News from NAHB

With tax season looming, builders, remodelers and consumers who utilized energy-efficient building products and techniques in 2012 will want to take advantage of two key housing energy-efficient tax credits that were renewed and extended as part of the fiscal cliff negotiations.

NAHB urged Congress to include the housing tax incentives in H.R. 8, the American Taxpayer Relief Act of 2012. The final bill, which averted damaging tax hikes and spending reductions that would have taken effect on Jan. 1, includes the following energy-efficiency tax credits:

Existing Home Retrofit Tax Credit (25C)The Existing Home Retrofit Tax Credit (25C) provides consumers a tax credit of up to $500 for the purchase of qualifying energy-efficient products. The tax credit expired at the end of 2011, and NAHB worked with a coalition of groups that share our interests to reinstate the tax credit.

H.R. 8 extends the credit at its 2011 levels of 10% of the installed costs with a maximum credit for all qualified retrofits of $500. The tax credit was retroactively reinstated through 2012 and extended through the end of 2013. However, there is a lifetime cap on the credit, so any home owner who previously claimed $500 or more in 25C tax credits since 2005 is not eligible to receive the credit.

Since the tax credit provides home owners with fixed tax incentives for performing energy efficiency upgrades, remodelers often leverage 25C tax incentives when working with clients. Consumers know exactly how much money they will get back, which makes it possible for them to weigh the costs and benefits of purchasing a more energy efficient product.

According to an NAHB analysis, the 25C tax credit supported almost 140,000 jobs in remodeling in 2009.

Remodelers who installed energy-efficient products for home owners in 2012 are encouraged to contact their customers and remind them they may be eligible to

receive a tax credit of up to $500 on the work done in their homes. This not only engenders good will, but also provides remodelers an opportunity to find out if their clients need additional services.New Energy Efficient Home Tax Credit (45L)The only federal incentive available for energy efficiency in new homes, The New Energy Efficient Home Tax Credit (45L), was retroactively renewed though 2012 and extended through the end of 2013.

Builders and developers are eligible to receive a $2,000 tax credit for the construction and sale of homes that achieve a 50% improvement in energy efficiency over the 2006 International Energy Conservation Code (IECC).

It is important to note that the 45L qualification standard was updated when the credit was renewed. Under prior law, qualified homes built before 2012

News from NAHB

had to achieve a 50% improvement in energy efficiency as measured by the 2004 IECC in order for builders to receive the $2,000 credit.

Builders must meet the 50% test relative to 2006 IECC standards under the extended credit rules. For homes built in 2012, builders should use the 2006 criteria to determine if the units qualify for 45L.

Delays for claiming the 45L credit for 2012 and 2013 homes may occur because the software to evaluate the qualifying criteria of homes must be updated for the new standard.

Both 45L and 25C are traditionally renewed by Congress at the end of each year as part of a package of expiring tax credits.

Commonly referred to as "tax extenders," this package has become more difficult to pass due to the government's fiscal belt-tightening.

Because extending these tax credits would increase the deficit, Congress is often required to offset the cost of the extension by either cutting spending or raising other taxes. Finding bipartisan "pay-for's" has been difficult.

In the current economic and political climate, the fate of the 45L and 25C credits beyond 2013 is highly uncertain.

Residential Energy Efficient Property (25D)Another important energy-efficiency housing tax credit is the Residential Energy Efficient Property, or 25D credit. The 25D credit, which rewards home owners for installing solar panels, geothermal heat pumps, small wind turbines and fuel cells, can be used in existing homes and new construction.

It provides a 30% tax credit for investments in properties that generate renewable energy, and the tax credit is available through the end of 2016.

Energy Efficient Commercial Buildings Deduction (179D)Rounding out major residential sector energy tax incentives is the Energy Efficient Commercial Buildings Deduction (179D), which is geared toward multifamily developers and property owners. The 179D deduction supports increased energy efficiency in multifamily housing by providing a deduction of up to $1.80 per square foot for eligible properties placed into service.

This credit targeting commercial and large multifamily energy improvements expires at the end of 2013. In the meantime, reforming the deduction's rules has also been a topic of discussion among real estate trade groups, including the Real Estate Roundtable and the Administration.

2013 NAHB International Builders ShowWe had an amazing time at the International Builder Show in Las Vegas last month. During the 3 day International Builders Show the 360,000 square foot Las Vegas Convention Center was loaded with amazing exhibits showing all of the latest building trends and materials. In addition, IBS featured outdoor exhibits, the Professional Builders Show Village. The homes were craned onsite and finished by crews in 4 days. The homes showcased energy efficiency and were designed to appeal to all homeowner prospects.

While in attendance at IBS, Tom Vanorio, Chip Pigman, Paul Beck and myself attended committee

meetings and educational seminars. There were even a few star sitings along the way including Paul Teutul Sr from reality tv fame American Choppers, Ty Pennington of Extreme Home Makeover, Norm Abram of This Old House, and country countdown host Kix Brooks.

For those of us who attended IBS, this show was and continues to be a rewarding and worthwhile event. Don’t hesitate to ask us any questions you may have regarding NAHB and the International Builders Show.

2013 Home & Ranch ExpoThank you to everyone who participated and attended our 11th Annual Home & Ranch Expo. Special Thanks to our sponsors Bitterroot Stoves & Billiards, Axmen Propane, Schrock Construction, Quest Enterprises, The Ranch and GRIP. I also want to thank Tom Vanorio,

Jaime Williams, Archie Thomas and Caleb Tipton for their help - thank you so much for all that you do!

2013 experienced our second Friday night opening. Increased attendance by the public that evening was a good sign and many had good quality leads right from the start. Saturday’s warm weather was great but unfortunately it turned the parking lot into a mud pit. Overall, attendance for our show was down 8% or 100 attendees. Whether this was due to other events in town, warm weather or a muddy parking lot we do not know for sure. Vendors however, expressed having a great turn out from quality potential buyers; who are exactly the market we want to reach. Be assured we have gathered ideas for next year’s

show to keep us all busy and hopefully increase our traffic.

Thank you again for your continued support

of the BBIA and the Home & Ranch Expo.
