will be made. These are some of the best examples that should be prioritized.

Me, too! (No! It should be “I, too!”)(The Most Widely Tolerated Grammatical Error

in the English Language)

Do you remember the grammatical blunder we used to talk about when

we were still both working at Diwa Scholastic Press in the Philippines? The use of ‘Me, too,’ instead of ‘I, too,’” asked a friend of mine.“Of course! Why?”“When are you going to write about it?”

I think I already wrote about it in the past, but only in passing. Thanks for reminding me. You just gave me a very interesting, because we hear this blunder every day—not only from students but also from professors or even lawyers and linguists. This grammatical blunder seems trivial, and unnoticed by many people; to me though, this is perhaps the most widely used and tolerated grammatical error in the English language. This grammatical error is a relative of “Me and my friends” when this is used as the subject of a sentence.A Relative of Me and My FriendsTo illustrate:Incorrect: “Me and my friends are watching a movie later.”Should be: “My friends and I are watching a movie later.” Or even,

“I and my friends are watching a movie later.”

The personal pronoun me should be used only in the objective case; while I in the subjective case. And, the location of the personal pronouns in the sample sentences above is in the subject part; therefore, the use of me as a part of the subject of a sentence (as in the first sentence I illustrated above) is incorrect. This applies also to the very common utterance “Me, too.”“Me, too” versus “I, too”

The common utterance “Me, too” is incorrect when used in a subjective case. I instead of me should have been used instead; as in, “I, too.”

Because, “I, too” (or the blunder “Me, too”) is simply a contraction of a sentence as in the example below:Gabriel to Mommy: “I want to go with you.”Evawwen, who also wanted to go with Mommy: “Me, too!”

Evawwen’s utterance is actually a contraction of “Mommy, me, too, want to go with you,” which is grammatically incorrect because he should have used the subjective case of the personal pronoun, which is I.

Therefore:Gabriel: “[Mommy,] I want to go with you.”Evawwen: “I, too!” (or to complete the utterance, “Mommy, I, too, want to go with you.”

Is there an occurrence when “Me, too” is correct?

Yes, there is; but there should be no comma that separates me from too. The utterance “me too” is grammatically correct when it’s occurrence is in the objective case.To illustrate:Mommy to Gabriel: “Mommy loves you.”Evawwen: “Me too!”—which is a contraction of the sentence, “Mommy loves me too!” In this sentence, “Me too” is correct.

The Last Leaf

Many people, especially those who are already accustomed all their lives to using “Me, too” instead of “I, too”—even though they mean this in a subjective manner—will surely stubbornly keep on committing the same grammatical blunder. Their reason will be any of the following: they are already used to it so why change; laziness to or fear of adopting something unconventional yet correct; they don’t care because they have “more important” things to take care of; or simply, “me, too” sounds right to them, while “I, too” does not.

As far as I’m concerned, there is no truth to “when it sounds right, then it’s right.” Knowledge is something that we acquire and develop by studying, learning, understanding, and putting to correct use—not by hunches or gut feelings.

Instrument of Change

Elected on a promise of “change,” President-elect Benigno “Noynoy” Aquino

III is now faced with the gargantuan task of fulfilling his promise. The magnitude of the work ahead of him is so overwhelming that he’s probably wondering where to start.

Indeed, he can pick any of the, perhaps, hundreds of agencies in the government where corruption was seeded and blossomed into a monstrous plutocracy during Gloria Macapagal Arroyo’s inglorious presidency. Noynoy can then attack them with laser-like precision and surgically incise the cancerous cells of corrupt officials that have institutionalized their nefarious modus operandi in the way the government conducts business. Today, corruption is deeply-rooted that it would take a Herculean effort to uproot it.

Recently, a firestorm of controversy was ignited when Gloria made more than 250 midnight appointments to various positions in government including the Armed Forces Chief of Staff and the Chief Justice of the Supreme Court. While Noynoy categorically said that Chief of Staff Delfin Bangit had to go, he gave himself some leeway to wiggle in the case of Chief Justice Renato Corona.

Heads to rollA few days ago, Noynoy said

that he will fire 5,000 employees and hire their replacements to make sure that everyone would “pull in the same direction.” Included in the planned reorganization are Gloria’s “midnight appointees.” To make his point clearly, Noynoy said, “The basic principle I think all of us will agree [is that] the power to appoint carries with it the power to dismiss. That has been decided in so many precedent-setting cases.” Interestingly, Malacañang is saying that there are only 1,000 employees who are co-terminus with Gloria. Makes one wonder if “ghost employees” made up the difference.

Replacing those who are co-terminus with Gloria would provide Noynoy with a grand opportunity to appoint people who would share his vision of a society free from corruption and poverty. When he became the apparent President-elect after the elections, he said that he would appoint to cabinet positions only those who do not have any record of corruption and that each prospective appointee would be extensively vetted to make sure that he or she was not in any way involved in corruption or questionable activities.

Now, that is a very tall order. However, it is doable. I’m pretty

sure that there are idealistic people out there who are honest and incorruptible. Many of them have never been in government service but they have exemplary track records in the private sector.

The question is: are they willing to abandon their professional careers and bright future in the private industry, and accept a lowly-paid -- and thankless -- government job with all the bureaucratic baggage that comes with the territory?

On the other hand, there are also those who have been in government positions before and have proven themselves, without a shadow of doubt, to be honest and incorruptible. However, there aren’t many of them around. Some have gone into full retirement and some would never go back to government service. But there are a few of this rare breed who are willing to sacrifice their lofty and safe nests for a stint in the murky waters of a kleptocratic bureaucracy.

Change vs. status quoNoynoy’s election did not come

as a surprise. While he had the good names of his parents -- Ninoy and Cory Aquino -- behind him, he rode the crest of “Change” fueled by “people power,” not in the tradition of EDSA 1 or EDSA 2 but in the spirit of empowering the powerless mass. It’s the self-actualization of the people’s burning fervor to free themselves from the clutches of corruption and the gnawing pain of poverty.

When the first partial results coming from various regions were announced at 8:00 AM on May 11, it became apparent then that Noynoy was being swept to victory by a flashing current of mass action at the

polls. The candidates of the defenders of status quo were being crushed as shown in the transmittals of election returns from the 86,000 Precinct Count Optical Scanner (PCOS) machines throughout the country. At the end of the day, Noynoy’s 5-million lead in votes over his closest rival was insurmountable. His victory was sealed… a fait accompli.

Last June 9, a joint session of Congress proclaimed Noynoy as President-elect of the Fifth Republic of the Philippines, a government shaped in spirit by the “Cory” constitution of 1987, only to be prostituted in the years following the sham EDSA 2 “people power” revolution that catapulted Gloria Macapagal Arroyo to power. Indeed, the EDSA 1 “people power” revolution of 1986 that dismantled the Marcos dictatorship and brought Noynoy’s mother, Cory Aquino to power has come to a full circle with the ascension of Cory‘s son. Finally, the people can once again rekindle their hopes of peace and prosperity. And this time around, they would not let their guard down.

High expectationsWith victory comes high

expectations. Unlike the “people power” revolution of 1986, the peaceful “people power” revolution at the polls in 2010 was different. In 1986, the people were complacent while the Cory government was hounded by military rebels who tried to depose her. But this time the people are in a virtual state of insurrection. They are expecting action -- right now! -- to correct wrongs that were done during the past nine years. The result of this year’s elections was

an expression of the people’s angst: enough is enough!

Noynoy must act right away to fulfill his promise to fight corruption and poverty. His slogan, “Walang corruption, walang mahirap,” resonated clearly with the voters. And now, it’s time for Noynoy to deliver, and deliver he must.

Zero toleranceNoynoy needs to put in place

the “instruments of change” to satisfy his covenant with the people. He should -- nay, must -- put honest and trustworthy men and women in his government, starting with his cabinet. He shouldn’t reward his political allies with exclusive fiefdoms to pursue their personal economic interests. He shouldn’t allow people who have his ears to influence his policies or the awarding of government contracts. He shouldn’t use “power of patronage” to achieve political supremacy but instead should hone his personal power to influence others to achieve the changes he wants. And he shouldn’t allow government officials to turn a blind eye or a deaf ear to corruption under their watch. Those who err should be punished and those who excel should be rewarded.

At the end of the day, Noynoy is the people’s ultimate “instrument of change.” He must take full responsibility and accountability for all the actions of his subordinates -- from the cabinet secretaries down to the lowest ranks in the government. If they fail Noynoy, then Noynoy fails the people. The people would not ask for more nor would they expect for less.

That is the price of leadership.
